3 RODO REGULATORY CHANGES WHAT AWAITS US IN THE FUTURE IN RELATION TO THE PROTECTION OF PERSONAL DATA In reference to the publication in the last Labor Market Radar for Q2 / 2017 we refer to the topic of RODO - "Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC." On 25 May 2018, the unified Union rules based on the General EU Data Protection Regulation (RODO) is coming into force. The new legal regulations will have an impact on many areas of cooperation between the temporary work agencies and their clients. Below we present key details about the new laws on personal data protection. In the first place, we would like to draw your attention to the second draft of the new Polish Act on Personal Data Protection published on 14 September 2017 by the Ministry of Digital Affairs. Compared to the previous draft, many changes have been made, and the works on the implementation of the personal data protection reform have accelerated. First and foremost, the content of the draft act puts a strong emphasis on further strengthening the protection of data subjects' rights. This is reflected in the very strong powers of the President of the Personal Data Protection Office, the data processing regulator to replace the current General Inspector for Personal Data Protection. This change carries a number of successive ones, including:. One-Instance One-instance regulation infringement proceedings. At present, the General Inspector for Personal Data Protection conducts proceedings in the second instance and then he or she may lodge an appeal to the Administrative Court. Stop processing of Personal Data President of the Personal Data Protection Office will be entitled to stop processing of the data or to indicate the data processing methods, even where there is only a likelihood that processing of data violates the regulations and that further processing can cause serious effects, which are difficult to remove. Immediate Enforceability Immediate enforceability of any decision issued by the President of the Personal Data Protection Office. Lack of possibility of appealing possibility of appealing against the decisions concerning the deferral or payment of administrative penalties or dividing the penalties into instalments. 3

4 RODO REGULATORY CHANGES WHAT AWAITS US IN THE FUTURE IN RELATION TO THE PROTECTION OF PERSONAL DATA Through expert eyes Jędrzej Sokół Lawyer/ Personal Data Protection Specialist Within the cooperation with the Polish HR Forum, Adecco took part in formulating comments and arguments aimed at overcoming the negative effects, which all the entrepreneurs might face in the extreme situation. It was important for us to avoid a situation, where a wrong or hasty decision of the President of the Personal Data Protection Office (e.g. stopping data processing) could paralyse the entire organisation. In practice, the entrepreneur, who wants to protect its interests, would not have the legal capacity to appeal against such a decision. Although we carry out our activity from an employment agency perspective, the comments made concern the general principles, which will also apply to our clients. The remarks drawn up were submitted by the PFHR association within the public consultation, which ended on 13 October We are currently looking forward to a summary of the work and possible responses from the Ministry.
