1 BY-LAW A BY-LAW OF THE CITY OF GREATER SUDBURY TO ESTABLISH MISCELLANEOUS USER FEES FOR CERTAIN SERVICES PROVIDED BY THE CITY OF GREATER SUDBURY WHEREAS Section 391(1) of the Municipal Act, 2001, S.O. 2001, C.25, as amended, allows municipalities to pass By-laws imposing fees or charges for services or activities provided, for use of property and related matters; WHEREAS the Council of the City of Greater Sudbury wishes to pass a By-law respecting fees for processing of applications to the City of Greater Sudbury, for services provided by the City of Greater Sudbury, for the use of property and facilities of the City of Greater Sudbury and related matters; AND WHEREAS Section 69 of the Planning Act, R.S.O. 1990, c. P.14 as amended, allows municipalities to pass a by-law imposing a tariff of fees for processing of applications made in respect of planning matters; AND WHEREAS the Council of the City of Greater Sudbury wishes to establish a tariff of fees for processing applications made under the Planning Act; NOW THEREFORE THE COUNCIL OF THE CITY OF GREATER SUDBURY HEREBY ENACTS AS FOLLOWS: PART 1 -COMMUNITY DEVELOPMENT DEPARTMENT 1. (1) Except as provided to the contrary in Section 2, all applications or requests made to the City of Greater Sudbury's Community Development Department for services, programs, activities or facility use, shall be accompanied by the appropriate fee as set out in the Schedules identified below, in order to recover part of the costs expended by

2 the City of Greater Sudbury in the processing of such applications, the provision of the services, programs or other activities described or the use of the facilities. In appropriate circumstances, bills may have to be sent out following the completion of the work, use of the facility, provision of the service, program or other activity, in which case the fee will then be due and payable. Schedule "CD-A" Schedule "CD- B" Schedule "CD-C" Schedule "CO-D" Schedule "CD-E" Schedule "CD-F" Schedule "CO-G" Schedule "CD-H" Schedule "CD-I" Schedule "CD-J" Schedule "CD-K" Schedule "CO-L" Schedule "CO-M" Schedule "CO-N" Schedule "CD-0" Day Care; Special Rates for Arena Ice Time; Ice Use Charges; Cemetery; Aquatics; Summer Camps; Camping I Parks; Ski Hills; Community Halls I Meeting Rooms I Arena Floors; Fitness and Recreation Centres; Leisure Services; Playing Fields; Ticket Charges - Sudbury Community Arena; Special Family Day; Anderson Farm Museum

3 (2) For the purposes of the fee categories identified in those Schedules listed in Subsection 1 (1 ): "child" means an individual 0 to 5 years of age and under; "junior" means an individual 6 to 14 years of age; "youth" means an individual 15 to 17 years of age; "adult" means an individual 18 years of age or older; "senior" means an individual 55 years of age or older; "family" means three or more family members residing in the same household; and "Family Day" means the third Monday in February in each year. Fee Reduction Etc. 2. (1) Notwithstanding Subsection 1 (1) above, the General Manager of Community Development may reduce the amount of, or waive the requirement for the payment of a fee in a Schedule identified in Subsection 1(1), where the General Manager of Community Development is satisfied it would be unreasonable in the circumstances to require payment in accordance with that Schedule. (2) Notwithstanding Subsection 1 (1) above, where a City facility is governed by a Joint Use Agreement with a School Board which establishes fees or provides for a fee waiver for the use of that City facility, the fee shall be governed by the Joint Use Agreement and not this By-law

