2 Vernon Recreation Centre INSTRUCTIONS TO SECTION Boiler Replacement BIDDERS Page 1 of TENDER CALL.1 Offers signed under seal, dated and marked "Tender , Vernon Recreation Centre Boiler Replacement" will be received on or before 2:00pm local time on Mar 13, Deliver tenders to the office of Regional District of North Okanagan at 9848 Aberdeen Road, Coldstream, BC V1B 2K9..2 Offers submitted after the above time will be returned to the bidder unopened. Bids submitted by fax will not be accepted..3 Those wishing to tender may meet District representatives at the site on Feb 22, 2013 at 2:00pm local time for an optional site viewing. All tenderers will be responsible for recording their presence at the site viewing by signing an attendance sheet provided by the Regional District of North Okanagan..4 Tenders will be opened publicly in the Board Room of the Regional District of North Okanagan s office, immediately after the closing hour of this Tender, at which time interested parties may be present if so desired. Contract will be awarded at the owner s discretion within 2 weeks of tender closing..5 Amendments to a submitted offer will be permitted if received in writing prior to Tender closing and if endorsed by the same party or parties who signed and sealed the offer..6 The work for this project can start as soon as possible (to be coordinated with site). 1.2 INTENT.1 The intent of this Tender call is to obtain offers under seal to perform work and services required to replace the existing boiler for the Vernon Recreation Centre. 1.3 CONTRACT DOCUMENTS IDENTIFICATION.1 The Contract Documents are identified as CCDC 2 Stipulated Price Contract, prepared by YONEDA and ASSOCIATES located at 1742 Springfield Road, Kelowna, B.C. 2.1 DEFINITIONS.1 Contract Documents: Defined in CCDC 2, Definitions with General Conditions and Supplementary General Conditions..2 Tender Documents: Contract Documents supplemented with Instructions to Bidders, Tender Form, Tender Securities and Tender Supplementary Forms identified herein..3 Tender: Act of submitting an offer under seal. 2.2 AVAILABILITY.1 Tender Documents may be obtained at the office of the Engineer and will be made available via PDF.

3 Vernon Recreation Centre INSTRUCTIONS TO SECTION Boiler Replacement BIDDERS Page 2 of AVAILABILITY (cont d).2 One set of hard copy Tender Documents can be obtained by Mechanical Contract bidders upon receipt of a refundable deposit by cheque in the amount of $ per set..3 Deposit will be refunded if Tender Documents are returned complete, undamaged, unmarked and reusable within 7 days of Tender submission. Failure to comply will result in forfeiture of deposit..4 Tender Documents are made available only for the purpose of obtaining offers for this project. Their issue does not confer a license or grant for other purposes. 2.3 EXAMINATION.1 Tender Documents may be viewed at the office of the Engineer or provided via (PDF)..2 Upon receipt of Tender Documents verify documents are complete; notify Engineer should documents be incomplete..3 Immediately notify the Engineer upon finding discrepancies or omissions in the Tender Documents. 2.4 QUERIES/ADDENDA.1 Direct questions to Yoneda and Associates, telephone number (250) , FAX number (250) Addenda may be issued during the Tender period. All addenda become part of the Contract Documents. Include costs in the Tender Price..3 Verbal answers are only binding when confirmed by written addenda..4 Clarifications requested by bidders must be in writing not less than seven days before date set for receipt of bids. The reply will be made in the form of an addendum, a copy of which will be forwarded to known plan holders. 2.5 PRODUCT/SYSTEM OPTIONS.1 Where the Tender Documents stipulate a particular product, alternates may be considered by the Engineer up to three days before receipt of Tenders..2 When a request to substitute a product is made, the Engineer may approve the substitution as an alternate. If an item is approved as an alternate, bidder may use that item in place of the specified item..3 In submission of alternates to products specified, bidders shall include in their bid, any changes required in the work to accommodate such alternates. A later claim by the bidder for an addition to the Contract Price because of changes in work necessitated by use of alternates shall not be considered.

