1 BROADVIEW HOMEOWNERS ASSOCIATION, INC. BROADVIEW III RESOLUTION REGULATION LAND USE: NO. 4 RULES AND REGULATIONS This document supersedes Resolution Regulation Land Use: No. 2 Rules and Regulations. WHEREAS, Article VII, Section 1., of the By-Laws of Broadview Homeowners Association, Inc., (the Association ) charges the Board of Directors with the responsibility to regulate the use of the Common Areas and Facilities, and the personal conduct of the members and their guests thereon, and to establish penalties for the infraction thereof; and WHEREAS, Article VII, Section 1., of the By-Laws of the Association further charges the Board of Directors to exercise all powers, duties and authorities vested in the Association and not reserved to the membership by other provisions of the By-Laws, the Articles of Incorporation, or the Declaration of Covenant, Condition, and Restrictions of the Association; and WHERAS, Article IX, Section 1., of the By-Laws of the Association charges that the Association shall appoint an Architectural Control Committee with powers and responsibilities enumerated therein, including but not limited to, the administration of the rules governing the property in the Association, and rules being passed by a majority of the vote of the membership of the Association; and WHEREAS, the Association duly established and passed said rules as prefaced immediately hereinabove as Broadview III Architectural Review Committee Rules (the Rules ); and WHEREAS, in establishing said Rules as prefaced immediately hereinabove, the Board of Directors were expressly given the power to make additional rules and procedures applicable as to the Association and in furtherance of the Rules, as stated above; WHEREAS, in furtherance of the Rules, the Board of Directors of the Association adopted Resolution BR-89-01; and NOW THEREFORE, BE IT RESOLVED, that the following additions to the Broadview III Architectural Review Committee Rules are hereby adopted: A. Restrictions: 1. Recreational Vehicles. Recreational vehicles are prohibited from being stored on or in the community with the exception of those vehicles which can be housed in the garage of the homeowner. Such recreational vehicles include, but are not limited to, mobile campers, pull campers, pop-up campers, fifth wheel campers, boats and any and all trailers used for the transportation of said vehicles. Any such vehicles needing minor repair may be placed in the driveway of the homeowner during that repair, but LIBER 0004 FOLIO 2391

2 in any event, not to exceed seventy-two (72) hours. Boats are to include all sea going vessels. 2. Commercial Vehicles. No vehicles in excess of three-quarter (3/4) ton capacity and/or displaying advertising shall be left parked on any parking area or street longer than is necessary to perform the business function of such vehicle at the said address. It being the express intention of this restriction to prevent the parking of any vehicle defined hereinabove as a commercial vehicle, including but not limiting to, trucks, vans, step vans, buses, etc., on parking areas for a time greater than that which is necessary to accomplish the aforesaid business purpose. Parking area as stated above excludes the full garage with fully functioning door(s) owned by or any subject homeowner. Parking of commercial vehicles in the community is permitted if the vehicle is completely contained within the garage of the homeowner. 3. Satellite dishes. Satellite dishes exceeding 18 inches are prohibited from being installed externally on any property within the Association. 4. Antennas. Antennas are permitted, however, they much be maintained, in proper working condition, and when possible, should not be visible from the street. Any antenna so installed shall not be more than eight (8) feet above the mooring and must be secured by guided wires. 5. Vehicles under repair. Vehicles under repair beyond three (3) days are prohibited. This includes all vehicles on blocks, lifts, ramps, jacks or those with visible portions of the vehicle such as doors, wheels, tires, hoods, etc. having been removed. Additionally, stored, non-workable vehicles are prohibited except in the homeowner s garage. 6. Clotheslines. Non-stationary clotheslines, such as umbrella or retractable types are acceptable. However, they should be removed and stored when not in use. Existing, fixed clotheslines requiring replacement must be replaced by one of the above. 7. Spas. Spas are acceptable if placed or located on or under decks. In any event, any spa so installed must meet Harford County Codes and must be child proof. 8. Shed. Sheds must be approved by the Architectural Review Committee prior to the placement and/or construction of same. All sheds must be constructed of wood with adequate roofing material being the same as or similar to that of the serviced home. Vinyl siding is permitted. 9. Tanks. Empty or used tanks used for storage purposes (except propane tanks used for grills) are prohibited. 10. Storage of Construction Materials. The permanent storage of construction materials and lumber (excluding firewood) is prohibited. Construction lumber to be utilized for LIBER 0004 FOLIO 2392