4 (3) Fees and Charges provided for in Schedule "CO-N "- Special Family Day shall be in effect on Family Day, despite the fee or charge provided for in any other Schedule. PART 2 -GROWTH AND DEVELOPMENT DEPARTMENT Fees - Planning Related Applications 3. (1) Except as provided to the contrary in section 4, all applications or requests for services made to the City of Greater Sudbury's Growth and Development Department, all applications made to the Committee of Adjustment, the Consent Official, or to the Planning Committee of the City of Greater Sudbury of the type set out in Schedule "G&D-A- Planning Application Fees", shall be accompanied by the appropriate fees as set out in Schedule "G&D-A- Planning Applications", in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such applications or requests for services. (2) On applications for re-zonings or Official Plan amendments the applicant shall, in addition to any applicable fees, pay for any Public Notices required, in the opinion of the Director of Planning, to be published in the newspapers and payment will be made prior to By-law enactment or immediately after publication if no By-law is required. (3) On all applications under the Planning Act, including without limitation, applications for minor variance, consent, re-zoning, Official Plan amendment, subdivision approval, submitted after March 29th, 2012 and before March 28th, 2014, the applicant shall, in the application for services, undertake to pay a fee of $6,000 per day or part thereof as a contribution towards the City's legal fees, costs and

5 disbursements associated with the preparation for and attendance at all Ontario Municipal Board hearings in the event that the application is approved by the Committee of Adjustments, the Consent Official or Council, as the case may be and (a) (b) the application is appealed by a third party to the Board; and the applicant wishes the City of Greater Sudbury to attend on or participate in the appeal. (4) The applicant shall pay to the City of Greater Sudbury in advance of any scheduled hearing date, an amount equal to the number of days the hearing is anticipated to last, times the specified fee of $6,000. In the event that payment is not made or guaranteed to the satisfaction of the City Solicitor, prior to the commencement of the hearing, the City of Greater Sudbury shall not attend upon the hearing. The applicant shall be responsible to pay any fees required by the Ontario Municipal Board, whether required to be paid by the City of Greater Sudbury or not and shall be responsible for payment of any costs associated with his or her own representation at the hearing. Any amount owing to the City of Greater Sudbury in excess of the amount secured by advance payment shall be a debt owing to the City of Greater Sudbury and bear interest at the rate provided for in this By- law until payment in full. (5) Nothing in Subsection 3(3) limits Council for the City of Greater Sudbury from determining that the City will attend and participate in the hearing of the third party appeal without the applicant being required to pay the specified fee

Etc.- Planning Applications 4. {1) Notwithstanding Subsection 3(1) above, City Council through the Planning Committee, may, by resolution, in respect of applications made to these bodies, reduce the amount of or waive the requirement for the payment of a fee where the body concerned is satisfied it would be unreasonable in the circumstances to require full payment in accordance with Schedule "G&D-A" - Planning Applications. (2) Notwithstanding Subsection 3(1) above, the Committee of Adjustment or the Director of Planning may reduce or waive the requirement for a fee for an application to the Committee of Adjustment when satisfied that it would be unreasonable in the circumstances to require full payment in accordance with Schedule "G&D-A" - Planning Applications. (3) Notwithstanding Subsection 3(1) above, the Consent Official, in respect to applications for Consent, may reduce the amount of, or waive the requirement for the payment of a fee for an application to the Consent Official where she or he is satisfied that it would be unreasonable in the circumstances to require full payment in accordance with Schedule "G&D-A" - Planning Applications. Plans and Documents & Fees and Exceptions 5. {1) Except as provided to the contrary in Subsection 5(2}, anyone who wishes to obtain any digital mapping drawings or any of the City's publications, statistics, maps, digital map files or information shall first pay to the City the appropriate fee as set out in Schedule "G&D-B" - Plans and Documents

7 (2) Notwithstanding Subsection 5( 1) above, the Director of Planning and the General Manager of Growth and Development are each authorized to provide any of the mapping, publications, or other documents referred to in Schedule "G&D-B"- Plans and Documents without any charge when it is in the interest of economic development in the City to do so. Parking I Licencing 6. (1) Except as provided to the contrary in Section 7, all applications or requests for services, licences or use of facilities/resources, made to the Growth and Development Department of the type identified in the Schedules listed below shall be accompanied by the appropriate fee as set out in the Schedules listed below, in order to recover part of the costs expended by the City in the processing of such applications, the provision of such services, the development and maintenance of licenced data or use of facilities I resources. In appropriate circumstances, bills may have to be sent out following the completion of the work, use of the facility, provision of the service or the licence, in which case the fee will then be due and payable: Schedule "G&D-C" Licencing Schedule "G&D-D" Parking Schedule "G&D-G" Environmental Services (2) Administrative fees or charges of the type described in the Schedule "G&D-D"- Parking shall be payable in order to recover part of the costs expended by the City for administrative costs, and shall be due on the date specified in the invoice