4 Vernon Recreation Centre INSTRUCTIONS TO SECTION Boiler Replacement BIDDERS Page 3 of PRODUCT/SYSTEM OPTIONS (cont'd).4 The Engineer shall be sole arbitrator when considering alternates and his decision shall be binding. No substitutions will be allowed or considered after tender closing dates unless specifically requested by the Engineer or Owner..5 Delivery dates are not an acceptable reason for substitution of products or systems unless approved by the Engineer prior to tender closing. Delivery dates must meet the requirements of the contract time and thus the Contractor and his trades shall be responsible for ensuring adequate lead time. Proof of delivery schedules may be requested by the Engineer at his discretion. 3.1 SITE EXAMINATION.1 Visit the project site and surrounding properties before submitting a bid. 4.1 SUB-CONTRACTORS.1 The Owner reserves the right to reject a proposed sub-contractor for reasonable cause..2 Refer to GL10 General Conditions. 5.1 TENDER INELIGIBILITY.1 Tenders that are unsigned, improperly signed or sealed, conditional, illegible, obscure, contain arithmetical errors, erasures, alterations or irregularities of any kind may be considered unacceptable..2 Tender Forms and enclosure which are improperly prepared may be declared unacceptable..3 Failure to provide security deposit, bonding or insurance requirements may result in the tender being declared unacceptable. 5.2 SUBMISSIONS.1 Bidders shall be solely responsible for the delivery of their Tenders in the manner and time prescribed..2 Submit one copy of the executed Tender on the forms provided, signed and corporate sealed in a closed opaque envelope, clearly identified with bidder's name, project name and Owner's name on the outside..3 Provide Letter of Surety and Bid Bond or other security clearly identified below..4 Improperly completed Surety Information or irregularities will be cause to declare Tender invalid or unacceptable.

5 Vernon Recreation Centre INSTRUCTIONS TO SECTION Boiler Replacement BIDDERS Page 4 of SECURITY DEPOSIT.1 Tender shall be accompanied by a security deposit as follows: Bid Bond or certified cheque in the amount of 10% of Bid Price..2 Endorse the bid bond or certified cheque in the name of the Owner as obligee, signed and sealed by the principal Contractor and surety..3 The security deposit will be returned after delivery to the Owner of required Performance and Labour and Material Payment Bond by the accepted Bidder or letter of irrevocable credit from approved financial institution..4 If no contract is awarded, all security deposits will be returned. 6.2 CONSENT OF SURETY.1 Submit with the Tender of Bid Bond, a "Consent of Surety" stating that the Surety providing the Bid Bond is willing to supply the Performance and Labour and Material Payment Bond required. Submit similar letter from financial institution if certified cheque used, stating letter of credit and amount forthcoming..2 Include the cost of bonds and/or securities in the Tender Price. 6.3 PERFORMANCE ASSURANCE.1 The accepted bidder shall provide a Performance Bond and a Labour and Materials Payment Bond in the amount of 50% of the contract value or irrevocable letter of credit for 50% of contract value..2 Include the costs in the Tender price. 6.4 INSURANCE.1 Refer to Supplementary General Conditions of the Contract. 6.5 TENDER FORM REQUIREMENTS.1 State in the Tender form the time required to complete the work. The completion date in the Agreement shall be this completion time added to the commencement date. 6.6 FEES FOR CHANGES IN THE WORK.1 Include in the Tender Form the overhead and profit fees applicable for changes in the work, whether additions to or deductions from the work on which the Tender Price is based..2 Include in the Tender Form, the fees proposed for sub-contract work for changes (both additions and deductions) in the work. The contractor shall apply fees as noted, to the sub-contractor's gross costs on additional work.

