1 Bridges of Rivermist Homeowners Association Meeting Monday, April 4, 2016 at 7:00 pm Crossview Church Corner of Bethany Road and First Street in DeKalb Minutes Open Board Meeting I. Call to Order Dan called the meeting to order at 7 pm II. Roll Call: Scot Spier, Ralph Tompkins, Dan Steimel,Jeff Thunder, Marshall Dirks, Alexandra Dailey and Dan Pavelich. ( Rick Madsen out ill) There were 16 homeowners in attendance. Approval of Minutes of previous Open Board Meeting Minutes November 9, 2015 Ralph motioned to approve the minutes as corrected. Scot seconded the motion. All were in favor of accepting the minutes as corrected. Financials ending December 2015 were presented for approval. As of December 31, 2015 the Operating fund was at $42, The Reserve account had a balance of $12, and the total accounts receivable was $418, Marshall moved we approve the month ending December 31, 2015 financials. Ralph seconded the motion. All were in favor of approving the December 31, 2015 financials. The month ending February 29, 2016 financials were also presented for approval. As of February 29, 2016 the Operating Fund had a balance of $58, The reserve account had a balance of $42, and the total Accounts receivable was $440, Ralph moved we approve the month ending February 29, 2016 financials. Marshall seconded the motion. All were in favor of approving the February 29, 2016 financials. III. Old Business Collections: Phase V- There is no update at this time regarding Phase V (85 lots).court has been continued until May 23. IV. New Business/Committee Reports. Architectural- Dorrence submitted requested for approval of house plans for Lot 249 on Larking.. Fred reviewed and all looks good. Dan Steimel motioned we approve the plans as submitted. Scot seconded the motion. Plans for construction by Dorrance on Lot 249 approved as submitted. Fence request for house at 140 Tygert Lane have been submitted for approval. The plans have been reviewed and are found to be acceptable. City permit will be coming as soon as available. Marshall motioned we approve the request for fence at 140 Tygert as per plans submitted. Ralph seconded the motion. All were in favor, fence request for 140 Tygert has been approved as submitted. Basic contract will be coming soon and will need to be reviewed and approved by board.

2 Budget and Finance- There was no additional discussion. Communications- Alex delivered copies of the Winter newsletter to the DeKalb Realtors Association and they were distributed to the realtor board. Feedback indicated they were well received so we will continue to provide some copies to them in the future. (Cost per additional copy is.75) In my conversation with Laura Boyer at Honig-Bell, she found the copies useful for her office and suggested that if we see a house listed we might want to contact the listing agent and provide a copy or two for potential buyers. I estimate we would need to get at least 20 or 25 copies. Michelle Ohlinger-Agent at Coldwell Banker Honig-Bell and resident of BRM was interested in placing an ad in newsletter. Contact information was provided and she did make contact with publisher. I will touch base with her if necessary. Electrical/Mechanical & Rills and Ponds Basic Irrigation has installed the new pump which is back to the original type of pump, by the waterfall/wheel house and it is flowing nicely. It needs only a minor repair in the electrical panel to allow it to be set to auto which should be done next week. The pump at Pond 1 did not sound good and will be checked out and repaired or cleaned. Bur Oak has completed the rill clean-up and Basic has put the dye into the ponds to prevent algae. There are aerators that need repair and repairs will be done shortly. It was commented that the leak in the lining in Phase which was repaired in the first step of the rill project appears to have corrected the issue of standing water and it has helped water flow in that area. Dan and Ponds Inc. did a walk through the subdivision to determine what improvements can be done to improve water flow and the overall health of our water system. We look forward to receiving this proposal with their suggestions and recommendations. We are interested in doing some projects in other areas of our subdivision. Grant Olson informed us that there was a light out on Tygert Bridge. Fred asked if we were going to take steps to have a pump in reserve in the event of pump failure since there is a long wait time to get this particular pump. This pump is a special order and made only as needed. This is something the board needs to seriously consider. Landscaping- Bur Oak has completed clean-up of the areas around ponds. The trees growing at the edge of the water will be cut and spraying for cattails is in progress. The area behind phase one which was reconstructed last fall has not yet been seeded but will be completed soon. Legal-This was covered in old business. Rules & Regulations The Board of Directors discussed and voted on the following changes to the Rules and Regulations at the meeting on April 4, Vacant Lots Vacant lots cannot be used for any purpose and must be maintained in accordance with Article VI, Section 1 of the Declaration: If a Residential Lot is vacant or a Dwelling Unit is under construction, it shall be the responsibility of the Owner of each Residential Lot or Dwelling Unit to have the Residential Lot or the area around each Dwelling Unit graded level and mowed so that the weeds and grass do not exceed a height of six(6) inches. The Residential Lot and the area around each Dwelling Unit shall be kept clean and free of all debris and garbage.

