1 Minutes Village Board of Trustees February 7 th, 2019 A meeting of the Village of Horseheads Board of Trustees was held on the above date at 7:00 p.m. Those present were: Village Board and Staff Mayor Rob Maloney Trustee Bill Goodwin Trustee Pat Gross Trustee Mike Skroskznik Village Manager Nate Nagle Village Atty. John Groff Clerk-Treasurer Donna Dawson Manager s Assistant Rachel Baer Others Present Michelle Jones, Lattabrook Rd. Resolution by, seconded by BE IT RESOLVED, that the reading of the minutes of the Board of Trustees Meeting of January 31 st, 2019 be dispensed with and the same stand approved as entered by the Clerk. D&A: Audit Rick McNeilly came forward to review the draft audited financial statements with the Board. Highlights were: - Justices accounts- there has been issues for years with reconciling the cash. The cash that is in the fine acct at the end of the month should equal check that goes to the Village Clerk. That should equal. That hasn t been done. I m not supposed to do

2 2 accounting work because I m doing the audit. We got through the bail and got those straight. Went through fine acct and showed where there were some issues. For example, accidentally depositing in one acct but should have been in another. She s working with Donna to rectify. I ll come back in and hopefully get it fixed. Then I suggest that either she gives her monthly bank reconciliations to Donna or Village Manager to assure that those things are done. What has been part of the problem is ncourt. Some of those deposits haven t been recorded. On Village audit itself: - Reviewed fund balances for each fund for 3 years yrs ago you set up capital funds. But when it came time to fund them the county started taking back sales tax. - That might be a good use for some of this extra money. equipment, capital projects, etc. Mr. McNeilly then reviewed detailed pages of the audit document with the Board. - Good balance leftover in the end. Mostly due to reduced spending. we paid cash for the new firetruck. Should we consider bonding next time Mr. McNeilly the bond spreads cost out and then you can build up capital reserve. Resolution by Trustee Skrosknik, seconded by BE IT RESOLVED, that the audited financial statements for FY for the Village of Horseheads prepared by Rick McNeilly CPA are hereby received and accepted, and same are to be placed on file with the Village Clerk-Treasurer Resolution by, seconded by Trustee Skrosknik BE IT RESOLVED, that a Draft Local law to Override the Tax Levy Limit Established in General Municipal Law 3-c is hereby received, and a public hearing regarding same is hereby scheduled for Thursday, February 21 st, 2019 at 7:00 p.m.

3 3 Discussion Small Cell Towers - Status Atty. John Groff: - These are small cellular antennae that go on buildings and existing poles - Far less visible - More development of theses on small scale basis to roll out 5G transmission - Federal gov has been aggressive in passing laws that limit municipal control over their placement - Draft law will come to you for review - Village Planning Board would act on them instead of Board of Trustees but tall towers would remain under your jurisdiction. Resolution by, seconded by WHEREAS, the Village of Horseheads regulates vehicles, traffic and pedestrians in certain manners as more specifically identified in Chapter 235, Vehicles and Traffic, of the Village Code, and WHEREAS, Section C allows the regulations and schedules of Chapter 235 to be amended by local law, resolution or motion, and WHEREAS, on January 22, 2019 the Village Traffic Commission reviewed certain parking situations and has made recommendations suggesting that the parking, stopping and standing restrictions be changed in the vicinity of Maple Grove Cemetery on W. Broad Street to enhance the flow of vehicular and pedestrian traffic for public safety. NOW THEREFORE BE IT RESOLVED, that this Board does hereby amend Chapter 235, Vehicles and Traffic, ADDING the following to Section Section , Schedule XV: Parking Prohibited at All Times Name of Street Side Location ADD W. Broad St. South From Westinghouse (Route 14) easterly to a point 82 feet east of the south terminus of the centerline of Gardner Road.

