CONSENT CALENDAR A. APPROVAL OF PLANNING COMMISSION MINUTES Consideration of Planning Commission Regular Meeting Minutes for March 3, Vice-Chair Kelley and Commissioner Painter moved and seconded to approve the minutes for March 3, 2016 as submitted. 6. CONSENT HEARINGS A. OIL COMPANY ROAD NAME CHANGE OIL COMPANY ROAD (File No. PL ) The Gasser Foundation is requesting that the City change the name of Oil Company Road to Sousa Lane. Oil Company Road extends west from Soscol Avenue and terminates at the Napa Valley Wine Train railroad right-of-way. Sousa Lane, which generally aligns with Oil Company Road at Soscol Avenue, extends east from Soscol Avenue and terminates at Silverado Trail. 2 Commissioner Painter and Vice Chair Kelley moved and seconded to forward a recommendation to the City Council to adopt a resolution changing the name of a street from Oil Company Road to Sousa Lane. B. WINKLER RESIDENCE 14 GLORY COURT (File No. PL ) Appeal of an Administrative Design Review approval for a new single-family house. The proposal includes a 3,194 square foot, four-bedroom, two-story house with an attached two-car garage. The project site is located on the north-side of Glory Court east of Pascale Place, within the SFR-99, Single-Family Residential General Plan Designation, and the RS-10 (PD-18), Single-Family Residential (Planned Development #18) Zoning District (APN ) (Felix) Commissioner Painter and Vice-Chair Kelley moved and seconded to continue this item to a date uncertain. 7. PUBLIC HEARINGS/APPEALS A. GASSER FOOD TRUCK CORRAL 165 GASSER DRIVE (PAD #4) (File No. PL ) Request for a Use Permit to operate a food truck corral on a vacant pad within the South Napa Century Center. The proposal includes use of an undeveloped building pad adjacent to the Century Theater for up to five food trucks including outdoor dining facilities for patrons of the food trucks. The project site is located at the center of the South Napa Century Center, southwest corner of intersection of Hartle Court and Gasser Drive within the MU-532, Mixed Use General Plan Designation, and the MP-G1, Gasser Master Plan Zoning District (APN ). (Allen) Associate Planner Allen presented the Staff Report. Vice-Chair Kelley asked if the one year permit is extendable and about the accessibility of the toilet rooms. Associate Planner Allen stated a new use permit can be applied for after a year; approval is at Commission level. At least one ADA Port-a-Potty is planned. 3 No Applicant was present. Chair Trzesniewski opened Public Comment. Noting no speakers, Chair Trzesniewski closed Public Comment and brought it back to the Commission. Commissioner Painter noted the restroom Port-a-Potties would be available during the one year period the food trucks would be in use. Any comments would be received by the Planning Manager during the one-year use. She was supportive of the project. Vice Chair Kelley noted prior projects did not have toilet rooms. He would like temporary toilet rooms to remain intact with the food trucks. Commissioner Huether was in favor of the project. The Commissioners made disclosures. Commissioners Painter and Huether moved and seconded to adopt a resolution approving a Use Permit for the temporary Gasser Food Truck Corral with the condition that the portable restroom facilities remain for the duration of this temporary use. B. ACCESSORY SECOND UNIT ORDINANCE AMENDMENT - CITYWIDE (File No. PL ) Proposal to amend the Napa Municipal Code creating a new Section Accessory Second Units establishing updated performance standards for issuing Accessory Second Unit permits and amending Napa Municipal Code Section , Accessory Structures, to implement corresponding changes. (Walker) Senior Planner Walker presented the Staff Report. Vice-Chair Kelley commented that he d like the design of the accessory unit to be more flexible and separate from the main unit, but compatible with the neighborhood. He would like an amendment to increase the square footage of the accessory unit. Commissioner Huether would like the Planning Commission to be flexible and allow complement or contrast to the existing unit. 4 Senior Planner Walker commented changes are under the City s control, such as: possible design manual, interdepartmental review, fee reductions. Interest regarding second units is already active. Planning Manager MacNab commented that some non-monetary incentives may be included. It is a complex issue. Publicity notification could be made available at the Planning counter. Senior Planner Walker noted that water fees for second units are being adjusted by the City which may create a model for other agencies to possibly follow. Commissioner Huether spoke about fire sprinklers systems and the term complementary design. Commissioner Painter asked if units will be available for affordable housing. Planning Manager MacNab responded that a potential incentive could be low interest loans if the owner agrees to keep it affordable for a certain period of time Senior Planner Walker noted privacy will be considered in the design. Commissioner