2 PROPERTY COMMITTEE MEETING Monday, January 8, :30 a.m. or After the Completion of the County Board Meeting Barren County Government Center - Room 2151 Barren, WI Minutes Members Present: Terry Henck, Bill Schradle, Bob Rogers, Dana Heller, Burnell Hanson, Louie Okey [alternate for McRoberts), Jess Miller [alternate for Rindsig) Others Present: Jeff French, Wendy Coleman, James Babler, John Cisek, Jodi Busch, Steve Olson, Chris Fitzgerald, Ken Beranek, Dave Main, Bruce Mohns Jr., ChadAlberg, Virginia Berglund, Carole Crisler, Linda Thompson, Don Erickson The Property Committee meeting was called to order by C-hair Henck at 10:50 a.m. French read the public meeting notification. Public Comment: Bob Held spoke and provided a handout concerning Ice Age Trail and motorized trail development. Deputy Moin confirmed that there is no change except to cross the Ice Age Trail at two [2) locations. Moin will review the property with Ice Age Trail members and report back. Motion: [Hanson / Heller) to approve the agenda as presented. Carried Motion: [Schradle / Rogers) to approve the minutes of December 4, Carried with Henck, Okey and Miller abstaining. New Courtroom at Justice Center Project: Bruce Mohns with Lien and Peterson Architects spoke regarding the bidding-process arid costs for the courtroom project. Proposal from Lechlietner Builders was reviewed with proposed costs and cost saving adjustments including $9,400 offset from the Capital Improvement Capital Outlay plan. Judge Babler spoke regarding additional costs for video conferencing for Branch 3 which is not included in Lechlietner bid and possible funding from Child Support with state reimbursement for courtroom furniture. Motion: [Rogers / Schradle) to proceed with courtroom project for $98, Discussion. Carried with no opposition. Purchase of Park Benches from WITC Welding Club: French explained request from WITC Welding Club to make benches to raise funds for the welding program. Discussion. Motion: [Miller / Rogers) to deny purchase of benches from WITC. Carried Page 1 of 2
3 ATV / Snowmobile Trails Grants and Projects: Moin gave an update on trail projects and funding. Barren County will be receiving $547,000 for trail projects. Geese Abatement - Silver Lake: Olson explained request for permit for geese abatement at Silver Lake. Project would be in conjunction with the Silver Lake Association. Chad Alberg with USDA explained methods to control population through reduction and egg oiling. Consensus to move forward with geese abatement project. Workforce Resource Rent Reduction: French explained request from Workforce Resource for reduction in rent. French recommended a reduction to $490 for February and then they would need to either reduce area or vacate by March 1st. Motion: [Rogers / Heller) to extend rent concession through February 2018 at which time they need to reduced square footage or vacate property. Discussion. Carried No staff reports or future agenda items were prqvkled. 4 Land Use and Recreational Use Agreement Between The County of Barren & Barron Area Nordic Trail Association (BANTA) This Agreement, made this _ day of_, 20_, by and between the Barren Area Nordic Trail Association (BANTA) a Non-Profit Corporation, Grantee and Barren County, a municipal body. Grantor. Whereas, the Grantor is the owner of the real estate on the route of the cross country and snowshoe trails, hereinafter known as "trails", and said property described as Parcel numbers and in the City of Barren Wisconsin. Whereas, the Grantee desires to maintain the aforementioned trail systems over and across the lands of Grantor, Now therefore, Witnesseth: The Grantor grants to the Grantee, a right to operate and maintain, a public, lighted cross country ski and separate snowshoe trail, on over, and across the lands described above. It is understood by the Grantor and Grantee, that this Agreement is subject to the following conditions. 1. Grantor's participation in costs of construction, development, and maintenance of said trail will be limited to budgeted, negotiated, and agreed upon amounts. All other costs are to be borne by the Grantee. 2. This agreement is non-transferrable by the Grantee. 3. Non-Waiver/No Assumption of Duty. County retains all rights and immunities it has under Wisconsin's Recreational Immunity Statute, Wis. Stat , and any and all other immunities and defenses to which it is entitled by law. Nothing in this Agreement shall be construed as an assumption by County of: a duty to keep the Property safe for recreational activities; a duty to inspect the Property; or a duty to give warning of an unsafe condition, use or activity on the Property. Likewise none of County's rights under this Agreement or the restrictions on the Permitted Recreational Uses shall be interpreted or construed as County approving or warranting the design, maintenance, condition, or safety of the Designated Trails or approving or warranting BANTA's actions, equipment, or methods of operation. 4. When there is snow on the ground, it is understood that there is to be no foot traffic on the ski trails. Grantee shall post signs to that effect. 5. All attempts will be made to maximize the use by the Public throughout the year. There may be times where the trails area are closed for maintenance such as seeding. 6. The grantee may prune trees, using proper techniques and times of the year, along the trails and mow vegetation on the trail.
5 7. This agreement may be revoked or cancelled at any time by the Grantor 8. Grantor will take the presence of trails into consideration when planning all future silvicultural practices in the vicinity of the trail. The presence of trails within the forest will not limit the Grantor's right to harvest timber. Grantor will attempt to minimize interference of ski trail operations by timber harvest, but all such conflicts will be resolved in favor of Grantor's forest management activities. 9. No signs will be permanently attached to trees. 10. The existing light maintenance shed is the property of the grantor. Maintenance of said building and structures will be the responsibility of the Grantee, so long as this Agreement is in effect. Upon cancellation of this Agreement, the Grantee shall remove all equipment within 30 days. 11. Any permits needed to construct and maintain trails and related structures and developments shall be the sole responsibility of the Grantee. 12. Grantee agrees to operate and maintain trail in a safe manner and condition. Grantee shall provide liability insurance and provide Grantor with proof of same, annually. 13. The Grantee may request donations for the upkeep of the trails, but they may not charge for a required trail pass. The trails are open to all without charge. 14. Grantee shall also: a. Maintain and groom trails b, Maintain and pay for electricity for the lighting system. c. Advertise and promote the area 15, Grantor shall: a. Restrict all unauthorized motor vehicles from the ski trail system. b. Work with BANTA to address erosion issues on the trail system. c. Cooperate with Grantee, as much as possible, to promote and develop the area as a "quality trail system and a recreational asset" to the Grantor. d. Promote the trails for use by hikers and those seeking to enjoy nature. 16. Day to day interpretation shall be by County Administrator. Any disputes shall be resolved by the Barren County Property Committee. All decisions by the Committee are final.