3 immediate project(s) is to be stored in the rear of the house when possible. Firewood should be stacked neatly in cord fashion on the side or rear of the house. 11. Fences. Fences may be installed in the rear of the home only. They must be constructed of wood or polyvinyl materials in the design of picket, stockade, split or ranch and shall not exceed 48 in height. Consideration shall be given to the type of fence (if any) your neighbor has erected. Wood fences shall be of natural color stain or sealant. 12. Basketball nets and board. Basketball nets and boards are acceptable. However, they shall be maintained in good working order and shall not face the street. Homemade basketball backboards are prohibited. 13. In-ground pools. In-ground pools are acceptable, however, they are to be properly fenced and landscaped. All in-ground pools shall be properly maintained and child proofed. Pools determined to be a safety hazard shall be back filled promptly. 14. Above-ground pools. Above-ground pools are acceptable but shall be shrubbed and contain a deck access which is child proofed. Any pool so installed shall have a 15 year warranty against rust and corrosion. Filters shall be enclosed with either shrubbery or pressure treated wood or lattice. Pools deemed inoperable or a safety hazard shall either be repaired or dismantled. Note: Special attention should be given when landscaping pools as to the type of shrubbery planted so as not to cause damage to the pools from the root system. Additionally, construction and/or the assembly of a pool shall require submission to and prior approval of the Architectural Review Committee. 15. Decks. Decks may be constructed with real or synthetic wood decking. Wood or polyvinyl railings are permitted. 16. Driveways. Driveways may be constructed of poured in-place concrete with broom finish or paved with asphalt. B. Procedure for submitting plans to the Architectural Review Committee: 1. Submission Policy and Materials to be Submitted. All plans shall be submitted in advanced of the construction of any regulated, proposed project requiring approval of the Architectural Review Committee (the Committee ). Plans shall be submitted to the Committee at least thirty (30) days prior to any proposed start date. Only plans from members in good standing shall be reviewed and approved, provided all standards have been met. LIBER 0004 FOLIO 2393

4 All plans shall be submitted with three (3) copies. This is necessary so that each member of the Board can receive a copy and study it in advance of the Committee meeting on the proposed project. Plans shall be in sufficient detail so as to list the size, measurements, kind/type and positioning of the project as it relates to the property. Where landscaping is required, the proposal for the Committee must be designate the area to be landscaped, and, when possible designate the type of plant materials to be used. When immediate planting is not possible/feasible, the proposal shall provide an estimated date of completion. Note: Greater details provided increases any possible approval by the Committee. Homeowners having projects of a rush or immediate nature shall contact one of the Board Members and request immediate attention, if possible. 2. Rejection Decision by the Committee. If you project is rejected by the Committee, you have the right to appeal the decision. Any Board Member contacted shall provide detailed information concerning appeal measures. Essentially, there are two (2) forms of appeal. If the Committee rejects your plans, the first level of appeal is to the Board of Directors of the Association. If the rejection decision is affirmed by the Board of Directors, a second and final level of appeal can be made by a homeowner requesting that a board consisting of three (3) disinterested homeowners from Broadview III review the prior decisions and plans. Any decision rendered by the second appeal board shall be final 3. Project Completion. Any and all projects approved by the Committee, Board of Directors or board of disinterested homeowners shall be completed no later than three (3) months from the date of approval. 4. Amendments, Supplements, Powers delegated to the Board and Committee. The Board of Directors may from time to time, make additional applicable rules and procedures as deemed necessary and as permitted by the Articles of Incorporation, the Declarations of Covenants, Conditions and Restrictions and the By-Laws of the Association. 5. Mission Statement of the Committee. It is not the intention of the Committee (or the Board of Directors) to deny anyone the right to improve or enjoy their property. Safety, aesthetic harmony, and property values, however, are a concern, as well as enforcing the rules agreed upon by all members at the time of settlement. Most individuals in this community take great pride in their homes and, in most cases, wish to see certain restrictions to protect their investment.
