Hansen, Commissioner Kent Goldthorpe, Commissioner September 5, 2017 Development Services TO: FROM: ACHD Commission, Director Wong Mitch Skiles, Impact Fee Administrator SUBJECT: Appeal of Decision of Impact Fee Administrator for Kuna Caves Storage Staff Report for September 13, 2017 Commission Meeting Executive Summary Riley Planning Services is appealing the decision of the Impact Fee Administrator to exclude data from a period with inclement weather from an individual impact fee assessment for Kuna Caves Storage, a self-storage facility located southwest of the intersection of Deer Flat Rd and Ten Mile Rd. Facts & Findings 1. On July 14, 2014, an original impact fee of $4,580 was paid for one building. 2. On October 29, 2014, an original impact fee of $29, was paid for six additional buildings. A total of $34, in original impact fees were paid for Kuna Caves Storage. 3. On April 1, 2015, ACHD entered into an agreement for individual assessment (AIA ) with Kuna Caves Storage, LLC. The initial impact fee in the agreement was $13, plus a 20% financial surety ($2,685.76) summing to $16, On April 10, 2015, ACHD issued a refund for $18, based on the agreement for individual assessment. 5. On March 25, 2017, Riley Planning Services submitted an Individual Assessment with data collected between January 3, 2017 and January 26, On March 31, 2017, District Staff sent an response to the Individual Assessment requesting additional data due to abnormal driving conditions in January. The noted that zero trips were recorded on January 4, 2017, a day that saw record snowfall. 7. On July 7, 2017, Riley Planning Services submitted a new Individual Assessment with data collected between March 3, 2017 and March 30, The assessment combined data from January and March. 8. Ada County experienced multiple days of snowfall during the month of January A record 6.5 inches of snow fell in Boise on January 4, Throughout the month, snow and ice had the following impacts on driving conditions: o Limited neighborhood and business access o Multiple days of school closures o Slick roads

2 9. On July 14, 2017, District Staff sent a refund memo with a notice that ACHD only considered the March data and excluded the January data in a revised assessment. The revised assessment was for an amount of $11, The refund was for $4, after interest and a review fee. 10. On August 11, 2017, Riley Planning Services submitted an Appeal of Decision of Impact Fee Administrator form requesting the January data be considered in the assessment. 11. On August 18, 2017, District Staff sent an response to the appeal requesting additional data from gate records to supplement the previously submitted data from March. 12. On August 31, 2017, Riley Planning Services sent an response with a preference to move forward with an Appeal Hearing. Fiscal Implications If the appeal is approved, District Staff will include the January data in the assessment bringing the impact fee to $10,315.94* and an additional refund check will be issued for an amount of $ plus interest. *This impact fee differs from the fee calculated in the July 7, 2017memo from Riley Planning Services due the trip rate being rounded to the nearest hundredth rather than the nearest thousandth and an incorrectly recorded trip length on the local arterial system. Policy Implications Policy for Individual Assessments is discussed in Section 7312 of the ACHD Policy Manual. Policy for Administrative Appeals is discussed in Section 7321 of the ACHD Policy Manual. The ACHD Guidebook for Individual Assessments states, Holidays, special events, construction, bad weather, and other external factors may alter traffic patterns from the norm, and therefore, counts should not be conducted on days when any of these are present. (pg. 5) Alternatives Alternative 1: Deny the appeal and close the individual assessment for the Kuna Caves Storage buildings included in the individual assessment. Alternative 2: Approve the appeal and issue an additional refund in the amount of $ plus interest. Recommendation District Staff recommends the Commission choose Alternative 1 and deny the appeal. Only the data from March 7, 2017 through March 30, 2017 was considered in the assessment. The determination and calculations are detailed on the attached spreadsheet. From the data, ACHD determined the Peak Hour Trip Rate (One Way) to be 0.04/1,000SF; New Trip Factor of 1.00; Average Trip Length of 3.79 miles; Network Adjustment Factor of 0.681; and from Ordinance 218 a VMT cost of $2,495. The impact fee determined from the Individual Assessment data is $11,245.