4 4 And does further amend Section REMOVING the following streets or portion thereof from the identified restriction: Section , Schedule XV: Parking Prohibited at All Times Name of Street Side Location REMOVE W. Broad St. W. Broad St. South South From Westinghouse Road (Route 14) to a point 650 east thereof. From the south terminus of the centerline of Gardner Road easterly for a distance of 82 feet, and westerly for a distance of 293 ft BUDGET Manager Nagle: We re just starting the budget process. Would like input from the Board regarding a tax increase and whether or not you want to meet with each department head. Biggest thing now is to discuss appearance changes we would like to make in the budget. Will make the budget easier to read and more user friendly. Manager Nagle reviewed the suggested changes to the budget. Clerk-Treasurer Dawson We put a lot of labor into separating all these expenses. Some bills come in and are split out over several departments. We d like to condense these and have it go to one line item, ex. our fuel from the bus garage. Each line would have a table we can access that still shows all the details if necessary. We keep spreadsheets on every expense we receive. would like to still see details in monthly budget reports. I like the new layout easier to read. Further discussion ensued regarding the new layout. Manager Nagle said he needs to know by next Thursday if the Board is comfortable with the change to the budget and the tables. The Board said yes. After brief discussion, the Board also agreed to schedule budget meetings for the purpose of meeting individually with the department heads.

5 5 BUDGET MTGS. DEPT HEADS: Tuesday, March 5 th 7pm Thursday, March 7 th 7pm Manager s Report: Manager Nagle reported on the following items: - Watermain break again - Mtg. on Hanover Square circulation study. Labella identified some issues. Utility pole and guide wire in sidewalk. Another was that our ADA ramps are non-directional. - Met with NYSERDA. Trying to promote Clean Energy Comm. program. Similar to Wendel energy performance program we did. - Tomorrow mtg on Restore NY. It s a 550k grant for Hanover Square. STEG is still going to be the administrators for that. - DPW looking to replace a bucket truck Audience Participation Don Zeigler, Watkins Road commented on the budget redesign. Said it should stay in the detailed format. The public has a right to see where the money is going. Manager Nagle - tentative budget will show tables, adopted budget will not. Michele Jones, Lattabrook Road on small cell antenna will you get tax revenues. Also I agree about financial reports should be detailed. Mary Jo Glanton, Thorne St. I agree you should keep your budget in detail form. BOT, Department Head Updates : - Would like a workshop in the summer to go over the new SEQR forms. Need assistance on these questions. : - I was asked to attend business networking breakfast. Met area business people.

6 6 Motion by, seconded by, that this Board along with the Village Atty. and Village Manager move into an executive session to discuss recent collective bargaining issues. At 8:40pm the Board moved into an Executive Session, the minutes of which are attached hereto and made a part hereof. At 9:12pm the Board reconvened back into its meeting of this date. Resolution by, seconded by WHEREAS, the Village of Horseheads and the Horseheads Police Benevolent Association ( PBA ) have entered into a collective bargaining agreement effective June 1, 2017 through May 31, 2021, and WHEREAS, recently the PBA has sought to modify the agreement by means of a Memorandum of Understanding regarding the availability of overtime or compensatory time off for officers involved in certain special detail activities, and WHEREAS, the proposed MOU has been reviewed by Village Manager Nate Nagle in consultation with the Village s labor relations counsel who have recommended that the Village enter into the proposed MOU, and WHEREAS, this Board has considered the implications of the MOU. NOW THEREFORE BE IT RESOLVED, that Village Manager Nathan Nagle is authorized to enter into the proposed MOU on behalf of the Village of Horseheads. 7 7 Village Board of Trustees EXECUTIVE SESSION February 7, 2019 An Executive Session of the Village of Horseheads Board of Trustees was held on the above date at 8:45pm in Village Hall. Present were Mayor Rob Maloney, Trustees Mike Skroskznik, Pat Gross and Bill Goodwin, Village Mgr. Nate Nagle, and Village Atty. John Groff. Discussion ensued regarding collective bargaining negotiations pursuant to Article 14 of the Civil Service Law. No action was taken. At 9:10pm a motion was made by, seconded by, that the executive session be adjourned, and the Board reconvene back into its meeting of this date. : : :