Insert the words "Sole Proprietor" under signature. Affix seal..3 Partnership: Signature of all partners in the presence of a witness who will also sign. Insert the word "Partner" against each signature. Affix seal against each signature..4 Limited Company: Signature of all duly authorized signing officers in their normal signatures. Insert the officer's capacity in which the signing officer acts against each signature. Affix the Corporate seal. If the tender is signed by officials other than the President and Secretary of the company or the President-Secretary Treasurer of the company, a copy of the by-law resolution of the Board of Directors authorizing them to do so must also be submitted with the tender in the tender envelope..5 If the bidder is a joint venture, each party to the joint venture shall execute the Tender under seal in the manner appropriate to such party. 6.8 APPENDICES TO TENDER FORM.1 Appendix 'A' - Contract Documents: Complete listing as scheduled..2 Appendix 'B' - Sub-Contractors: Include the names of all Sub-Contractors and the portion of the work the bidder will require them to perform..3 Appendix 'C' - Separate Prices: Including a listing of separate prices as specifically requested in the specification..4 Appendix 'D' - Unit Prices: Include a listing of unit prices as specifically requested in the specification. 7.1 DURATION OF OFFER.1 Tenders shall remain open to acceptance and shall be irrevocable for a period of thirty (30) days after the bid closing date. 7.2 ACCEPTANCE OF OFFER.1 Bidders are notified that the lowest or any Tender need not necessarily be accepted and the Owner reserves the right to reject any and all bids without further explanation..2 The basis for acceptance shall be a combination of the base bid price, separate price and/or unit prices used in combination or singularly at the Owner's discretion..3 After acceptance, the Owner will issue to the successful bidder a written Tender Acceptance..4 After a Tender has been accepted, all rejected Tenders will be returned to the respective bidders with submitted tender securities and other requested enclosures.

13 Vernon Recreation Centre SUPPLEMENTARY CONDITIONS SECTION Boiler Replacement Page 1 of 5 PART 1 GENERAL 1.1 FAIR WAGE CLAUSE.1 Workmen, artisans, mechanics, labourers, etc., employed shall be entitled to such wages and remuneration as are usually acceptable by the region for competent workmen in each trade, and whereby all Contractors and all Sub-Contractors shall be bound to pay such wages. Should a dispute arise, the Ministry of Labour shall be the sole arbitrator. 1.2 TAXES.1 Pay all taxes properly levied by law, including Federal, Provincial and Municipal. Changes in such taxes shall be an increase or decrease of the contract sum, accordingly. 1.3 FEDERAL SALES TAX REBATE.1 Section 47A of the Excise Tax Act provides that where materials have been purchased by or on the behalf of the school, or similar institution for use exclusively in the construction of a building for that institution and the tax imposed by Part VI has been paid in respect of those materials, the Minister may, upon application of such institution pay to such institution an amount equal to the tax..2 It is the intention of the Owner to claim for the tax paid by the formula method. 1.4 COURSE OF CONSTRUCTION INSURANCE.1 GC19 INDEMNIFICATION, replace entirely with the following: GC19.1 GC19.2 The Contractor will indemnify and save harmless the Owner, its employees and agents, from and against any and all losses, claims, damages, actions, causes of action, costs and expenses that the Owner may sustain, incur, suffer or be put to at any time either before or after the expiration or termination of this Contract, where the same or any of them are based upon, arise out of or occur, directly or indirectly, by reason of any act or omission of the Contractor or of any agent, employee, officer, director or Subcontractor of the Contractor pursuant to this Contract, excepting always liability arising out of the independent negligent acts of the Owner. Notwithstanding GC 1 - DOCUMENTS, paragraph 1.6, in the event of conflict between the provisions of this General Condition and Article A-5 RIGHTS AND REMEDIES paragraph (a) or GC 22 - DAMAGES AND MUTUAL RESPONSIBILITY, the provision of this General Condition shall govern..2 GC20 INSURANCE, replace entirely with the following: GC20.1 Without restricting the generality of GC19 INDEMNIFICATION, insurance coverages will be arranged and paid for as undernoted:

(2) The insurance shall cover the Contractor, Owner, and Engineer and shall also cover all Sub-Contractors and anyone employed directly or indirectly by the Contractor or his Sub-Contractors to perform a part or parts of the Work but excluding suppliers whose only function is to supply and/or transport products to the job site. The insurance does not extend to any activities other than those directly related to the Work of this Contract. (3) The insurance shall also include architectural and engineering consultants of the Owners. (4) The insurance shall preclude subrogation claims by the Insurer against anyone insured thereunder. (5) The insurance shall include coverage for:.01 Premises and Operations Liability.02 Products or Completed Operations Liability.03 Blanket Contractual Liability.04 Cross Liability.05 Elevator and Hoist Liability.06 Contingent Employer's Liability.07 Personal Injury Liability arising out of False Arrest, Detention, or Imprisonment, or Malicious Prosecution, Libel, Slander or Defamation of Character; Invasion of Privacy, Wrongful Eviction or Wrongful Entry..08 Shoring, Blasting, Excavating, Underpinning, Demolition, Pile Driving and Caisson Work, Work Below Ground Surface, Tunnelling and Grading as Applicable..09 Liability with Respect to Non-Owned Licensed Vehicles..10 Broad Form Property (6) Any property damage deductible applicable shall not exceed $1,000. The Mechanical Contractor is to pay all deductible amounts for any occurrence. (7) This insurance shall be maintained continuously from commencement of the Work until the certificate of Total Performance of Work is issued, plus with respect to completed operations, cover a further period of 24 months from the date of Total Performance.

15 Vernon Recreation Centre SUPPLEMENTARY CONDITIONS SECTION Boiler Replacement Page 3 of COURSE OF CONSTRUCTION INSURANCE (cont'd).2 GC20 INSURANCE (cont'd) (b) Automobile Liability Insurance (1) The Contractor shall provide, maintain, and pay for, and require all Subcontractors and trades concerned to provide, maintain and pay for, Automobile Liability Insurance in respect of owned licensed vehicles, subject to limits of not less than one million dollars inclusive per occurrence for bodily injury, death, damage to property under either a Standard Owners Form Automobile Policy or similar Autoplan Owners certificate providing Third Party Liability and Accident Benefits Insurance. (c) Aircraft and Watercraft Liability Insurance (1) The Contractor shall provide, maintain and pay for liability insurance with respect to owned or non-owned aircraft and watercraft if used directly or indirectly in the performance of Work, including use of additional premises, subject to limits of not less than one million dollars inclusive per occurrence for bodily injury, death, and damage to property including loss of use thereof and limits of not less than one million dollars for Aircraft Passenger Hazard. Such insurance shall be in the joint names of the Contractor, the Owner, the Engineer and those parties defined in GC (.2 &.3) where they have an interest in the use or operation of such aircraft or watercraft. (2) The insurance shall preclude subrogation claims by the Insurer against anyone insured thereunder. (d) Property Insurance (1) The Owner shall provide, maintain and pay for standard course of construction insurance, subject to the normal exclusions of such a policy, against "All Risks" of physical loss or damage occurring and will cover all materials, property, structures and equipment purchased for, entering into, or forming part of the Work while located anywhere within the continental U.S.A. or Canada, including while in transit or storage on or over land, or inland waters, or coastal waters, at the site of the Work and during construction, erection, installation and testing until handed over and finally accepted by the Central Okanagan Regional District, but such insurance shall not include coverage for Contractor's equipment of any description. There will be a deductible of $2,500. for each and every occurrence, except for the perils of flood which shall have a deductible of $10,000 and earthquake which shall have a 3% (subject to minimum $50,000).