Huether recommended that if it can t be seen from the street, there could be some leeway. Deputy City Attorney Spoerl noted there is some ambiguity to the statutes that regulate standards: architectural review. however not discretionary review. Architectural compatibility would be part of the administrative function. He would like to look at the legistrative history of the statute. Architectural review could be building standards rather than architectural standards. Commissioner Huether would like to include terms like liberal, flexible, logical and quality. Incentives should encouraged. Vice-Chair Kelley agreed with flexibility and quality vs. compatible. He would like to open up the options for types of buildings and materials. He would like the parameters to be unambiguous and the process easy. Planning Manager MacNab commented about not constraining design. Planning Commission could recommend to the Council that the phrase on design be deleted. that delete the word complimentary Commissioner Painter suggested taking Item A relating to compatibility off of the Design Standards. She recommended a checklist and a form-based set of guidelines. Planning Manager MacNab agreed with Commissioner Painter, that to change wordings would seem to be discretionary. 5 Vice-Chair Kelley asked what affect a HOA would have Planning Manager MacNab is not sure requirement could be built into the guidelines. Deputy City Attorney Spoerl commented that covenants and servitudes could be added for HOAs as private property owner regulations. Vice-Chair Kelley would like to make sure the homeowner and the City are protected from HOA issues. Commissioner Painter noted if the homeowner is part of an HOA, it is their responsibility to check with the HOA. Chair Trzesnieski asked if wording regarding not being seen from the street could be included. Deputy City Attorney Spoerl noted the City Attorney office reviews common areas to enforce covenants and include the City as a third party beneficiary. Commissioners gave disclosures. Chair Trzesniewski opened Public Comment. Dennis Bertolucci,1627 Meek Avenue, spoke. He has tried to get a second unit. Privacy is an issue. The letter streets in downtown area were affected with high density housing. If not seen from the street, structures will still be seen by the neighbors. Look at setbacks, a critical issue. Bob Masarow spoke regarding design issues. As a builder and a citizen, a matrix should be considered as with 600 sq. ft. units. Flexibility discussion needs to be included; the less language the better. Fees are the biggest issue. Seeing no more speakers, Chair Trzesniewski closed Public Comment and brought it back to the Commission. The Commission discussed the following aspects of the project: Financial and nonmonetary incentives Incentives timeline for developing Fire sprinklers Setbacks Height limits Flexibility for accessory units and second units parity Possible revision of fees to make housing affordable Space for potential second units How second unit requirements would affect the main unit Planning Commission Regular Meeting Minutes for March 3, 2016 Page 5 of 7

6 Planning Manager MacNab suggested a considerations list could be included with the application. Commissioners Painter and Huether moved and seconded to forward a recommendation to the City Council to adopt a resolution adopting a Negative Declaration and adopt an ordinance amending the Napa Municipal Code creating a new Section and amending Section pertaining to Accessory Second Units, with the amendments striking Item 4.a. in the Design Standards, amending height limits in Item 1.b. and doing some additional research regarding setback for top of bank. 8. ADMINISTRATIVE REPORTS A ANNUAL HOUSING ELEMENT PROGRESS REPORT CITYWIDE Consideration of the 2015 Annual Housing Element Progress Report. (Walker) Senior Planner Walker presented the Staff Report. 9. COMMENTS BY COMMISSIONERS AND STAFF Planning Manager MacNab commented on levels of review for projects. April 21 Planning Commission has a big agenda, so he would like a full attendance. Tooker spoke regarding the City Council discussion of parking. March 1: supply and demand, expanding parking exempt district and increase parking fee. 955 parking space deficit, so two large garages would need to be built. Archer lease will be affected: 145 spaces in the near term. 77 parking space deficit in the near future of approximately 2 years. Interim spaces may be available at Pearl Street, Cinedome property and 1300 Main Street. Proposed increase in parking space fee. A pilot program for meters in the downtown area would make spaces available for customers and get the business owners and employees in the parking garages. A proposed plan would make signs for available spaces in the parking structures. A goal is incentives with superior development and high quality architecture. Commissioner Huether asked about hosted vacation rentals. Planning Manager MacNab noted 55 applications received, but some have dropped out. Enforcement activities have started.