8 Fee Reduction Etc - Parking/Licencing/Environmental Services 7. Notwithstanding Section 6, above, the General Manager of Growth and Development may reduce the amount of, or waive the requirement for the payment of a fee or charge in any Schedule identified in Section 6, where the General Manager of Growth and Development is satisfied it would be unreasonable in the circumstances to require payment in accordance with that Schedule. Building Fees & Fee Reductions Etc. 8. (1) All requests for Services from the Building Services Division of the Growth and Development Department of a type identified on Schedule "G&D-E" - Buildings shall be accompanied by the appropriate fee as set out in the corresponding line in the said Schedule "G&D-E" Buildings in order to recover part of the costs expended by the City of Greater Sudbury in the provision of the services described. (2) Notwithstanding Subsection 8(1) above, the General Manager of Growth and Development may reduce the amount of, or waive the requirement for the payment of the fee in Schedule "G&D-E" - Buildings where the General Manager of Growth and Development is satisfied it would be unreasonable in the circumstances to require full payment in accordance with that Schedule. Sign By-law Fees and Reductions Etc. 9. (1) Except as provided to the contrary in Subsection 9(2), all applications or requests made to the City of Greater Sudbury Growth and Development Department under Bylaw the Sign By-law, as amended or replaced from time to time, of the type

9 specified in Schedule "G&D-F" - Signs shall be accompanied by the appropriate fees as set out in Schedule "G&D-F" Signs, in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such applications or requests. (2) Notwithstanding Subsection 9(1) above, General Manager of Growth and Development may reduce the amount of, or waive the requirement for the payment of a fee in Schedule "G&D-F" - Signs where the General Manager of Growth and Development is satisfied it would be unreasonable in the circumstances to require full payment in accordance with that Schedule. Downtown Market By-law Fees and Reductions Etc. 10. (1)Except as provided to the contrary in Subsection 10(2), all applications or requests made to the City of Greater Sudbury Growth and Development Department of the type specified in Schedule "G&D-H"- Downtown Market shall be accompanied by the appropriate fees as set out in Schedule "G&D-H" Downtown Market, in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such applications or requests. (2) Notwithstanding Subsection 10(1) above, General Manager of Growth and Development may reduce the amount of, or waive the requirement for the payment of a fee in Schedule "G&D-H"- Downtown Market where the General Manager of Growth and Development is satisfied it would be unreasonable in the circumstances to require full payment in accordance with that Schedule

10 Development Engineering By-law Fees and Reductions Etc. 11. (1) Except as provided to the contrary in section 11 (2), all applications or requests for services made to the City of Greater Sudbury's Growth and Development Department, all applications made to the Committee of Adjustment, the Consent Official, or to the Planning Committee of the City of Greater Sudbury of the type set out in Schedule "G&D-1"- Development Engineering shall be accompanied by the appropriate fees as set out in Schedule "G&D-1" Development Engineering, in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such applications or requests. (2) Notwithstanding Subsection 11 (1) above, General Manager of Growth and Development may reduce the amount of, or waive the requirement for the payment of a fee in Schedule "G&D-1" - Development Engineering where the General Manager of Growth and Development is satisfied it would be unreasonable in the circumstances to require full payment in accordance with that Schedule. PART 3 -INFRASTRUCTURE SERVICES DEPARTMENT Fees 12. Except as provided to the contrary in Section 13, all applications or requests for services or use of facilities made to the City of Greater Sudbury's Infrastructure Services Department for services of the type identified in the Schedules below shall be accompanied by the appropriate fee as set out in that Schedule in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such application, the provision of such services or the provision of such facilities