16 Vernon Recreation Centre SUPPLEMENTARY CONDITIONS SECTION Boiler Replacement Page 4 of COURSE OF CONSTRUCTION INSURANCE (cont'd).2 GC20 INSURANCE (cont'd) (2) The insurance shall include as an Insured, each Contractor or Sub-contractor or Engineer who is engaged under the contract from the commencement or work until the Work is either completed to the satisfaction of the Owner or the Owner agrees that the Contractor or Subcontractor shall abandon the work. (3) The insurance will contain a waiver of the insurer's rights of subrogation against all insurers except where a loss is deemed to have been caused by or resulting from any error in design or any other professional error or omission. (4) The Contractor shall, at his own expense, take special precaution to prevent fires occurring in or about the works and shall observe, and comply with, all laws and regulations in force respecting fires. (5) The Owner shall not be responsible for injury to the contractor's employees or for loss of damage to the Contractor's or to the Contractor's employees' machinery, equipment, tools or supplies which may be temporarily used or stored in, on or about the premises during construction and which may from time to time, or at the termination of the contract, be removed from the premises. The Contractor hereby waives all rights of recourse against the Owner or any Other Contractor which regard to damage to the Contractor's property..3 GC20.2 Unless specified otherwise, the duration of each insurance policy shall be from the date of commencement of the Work until the date of the Certificate of Total Performance of the Work..4 GC20.3 The Owner shall provide the Contractor with proof of insurance for those liability insurances required to be provided by the owner prior to commencement of the Work and shall promptly provide the Contractor with either a certified true copy of each such Insurance policy, or a Certificate of Insurance..5 GC20.4 The Contractor and/or his Sub-Contractors as may be applicable shall be responsible for any deductible amounts under the policies and for the purchase of such additional insurance, if any, as they may wish to effect in their own interests..6 GC20.5 The Contractor shall provide, maintain and pay for any additional insurance which he is required to provide by law or which he considers necessary to cover risks not otherwise covered by insurance specified in this section.

17 Vernon Recreation Centre SUPPLEMENTARY CONDITIONS SECTION Boiler Replacement Page 5 of COURSE OF CONSTRUCTION INSURANCE (cont'd).7 GC20.6 Insurance purchased by the Owner is described herein in a general way only. The Owner does not accept responsibility for the accuracy of the descriptions, and does not represent or warrant that any policy contains insurance for any particular coverage or extent of coverage. It is the Contractor's responsibility to ascertain the exact nature and extent of coverage of the policies..8 GC20.7 The Owner will take reasonable steps to ensure the coverages purchases by the Owner are continuous for the duration of this Contract but the Owner does not accept responsibility for providing coverage in the event the insurance is cancelled or reduced by the insurer..9 GC20.8 The Contractor shall, upon request, provide the Owner with proof of insurance for those insurances required to be provided by the Contractor prior to the commencement of the Work.

18 Vernon Recreation Centre SUMMARY OF WORK SECTION Boiler Replacement Page 1 of DESCRIPTION OF WORK.1 CONTRACTORS RESPONSIBILITY.1 Supply all labour, equipment, and material necessary to install a complete and operational system described and shown on mechanical drawings M-1 thru M-2..2 Owner Responsibility: removal of any required HVAC equipment and ductwork in crawlspace area, decommissioning of hydronic loop serving north wing of building. Note: Provide hoarding and suitable protective barriers to the approval of Regional District of North Okanagan. Take every precaution to prevent accidental harm to public and coordinate all activities with Regional District of North Okanagan. The Owner, Regional District of North Okanagan, will appoint a representative to coordinate where necessary any and all activities which may interfere with the normal operation of the building. Schedule all activities and coordinate with the Owner and in particular work which requires interruption of services, etc. to the existing building. Schedule all work to proceed during normal hours and coordinate any work required to proceed outside of normal building hours.

