The tenders should be submitted in two bid system i.e technical and financial bid separately. Statement containing serial number of the item, generic name, brand name, strength, pack size and detailed specification of the drugs quoted with brochure and literature if any. 2. Earnest money deposit of 1% of the total value of the quoted drugs 3. Delivery period. 4. Place of Delivery 5. Payment condition The financial bid should contain :- Unit price of the drugs. The tender duly signed and sealed in each page by the tenderer along with necessary documents shall be submitted to the Purchase Officer, Regional Cancer Centre, Trivandrum on or before 4 PM on 06/11/2014. Late tenders will not be accepted. The technical bids will be opened at 2 PM on 07/11/2014 in the presence of such tenderers or their authorized representatives who may be present at that time. The tenderer should submit the EMD of 1% of the total value of quoted products, along with the technical bid. The EMD amount may be paid either by demand draft, Fixed Deposit Receipt or Bank Guarantee in favour of Director, RCC, Trivandrum. Earnest Money Deposit (EMD) is exempted in the following cases. If the tenderer comes in any of the following category, they should submit the copy of the relevant certificate attested by a Gazetted Officer in technical bid for EMD exemption. 1. Firms who are registered with the Stores Purchase Department or the Directorate General of Supplies and Disposals, New Delhi are exempted from furnishing EMD for tenders in respect of stores by which they have registered as suppliers of stores. 2. Micro and small enterprises and Industrial Co-operatives within the Kerala State which are certified as such by the Director of Industries and Commerce or by the General Manager, District Industries Centre are exempted in respect of certified items from

5 furnishing EMD in support of tenders. 3. The Khadi and Village Industries Co-operative Societies and the Institutions registered under the Travancore Cochin Literary, Scientific and Charitable Societies Registration Act, 1955 within Kerala State which are certified as such by the Secretary, Kerala Khadi and Village Industries Board are exempted from furnishing EMD in support of tenders. 4. Micro, small & Medium enterprises registered with the National Small Industries Corporation Limited, New Delhi and in respect of which competency certificates are issued by the Corporation will be exempted from payment of EMD. 5. Government Institutions/Kerala State Public Sector Undertakings which manufacture and supply stores are exempted from furnishing EMD 6. Kerala State Small Industries Development Corporation Ltd when it participates in tender on behalf of Small Scale Units will be exempted from furnishing EMD. EMD will be refunded to the unsuccessful tenderer immediately. The financial bids of technically qualified firms will be opened at a later stage and the date will be intimated. Terms and conditions :- 1. The offer should be valid upto 31/03/ The price quoted should be inclusive of all taxes and duties. 3. The Brand name of the drugs should be clearly mentioned in the tender. 4. The quantity mentioned in the list is an approximate quantity which may be changed. RCC has the right to increase or decrease the quantity. 5. All items as per the supply order shall be supplied to our Central Store only. 6. The supply order will be released on installment basis as per requirement. 7. The supplied medicines should have an expiry of at least one year from the date of supply. However the drugs with below one year expiry are supplied and accepted by RCC in emergency situation, RCC has the authority to deduct 5% of the cost of drugs per month or part thereof and payment will be released only after fully utilization of the drugs within the expiry period. In any circumstance, RCC will not accept the drugs with less than 3 months expiry. 8. The date of delivery is the essence of the contract. If the drugs are not supplied within the stipulated period, the supply order will automatically stand cancelled at the risk and cost of the supplier. Subsequent purchase will be made from other sources and the loss if any sustained to RCC on this account will be realized from

6 the defaulter. 9. Payment will be released only after supply of the products. 10. Director, Regional Cancer Centre, Trivandrum reserves the right to accept or reject all or any tender at his sole discretion without assigning any reasons. 7 AGREEMENT Articles of agreement executed on this the...day of... between the Regional Cancer Centre (hereinafter referred to as Centre ) of the one part and Shri... (H.E name and address of the tenderer) (hereinafter referred to as the bounden ) of the other part. WHEREAS in response to the Notification No Limited Tender No dated. the bounden has submitted to the Centre a tender for the supply subject to the terms and conditions contained in the said tender. WHEREAS the bounden has also deposited with the Regional Cancer Centre a sum of Rs... as earnest money for execution of an agreement undertaking the due fulfillment of the contract in case his tender is accepted by the Centre. NOW THESE PRESENTS WITNESS and it is hereby mutually agreed as follows ; 1. In case the tender submitted by the bounden is accepted by the Centre and the contract for...is awarded to the bounden, the bounden shall within...days of acceptance of his tender execute a agreement with the Centre incorporating all the terms and conditions under which the Centre accepts his tender. 2. In case the bounden fails to execute the agreement as aforesaid incorporating the terms and conditions governing the contract, the Centre shall have power and authority to recover from the bounden any loss or damage caused to the Centre by such breach as may be determined by the Centre by appropriating the earnest money deposited by the bounden and id the earnest money is found to be inadequate the deficit amount may be recovered from the bounden and his properties movable and immovable in the manner hereinafter contained. 3. All sums found due to the Centre under or by virtue of this agreement shall be recoverable from the ounden and his properties movable and immovable under the provisions of the Revenue Recovery Act for the time being in force as though such sums are arrears of land revenue and in such other manner as the Centre may deemed fit.
