2 Page 2 of 9 6 SWEAR IN ANYONE WISHING TO TESTIFY Assistant City Clerk Jacqueline Poole swore in members of the audience and staff that wished to testify in any of the cases before the board 7 OLD BUSINESS a CASE NO DEREK J ZENTGRAF MARISOL ZENTGRAF LOCATION 580 S WOODLAWN AVE BARTOW FL PARCEL VIOLATION CITY ORDINANCE CHAPTER 3826 OVERGROWTH Investigator Wiggins who gave the following testimony Investigator Wiggins said that a reduction of fines is being requested for this case and the following case Case Nos and He said that both properties have been bank foreclosed He stated on September Code Enforcement received a letter from Realtor Randy Benton representative for Coldwell Banker requesting a reduction of fines on both cases Investigator Wiggins read the correspondence into the record and is attached herein as Exhibit A Investigator Wiggins stated the initial violation was on May and was presented before the Code Board at July hearings at which time a 50 per day fine plus administrative costs were imposed The fines ran for 11 days Investigator Wiggins stated fines of and administrative costs associated with the case total Board Member Jones asked whose responsibility was it when it was initially cited He also asked when a bank repossesses property do they assume liability for any debts Investigator Wiggins stated at that time the property was being repossessed it was privately held as it had not gone through foreclosure yet He said the property is being maintained Board Member Spence asked if it has been maintained since the bank has control of the property He said since it is basically a new owner he believed it would be appropriated to waive the fines and assess the administrative fees only MOTION was made by Board Member Spence seconded by Board Member Lovelace to waive fines of that accrued in this case and to assess only the administrative fees totaling b CASE NO DEREK J ZENTGRAF MARISOL ZENTGRAF LOCATION 580 S WOODLAWN AVE BARTOW FL PARCEL VIOLATION CITY ORDINANCE CHAPTER 3826 OVERGROWTH Investigator Hernandez who gave the following testimony Investigator Hernandez said this particular case was brought before the Board on February at which time the Board granted the Respondent 15 days to bring the violation into compliance and if the violation was not corrected within that time period that

3 Page 3 of 9 Code Staff would arrange to have the lawn mowed Investigator Hernandez said the city mowed the property and the cost was and the administrative costs were for a total of Board Member Munroe asked if any fines were imposed to the February case Board Member Jones said since the city took care of the mowing it would be considered as city expenditure MOTION was made by Board Member Jones seconded by Board Member Spence denied the request and assessed the cost for for mowing plus in administrative costs for a total of NEW BUSINESS a CASE NO 10171AH FLORIDA CAPITAL ASSOCIATES INC LOCATION 435 S 7 AVE BARTOW FL PARCEL VIOLATION CITY ORDINANCE CHAPTER VIOLATION STANDARD HOUSING CODE SECTION MAINTENANCE VIOLATION STANDARD HOUSING CODE SECTION WINDOWS VIOLATION STANDARD HOUSING CODE SECTION WINDOWS TO BE GLAZED VIOLATION STANDARD HOUSING CODE SECTION WINDOW SASH OVERGROWTH VIOLATION STANDARD HOUSING CODE SECTION PROTECTIVE TREATMENT Investigator Hernandez who gave the following testimony Investigator Hernandez said this case was submitted by the Building Department and that she took the photographs for this case and they depict what she actually saw She stated that a Notice of Violation and Hearing was mailed to the Respondent via Certified Mail on July Investigator Hernandez said she notice was refused On August she posted the property City Hall and mailed a copy of the notice via 1s Class mail Investigator Hernandez stated she has not had contact with the Respondents She said the most recent inspection was today and that the violations remain She said it has been in violation for 62 days Investigator Hernandez requests that the Respondent be given 30 days to bring the violation s into compliance and if the property is not brought into compliance within the time period indicated that a fine of per day pursuant to Florida Statute to accrue until the property is brought into compliance plus any and all administrative costs Board Member Frean asked if the property was vacant Board Member Jones asked if it is in foreclosure Investigator Hernandez said the property is vacant but is not in foreclosure MOTION was made by Board Member Jones and seconded by Board Member Bohde to grant the Respondent 30 days to bring the violation into compliance and if the property is not brought into to