19 Vernon Recreation Centre SPECIAL PROJECT PROCEDURES SECTION Boiler Replacement Page 1 of SPECIAL PROJECT PROCEDURES.1 STANDARD SPECIFICATIONS AND CODES Conform to or exceed the minimum applicable standards of the Canadian Government Specifications Board (CGSB), the Canadian Standards Association (CSA) and the British Columbia Building Code..2 NUMBERING OF SPECIFICATION SECTIONS The numbering of sections in this specification corresponds to the numbering and indexing of the Uniform Construction Index (1983)..3 SPECIFICATIONS Simple verbs imply the legal "shall". Unless specifically noted, all items mean supply and installation. The Engineer will not arbitrate to establish limits to contracts between contractor and sub-contractor. Each Sub-Contractor shall afford all other Sub-Contractors every reasonable opportunity for installation of their work and for storage of their materials. 1.2 SUB-CONTRACTS.1 The Mechanical Contractor shall hold full responsibility for all trades, shall supervise each Sub-Contractor, hold each Sub-Contractor to do all work required by the drawings and specifications when required by other trades, and give every facility for completion on schedule of the work of the several trades..2 The Mechanical Contractor shall in the case of his Sub-Contractors be held responsible for and shall see that said Sub-Contractors obtain and pay for all necessary permits, licenses and certificates of inspection in connection with the work as may be required by local or provincial regulations, and those requirements of the Owner.

21 Vernon Recreation Centre REGULATORY REQUIREMENTS SECTION Boiler Replacement Page 1 of 1 PART 1 - REGULATORY REQUIREMENTS 1.1 SITE EXAMINATION.1 The Contractor shall visit and examine the site and become familiar with the conditions under which the contract will be executed. 1.2 SETTING OUT OF WORK.2 Set out the work with the information given on the drawings and furnished by the Engineer, and during the progress of the work, amend at additional cost all errors arising from inaccurate setting out. 1.3 REMOVED MATERIAL.1 Unless otherwise stated, materials indicated for removal become the property of the Contractor and shall be removed from the site. 1.4 CUTTING, PATCHING AND MAKING GOOD.1 Mechanical Contractor shall be responsible for all cutting, fitting or patching of work as required to fit the work to receive or be received by work of other trades, as shown upon the contract documents or reasonably implied. Make good as the Engineer directs. Hire trades skilled in such work. 1.5 MISCELLANEOUS METAL INSTALLATION.1 The Mechanical Contractor shall install all items of miscellaneous metal not specified to be installed by others.

22 Vernon Recreation Centre QUALITY CONTROL SECTION Boiler Replacement Page 1 of INSPECTION.1 The Owner and the Engineer shall have access to the Work. If parts of the Work are in preparation at locations other than the Place of the Work, access shall be given to such work whenever it is desired..2 Give timely notice requesting inspection if Work is designated for special tests, inspections or approvals by Engineer, instructions, or the law of the Place of the Work..3 If the Contractor covers or permits to be covered Work that has been designated for special tests, inspections or approvals before such is made, uncover such Work, have the inspections or tests satisfactorily complete and make good such Work..4 The Engineer may order any part of the Work to be examined if such work is suspected to be not in accordance with the Contract Documents. If, upon examination such work is found not in accordance with the Contract Documents, the Contractor in whose section the work occurs shall correct such work and pay the cost of examination and replacement. 1.2 REJECTED WORK.1 Remove defective Work, whether the result of poor workmanship, use of defective products or damage and whether incorporated in the Work or not, which has been rejected by the Engineer as failing to conform to the Contract Documents. Replace or re-execute in accordance with the Contract Documents..2 Make good other Contractor's work damaged by such removals or replacements promptly..3 If in the opinion of the Engineer it is not expedient to correct defective Work or Work not performed in accordance with the Contract Documents, the Owner may deduct from the Contract Price the difference in value between the Work performed and that called for by the Contract Documents, the amount of which shall be determined by the Engineer. 1.3 INSPECTION NOTICES.1 The Contractor shall give at least 24 hours notice for inspection in the following schedule. The failure to give such prescribed notices will render the Contractor liable to remove or uncover work as may be necessary to permit inspection, at the Contractor's cost. The Contractor shall bear the costs of any special tests which the Engineer may require to satisfy himself of the adequacy of the work necessary because of failure of the Contractor to give the prescribed notices..2 SCHEDULE.1 Mechanical rough-in (uncovered).2 Substantial Completion

