1 THE CORPORATION OF THE COUNTY OF DUFFERIN BY-LAW NO XX A by-law to adopt Amendment No. 1 to the Official Plan for the County of Dufferin WHEREAS the Planning Act, R.S.O. 1990, c.p.13, as amended, permits the County of Dufferin to adopt an Official Plan or amendments thereto; AND WHEREAS County Council at its meeting on, 2016, decided to adopt County Official Plan Amendment No. 1 to the Dufferin County Official Plan, March 2015; The Council of County of Dufferin HEREBY ENACTS as follows: 1. County Official Plan Amendment No. 1 to the Dufferin County Official Plan, March 2015 (DCOPA No.1), consisting of the text attached hereto as Schedule A is hereby adopted. 2. DCOPA No. 1 is subject to approval by the Minister of Municipal Affairs. 3. Schedule A attached hereto and forming part of this By-law constitutes DCOPA No.1. 3 Amendment No. 1 to the Dufferin County Official Plan PART A THE PREAMBLE 1. Purpose of the Amendment The purpose of this Amendment is to establish revised population forecasts and allocations and revised employment forecasts and allocations to the Town of Shelburne to the year 2031 and Location This Amendment represents a general policy amendment to the Dufferin County Official Plan (DCOP) that applies to the Town of Shelburne. 3. Basis As an upper-tier municipality, the County of Dufferin is responsible for establishing growth forecasts and allocations to each of the local municipalities in accordance with the requirements of the Planning Act and the Growth Plan for the Greater Golden Horseshoe. Prior to undertaking the DCOP, the County prepared a Growth Management Strategy (GMS), 2009, which formed the basis for addressing the growth management matters in the County. As an outcome to the County s GMS, and the Ministry of Energy and Infrastructure s review of the GMS, the Minister issued a letter dated August 13, 2010, which approved population and employment forecasts and allocations to each of the local municipalities. The Dufferin County Official Plan was approved in March 2015 with Table 3.2a and 3.2b identifying the population and employment forecasts and allocations to the local municipalities. During the course of preparing the Dufferin County Official Plan, and due to the lack of available municipal services to accommodate the full 2036 population forecast for the County of 81,000, and the full 2036 employment forecast of 31,000, a future reserved allocation of 3,057 persons and 4,000 jobs was identified, with the intention that it be allocated when more certainty had been established regarding servicing capacity status and improvements in the local municipalities. However, during the preparation of the DCOP, it was recognized that the Town of Shelburne was actively undertaking servicing and assimilative capacity studies in support of their on-going Municipal Comprehensive Review, to increase the Town s municipal servicing capacity and support the Shelburne West Settlement Area expansion. At that time, it was determined that approximately 1,600 persons of the future reserved population allocation was intended to be accommodated within Shelburne, for a total population of 10,000 persons to 2031, subject to satisfying the Shelburne Urban Settlement Area Expansion policies of Section of the DCOP. 4 The Town has since undertaken a Municipal Comprehensive Review and additional servicing investigations and improvements to accommodate a population of 10,000 persons to the year 2031, without the need to expand the Shelburne Urban Settlement Area or complete the assimilative capacity study. The Shelburne Urban Settlement Area expansion and ability to accommodate additional growth is being deferred pending confirmation of servicing capacity and the assimilative capacity study. Following completion of the assimilative capacity study, the Town does anticipate an Urban Settlement Area expansion. As a result, the County of Dufferin undertook the preparation of the Dufferin County Land Needs Update (DCLNU) to confirm the County s overall land needs status and to review the Countywide implications of Shelburne s proposal for selected employment land conversions, future settlement area expansion and the allocation of a portion of the County s future reserved population allocation. The report advances and updates the County s land budget and informs recommendations relative to Shelburne s Municipal Comprehensive Review. The DCLNU confirms that Shelburne has nearly reached its 2031 DCOP population projection of 8,400 and exhausted its built boundary and greenfield residential land supplies. The DCLNU has also verified that the employment lands conversions proposed by Shelburne will provide sufficient additional land supply to accommodate the requested increase of 1,600 persons from the DCOP s 2031 future reserved population allocation for a total 2031 population of 10,000 and allow it meet its minimum intensification rate and greenfield density obligations within the existing urban boundary. The DCLNU also recommends that the County allocate an additional 200 jobs from the DCOP s 2031 future reserved employment allocation to Shelburne with the intent of preventing the Town s employment to population ratio from declining below its 2011 benchmark as a result of the requested additional population allocation. The DCLNU confirms that there is sufficient employment land supply in both Shelburne and the County as a whole to meet projected needs to 2036 and that the proposed conversion will not affect the viability of the County s remaining employment areas. Furthermore, alternative sites exist within the County-wide employment land supply to accommodate uses of this nature. This proposed Amendment provides for the allocation of additional population and employment from the DCOP s future reserved allocations to the Town of Shelburne which may be accommodated within the Town s existing urban settlement area and supported through recent servicing capacity improvements and the reassessment of the existing sewage services. PART B THE AMENDMENT The Dufferin County Official Plan is hereby amended by the following: 1. Table 3.2a Population Forecasts and Allocations to Local Municipalities is amended in accordance with the following: a) Population Forecast to 2031 for Shelburne is amended by deleting 8,400* and replacing it with 10,000* ; b) Population Forecast to 2036 for Shelburne is amended by deleting 8,400* and replacing it with 10,000* ; c) Future Reserved Allocation to 2031 is amended by deleting 2,332 and replacing it with 732 ; MMM Group Limited Page 4

5 d) Future Reserved Allocation to 2036 is amended by deleting 3,057 and replacing it with 1,457 ; and e) Table Footnote ** is deleted in its entirety and replaced by the following: Additional Future Reserved Allocation may be accommodated within Shelburne, subject to satisfying the Shelburne Urban Settlement Expansion policies of Section Table 3.2b Employment Forecasts and Allocations to Local Municipalities is amended in accordance with the following: a) Employment Forecast to 2031 for Shelburne is amended by deleting 3,560 and replacing it with 3,760 ; b) Employment Forecast to 2036 for Shelburne is amended by deleting 3,560 and replacing it with 3,760 ; c) Future Reserved Allocation to 2031 is amended by deleting 2,000 and replacing it with 1,800 ; d) Future Reserved Allocation to 2036 is amended by deleting 4,000 and replacing it with 3, Section Shelburne Urban Settlement Area Expansion is deleted in its entirety and replaced with the following: Shelburne Urban Settlement Area Expansion Further to the County Growth Management Strategy, 2009, and the Town of Shelburne Comprehensive Review & Shelburne West Secondary Plan, 2016, the Town is undertaking preliminary work in support of an environmental assessment to increase municipal sewage service capacity. Upon confirmation of the existing and planned servicing capacity, and satisfying the municipal comprehensive review requirements of Section of this Plan as it applies to lower tier municipalities, the Town will determine the quantity of land needed and, if necessary, the most suitable location to expand the urban settlement area boundary. This assessment will apply, at a minimum, the specified intensification and designated greenfield area targets for the Town as provided in Tables 3.4 and 3.5 of this Plan. An amendment to this Plan will be required in conjunction with a local municipal official plan amendment that provides for the settlement area expansion, if required. In the event that Shelburne is unable to demonstrate sufficient servicing capacity to accommodate the future reserved population growth prior to the first County review of the Official Plan, the County may allocate the future reserved population growth to urban settlement areas or the community settlement areas, in accordance with Section MMM Group Limited Page 5
