1 Balfour Townhomes HOA Rules and Regulations Balfour is a community, which has an Architectural Committee / Maintenance (Arch) and Covenant Committee whose responsibility is to enforce the Architectural/Maintenance Guidelines and all Covenants, as explained in the Legal Documents When you close on your home your real estate agent, or closing attorney, must provide a copy of the Declaration, Bylaws and Articles of incorporation~ you will be asked to sign a statement which acknowledges you have read, understood and agree to abide these documents. If you decide to rent your home, it is the owner's responsibility to ensure the renter receives of copy of all documents, as owner you will be held accountable for the actions, or lack of, of the renters. The purpose of these rules is to maintain a specific appearance and sense of well being in your community; sometimes allowing each homeowner to make minor alterations to this home in order to adapt your home to the needs of your family and your landscaping ideas. While each home will have its own personality, the control will ensure that property values in the Community will not be affected by any "non-traditional" actins or improvements. Architectural / Maintenance Committee As part of the review process, you are required to submit an Arch. Request Form before altering the exterior of your home or landscape. This form asks for detailed information about the project, diagrams, drawings, photos, rooflines, dimensions, colors, plat plans, types of plantings, and signatures of your neighbors... The approval of your request does not ensure that your project meets any City, County or State codes, rules, and guidelines. Please contact these agencies to learn what is required of you and to obtain all necessary permits. After receipt of your request, the Arch Committee will review and respond to you within 45 days, in writing, with an approval or disapproval. If you disagree with any comments or requests made of the Arch Committee you may contact your Board and ask for an opportunity to present written appeal of your concerns with them at the next, regularly scheduled Board meeting. At this time they will hear and take into consideration your point of view. They will not be required to make a decision without reviewing the legal documents and discussing the matter with the Arch Committee. COMMON EXPENSES The Homeowners Association and the Board are responsible for the following items Maintenance, replacement, and repair of the common and limited common areas, buildings, roofs, gutters, doors, sidewalks, stairs, parking lots, drainage systems, landscaping, however, this does not include water, gas and sewer lines, and wiring located within the walls.

2 Incidental damages caused to a unit by the maintenance, replacement and repair of the common areas or facilities. Replacement of windows, window panes, and exterior doors, unless the damage was caused by the unit owner, resident or guests. OWNER EXPENSES Unit owners are responsible for the following, at their own expense. Exterior maintenance on all surfaces, including glass surfaces, except as indicated above. Maintain, repair, replace and keep in a clean and sanitary condition, porches, decks and limited common areas. Maintain, repair, or replace all heating and air conditioning units and ducts, stoves, fans, refrigerators, or other appliances and their equipment, their connections and service lines. Maintenance, repair and replacement of the interior surfaces of all exterior doors, windows, walls, ceilings and floors, within the unit. This includes painting, decorating, and furnishings and other accessories. Maintenance of any improvements in any limited common area adjacent to their unit. The cost of reasonable repair and maintenance of a party wall shall be shared by the owners who make use of the wall in proportion to such use. Every owner shall perform all maintenance and repair work, as needed, which if omitted would affect the homes belonging to other owners. Every owner is expressly responsible for the damages and liability which this failure to do so may engender. In the event that the owner fails to properly maintain the rear yard and other improvements in accordance with such standard the Board shall give the owner written notice of its maintenance requirements and thirty days to meet these requirements. Upon the owner's failure to meet these requirements within the time allowed, the Board shall cause the maintenance to be done, for a period of one year, and shall add such cost to the owner's next monthly assessment after such maintenance is completed.

3 Rules and Regulations The Rules of this community were put in place to ensure that each resident would be able to live this community and feel welcome, safe, and secure. In addition to the rules covered in the Covenants, your Board has approved additional rules. These rules and regulations do not change or override the Declaration and Bylaws, and may be subject to future change. Animals, livestock, or poultry of any kind shall not be raised, bred, or kept in any unit, general or limited common areas and facilities. Dogs, cats or other household pets n1ay be kept in the units. When not in the unit, dogs, cats and other household pets must be on a leash, be carried or otherwise restrained. You are responsible for animal waste. Do not leave animal waste on the general or limited common areas and facilities. Activities No immoral, improper, offensive or unlawful use shall be made of the property, or any part thereof, and all valid laws, ordinances, and regulations of all governmental agencies having jurisdiction thereof shall be observed. No obnoxious or offensive activity shall be carried on upon the property, nor shall anything be one which may be or may become a nuisance or annoyance to residents within the property. Alterations Nothing shall be altered or constructed, or removed from the general or limited common areas and facilities except upon the prior written consent of the Board. Additions / Changes (see above for more details) All external changes to homes and property must have approval form the Arch. Committee before any work begins. This includes, but is not limited to the following: changes to doors, windows, landscaping... When in doubt, submit a request form. Conduct The applicant must ensure that all contractors etc. control the conduct of their employees while working on your unit. Loud music, profanity, and other unbecoming behavior will not be tolerated. Work must not begin before 7:00 AM and cleanup will be done before 6:00 PM, unless there is an emergency. Site Cleanliness Work sites must be maintained in a clean and orderly manner at al times

4 Bikes and Play Equipment These must not be left on the street or front yards. Please ensure that all such equipment is put back on your patios after use. Damage to automobiles or personal property through reckless play with any recreational equipment will be reported to the police. BBQ's The State Fire Code states that all free standing, charcoal or gas grills must be 10ft. from any burnable material. Fixed, electric grills may be less then l0ft from burnable material. Children Children at play must be under the supervision of an adult to ensure the safety of the children and to ensure proper play activities. Damage to automobiles or personal property through reckless play will be reported to the police. Decorations, Seasonal Seasonal decorations my be put in place two weeks before the holiday and must be removed two weeks after the holiday. Fenced in Yards Owner may plant trees, shrubs, flowers and grass in the fenced or enclosed portion as he elects and shall maintain the fenced or enclosed portion at his own expense, provided that such maintenance dies not hinder the Balfour Association in performing its maintenance duties to the town home, the remaining yard space or the limited common area. Front Yard Planting Plants and vegetation, (specifically including, hut not limited to, flowers, trees, shrubs, vegetables, vines and moss) in front of the town home, except with the prior written approval of the association will not be allowed. Firewood Please ensure that all firewood is kept away from wooden fences, all structures and not in any common or limited common area. Garden Statuary and Decorations Please submit an Arch Application before placing statues and ornaments in your front yards.

5 Garbage All waste is to be place in the proper containers. Do not put furniture, metal, construction debris, etc. in the containers or leave such itel11s on the side of the container. No waste shall be committed on any portion of the common area and facilities (debris, garbage, furniture, etc, shall not be allowed to collect on or in the common area, facilities or each unit). Removal of such by the HOA will be assessed to the homeowner of such unit. Insurance Nothing shall be kept in any building or town home or the common area and facilities which will increase the rate of insurance, applicable to residential use for the property of the contents thereof No owner shall do or keep anything, nor cause or allow anything to be done or kept, in this town home or in the common area and facilities which will result in the cancellation of insurance on any portion of the property, the contents or which will be in violation of any law, ordinance, or regulation. Every owner shall maintain insurance in effect at all times, fire and hazard insurance in an amount equal to the full insurable value of this town home except that the amount shall not be required to exceed the replacement cost of the town home. Proof of insurance may be requested. Mailboxes Mailboxes are managed and maintained by the Postal Service. Please do not call the management company for replacement keys. Misc. Balfour may regulate or prohibit the erection of clothes lines and television antennas. Hanging or Container Plants Reasonably sized plants and planters will be allowed. Noise Music/TV/Auto/Animal/Etc. Each person has their own tolerance level for noise. Please keep your "sounds" to a level that it will not travel to the homes of other residents. County noise ordinance regulations will be enforced.

6 Parking Two parking spaces are al10wed per unit. One tnay be in front of or as close as possible to your home, the other will be towards the end ofthe parking lot. All vehicles n1ust have current registration and be in proper working order. Recreational Vehicles Balfour may regulate the parking ofboats, trailers, campers, motor homes, trucks or tractors owned by a member his guests, or family members shall be parked within the right ofway ofany public or private street in or adjacent to Balfour. All such vehicles must have current registration and be in proper working order. Recreational Facilities When assessments are not current, pool and clubhouse privileges will be suspended until the account is brought current. Screening, Window Window screens must be installed, and in good condition, on the front windows of each home. Please contact the Arch Comm. Or the Board President for specifications. Signs No owner shall display, or cause or allow to be displayed, to public view any sign, placard, poster, billboard, or identifying name or number upon any town home, building or any portion of the common area and facilities, except as allo,ved by the association. "For rent" and "for sale" may be displayed in your yard, only. Solicitation Solicitation is not allowed, police will be called. Snow and Ice When winter storms bring in snow and ice, each homeowner is responsible for removing it from their sidewalks. The Association does not have a contract for someone to provide this service. Vehicles Each lot is entitled to not more then two parking spaces. Vehicles will be parked in the proper locations for your unit, and will not prohibit safe driving on the streets. Remember, there are children in the community who use the streets for riding bikes and play. All vehicles must have current registration and tags. The Association and owners have the right to tow unauthorized vehicles, at the vehicle owner's expense.

7 Each unit owner and resident shall comply with the Covenants and the Rules voted on by the Board. Failure to do so shall result in one warning letter; the second violation will result in a fine of $50.00 per day being assessed to the homeowners account without further notice. Additional fines may be assessed at the discretion ofthe Board. Whatever you do, or do not do, within your property lines has an affect on your property values as well as the other homeowners in your neighborhood. Your Board hopes that you will do your part in this community in a manor that will not detract from the overall style and beauty and comfort level ofthe community as a whole. If you disagree with any ruling, you may appeal it at the next Board meeting. Please contact your Board president for date, time and location and spot on agenda. However, until the situation is resolved all fines will remain in place and the decision will be considered final.