ACCESS TO SITE Provide and maintain access roads, sidewalk crossing, ramps and construction runways as may be required for access to the work. 8. UTILITIES 1. Temporary Hot and Cold Water provide temporary connections as required to minimize down time of services. Coordinate service descriptors with Central Okanagan Regional District. 9. PROTECTION 1. PROTECTION FOR OFF-SITE AND PUBLIC PROPERTY 1. Protect surrounding private and public property from damage during performance of work. 2. Be responsible for damage incurred. 2. FIRE PROTECTION 1. Provide and maintain temporary fire protection equipment during performance of work required by insurance companies having jurisdiction and governing codes, regulations and by laws. 3. CGSB - Canadian General Standards Board. CPCA - Canadian Painting Contractor's Association. MSMCRCA - Canadian Roofing Contractor's Association CSA - Canadian Standards Association. BCBC - B.C. Building Code. (British Columbia) NEMA - National Electrical Manufacturers' Association. ULC - Underwriters' Laboratories of Canada. CMHC - Central Mortgage and Housing Corporation. Conform to these standards, in whole or in part, as specifically required in the specifications. Standards listed elsewhere than on the above noted list shall be included as a reference standard. In the case of dissimilarities between reference standards on a particular subject, the most stringent standard shall apply. 3. STORAGE, HANDLING AND PROTECTION 1. Handle and store Products in a manner to prevent damage, alteration, deterioration and soiling and in accordance with manufacturer's instructions when applicable. 2. Store packaged or bundled Products in original and undamaged condition with manufactured's seals and labels intact. Do not remove from packaging or bundling until required in the work. 3. Store products subject to damage from weather in weatherproof enclosures. 4. Remove and replace damaged Products at own expense and to the satisfaction of the Engineer. 4. TRANSPORTATION 1. Pay costs of transportation of Products required in the performance of work.

Transportation cost of Products supplied by the Owner will be paid for by the Owner. The Contractor in whose section the material is used shall unload, handle and store such Products. 5. WORKMANSHIP 1. Workmanship shall be the best quality, executed by workers experienced and skilled in the respective duties for which they are employed. Immediately notify the Engineer if required work is such as to make it impractical to produce required results. 2. Do not employ any unfit person or anyone unskilled in their required duties. The Engineer reserves the right to require the dismissal from the site of workers deemed incompetent, careless, insubordinate or otherwise objectionable. 3. Decisions as to the quality or fitness of workmanship in cases of dispute rest solely with the Engineer whose decision is final. 6. COORDINATION 1. Ensure co-operation of workers in laying out work. Maintain efficient and continuous supervision. 2. Be responsible for co-ordination and placement of openings, sleeves and accessories. 7. LOCATION OF FIXTURES 1. Consider the location of mechanical and electrical items indicated as approximate. 2. Inform the Engineer of a conflicting installation. Install as directed. 8. PROTECTION OF WORK IN PROGRESS 1. Adequately protect work completed or in progress. Work damaged or defaced due to failure in providing such protection is to be removed and replaced, or repaired, as directed by the Engineer, at no increase in Contract Price. 2. Prevent overloading of any part of the building. Do not cut, drill or sleeve any load bearing structural member, (unless specifically indicated) without written approval of Engineer. 9. EXISTING UTILITIES 1. When breaking into or connecting to existing services or utilities, execute work at times directed by local governing authorities, with a minimum of disturbance to work, and/or building occupants and pedestrian and vehicular traffic.
