Conduct a public hearing on the proposed User Fees and Charges. B. Adopt Resolution No. 15- entitled A Resolution of the City Council of the City of Goleta, California, Approving and Adopting the 2015 User Fees and Charges. BACKGROUND: On November 18, 2008 the City Council adopted Resolution adopting the 2008 User Fees and Charges, which took effect on December 1, That resolution subjects the adopted User Fees and Charges to annual modification, based on the prior year change in the Consumer Price Index (CPI) for All Urban Consumers for the Los Angeles-Riverside-Orange County area. User Fees were last adjusted for CPI on April 17, 2012 effective July 1, On March 16, 2010 the City Council set a minimum threshold of 3% CPI change for consideration of adjustments to User Fees and Charges. The intent of the March 20, 2010 action by Council was to minimize small adjustments, thereby setting the floor for future adjustments only if the CPI is at or above 3%. The CPI increased 2% in 2012 and the 1.1% in 2013, which when added to the 2012 increase of 2%, represented an increase of 3.1% over the two-year period (2012 and 2013). The modification of 3.1% was presented to the City Council on April 15, 2014 for a fee increase consideration. The City Council voted to keep the fees the same and not implement the increase. At that time, City Council also reduced the major and minor appeal fees. DISCUSSION: User Fees are charges for services such as planning related services whereby those receiving the services from the City are required to pay the costs rather than burdening the residents. State law precludes charging more than the cost of providing the service. The current User Fees are based on a cost analysis performed by Willdan Finance Services and finalized in November

2 In 2014 the Annual CPI increased 1.3% and when added to the 2012 and 2013 increase of 3.1%, represents an increase of 4.4% over the three-year period since the last fee adjustment (2012, 2013 and 2014). While for the most part, the application of a 4.4% increase in rates may seem minimal, it does add up over time. Furthermore, each year that transpires without modification of the rates to reflect the cost of doing business reflects a loss of revenues that can not be recovered in the future and are therefore borne by the City s General Fund. Staff recommends modification of the existing User Fees and Charges to reflect the inflationary increase as presented in Exhibit A of the attached resolution. Please note that the recommended rates are rounded to the nearest whole dollar, with the exception of rates that are currently in cents. Also, for ease in comparing the change in rates, Exhibit A displays a column with the current rates. This column will not be a part of the permanent Exhibit to the adopting resolution, or a part of the User Fees and Charges schedule. Should the proposed rates be approved, they would be effective July 1, 2015 to coincide with the City s fiscal year. The fees for business licenses (General Business License, Firearm, Massage, Taxicab, Tobacco Retail) have not been increased by the 4.4% CPI adjustment as these fees have been set by ordinance and/or resolution. Staff anticipates including the cost of a User Fee Study in the upcoming Fiscal Year 2015/16 Operating Budget that would represent 8 years since the last study was conducted. An updated fee study will provide the opportunity to reevaluate all user fees as they relate to Council policy, staff time and the related cost to provide the service. Once the study is complete, Council will have the opportunity to adopt the fees at full cost recovery or less than full cost recovery for some or all fees. The fee study will also include coordination with the new Zoning Ordinance to account for streamlined processes and possibly reduced fees for applications processed under different levels of reviews (such as administrative) dependent on Council approval. ALTERNATIVES: A. Take no action, thereby maintaining the current User Fees and Charges. B. Direct Staff to modify User Fees and Charges by a percentage other than the linked CPI change. FISCAL IMPACTS: It the City Council adopts the 4.4% increase to User Fees, approximately $40,000 in additional revenues to the General Fund will be generated annually. 2

8 RESOLUTION NO 15_ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GOLETA, CALIFORNIA APPROVING AND ADOPTING THE 2015 USER FEES AND CHARGES WHEREAS, California Government Code Sections et seq authorize the imposition of various user fees for providing City services and reviewing entitlement applications; and WHEREAS, the City Council on April 21, 2015 conducted a Public Hearing on the proposed User Fees, wherein the Council considered the Consumer Price Index data supporting the modification of the fees, and WHEREAS, the User Fees and Charges attached as Exhibit A are justified and appropriate, not exceeding the cost of the services provided therefore. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF GOLETA FINDS AND DETERMINES AS FOLLOWS: SECTION 1. Findings. Council finds recitals to be true and accurate and incorporates them by this reference. SECTION 2. Adoption of User Fees. User Fees and Charges, attached hereto as Exhibit A and incorporated herein by reference, are hereby adopted and are effective on July 1, 2015 and supersedes any and all prior user fees and changes that are inconsistent with Exhibit A. SECTION 3. Master Fee Resolution. This resolution shall be known as the Master Fee Resolution. 8
