3 2014 OL-1 T/A Bid Package Invitation to Bid You are invited to submit a proposal for the work, as described below, at the location indicated. Bid Package No.: V2E6A (M8196) Owner: Formosa Plastics Corporation, America Location: Point Comfort, Texas Description: OL E, 3499E, 4403F FIREPROOFNING REPLACEMENT IN T/A. Tentative Scheduled Commencement Date: _01/17/2016 Request Completion within 8 calendar days The tentative scheduled commencement date is provided for your scheduling purposes only. It may be subject to changes by the Owner according to the actual project requirement. The actual construction commencement date will be determined and provided by Owner after the Contract award. NOTE: The Contract contains provisions for a retainage by Owner, which should be reviewed by Bidder. All payments made to the successful bidder (hereinafter referred to as Contractor) will be made on measured work complete, such measurements shall be summarized on a C-Chart in accordance with the approved Measurement Plan and shall require approval from Owner s Representative. This C-Chart is the summary of work events presented by the Contractor in the Detailed Work Plan and is progressed in accordance with the agreed upon Measurement Plan and is used for payment purposes only. Any other schedules, or other tracking mechanisms, submitted by Contractor for the coordination and scheduling of the Work will not be used for payment purposes. Contractor must prepare a Measurement Plan, which assigns a value for each portion of the Work and submit such to Owner, for Owner s review and approval, within 10 days after the award of the Contract. Failure to submit the Measurement Plan will be grounds for termination of the Contract. Please check the Bid Package to assure that it includes all drawings and specifications that you require in order to prepare this bid. Should there be any discrepancy, please notify William Wu, williamwu@ftpc.fpcusa.com as soon as possible to avoid any delays. The bid should be submitted to the designated office no later than 11/11/2016 and must include the following: 1. Bid Form 2. Bid Breakdown 3. Additional Work Schedule The Owner reserves the right to accept or reject any or all bids. We will advise you of the results as soon as practical. All questions must be addressed in writing by mail or facsimile to the designated office below. Please include the Bid Package Number with any questions. Any controversy or claim arising out of or relating to this Invitation to Bid shall be settled by arbitration by a mutually agreed upon single commercial arbitrator (unless one party hereto requests a panel of three commercial arbitrators) in accordance with the latest Rules of the American Arbitration Association, in the state where the work was performed, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator(s) shall provide the parties with a written explanation of the reasoning behind the decision and award. If a sole arbitrator is utilized, he shall be unbiased and shall not have worked as an employee or arbitrator for either party. If three arbitrators are utilized, each shall meet the same criteria. All arbitrators shall be chosen in accordance with the latest Rules of the Association. Such arbitration shall be instituted in accordance with such Rules, and notice of such arbitration shall be sent to the Bidder at the address provided on the Bid Form, and to Owner at 9 Peach Tree Hill Road, Livingston, New Jersey 07039, Attention: Legal Department Owner and Bidder expressly intend, agree and acknowledge that they both knowingly, unequivocally and absolutely waive any and all right to bring any demand claim or action against the other for exemplary, treble or punitive damages in any forum, under any theory of recovery, at any time. Owner may require Contractor s employees to sign a Site Access Agreement before a badge is issued or access to Owner s premises is allowed. The Site Access Agreement may contain an arbitration clause in addition to other site specific provisions or requirements of Owner. In submitting this bid, and such other documents, as bidder deems indicative and appropriate for purpose herein, bidder hereby agrees: (1) To hold this bid open for 30 calendar days following the date of final revision. (2) To furnish, at least 48 hours prior to initial access, an insurance certificate acceptable to Owner and any other documentation, including but not limited to all safety information, time schedules and performance bonds as required by the Contract. 9 Additional Work Schedule A. General Mechanical Construction Work 1. Please submit unit price information for extra work items that may arise during the course of the Contract. 2. If you cannot provide the unit price information for the extra work items, additional work, subject to Owner s approval, will be estimated based on % of the applicable unit man-hours in the latest edition of Richardson s Process Plant Construction Estimating Standards or % of the applicable unit man-hours in the latest edition of John Page. (Please provide percentage) Labor rates for price calculation should be listed in Item 4 below. 3. Owner may request additional work be performed on a fixed price basis. Owner may, at Owner s sole discretion, accept, reject or negotiate the fixed price submitted. 4.
