13 Contrtors Plnt Poliy Wording Generl Conditions 1 Survey nd Risk Improvement Sujetivity Condition It is Condition of this Poliy tht the Insurers hve the right to rry out survey of the risks insured t ny time mutully greed with the Insured the Insured shll omply with ll survey risk requirements stipulted y the Insurers within the ompletion time sles speified y the Insurers. In the event tht risk requirement is not ompleted or risk requirement proedures re not introdued within the ompletion time sles speified y the Insurers then the Insurers reserve the right to either ontinue over sujet to ltertion of the terms nd Conditions of suh over or to suspend over effetive from the expiry of ny time period speified y the Insurers for ompletion/introdution of the required survey risk improvements until suh risk requirement is ompleted or risk requirement proedures introdued. If the terms or Conditions of over re mended y the Insurers then the Insured will hve fourteen (14) lendr dys to ept or rejet the revised sis of over. If the Insured elet to rejet the revised sis of over then the Insured will e entitled to refund of premium provided tht no lim hs een mde during the urrent Period of Insurne. If the Insurers exerise the right to suspend over then the Insured will e entitled to refund of premium in respet of suh period tht over is suspended provided tht no lim hs een mde during the urrent Period of Insurne. All other terms nd Conditions of this Poliy shll pply to the extent tht they re not in onflit with this Condition. 2 Oservne of Poliy Terms The liility of the Insurers will e onditionl on the Insured omplying nd s pproprite ny other person entitled to indemnity omplying s though they were the Insured with the terms of this Poliy. 3 Fir Presenttion of the Risk The Insured must mke fir presenttion of the risk to the Insurers t ineption renewl nd vrition of the Poliy. The Insurers my void the Poliy nd refuse to py ny lims where ny filure to mke fir presenttion is i delierte or rekless or ii of suh other nture tht if the Insured hd mde fir presenttion the Insurers would not hve issued the Poliy. The Insurers will return the premium pid y the Insured unless the filure to mke fir presenttion is delierte or rekless. If the Insurers would hve issued the Poliy on different terms hd the Insured mde fir presenttion the Insurer will not void the Poliy (exept where the filure is delierte or rekless) ut the Insurers my insted i redue proportiontely the mount pid or pyle on ny lim the proportion for whih the Insurers re lile eing lulted y ompring the premium tully hrged s perentge of the premium whih the Insurers would hve hrged hd the Insured mde fir presenttion nd/or ii tret the Poliy s if it hd inluded suh dditionl terms (other thn those requiring pyment of premium) s the Insurers would hve imposed hd the Insured mde fir presenttion. Upon eing notified of ny suh ltertion the Insurers my t their solute disretion i ontinue to provide over under this Poliy on the sme terms ii restrit the over provided under this Poliy iii impose dditionl terms iv lter the premium v nel the Poliy. If the Insured fils to notify the Insurers of ny mteril ltertion of the risk the Insurers my 1 tret the Poliy s if it hd ome to n end s t the dte of the ltertion of the risk returning proportionte mount of the premium for the unexpired Period of Insurne if the Insurers would hve nelled the Poliy hd they known of the inrese in risk 2 tret the Poliy s if it hd ontined suh terms (other thn relting to premium) or other restritions (if ny) from the dte of the ltertion in risk s the Insurers would hve pplied hd they known of the inrese in risk 3 redue proportiontely the mount pid or pyle on ny lim the proportion for whih the Insurers re lile eing lulted y ompring the premium tully hrged s perentge of the premium whih the Insurers would hve hrged hd they known of the inrese in risk. 5 Resonle Preutions It is ondition preedent to the liility of the Insurers tht the Insured shll tke ll resonle preutions to sfegurd the Insured Property ginst loss or dmge nd the Insured shll mintin the Insured Property in n effiient ondition nd tke ll resonle steps to ensure tht ll Government nd other regultions relting to the opertion nd use of the Insured Property re oserved. 6 Lw nd Lnguge Applile Unless the Insurers gree otherwise the lnguge of the Poliy nd ll ommunitions relting to it will e in English nd ll spets of the Poliy inluding negotition nd performne re sujet to English lw nd the deisions of English ourts. 7 Cnelltion Other thn where Clims Condition 3 pplies the Insurers my nel this Poliy y giving the Insured thirty (30) lendr dys notie in writing t their lst known ddress. Provided the premium hs een pid in full nd no lim hs een mde during the Period of Insurne the Insured shll e entitled to proportionte rete of premium in respet of the unexpired period of the insurne. If the premium for this Poliy is pid y instlments nd in the event tht the Insured fils to py one or more instlments whether in full or in prt the Insurer my nel the Poliy y giving the Insured fourteen (14) lendr dys notie in writing t their lst known ddress. 8 Delrtions Where the premium is deposit nd hs een lulted on estimtes supplied y the Insured they shll keep n urte reord of informtion on mtters for whih estimtes hve een given. This reord shll e supplied to the Insurers within one month following expiry of the Period of Insurne to enle the djustment of premium to e lulted. 12

15 Contrtors Plnt Poliy Wording Generl Conditions ontinued 9 Adjustment of Premium If the premium lulted on the sis greed etween the Insurers nd the Insured on the delrtions mde for the Period of Insurne exeeds or flls short of the deposit then the Insured shll py or the Insurers shll refund the differene s the se my e in respet of Cover One 50% (fifty perent) of the differene nd in respet of Cover Two the whole of the differene sujet to minimum retention of 75% (seventy five perent) of the deposit or the minimum nnul premium retention speified in the Shedule whihever is the greter. 10 Assignment The Insured shll not ssign ny of the rights or enefits under this Poliy without the prior written onsent of the Insurer.