11 Inappropriate circumstances, bills may have to be sent out following the completion of the work in which case the fee will then be due and payable: Schedule "IS-A"- Infrastructure- General; Schedule "IS-B" - Transit 13. Notwithstanding Section 12 above, the General Manager of Infrastructure Services may reduce the amount of, or waive the requirement for the payment of a fee where he or she is satisfied it would be unreasonable in the circumstances to require full payment in accordance with: Schedule "IS-A" Infrastructure- General Schedule "IS-B" Transit PART 4- EMERGENCY SERVICES DEPARTMENT Fees 14. Except as provided to the contrary in Section 15, all applications or requests for services or use of facilities made to the City of Greater Sudbury's Emergency Services Department for services of the type identified in the Schedules below shall be accompanied by the appropriate fee as set out in that Schedule in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such application, the provision of such services or the provision of such facilities. In appropriate circumstances, bills may have to be sent out following the completion of the work in which case the fee will then be due and payable: Schedule "ES-A" - Emergency Medical Services; Schedule "ES-B" - Centre Lionel E. Lalonde Centre

12 Fee Reductions. Etc. 15. Notwithstanding Section 14 above, the Chief of Fire and Paramedic Services may reduce the amount of, or waive the requirement for the payment of a fee where he or she is satisfied it would be unreasonable in the circumstances to require full payment in accordance with: (a) Schedule "ES-A"- Emergency Medical Services; (b) Schedule "ES-B"- Lionel E. Lalonde Centre. FIRE SERVICES Fees- Inspections I Searches/ Reports 16. (1) Except as provided in Subsection 16(2), all applications or requests for services made to the City of Greater Sudbury Fire Services Division for conduct of file searches, provision of reports, conduct of inspections and other services identified in Schedule "ES-C"- Reports, Inspections, etc. shall be accompanied by the appropriate fee as set out in Schedule "ES-C"- Reports, Inspections etc., in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such applications or the provision of such services. In appropriate circumstances, bills may have to be sent out following the completion of the work in which case the fee will then be due and payable. (2) Despite Subsection 16(1), the fees set out in Schedule "ES-C"- Reports, Inspections etc. shall not apply to inspections performed or other services provided by the Greater Sudbury Fire Services as part of as a requirement of an application under:

13 By-law , the Business Licencing By-law , the Trailer, Trailer Camp and Trailer Park By-law; By-law , the Adult Entertainment Establishment Bylaw; By-law , the Body-Rub Parlour By-law; By-law , the Second Hand Goods By-law; or By-law B, the Building By-law; all as amended or replaced from time to time. Fees --Vehicle Response and Foam Use 17. (1) In order to recover part of the costs expended by the City of Greater Sudbury in the provision of services, fees or charges assessed for provision of the services described on Schedule "ES-D" -Vehicle Response and Foam Use shall be determined in accordance with Schedule "ES-0". (2) Where fees or charges are payable for the services provided in Schedule "ES-D" - Vehicle Response Fees and Charges on an hourly rate, fees shall be payable at the specified hourly rate for the travel time of the person providing the service. Fees and charges shall be due and payable on the date specified in the invoice. Fees- False Alarms 18. (1) In order to recover part of the costs expended by the City of Greater Sudbury in responding to false alarms, fees or charges for responding to false alarms designated as Type 1 False Alarms-No Reasonable Cause and Type 2 False Alarm- Failure to Advise of Testing shall be determined in accordance with Schedule "ES-E"- False Alarms

14 (2) For the purposes of this By-law: "Type 1 False Alarms- No Reasonable Cause" are alarms where the Greater Sudbury Fire Services determines that the alarm was given without reasonable cause, including without limitation, alarms resulting from improperly maintained alarm systems; and "Type 2 False Alarms- Failure to Advise of Testing" are alarms in situations in which the Greater Sudbury Fire Service determines the alarm resulted from testing the fire alarm system without prior notification to the Greater Sudbury Fire Services of the particulars of the timing of the proposed testing and compliance with Fire Service protocols for alarm testing then in effect. (3) Fees or charges assessed in accordance with Schedule "ES-E"- False Alarms. Responses shall be payable by the person or persons registered in the Land Titles or Land Registry Office as owner of the property on which the alarm system is situate and shall be due and payable on the date specified in the invoice. (4) If payment of any amount owing under Subsection 18(2) is not made within thirty days of the date specified on the invoice, the City of Greater Sudbury may, in the discretion of the Chief of Fire and Paramedic Services and in addition to any other remedy it may have at law, add the balance outstanding to the tax roll of the property where the false alarm occurred, and recover the outstanding amount in like manner as municipal taxes. The City's Chief Financial Officer I Treasurer is hereby authorized to take all necessary action to do so