3 If the owner of a Residential Lot containing a Dwelling Unit owns an adjacent lot, the owner may keep the lot vacant and follow the rules stated above or use the adjacent lot subject to the requirements of the Declaration and Rules and Regulations for a Residential Lot containing a Dwelling Unit. If the vacant adjacent lot is used for any purpose, the owner is required to install the public sidewalk, grade the lot level with the sidewalk and install sod or seed and parkway trees. Rule addition regarding the use of vacant lots was presented and discussed. Ralph motioned we accept the rule change as presented, Scot seconded. All were in favor of the rule change regarding use of vacant lots and will be effective on this day April 4, Fences All fences installed after April 4, 2016 shall be Powder Coated Aluminum not exceeding five (5) feet in height. Fences shall be manufactured by either ULTRA FENCING*RAILING ULTRAFENCE.COM or ELITE FENCE PRODUCTS Inc. elitefence.com as described in their company specifications for RESIDENTIAL purposes. The proposed color of the fence is also subject to review and must be approved as part of the fence material review process. Other manufacturers complying with similar specifications of Elite or Ultra Fencing*Railing may also be installed if approved by the Rivermist Homeowners Association. Detailed specifications are available from the Homeowners association upon request. Wood fences are allowed on lots 44-57, 70-75, , , and Any wooden fences installed prior to April 4, 2016, if properly permitted by the City of DeKalb and approved by the HOA at the time of installation, shall be grandfathered. They must be maintained as originally installed and shall be considered in complete compliance with all fence rules and regulations. Fences are only allowed in the back yard. The fence may not extend toward the street beyond the back of the house in the side yard. An exception can be made for enclosing a side garage door. The fence may then extend two feet beyond the door casing. The back of the house shall mean the main structure. Screen rooms and sun rooms shall not be considered part of the house in determining the back of the house. On corner lots the fence must be a minimum of twenty five feet from the sidewalk. A plat of survey, site plan showing the location of lot lines, existing structures, sidewalks, drainage ways and the proposed fence must be submitted to and approved by the Rivermist Homeowners Association prior to receiving a City of DeKalb fence permit. No construction shall be started until both the Rivermist and City permits are received. It is the owner s responsibility to provide a copy of the City permit to Rivermist five days prior to starting construction. Article 8, section 9 of the declaration of the Bridges of Rivermist shall also apply. Rule change regarding the installation of fences was presented. After some discussion it was determined that the material acceptable may need to be modified to include PVC and vinyl. Since it was necessary to obtain the correct way of identifying these other materials Marshall moved to accept the rule change regarding the installation/construction of a fence as written subject to amending to include these other materials at the next meeting. Scot seconded the motion. All were in favor of the rule change as presented. This rule is effective April 4, The following language from the Rules and Regulations will be eliminated because it is in conflict with the Declaration: Leasing 1. Leasing or renting of a home at Bridges of Rivermist is not allowed by the terms of the Rules and Regulations. 2. Homes are to be occupied only by owners of record as shown on the title of the property, and by immediate family members.

