Subgrade preparation (Subgrade was completed by MD of Bonnyville in fall 2016). May need prep. Work for GBC) b. Placement of a 100mm Granular A base: Fine grading and compaction of 98 standard Proctor density with +- 2 of optimum moisture content to be done by the contactor. c. Prime Coat d. Placement of 75mm of M1 asphalt surfacing to provide a 7ft wide paved trail. Other Requirements: a) The contractor should provide an approved traffic management plan to the MD of Bonnyville before the start of construction. b) All excavation works required for placement of the granular and asphalt is to be included in the unit price bid for Granular A c) Payment will be made based on a complete finished paved trail (placement of granular and asphalt and any required restoration works). d) The completed pavement shall have an average density of ninety-eight percent (98) and in no case shall any individual density test be less than ninety-six percent (96) of the laboratory compacted density. as determined by ASTM Designation D2726, Resistance to Plastic Flow of Bituminous Mixtures Using Marshall Apparatus, using a compaction of fifty blows for each face. The intent is that a long term durable product be provided. The following table represents payment reduction based on average density of cores not meeting minimum values.

6 The Successful Bidder will be notified in writing of the decision of the Municipal District of Bonnyville to award the contract on, or about March 10, The contractor shall complete the entire project in accordance with the information contained within tender. The contractor shall complete all work in a good and workman like manner. If the contractor fails to complete the work by August 01, 2017 and to all the specifications as per the tender documents, a penalty of $1000 per day will be charged liquidated damages and will be deducted from the progress billings. 2. INFORMATION TO BE INCLUDED WITH TENDER The Bidder shall submit with its tender, on the prescribed forms attached hereto and forming part of the Tender Form, the following information: a. Bid bond equal to 10 of total contract value. The Bid bond will only be returned back after the tender has been officially awarded. The bid bond to the unsuccessful bidders will be returned by mail. b. Qualifications - The Bidder shall give a list of previous or current work, similar in nature, scope, and value to demonstrate ability and experience to perform this Work. 3. POST TENDER SUBMISSION: The successful bidder will be required to provide a Performance Bond for 50 of the Contract Value within 15 days of award of the tender. Failing to do so may result in tender being awarded to the next lower bidder and the bid bond deposit will be forfeited. 4. INSURANCE/OTHER REQUIREMENTS The Contractor shall, at no cost to the Municipality, adequately insure all vehicles and equipment used and required to perform the work. Evidence of coverage must be provided to the Municipality prior to commencing work. The Contractor is required to obtain Comprehensive General Public Liability coverage with limits of not less than $2,000,000 per occurrence or incident. The policy must name the MD of Bonnyville as an additional insured in respect of all matters associated to the contract and will protect the Municipality in respect of any and all claims arising directly or indirectly as a result of the contract. Coverage must include bodily injury, death and property damage, including loss of use thereof and shall not have a deductible that exceeds $ Prior to the Contractor beginning work for the Municipality, a Certificate of Insurance must be provided to the Municipality. Prior to the termination of such coverage, the Insurer must notify the Municipality of the date of termination. Upon renewal of the policy, the Insurer will provide an updated Certificate to the Municipality. The Contractor shall be registered in good standing with Worker s Compensation Board. The Contractor shall ensure that he and those employed by him follow Provincial and/or Federal requirements for Safety & Health practices and that any required protective equipment is provided and utilized at all times.
7 5. DISCREPANCIES, OMISSIONS Prospective bidders finding discrepancies in, or omissions from the Contract Documents, or having any doubt as to the meaning or intent of any part thereof, should at once notify the Transportation & Utilities Director or Manager of Transportation. 6. EXAMINATION OF CENTRES All potential Bidders shall familiarize themselves with the extent of work expected before sending in their Tender and make themselves thoroughly acquainted with Municipal facilities and obtain for themselves any and all information that may be necessary for the proper performance of the Contract. The Bidder shall ensure that all employees employed on this contract will be familiar with the Municipal District of Bonnyville No. 87, and supplied with an appropriate map, by the Contractor. 7. ADDENDA Addenda, bulletins or corrections issued during the time of tendering are to be included in the Tender and shall become a part of the Contract. 8. TENDER CLOSE The tendering period shall end at am on Monday, February 27, 2017, or at an extended time and date specified in a written notice. 9. WITHDRAWAL OF TENDER A bidder shall be permitted to withdraw their tender unopened after it has been deposited if such request is received in writing by the Owner prior to the time specified for opening tenders. 10. OPENING TENDERS Tenders shall be opened publicly. Bidders are welcome to attend the meeting of council at which the contract will be awarded. 11. TENDER EVALUATION No contract shall be awarded to any Bidder who, in the judgment of the Owner, is not a responsible Bidder or does not have all the necessary experience, capital, organization and equipment to perform the Work in strict accordance with the terms and provisions of the Contract. The Owner reserves the right to evaluate tenders on the basis of criteria of its own choice, in its sole discretion, whether previously disclosed to bidders or not, provided only that the reasons for selection of a tender shall not be frivolous, irrelevant or malicious. In evaluation of tenders the owner may, but is not obligated to, consider previous or on-going disputes from other contracts, with a bidder. The selection criteria are as follows:
8 Location (10 ): MD of Bonnyville encourages tenderers to bid from any region however Bidders within the MD of Bonnyville will be awarded 10, Town of Bonnyville, Edmonton, and Calgary with a 5, other regions within the Province of Alberta 2 and out of Province 0. Relevant Experience (10): Previous experience of the tenderer needs to be assessed in relation to the fields of expertise required to achieve the intended outcomes of the project. Recent experience is more valuable than historic experience. The company s previous experience in technical areas comparable to the tendered project, the scale of past projects and the role undertaken within those projects will be considered as well as overall safety record of the company. Contractor is required to fill in the form titled Relevant Experience for three (3) projects that is included with the tender form. Failure to provide the information on three projects will result in a score of zero. For example if contractor provides information on two projects, they will get 2/3 of the points. Past Performance (10) : The tendering organisation's performance in completing past projects to the quality standards required, time performance, within budget, claims history, project management, will be assessed. Contractor is required to fill in the form titled Past Performance for three (3) projects that is included with the tender form. Price (70): The price is the sum that the Owner would be required to pay to the tenderer for the work or service provided. This must include all costs over the duration of the contract. 12. ACCEPTANCE OF TENDERS The Owner reserves the right to object any or all tenders, to waive irregularities and informalities at his discretion and to accept the tender, which the Owner deems to be in its best interest. The lowest tender will not necessarily be accepted. The Bidder agrees that his tender is to continue open to acceptance and irrevocable for thirty (30) calendar days and that the Owner may, at any time within thirty (30) days of the date of the tender closing, accept this tender, whether any other tender has been accepted or not. The Owner reserves the right to negotiate at the time of acceptance, with the lowest bidder only, for a lower tender price, or for the removal from the tender of qualifying conditions, or both. 13. PRICES AND PAYMENT The Bidder shall provide a price for each item of Work identified in Section II Tender Forms. The work shall be measured and paid for on a unit price basis. The units to be measured and paid for shall be as identified on Section II Tender Form. The quantities listed on Section II tender Form are to be considered approximate only. The Owner will
9 use the said quantities for the purpose of comparing bids. The quantities for which payment will be made to the Contractor are to be determined by the Work actually performed and completed by the contractor. The unit price shall exclude the Goods and Services Tax, which shall be an extra where applicable in the unit priced. Any work required that does not have a unit price will be considered an extra. All extra work is to be agreed upon and understood in writing before the said extra work commences. The price for any extra work shall also be understood in writing prior to the commencement of said work. A hold back of 10 will be deducted from each submitted invoice. 14. GUARANTEE PERIOD 1. Neither the final progress payment nor the Notice of Acceptance shall relieve the Contractor of responsibility for faulty materials or defective workmanship. 2. The Contractor, unless specifically stated otherwise herein, guarantees all materials furnished and Work performed by him during construction and warranty period. The guarantee period includes the construction period (from the Notice of Acceptance to Construction Completion Certificate) and two (2) years warranty period following the Construction Completion Certificate until Final Acceptance Certificate (FAC). 3. Faulty materials shall be replaced and defects discovered and failures which occur during the two (2) years Guarantee Period shall be rectified to the satisfaction of the Engineer and in accordance with the Contract Documents, including, if deemed necessary by the Engineer, replacement of all or a portion of the Work. 4. If the Owner observes through use of the Works, or if it is discovered by tests or inspection of the Works prior to the end of the Guarantee Period, that a deficiency or defect exists in the materials or workmanship in respect to the specified Works, the Owner shall immediately notify the Contractor, by whatever means are available, of the defect or deficiency and instruct him to rectify the fault. Such notification shall be confirmed by the Owner in writing to the Contractor. 5. In the event that this Work, in the opinion of the Owner, must be done immediately to prevent serious damage, injury, or loss of life, the Owner may perform or cause to be performed, the necessary Work and shall notify the Contractor accordingly. 6. Work required under guarantee shall, except as otherwise provided herein for emergencies, be carried out by the Contractor or his representative within ten (10) days of the Owner's written instruction to perform the Work. 7. In the event that this Work is not done by the Contractor within five (5) days, the Owner may take whatever action is necessary to have the Work done. 8. All costs resulting from the necessity to do Work under the guarantee requirement, whether it be done by the Contractor, his representative, or the Owner, as provided herein, shall be borne by the Contractor. 9. The Contractor shall, in addition, be liable to the Owner for all expenses, losses, or damages incurred by the Owner as a result of such faulty materials and defective
10 workmanship or as a result of the Contractor's failure to meet the guarantee requirements as specified herein. 10. This Article shall not restrict the liability of the Contractor in any way. 15. PRIME CONTRACTOR The Contractor is the Prime Contractor as defined by Health and Safety agencies and shall fulfill all obligations and responsibilities associated with this designation. The Contractor shall be the Prime Contractor for the full duration. He shall also be the Prime Contractor whenever the Contractor s personnel, equipment or subcontractors are on site. 16. The Contractor agrees to indemnify and save harmless the Owner from all claims of every nature and kind which may be made or brought against the Owner by reason of the Contractor carrying out the terms of this contract. 17. The Contractor shall comply with all instructions and regulations imposed by MD of Bonnyville in connection with the manner in which the Contractor shall carry out this contract.