15 (2) For the purposes of this By-law: "Type 1 False Alarms - No Reasonable Cause" are alarms where the Greater Sudbury Fire Services determines that the alarm was given without reasonable cause, including without limitation, alarms resulting from improperly maintained alarm systems; and "Type 2 False Alarms- Failure to Advise of Testing" are alarms in situations in which the Greater Sudbury Fire Service determines the alarm resulted from testing the fire alarm system without prior notification to the Greater Sudbury Fire Services of the particulars of the timing of the proposed testing and compliance with Fire Service protocols for alarm testing then in effect. (3) Fees or charges assessed in accordance with Schedule "ES-E"- False Alarms. 16 Reduction of Fees, Etc. 19. Notwithstanding Sections 16, 17, and 18 above, the Chief of Fire and Paramedic Services may reduce the amo!jnt of, or waive the requirement for the payment of a fee where he or she is satisfied it would be unreasonable to require payment in accordance with Schedule "ES-C" - Reports, Inspections, etc or with Schedule "ES-D" -Vehicle Response and Foam or with Schedule "ES-E"- False Alarm Responses, as the case may be. PART 5- ADMINISTRATIVE SERVICES DIVISION Fees 20. Except as provided to the contrary in Section 21, all applications and requests for services, subscriptions and photocopies made to the Administrative Services division of the City of Greater Sudbury, of the type identified in the schedules listed below shall be accompanied by the appropriate fee as set out in the Schedules listed below, in order to recover part of the costs expended by the City of Greater Sudbury in process of such applications or the provision of the services, subscriptions and photocopies described: Schedule "AS-A": General Matters; Schedule "AS-B": Services Under the Marriage Act ; Schedule "AS-C": Schedule "AS-0": Legal Services; Provincial Offences

17 Fee Reduction. Etc. 21. (1) Notwithstanding Section 20, the Executive Director of Administrative Services is hereby authorized to reduce or waive fees in Schedule "AS-A" - General Matters when she or he is satisfied that it would be unreasonable in the circumstances to require payment in accordance with the said Schedule. (2) Notwithstanding Section 20, the City Clerk and in her or his absence, the Executive Director of Administrative Services, is hereby authorized to reduce or waive fees in Schedule "AS-B" - Services under the Marriage Act when she or he is satisfied that it would be unreasonable in the circumstances to require payment in accordance with the said Schedule. (3) Notwithstanding Section 20, the City Solicitor, and in his or her absence, the Executive Director of Administrative Services is hereby authorized to reduce or waive fees set out in Schedule "AS-C"- Legal Services when he or she is satisfied that it would be unreasonable in the circumstances to require payment in accordance with the said Schedule. (4) Notwithstanding Section 20, no fee shall be charged to commission a document pursuant to Schedule "AS-C" - Legal Services: (a) (b) where the document is commissioned by a City Councillor; or where the document is required by the City in support of an application for an approval, service, benefit or program of or administered by the City

18 (5) Notwithstanding Section 20, the City's Co-Ordinator of Court Services, and in her or his absence, the Executive Director of Administrative Services is hereby authorized to reduce or waive fees set out in Schedule "AS-D" - Provincial Offences in accordance with the POA Write-off Policy as approved by Council. PART 6- FINANCIAL SERVICES DIVISION Fees and Reductions, etc. 22. (1) All applications or requests for services made to the City of Greater Sudbury's Financial Services Division for services of the type identified in Schedule "FN-A" - Financial Services shall be accompanied by the appropriate fee as set out in Schedule "FN-A" - Financial Services, in order to recover part of the costs expended by the City of Greater Sudbury in the processing of such applications or provision of such services. In appropriate circumstances, bills may have to be sent out following the completion of the work in which case the fee will then be due and payable. (2) The Chief Financial Officer I Treasurer is hereby authorized to reduce or waive fees in Schedule "FN-A"- Financial Services when she or he is satisfied that it would be unreasonable in the circumstances to require payment in full in accordance with Schedule "FN-A" - Financial Services. Interest on Receivables 23. (1) Unless a contrary rate is provided for elsewhere, overdue amounts owing to the City shall bear interest at the rate set out on Schedule "FN-A" as the rate payable on overdue amounts, from the due date until payment in full

