Box 1960, Buckley WA Phone: ext 200 Fax: Memo To: Mayor & City Council From: City Administrator Date: February 9, 2017 RE: Support for Nall Property Rezone Staff recently received a request from an individual representing Scott Nall that asked that the City consider providing a letter of support for a County rezone application for parcel numbers , , The rezone is necessary to change the property zoning to a zone that allows the owners proposed use. The owner is proposing to construct an indoor sports facility that would include a soccer field and room for other athletic activities as well. The project could also include some outdoor fields if room allows. The owner indicates that there is limited field availability on the plateau, so this project would meet a need in the community. Use by schools, clubs, and weather issues during the winter contribute to the problem. The owner is putting up his land and personal resources to make this happen. Since all 3 parcels are located in an area that the City has identified as future UGA, and we re currently in discussion with the County over this subject, we thought that the City Council should consider whether or not supporting a rezone for the proposed use meets the City s long term vision for this area. Since we currently receive Federal funding for the Realignment Project, WSDOT is requiring the City to have approved signature authority for requesting reimbursement for project funds. 12 CITY OF BUCKLEY, WASHINGTON RESOLUTION NO. 17- IN THE MATTER OF DELEGATING TO THE CITY ADMINISTRATOR AUTHORITY TO LEGALLY BIND THE CITY OF BUCKLEY, PIERCE COUNTY, WASHINGTON FOR THE SOLE PURPOSE OF REQUESTING FEDERAL REIMBURSEMENT WHEREAS, The City Administrator has been duly appointed by the Mayor in accordance with BMC 2.06, which includes administration of the business of the City government; and, WHEREAS, The Federal Highway Administration, through the State authorizes federal transportation funding to the City of Buckley, Pierce County, Washington for transportation projects; and, WHEREAS, The Code of Federal Regulations, 2 CFR (a) has been revised to ensure that final fiscal reports or vouchers requesting payment under Federal agreements must include a certification, signed by an official who is authorized to legally bind the non-federal Agency; and, WHEREAS, the City Administrator executes all Federal grant funding agreements and supplemental agreements; and, WHEREAS, in order to seek timely reimbursement for proper expenditures related to the Federally funded grant projects, the City Council of the City of Buckley delegates to the person appointed as the City Administrator the authority to legally bind the City of Buckley, Pierce County, Washington solely for the purpose of requesting Federal Grant reimbursement; NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Buckley that for the purposes of requesting reimbursement for Federally funded transportation projects, the City Administrator shall be delegated authority per 2 CFR (a) to legally bind the City of Buckley, Pierce County, Washington in furtherance of the intent of this resolution; and, BE IT FURTHER RESOLVED, by the City Council of the City of Buckley that the person duly appointed as the City Administrator shall be authorized to sign all grant reimbursement vouchers for grant funded transportation projects on behalf of the City of Buckley. 2 CFR (a): By signing this report, I certify to the best of my knowledge and belief that the report is true, complete, and accurate, and the expenditures, disbursements and cash receipts are for the purposes and objectives set forth in the terms and conditions of the Federal award. In the summary staff discussed the fact that the scope did not include construction management, at that time, due to the limited budget for the project. In August, 2016 the City Council awarded bid of the project to Miles Resources, LLC for $380, This was out of a total budget of $435,000, which left $54, in remaining funds. Although we issued a notice to proceed and Miles completed a portion of the project we have yet to approve a scope of work for construction management. This is now being presented for consideration. 26 City Council January 24, 2017 Mayor Johnson called the regularly scheduled meeting to order at 7:00 PM. Upon roll call the following Council members were present: Sundstrom, Rose, S. Burkett, Leggett and Tremblay. Council member Boyle Barrett arrived at 7:05 PM and Council member B. Burkett arrived at 7:06 PM. Also in attendance were City Administrator Schmidt, Police Chief Arsanto, Assistant Chief Northam, Police Detective Garrett and Assistant Public Works Supervisor Banks. CITIZEN PARTICIPATION None. STAFF REPORTS Police Chief Arsanto distributed and discussed call stats from 2016, and announced that two new police trucks have arrived and should be equipped and on the road in the next couple weeks. City Administrator Schmidt stated that the new realignment project signal has raised concerns and the City has received a few complaints pertaining to the positioning of the signal. The City has been in contact with WSDOT and is trying to get a light on a post to make the signal more visible from highway 165. A meeting is scheduled for next Wednesday with AHBL for the new housing development off Division Street. Highline Homes closed on the Nanevicz property and they are scheduled to start construction this summer. Lastly, Finance Director Bazzar, Mayor Johnson and I are scheduled to have our last conference call with the auditor and will be scheduling the exit interview. Council member S. Burkett seconded the motion. Motion carried. CONSENT AGENDA Council member Boyle Barrett moved to approve the Consent Agenda. Council member Leggett seconded the motion. Motion carried. Approve Minutes of January 10, 2017 City Council Meeting Claim check numbers through 56273, in the amount of $100,599.69, for the period of December 14, 2016 through December 27, 2016; Claim check numbers through 56351, in the amount of $89, for the 2016 Open Period through January 20, 2017; Claim check numbers & 53276, and 56353, in the amount of $268,868.26, for the period of January 1, 2017 through January 10, 2017; and Claim check numbers through 56406, in the amount of $224, for the period of January 11, 2017 through January 24, 2017; Payroll check numbers through 36328, in the amount of $120, and ACH payroll in the amount of $278, for a total December 2016 payroll amount of $398,530.24; and Treasurer check numbers through in the amount of $1, and ACH payments in the amount of $12, for a total amount of $13, for the month of December 2016 are hereby approved and ordered paid this 14 th day of February, COMMITTEE REPORTS Mayor s Report: Mayor Johnson stated that she put the House Bill No in front of each Council member. This bill will help restore funds the City lost on liquor tax. The AWC legislative meeting is next month and she will be attending. Administration, Finance & Public Safety: Council member Boyle Barrett stated they will meet on February 7 th. City Council Agenda Packet Page 27

28 Transportation & Utilities: Council member Tremblay stated they discussed the dam project and the high concern of having a viewing station. The vac truck in the 2017 budget was also discussed. Their next meeting will be February 21 st. Community Services: Council member Rose stated they will be meeting on Thursday. Council Member Comments & Good of the Order: Council member Sundstrom made a few comments pertaining to an article that was put in council member mailboxes. Council member Tremblay moved to adjourn.
