22 NZPA Newswire 12-Aug-2010 National By: NZPA Market: NZ National Type: National Frequency: MTWTFSS Law changes will make builders more accountable - minister Wellington, Aug 12 NZPA - The Building Act is going to be changed so that builders are more accountable for their work, the Government said today Building and Construction Minister Maurice Williamson said there would be a greater incentive to "build it right first time" while red tape and bureaucracy would be cut Legislation to be introduced to Parliament this year will:* Explicitly state that builders and designers are accountable for meeting Building Code requirements;* Introduce mandatory written contracts for building work above $20,000 that sets out expectations, warranties and remedies, and how any disputes will be resolved; and* Require those doing the work to explain what, if any, financial back-up or insurance they have to remedy any faults "I expect these measures will lead to fewer disputes and see most arguments sorted out quickly and relatively cheaply," Mr Williamson said "We want to make it easier for homeowners commissioning building work to hold contractors to account for fixing any defects that arise."the changes will also see some minor work, such as building a carport or veranda, exempted from the need for a building consent NZPA PAR pw gt 12/08/ NZ Ref:

25 NZPA Newswire 13-Aug-2010 National By: NZPA Market: NZ National Type: National Frequency: MTWTFSS More protection sought from home-owners By Chris Ormond of NZPAWellington, Aug 13 NZPA - Building Act changes announced yesterday are a move in the right direction but more is needed to ensure homeowners get the water-tight protection they deserve, says the Home Owners and Buyers Association (HOBA) Building and Construction Minister Maurice Williamson said the changes to the Act would ensure builders were more accountable for their work Legislation to be introduced to Parliament this year would explicitly state builders and designers were accountable for meeting Building Code requirements The legislation will involve introducing mandatory written contracts for building work above $20,000 that sets out expectations, warranties and remedies, how any disputes will be resolved, and require those doing the work to explain what, if any, financial back-up or insurance they have to remedy any faults Minor work such as attached car-ports and verandas will no longer require a consent, and eventually consent processes in general will be streamlined HOBA chief executive John Gray told NZPA any moves giving homeowners more protection were welcome, but there was still a concern skill levels within the industry were not always up to scratch, and the legislation still left room for homeowners to be left out of pocket Tightening contracts was an "essential step" to ensuring matters relating to the performance of builders were adequately addressed, Mr Gray said "But it's all very well to have a paper with a warranty and disputes resolution scheme, but if the builder is dead or departed and living on the Gold Coast, you need a fall-back." The association urged the Government to provide a last resort measure to ensure there was a proviso to address such situations, such as a fidelity fund There needed to be continued push in the building industry for improvements in skill levels and outcomes, Mr Gray said "We've been a bit disappointed by some of the sectors of the building industry that seem to be more focused on trying to evade liability than focusing on quality outcomes," he told NZPA "We just find that rather strange..."certified Builders Association (CBA) chairman Allan Shaw said the changes would force the less reputable players to lift the bar Costs would also be reduced for people doing smaller work, he said "It means builders can arrive on the job, complete the task and move on."streamlining the consents process was a case of trying to get everyone on the same page, he said "It will make it a lot easier for people to get permits, it will be a lot quicker and there will be savings in the industry right across the board."enforcing contracts was something already required by members by of the CBA, he said "For Joe public out there it is a great thing because now they know exactly what they are going to get, they know the course and if there is any problem they have the documentation to go back and resolve it."those who worked without contracts and created the "aggravations" would either "have to lift the bar or move out. 32 NZPA Newswire 12-Aug-2010 National By: NZPA Market: NZ National Type: National Frequency: MTWTFSS Govt's PPP policy faces mounting criticism Wellington, Aug 12 NZPA - The Government's move towards public-private partnerships (PPPs) for big infrastructure projects is facing mounting criticism, with Labour saying today it will inevitably lead to fire sales of state-owned assets Finance Minister Bill English announced the new policy yesterday, saying government agencies would have to consider PPPs for projects costing more than $25 million "We'd rather be providing a high quality public service that the public can rely on than sitting on our hands watching services go downhill because we won't use tools that everyone else uses," he said Since then Labour, the Greens, trade unions and the Public Service Association (PSA) have said PPPs make no sense and create risks for taxpayers "This is one more desperate ploy by a government with no coherent plan for growing the economy or creating jobs," Labour's finance spokesman David Cunliffe said today "It desperately hopes the private sector will finance projects it lacks the vision, courage or resources to do itself."mr Cunliffe said PPPs were a sop to private interests and had nothing to do with prudent asset management "It will inevitably lead to bad decision-making, fire sales of crown assets and higher capital costs for taxpayers," he said "Negotiating PPPs with savvy investment banks requires specialist skills most crown entities simply don't have, so National's one-size-fits-all approach risks taxpayers being taken for a ride."psa national secretary Richard Wagstaff said PPPs carried financial risks for the Government and taxpayers, and a loss of public control over services and facilities "The Government is once again presenting PPPs as a more efficient, value for money option but international evidence suggests these assumptions are wrong," he said The Council of Trade Unions (CTU) said the Government could always borrow more cheaply than the private sector, so it was difficult to see why public infrastructure should be built with private money CTU economist Bill Rosenberg said there were big risks in 25 to 30 year projects and not all of them could be transferred to the private sector Mr English says PPPs won't mean privatisation of public assets but the Greens say they are simply privatisation in disguise The business sector has welcomed the announcement Business New Zealand chief executive Phil O'Reilly said it was a win-win policy "PPPs can unlock value so that more investment can be made in valuable public services," he said "In a small country it makes sense for the public and private sectors to be working in partnership."nzpa PAR pw kc ajb nb 12/08/ NZ Ref:
