1 Minutes Village Board of Trustees March 23, 2017 A meeting of the Village of Horseheads Board of Trustees was held on the above date at 7:00 p.m. Present were: Village Board and Staff Mayor Louise McIntosh Trustee Mike Skroskznik Trustee Pat Gross Trustee Bill Goodwin Trustee Rob Maloney Village Atty. Kelley, Michael Maloney, Westlake St. Kendra Griswold, Sage St. Resolution by Trustee Skroskznik, seconded by Trustee Goodwin BE IT RESOLVED, that the reading of the minutes of the Board of Trustees Meeting of March 9, 2017 be dispensed with and the same stand approved as entered by the Clerk. Resolution by Trustee Skroskznik, seconded by Trustee Gross BE IT RESOLVED, that the Justice Reports for February 2017 be received and placed on file in

2 2 the Village Clerk s Office. Trustee Gross asked about that other report we receive on the funds. Manager Lytle stated that we receive that report from the State, and it hasn t come in yet. Resolution by Trustee Gross, seconded by Trustee Goodwin WHEREAS, the Village of Horseheads Board of Trustees has adopted Rules of Procedure governing the conduct of its various board and committee meetings, and WHEREAS, such policy is to be reviewed annually, and WHEREAS, this Board has recently reviewed same and has considered minor amendments. NOW THEREFORE BE IT RESOLVED, that the Village of Horseheads Rules of Procedure, with proposed amendments dated March 2017, be adopted. A copy of the policy shall be placed on file with the Village Clerk-Treasurer. Audience Participation Brian Coon Lattabrook Road not a Village resident but I used to be for years. He stated that he saw a Horseheads Police Officer with a young child in a marked patrol car, dropping off at school. I stopped and was going to come to station and talk about dangers and liability of doing that. I witnessed him running radar with the child in the car. The child should be in a car seat in the rear of the vehicle. I approached him in the car. He said he was on duty. I asked if he was running radar. Mayor McIntosh I appreciate you bringing this to our attention, but this as a personnel issue we cannot discuss in this room publicly. We will address this. Mr. Coon I d like to know it will be addressed. I d like a letter saying that. Just to wrap up, in discussion with other police depts. that I had, that officer was putting that child at risk. I called Child Protective Services, they declined to step in. If it doesn t get taken care of, I will reach out

3 3 to PESH (Public Employee Safety and Health Bureau). Jack Murray, Co-President - Sister City Association just finished another very successful visit. Thank you very much for all your support with the program. We ve been in discussions with our sister city. Two years ago they sent an adults only delegation, for our 25 th anniversary. Next year we would like to reciprocate and send an adult only trip over to Japan, in fall of We d love for the Village to be represented. Mr. Sweet has agreed to spearhead this. We re looking at fall of Tom Sweet, Center St. next year is 25 th anniversary of our delegation going over there to sign the charter. So Mayor, you are cordially invited to join us. But, we need a letter to their mayor requesting and telling them that we are planning on coming. It s because this will put it on the governmental protocol. More than just their sister city committee, it will be the whole town. I don t expect you to write this by yourself. But Kevin Blackburn has volunteered to help write this letter. Should be sent out within next month or so. We talked with the adults last week and both agreed that fall would be a better time for us to go there. Around October 10 th, Manager s Report Brad I didn t write a report last week I was out of town. - Since I ve been back, had first mtg with PBA - Mtg for hometown heroes banners. They brought samples. 19 places they could be placed. Mr. Swackhammer has 18 people that have purchased banners. It would be for a 3 year commitment. Leaving it up to us. Would like them up from Memorial Day through July 4 th. Then again, before veterans day. Will have to come back for board approval. - Gardner Road Villas Lynhurst Ave. almost time to come back to Village Board. Have a few more loose ends to clear up. BOT, Department Head Updates Trustee Gross thanked Nate for St. Patricks parade. - Sister City visit was great. - South Ave. property we did not ask Mr. Kapral about that parcel to see if he may be interested in that. Skrosknik - Sister city visit was great. We hosted a family. Hope we can continue this program. Nate Nagle - CC Youth Board awarded the Village Parks Dept the Synergy award, in cooperation with summer cohesion program. Award was started in This is first time we ve received it. There will be a presentation on April 25 th.