19 (2) Notwithstanding Subsection 23(1 ), the Chief Financial Officer I Treasurer is hereby authorized to reduce or waive accrued interest when she or he is satisfied that it would be unreasonable in the circumstances to require payment in full in accordance with that Schedule. PART 7- HST 24. Fees included in all the Schedules attached to this By-law are subject to the Harmonized Sales Tax where applicable. PART 8- ANNUAL INFLATIONARY INCREASE 25.(1) Except as otherwise provided in Subsections 25(2), 25(3), 25(4) and 25(5) the fees provided for in this By-law shall be automatically adjusted for inflation on January 1st,, 2015 and on January 1st in every year thereafter by the Chief Financial Officer I Treasurer in the amount the Chief Financial Officer I Treasurer deems appropriate, based on the greater of 3% and the September Stats Can Consumer Price Index for all Items and provided further that the Chief Financial Officer I Treasurer may consider previous Index changes, and previous fee adjustments or non-adjustments in making her or his determination, and the Chief Financial Officer I Treasurer shall inform Council of these annual adjustments, and this By-law shall be deemed to have been amended accordingly. (2) Despite Subsection 25(1 ), there shall be no adjustment for inflation to the Ticket handling fees as set out in Schedule "CO-M" -Ticket Charges - Sudbury Arena; (3) Despite subsection 25(1 ), the adjustment for inflation as described in Subsection 25. (1) Shall come into effect only on April 1st, in each year, commencing April 1st, 2015, for the fees in the Schedules noted below:

20 (a) "CD-E" (b) "CD-F" (c) "CD-H" (d) "CD-I" (e) "CD-J" (f) "CD-K" Aquatics; Summer Camps, Ski Hills; Community Halls I Meeting Rooms I Arena Floors; Fitness and Recreation Centres; Leisure Services. (4) Despite subsection 25(1) the adjustment for inflation for fees described in Subsection 25(1) shall not be applied to the fees in the Schedules identified below until September 1st, 2014 and on September 1st in each year thereafter: (a) (b) "CO-B"- Special Rates for Arena Ice Time; "CD-C"- Ice Use Charges. 26. By-law is hereby repealed. PART 9- REPEAL PART10-GENERAL Effect 27. (1) This By-law shall come into force and take effect upon January 1, 2014 save and except where approval of any fee by any regulatory agency or body is required, in which case the fee shall come into effect only upon such approval being granted

21 (2) Despite anything to the contrary in this By-law, where a Schedule in this By-law has specified effective dates, then any such Schedule shall be in effect only until the date set out therein, or shall come into effect only as of the date set out therein, as the case may be. Short Title 28. This By-law shall be known as the "User Fees By-Law" Accessibility 29. In accordance with the Accessibility for Ontarians with Disabilities Act, 2005, S.O. 2005, c.11, and regulations thereunder, all as amended or replaced from time to time, no additional fee shall be charged to a person with a disability arising from or related to their disability. Schedules 30. In this Schedule "CD-C-1" "commercial" means a corporation, sole proprietorship, partnership or unincorporated association which is intended to be a for-profit corporation or association including but not limited to a hockey school; "non-prime time" means the hours between 9:30 in the morning and 5:00 in the afternoon on each day from Monday to Friday inclusive in each week, and 7:00 to 8:00 in the morning on Saturday and Sunday; "prime time" means the hours between 5:00 in the afternoon and 1 :00 in the morning on each day from Monday to Friday inclusive in each week and between the hours of 8:00 in the morning and 1 :00 in the morning on each Saturday and Sunday in each week; "regular season" means the period from September 1" in any year to and including March 31st in the next following year; and "summer season" means the period from April 1st to August 31st, inclusive, in any year. 2.
