SCOPE OF THIS ADDENDUM The following becomes a part of the original project manual and drawings, taking precedence over the items that may conflict. The bidder shall note receipt and make acknowledgment of the Addendum on his/her bid form, incorporating its provision in his/her bid. GENERAL General for Project Manual, Project Drawings, and Project Addenda Replace: Any reference to a Bid Opening Date and Time of 1:30 PM on June 29, 2017 in the Project Manual, Project Drawings or Addenda with 1:30 PM on July 24, PROJECT MANUAL The following additions, changes and clarifications have been made to the Project Manual. 4 AD FOR BIDS Notice is hereby given that the City of Pierre, South Dakota will receive sealed bids for construction of Wastewater Treatment Plant Improvements. Project scope will include the following: Construct new UV Disinfection Building Provide and Install new UV Disinfection Equipment Mechanical Work Electrical Work Special Coatings Replace Aeration Basin Feed Piping Site Utilities All other miscellaneous work required not herein mentioned, but inferred from the construction contact documents. The Bids must be prepared on bid forms supplied in the Bidding Documents and filed with the City Finance Officer, City of Pierre, 222 E. Dakota Ave., Pierre, South Dakota, not later than 1:30 P.M., Local Time, July No bids will be received after the specified hour and date, and Bids which are not prepared and filed in accordance with Instructions to Bidders may be rejected. All Bids will be publicly opened and read aloud in the presence of the Bidders and their representatives on this same day at 1:30 P.M. Each Bid must be submitted in a sealed envelope. Each sealed envelope containing a Bid must be plainly marked on the outside as Bid for Pierre Wastewater Treatment Plant Improvements Bidder. If forwarded by mail or other delivery system, the sealed envelope containing the Bid must be sealed in another envelope, with the notation Bid Enclosed Pierre WWTF Improvements Project 2017 on the face thereof, and addressed to the City Finance Officer, City of Pierre, 222 E. Dakota Avenue, Pierre, South Dakota, Bidding Documents may be examined at the offices of Banner Associates, Inc. in Brookings, SD. A complete set of Bidding Documents may be obtained at the office of Banner Associates, Inc., nd Avenue South, P.O. Box 298, Brookings, SD 57006, (605) or may be ordered from Copies may be obtained upon a refundable payment in the sum of $84.14 ½ size and $ full size including applicable taxes and fees for each set of Bidding Documents. Electronic copies are also available and can be ordered and downloaded from the above website for a $25.00 non-refundable fee. Upon request, in accordance with South Dakota Codified Law 5-18B-1, one copy of electronic or paper Bidding Documents shall be furnished, without charge, to each prime contractor resident in South Dakota who intends, in good faith, to submit a bid to the Owner. Additionally, if a paper copy is provided under the conditions of SDCL 5-18B-1, in consideration of the documents being provided at no charge, unsuccessful bidders agree to return the documents to the office of Banner Associates, at the address listed above, within thirty (30) days after the bid opening. The Bidder to whom the contract is awarded will be required to furnish a construction performance bond and a construction payment bond to the Owner in the amount of one hundred percent (100%) of the contract award for each bond, in conformance with the requirements of the Contract Documents. The construction performance bond and construction payment bond shall remain in full force until the completion of the Contract as specified in the General Conditions. All bids must be accompanied by a Bid security. Bid security will take the form of a bid bond in an amount of ten percent (10%) of the Bidder's maximum Bid price or a cashier's or certified check made payable to Owner in an amount of five percent (5%) of the Bidder's maximum Bid price. The Bid security will be retained by the Owner as liquidated damages if the successful bidder refuses or fails to enter into an Agreement within fifteen (15) days after Notice of Award or fails at time of executing the contract to furnish a construction performance bond and construction payment bond guaranteeing the faithful performance of the work. Any contract or contracts awarded under this Advertisement for Bids are expected to be funded in part by a loan from the South Dakota State Revolving Loan Fund. Neither the State of South Dakota nor any of its departments, agencies or employees is or will be a party to this Advertisement for Bids or any resulting contract. This procurement will be subject to regulations contained in 40 CFR , and Bidders on this work will be required to comply with Title 40 CFR 33 and executive Order (WBE). 5 for bidders and contractors under this regulation that concerns utilization of Disadvantaged Minority Business Enterprises (DBE/MBE) and Women s Business Enterprises (WBE) are explained in the Specifications. The MBE goal for this project is 1.0% of the total dollar value of the job while the WBE goal is 4.0% of the total dollar value of the job. NONDISCRIMINATION IN EMPLOYMENT (a) (b) Bidders on this work will be required to comply with the President's executive orders Nos as amended, 11458, 11518, and The requirements for bidders and Contractors under these orders are explained in the Specifications. The goal for female utilization which shall be included in all federal and federally assisted construction contracts and subcontracts in excess of $10,000 shall be 6.9%. The goal for minority utilization which shall be included in all federal and federally assisted construction contracts and subcontracts in excess of $10,000 shall be 7.9%. The goals are applicable to the Contractor's aggregate on-site construction workforce whether or not part of that workforce is performing work on a federal and federally assisted contract or subcontract. Davis-Bacon and related acts provisions apply to this project. All provisions relative to those acts must be met. The low responsive bidder will be required to certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal. Please be advised that waivers and exemptions from the American Iron and Steel provision that city International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision does not apply to certain products based on the International Trade Agreement Bids may not be withdrawn after the time fixed for opening them. 9 Addendum #3 - Attachment #2 Page 4 of 6 The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate). Union Rate Identifiers A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM /01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers indicates the local union number or district council number where applicable, i.e., Plumbers Local The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate. Survey Rate Identifiers Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA /13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier. Survey wage rates are not updated and remain in effect until a new survey is conducted. Union Average Rate Identifiers Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH /29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage

10 Page 5 of 6 determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier. A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/cba rate of the union locals from which the rate is based. WAGE DETERMINATION APPEALS PROCESS 1.) Has there been an initial decision in the matter? This can be: * an existing published wage determination * a survey underlying a wage determination * a Wage and Hour Division letter setting forth a position on a wage determination matter * a conformance (additional classification and rate) ruling On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.) and 3.) should be followed. With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations.