4 The topic was open for discussion. It appeared that some in attendance were not aware that there were renters in some of the homes. It was stated that any issue with a rental property would be taken up with the owner and not the renter. Marshall motioned we eliminate the language regarding leasing from the rules. Scot seconded the motion. All were in favor of eliminating the leasing language and the section will be eliminated as of April 4, The following language from the Rules and Regulations regarding Assessments states: 3. Any assessments not received by the end of the first month of each quarter shall cause a late fee of $18 to be assessed against that unit owner s account. 4. Similar late fees of $18 shall continue to accrue against the account as long as the owner remains in arrears to the Association in assessment amounts greater than or equal to their quarterly assessments. It will be replaced by this language: 3. Any assessment not paid when due will be charged a late fee of 10% of the total cost of the assessment for each thirty day period that said assessment remains unpaid. Scot moved that we approve the new language regarding assessments. Dan Steimel seconded. All were in favor of approving the modified language regarding assessments. This rule change is effective April 4, The following language from the Rules and Regulations regarding Collections states: 1. At such time as a unit owner accrues a delinquent balance to the Association equal to or greater than twice the quarterly assessment amount, the managing agent will issue a warning letter to the owner to bring their account back into balance. 2. Failure of the owner to act upon this letter and with the on-going accrual of a delinquent balance greater than or equal to three times the quarterly assessment amount, the managing agent shall be compelled to submit the account to a collections attorney. 3. At such time as an account is entered into the collections process, all fees associated with and caused by the collections effort shall be charged back to the unit owner. These shall become part of the delinquent balance, and shall be pursued by collections in the same manner as all other properly due assessment amounts, late charges, violation fines, etc. It will be replaced by this language: 1. At the Board s discretion, a notice requesting payment may be sent to an owner who is over 30 days delinquent in paying their quarterly assessment. If an owner is delinquent in the amount of two or more quarterly assessments, an attorney will be contacted to pursue collection. All associated fees and expenses incurred by the Association in its collection efforts shall be charged back to the unit owner. These shall become part of the delinquent balance and shall be pursued by collections in the same manner as all properly due assessment amounts, late charges, violation fines, etc. Scot moved that we approve the revised language regarding Collections as presented. Dan Steimel seconded. All were in favor of approving the language change as presented regarding Collections. This Rule change is effective as of April 4, Social Report- A Dutch Treat Lunch was held at Jamrah Middle Eastern Restaurant on March 9 at 11:30 am. The owner and resident of BRM, Mr. Ammari Mahmood gave samples of the falafel and hummus to the 4 who attended. It was expressed that if it were an evening meal we may have more attending due to work schedules. Our next Dutch Treat meal will be held on May 4 th. If you plan on attending arrive anytime

5 between 5:30 and 6:00 pm. All entrees are freshly made to order. Jamrah is located at 2672 DeKalb Avenue (by HyVee) We held a Boxed pasta and cake mix collection on April 2 and accepted donations tonight at this meeting. Donations that were left on front porches have been collected. Items collected will be delivered to Feed em Soup this week so if you still want to donate, just bring it to Alexandra s house. Spring Garage Sale will be May 20 and 21. As usual, ads will be placed and banners put out at entrances. Just FYI: Barb City Manor s Resale Shop is looking for donations of quality clothing and accessories for men and women, housewares, books and craft supplies, knick knacks and more. Donations can be dropped off at office at any time. All donations are tax deductible and proceeds from sales benefit BCM residents. (680 Haish Blvd, DeKalb ) V. Open Forum Gerry Miller expressed his concern regarding the mowing of Phase V. He keeps in contact with the city. Dan stated that there were no fines issued last year. It was questioned why the amount owed by the previous owner of Phase V has not been written off. It remains on our financials because there is still one lot that is owned by the previous owner. It was asked if we are receiving assessments on Phase V. No we are not receiving assessments on the 85 lots in Phase V but the other 13 lots are current. Dan was asked to make Dorrence aware of the load limits on the Tygert Bridge. He needs to have his hauling, and delivery trucks enter at Sangamon. The load limit is posted on bridge. VI.
