1 2018 ABBOT KINNEY FESTIVAL RULES & REGULATIONS Celebrating 34 years of giving back to Venice, the 2018 Abbot Kinney Festival (hereinafter Festival ) is Sunday, September 30th from 10:00 AM to 6:00 PM. Founded in 1984, the Abbot Kinney Festival is one of the largest of its kind in the country. This FREE community event attracts just over 100,000 attendees from across the Southland. With over 300 exhibitors, 10,000 parents and children who participate in a day of cultural activities and entertainment inside of the Festival s KidsQuad, 3 live music stages and 3 beer gardens there is something for everyone! Each exhibitor must submit an online application. Exhibitor participation in the Festival is contingent on acceptance of the application according to the rules and regulations set out below. Space is limited and subject to jury approval. Exhibitor registration will close August 15, I. APPLICATION PROCESS Exhibitors must complete the online application, which includes uploading (3) photos of the products being sold, a minimum of (1) photo of the booth layout with product, and submitting the required fees. Payment will be processed upon completion of application. If your application is declined by the jury committee, you will be notified via within 21 days and all fees will be refunded. If the jury committee determines you are registered in an incorrect category, you will be notified via within 21 days and given the opportunity to change categories or withdraw your application without penalty. Participation in previous festivals does not guarantee acceptance. Exhibitor booth presentation is very important to the overall quality of the festival. In order to effectively jury all exhibitors we must have some visual representation of how you will be displaying your goods at the festival. This may require you to set up a "mock booth" at your house or business in order to meet this requirement. Please note ACCEPTANCE WILL NOT BE GRANTED TO EXHIBITORS WHO DO NOT SUBMIT A BOOTH PHOTO. 2 JURY SELECTION All applications are subject to jury approval. Application selection is under the sole discretion of the jury. The jury reserves the right to reject any application. AKFA also has the right to demand the release of any rented space at any time before or during the Festival for misrepresentation of products being sold. FEES Registration fees are based on the design and workmanship of the product being sold. Registrations completed on or after August 1 st will incur a $100 late fee. CANCELLATION A full refund less a $50 cancellation fee will be given for cancellations up to July 31st; Cancellations August 1st - August 15th will receive a refund equal to 50% of your registration fee; Cancellations made on or after September 1st will forfeit all fees paid. LATE FEES WILL NOT BE REFUNDED. II. BOOTH MAINTANENCE SET UP Booth set up begins at 7:00 a.m Exhibitors will not be permitted to begin setting up their booths prior to 7:00a.m. Vehicles may unload goods and the Blvd must be cleared by 9 a.m. or they will be subject to towing. BREAK DOWN All Exhibitors must stop selling and begin packing their goods for pickup promptly at 6pm. **Please note vehicles will not be allowed on the street until Los Angeles Police Department has deemed it safe. This process must be followed to insure the Blvd is safely cleared of pedestrians prior to allowing vehicles to enter. PARKING PARKING IS NOT PROVIDED. There are some public lots for use on a First come-first Serve basis. Parking and transportation information will be posted on prior to Festival. BOOTH SIZE & SPACE RESTRICTIONS All booth spaces (except Community information tables) are rented as a single unit consisting of 10 X 10 canopy tent. No sidewalls, tables or chairs will be provided. 3 All exhibitors must sell their goods or represent their organization within their rented booth space. Booth inventory must be contained in the assigned space/site provided. No person, chairs, signs or other items from Vendors space/site may block an aisle or another space/site. Violation will be subject to a penalty of $250. Exhibitors may not move to another location without permission from the Festival and may not occupy open spaces without paying for said space. No roving is allowed. AKFA does not provide electrical hookups, electrical outlets, power strips, easels or water. All Exhibitors must supply their own display tables, counters, racks, easels, banners and seating. All Exhibitors must clean and maintain their areas throughout the day and leave their space free of debris. Exhibitors must use recyclable bags (such as paper, compostable or bio-degradable bags) NO PLASTIC BAGS may be given to customers! Fire Inspector approved canopies will be provided. NO EXHIBITOR OWNED CANOPIES WILL BE ALLOWED WITHOUT PRIOR AND WRITTEN APPROVAL FROM THE FESTIVAL. ALL CANOPIES MUST BE PROVIDED BY ABBOT KINNEY FESTIVAL PER THE LOS ANGELES FIRE DEPARTMENT. No burning of any materials, including candles and incense will be permitted due to Los Angeles City and County fire regulations. Exhibitor sites are subject to Los Angeles Fire Department inspection and if fire codes are not met, exhibitors will be subject to removal from the festival and/or citations. Any required permits, with the exception of the LA County Health Department permits required for food exhibitors, needed to participate in the Festival are the assumed responsibility of the Vendor. Vendors shall be responsible for collecting and reporting taxes. For more information about collecting and reporting state taxes and/or to obtain a resale number, contact the local office of the State Board of Equalization or call III. GENERAL LIABILITY Exhibitors are responsible for their own money, taxes, and licenses. All Participants and Exhibitors are responsible for their own display; the City of Los Angeles, the Abbot Kinney District Association, and the Abbot Kinney Festival Committee shall not be held liable for any damage or loss to property belonging to Participants or Exhibitors. 4 IV. CODE OF CONDUCT PARTICIPANTS The Festival Committee expects all participants, whether they are Exhibitors, musicians, or members of the public, to conduct themselves in a peaceable and lawful manner. Any person found acting in an unreasonable, abusive, violent, belligerent, loud, or offensive manner will be in violation of these Rules and Regulations and asked to leave the Festival. If a violating person refuses to leave, he or she may be removed by the Los Angeles Police Department officers and be subject to possible arrest and detention. All individuals will be expected to obey all laws, Municipal, State and Federal. ALCOHOL Alcohol may be sold only in businesses or sanctioned areas that have legal permits to sell alcohol. The sale and consumption of alcohol must conform to all State and Municipal laws. Exhibitors in violation of the law may be subject to penalties, including booth closure, forfeiture of fees, and possible arrest. V. ENFORCEMENT BOOTH CLOSURE AND SHUT DOWN Exhibitor booths may be shut down for violations of these Rules and Regulations, any violation of State or Municipal law, or for just cause within the Festival Committee s discretion. Exhibitors may be shut down and their booths closed by any official department or government agency, such as the Los Angeles Fire Department or Los Angeles Police Department. FORFEITURE OF FEES If an Exhibitor is shut down due to a violation of the AKFA Rules and Regulations outlined here, or if an exhibitor withdrawal is made after 11:59 on August 15, 2018 all fees will be forfeited. FUTURE EXCLUSION The Festival Committee has the right to bar any Exhibitor from participation in future Festivals. Violation of any of these Rules and Regulations may result in being barred from participating in future festivals. Page 4 of 5

GENERAL NON-LIABILITY CLAUSE All Participants and Exhibitors are responsible for their own display; the City of Los Angeles, the Abbot Kinney District Association, and the Abbot Kinney Festival Committee shall not be held liable for any damage or loss to property belonging to Participants or Exhibitors. Vendor shall defend, indemnify, and hold harmless the City of Los Angeles, Abbot Kinney Festival Association, its officers and Festival Sponsors/Partners from any and all actions, suits, proceedings, claims, costs, and expenses, including attorney s fees, for loss or damage to any items displayed for sale or any equipment. VII. PAYMENT Payment may be made online with Mastercard, Visa, American Express or by check payable to: Abbot Kinney Festival Association and mailed to ½ Washington Place, Suite C, Los Angeles, CA NOTE: applications will not be reviewed until payment is made or checks are received.
