1 Pardee Recreation Area Concession RFP Page 1 of 5 QUESTIONS & ANSWERS (#2) FOR PARDEE RECREATION AREA RFP Question: Please provide a detailed list of the current concession s personal property assets including modular structures, vehicles, vessels, heavy equipment, tools and furnishings/fixtures/equipment. What is the appraised value? Response: This information is proprietary and owned by the incumbent. EBMUD does not have access to this information nor can the incumbent be required to provide it. 2. Question: Does the current concession have maintenance logs in place on MCIF equipment? If so, please provide a sample of the approved log. Response: The current concession contract does not require maintenance logs. 3. Question: What is the three year annual utility expense?: Electric, Trash Response: Electricity for 2016 = $33,508; Electricity for 2015 = $23,457.66; Electricity for 2014 = $27, Trash for 2016 = $5,806; Trash for 2015 = $5,683.01; Trash for 2014 = $6, Question: Provide updated Exhibit E from Sample Contract. Are all rental fleet in serviceable state of repair? Will the District plan to add capacity to the existing fleet? Response: Exhibit E is intended only to capture the large items in the MCIF and is not intended to be all-inclusive; therefore, there is no updated version. To the best of our knowledge, all rental boats are currently operable and the inventory has been sufficient to cover demand. There are no current plans to add to the fleet. 5. Question: Why is the District turning over inspection for invasive species to the Concessionaire? Who performs decontamination when required? Does the District own decontamination equipment? What make/model? Is a fee charged? What will be the training requirement for inspectors? Will every vessel require inspection? Response: There are no plans to turn over aquatic invasive species prevention programs or related decontamination programs to the concessionaire. District staff and Camanche Recreation staff perform decontamination for a fee at the Camanche South Shore decontamination station. 6. Question: Please provide 2015 and 2016 gross revenues. Response: Gross revenue for 2015 and 2016 are not provided due to park closures for portions of both seasons; therefore, those numbers would be incomplete. 7. Question: Regarding the exhibit provided on page 7-8: The Gross Revenue and Gross Receipts do not equate? Even with Fishing Access Fees removed, the two exhibits are not equal. Why? Response: The information provided in the Gross Revenue and Fee Breakdown table is just a snapshot and not intended to be comprehensive. 8. Question: How many points are possible in the Section A evaluation? Twenty? How many points are possible in the Section B evaluation of the short listed submittals? Additional Twenty? Response: The District is not allowed to answer this question at this time. Point values for responses cannot be provided before or during the evaluation. Prospective bidders are expected to provide determinative answers to the best of their ability. After the award has been made, the District is willing to schedule a meeting with a representative from EBMUD, who will briefly offer feedback, and discuss suggestions for future RFP responses.

How many points are given for SBE or DVBE short listed entities? What is the point award for local business status? Response: A maximum total of five (5) Contract Equity points per proposal will be awarded after the presentation and interview. 10. Question: Reference is made to Standard Questions asked in the Interview of short-listed bidders. What are the Standard Questions? Response: Use of the term standard questions was meant to convey that they would be the same questions asked of each proposer. No questions are available for any proposer prior to the interview. 11. Question: Please provide incumbent s District approved Hazardous Materials Business Plan and Spill Prevention Control and Countermeasures Plan for the current operation. Provide evidence that the plans are current and in force. Response: The concessionaire has a current HMBP on file with Amador County through CERS, and has filed a Tier 1 SPCC plan. The District has verified that both are current. 12. Question: Is the Haz-Mat operator (CERS) license under EBMUD or Concessionaire? Who will handle transport from property and inspections? Response: The concessionaire maintains their own HMBP via CERS. Amador County conducts official inspections and the District conducts independent quality control inspections. 13. Question: What is the current balance in the Pardee MCIF? What is projected to be balance at end of term? Response: Current balance varies daily with deposits and expenditures; however, projected balance at end of term is expected to be $13, Question: What resources does the current concession use to comply with the Sanitary Patrol provision of the Sample Contract? How many seasonal employees are required? Response: Please refer to Question #2 on previous questions and answers posted on the RFP website for information current staffing levels. 15. Question: Would the District allow the Lake Manager role to be filled by a General Manager at a nearby facility who would over-see both operations? Response: Each proposal will be evaluated based upon its entire package. The concessionaire s manager or other District approved representative shall reside at Pardee Recreation Area. 16. Question: Is Attachment C of the Sample Contract finalized as presented? Response: It is finalized for the purposes of presenting a Sample Contract only. 17. Question: It appears only one of the fuel pumps/tanks at the marina was operational? Will all units be in operation and certified prior to a new concessionaire taking possession? Response: Of the three tanks, two are currently permitted and operated: one for resale of unleaded gas, one for concessionaire s sole use of diesel.

Response: There is a process to modify the current approved and/or proposed rate structure on a case by case basis. 20. Question: What is the current list of MCIF projects and list of past MCIF projects completed for last three years? Response: Current List: Dock Refurbishment, Portable ADA accessible toilet, Pool Deck Repair, Building Repairs, Pool Building Roof Repair and Pump for Pools (Please refer to Response to Question 18 above for data from last three years.) 21. Question: Sample Contract 1.4 I Sanitation, Safety and Patrol Page 6: Please provide scope of the required public information program requirements. Response: This is standard concession contract language. No additional detail is available at this time. 22. Question: Sample Contract 1.11 Page 11: Are there current Hazardous Materials Kits in place and are they owned by the District or Concessionaire? Response: Concessionaire is responsible for maintaining its own Hazardous Materials response kit and inventory. 23. Question: Sample Contract 2.1 page 12 Established days and hours: What is the initial business hours and days requirement for the store and restaurant? Response: There are no such standards developed at this time. Each proposal will be evaluated based upon the merits of its entire package. 24. Question: Attachment B: 2. Sanitary Patrol: Is it the concessionaire s responsibility to inspected [sic] and clean the entire shoreline of the lake twice per day? Response: Attachment B section B2 shall be removed from the final contract language. Refer to section B1 for frequency. 25. Question: Attachment B: 4. Invasive Species Control: Can you provide the extent of the required IPM that will be required for invasive vegetative species and the current control methods authorized? Response: Current control efforts target general weeds, thistles, and other species on approximately 2.5 acres surrounding specific park facilities,.25 acres around campsite amenities, and.25 acres of general treatment areas. Current approved herbicides include the use of Round Pro Concentrate and Surflan.
5 Pardee Recreation Area Concession RFP Page 5 of Question: Attachment B: 4. Trails: How many miles of trail are required to be maintained by the concessionaire? Are MCIF mowers allowed on trails? Response: Approximately three (3) miles of shoreline and inland trails are required to be maintained as per attachment B, section B4, Trails. Current concessionaire utilizes a flail mower attachment on their tractor for portions of the trail. Other portions do not lend themselves to mowers and smaller equipment is used instead (e.g. weed eaters). MCIF inventoried mowers are zero-turn mowers, unsuitable for trail use. 27. Question: Attachment C: Pardee MCIF Approved Expenditure Clarification: It appears that funding would not be adequate to cover all the items listed in the Attachment. What happens if repairs need to be made and funding is not sufficient? Response: Additional repair and replacement needs above and beyond the funding ability of the MCIF would be dealt with on an as needed basis. 28. Question: Please confirm Cost of Goods items and fuel sales are exempt form [sic] MCIF fees. Response: Cost of Goods items and fuel sales are not exempt from MCIF fees in either the current or sample contract.