4 4 Mayor McIntosh - Thanked the Fire Dept. for all their work for St. Patricks parade and dinner. Motion by Trustee Goodwin, seconded by Trustee Skroskznik, that this Board and the Village Manager move into an Executive Session to discuss the employment history of particular people. At 7:25 p.m. the Village Board and Village Manager moved into an Executive Session, the minutes of which are attached hereto and made a part hereof. At 8:00 p.m. The Board reconvened back into the regular meeting of this date. Motion by Trustee Gross, seconded by Trustee Maloney, that the following items be added to the agenda: - Authorize Lease with Chemung County Blostein Compost Site - Award RFP Archeological Survey Wells Receive Tentative Village Budget, Set Public Hearing Resolution by Trustee Gross, seconded by Trustee Goodwin WHEREAS, the Village of Horseheads owns real property commonly known as 715 Blostein Blvd., which was formerly used as a landfill, and WHEREAS, portions of the site have been converted to use as a composting area for residentially generated organic materials, and WHEREAS, the Village and Chemung County have consulted regarding the conversion of the use of such facility to composting of such materials from sites outside of the Village, but within Chemung County, and for the County to oversee the management, operation, and maintenance of the facility while the Village remains the owner thereof, and

5 5 WHEREAS, Village Manager Brad Lytle, Village Attorney John Groff and representatives of the County have negotiated terms and conditions of a lease being an inter-municipal agreement for a composting facility between the parties, and the Village Manager has recommended approval of same to this Board, it being in the best interests of the residents and property owners within the Village. NOW THEREFORE BE IT RESOLVED, that Village Manager Brad Lytle is authorized to enter into a lease with Chemung County substantially in the form of the proposed lease presented to this Board, and as recommended by Village Attorney John Groff, and be it further RESOLVED, that a copy of said lease shall be placed on file with the Village Clerk-Treasurer. Manager Lytle stated that the County will be paying us 5k per year for five years, then renegotiate. Trustee Gross will there be a fee for residents. Atty. Groff free for residents of Chemung County. Manager Lytle added that it would be open year round. Resolution by Trustee Skroskznik, seconded by Trustee Gross WHEREAS, the Village of Horseheads was awarded and accepted a grant from the Federal Emergency Management Agency for the construction of a water treatment facility at Village of Horseheads Water System Well #5 for water sourced from Well #5, and subsequently constructed such facility, and WHEREAS, the grant was amended to allow for the construction of an interconnecting water line from Well #4 to the treatment facility, and the Village issued bonds to finance the construction of the project, and WHEREAS, payoff of bond financing cannot occur without the performance of a Phase 1 Archeological Survey and review of results from same, and WHEREAS, this Board previously authorized the Village Manager to solicit, through Wendell Engineering, Requests for Proposals for the required survey, and WHEREAS, the following bids were received:

6 6 Public Archaeological Facility (SUNY Binghamton) $ 4,995 Panamerican Consultants, Inc $ 11,990 Environmental Design & Research $ 13,350 And WHEREAS, said bids have been examined and determined to be in order, and WHEREAS, Village Manager Lytle and representatives from Wendell Engineering have submitted their recommendations regarding the bids and the award of a contract, the same recommending award to Public Archaeological Facility. NOW THEREFORE BE IT RESOLVED, that the Village of Horseheads Board of Trustees does hereby accept the bid of Public Archaeological Facility, and that Village Manager Lytle is hereby authorized and directed to take all steps necessary including executing any agreements with said company to effectuate this resolution. Manager Lytle we are paying for this. Could have fought it, but its low cost. Biggest fight we will have is regarding water. We would have had to pay for this when they did it, they aren t charging us for work in putting out the RFP which was very substantial. Only 5,000 then we can get our FEMA money. Still money in our grant too. We re going to get this done soon. Resolution by Trustee Skroskznik, seconded by Mayor McIntosh BE IT RESOLVED, that the Tentative Village Budget presented to this Board by Budget Officer Brad Lytle is hereby received, and be it further RESOLVED, that a public hearing regarding said tentative budget is hereby scheduled for Thursday, April 13, 2017 at 7:00 p.m. Mayor McIntosh we may want to have a town hall meeting to talk to residents about this budget. Hopefully we can vote on budget on April 13 th.

7 7 Mayor McIntosh I d to set a up a workshop on fees - specifically for Parks and Rec. After brief discussion it was decided to have a workshop on Thursday, April 27th at 6pm, before the Board meeting. As there was nothing further to come before the Board, the meeting was adjourned at 8:13 p.m. /rmb

8 8 Village Board of Trustees EXECUTIVE SESSION March 23, 2017 An Executive Session of the Village of Horseheads Board of Trustees was held on the above date at 7:25 p.m. in Village Hall. Present were Mayor Louise McIntosh, Trustees Mike Skroskznik, Pat Gross, Bill Goodwin, and Rob Maloney. Also in attendance was Village Manager Brad Lytle, at which time they discussed the employment histories of particular persons. No action was taken. At 8:00 p.m. a motion was made by Trustee Maloney, seconded by Trustee Gross, that the executive session be adjourned, and the Board reconvene back into its regular meeting of this date.
