1 REQUEST FOR PROPOSALS FOR BID TOWN OF MIDDLESEX, VERMONT TROPICAL STROM IRENE FEDERAL BUYOUT DEMOLITIONS Contact: Sarah Merriman Town Clerk/Select Board Assistant Town of Middlesex 5 Church Street Middlesex, Vermont (802) Issuance: Thursday, August 22, 2013 Response Deadline: 4:30 pm, Thursday, September 19, 2013 Pre-bid site visit: After September 4, 2013, by appointment Project Purpose The Town of Middlesex, Vermont, is soliciting lump sum bids for the demolition and removal of the following properties: 191 Three Mile Bridge Road 195 Three Mile Bridge Road Demolition will include removal of contents and items on each property, and, if necessary, lead/asbestos abatement. In addition, the sites must be return to grade, with leveling, final pumping and removal of septic tanks, as well as site and river bank stabilization along with other work. Required Professional Services Contractor Services are to be provided by an insured contractor in good-standing with the State of Vermont, holding any required certifications for the proposed work to be completed. A license or certification is required for the following professional services in Vermont: asbestos abatement, lead abatement, electrical, plumbing, and some aspects of septic system, water supply, and survey work. Services will be procured by competitive bid, and must be consistent with and is subject to the regulations in 24 CFR as it pertains to procurement services. All contractors who wish to bid on the advertised project must meet all the minimum qualifications established by the Middlesex Select Board to be deemed eligible for their competitive bid to be considered. 1

2 Bidding Qualifications All contractors who wish to respond to the Request for Bids must demonstrate the following qualifications to be considered eligible: a) Provide proof of license or certification for any work to be provided, as required. b) Provide proof of insurance to include Commercial General Liability and Workmen s Compensation. c) Provide documentation of technical capability, education, or expertise with regards to the skills and knowledge required to perform residential demolition projects. Work must be completed in accordance with permitting requirements, OSHA standards, and all material must be disposed of properly. d) Provide contact information for three recent and unduplicated clients for similar projects, which need to include name, contact person, date of work, address and phone number. e) Provide a sworn statement regarding public entity crimes. f) Provide staff, availability information, and indicate the ability to complete the proposed demolition by a designated, written completion date approved by the Town of Middlesex before work commences. Project Specifications This project consists of demolition of 191 and 195 Three Mile Bridge Road, Middlesex, Vermont. A Project Specifications Package is on file at the Middlesex Town Clerk s Office at 5 Church Street, Middlesex, Vermont that may be inspected from 8:30 to 4:30 p.m., Monday through Thursday. The package contains the following: several photographs of both mobile homes to be demolished and removed, a copy of the tax map with 191 and 195 Three Mile Bridge Road circled, copies of the appraiser s reports and a legal description of the properties. An asbestos survey will be available at a later date. Instructions to Contractors Contractors will provide their competitive bid to demolish and/or remove all improvements, abandon septic systems, abandon water wells, remove and dispose of hazardous materials, and return the project site to the smooth graded, stabilized condition that is in accordance with all applicable federal, state, and local statutes, 2

3 policies, plans, and regulations. All aspects of site preparation, demolition, site work, and disposal of materials must be conducted in compliance with federal, state and local statute, rules and regulations. Requirements for obtaining permits and all costs associated with permitting and potential asbestos abatement must be included with the bid form. Any consideration of salvage must be reflected in the final bid. Contractual Responsibilities The selected contractor will work for Middlesex s Select Board and will be responsible to both the Town and the State of Vermont for satisfactory completion of the project. Final payment for services rendered in accordance with the contract will be made following successful completion of the final inspection of the property by the State Hazard Mitigation Officer and/or Vermont Division of Emergency Management & Homeland Security (DEMHS). Instructions to Contractors The two abutting properties referenced above comprise the total number of properties to be demolished. The bid is to provide a cost for both properties, provided on the attached Bid Form. The final bid is the Net Dollar Amount for both properties. Salvaging portions of buildings, selected materials, or entire structures is the choice of the contractor. Any salvage considered must be identified and given a value specified on the Bid Form as a negative number. The actual resale value of the salvage is not pertinent, but the allocation of Salvage Value will affect the final Net Dollar Amount will indicate a payment to the community by the Contractor. Project Description The Town invites qualified demolition contractors to provide a lump sum bid to demolish both of the mobile homes identified with a total bid amount. These properties are currently under private ownership, but are on track to be purchased by the Town of Middlesex with a scheduled closing date of September 4, The successful bidder shall furnish all labor, equipment, materials, services, insurance, notifications, permits, licenses/certificates, clean fill, etc. for the proper removal of the structure(s) and filling of the foundation hole. The contractor will coordinate the pertinent power company to terminate all abandoned utilities at least two (2) feet below the finish grade of the site. The contractor will properly abandon all wells, including capping, and remove associated components. 3

4 The demolition contractor will be responsible for pumping and removal of septic tanks. (If not removed, the tanks must be pumped and either crushed in place or filled with clean fill to prevent a void space hazard). The demolition contractor will remove all contents and disposal of fuel tanks. The contractor will also remove all structure, foundation and basement walls to at least one (1) foot below the finish grade of the site. Care should be taken to remove only those trees that restrict the demolition work and to preserve and protect the integrity of the river bank whenever possible. Bank stabilization shall include excavating material from the site to produce a more stable bank. Finally, the contractor will grade, level and stabilize the demolition site. General Conditions The conditions of this contract and general requirements of this document apply to this contractor, all subcontractors, materials and suppliers and other persons furnishing labor and materials under this bid. The bidder is to acknowledge the following: 1. All permits are to be obtained by the contractor and must be posted appropriately. These may include: Stream Alteration Permits, permits required by the Army Corps of Engineers, and any other permits required by the Local, State, and/or Federal governments. 2. The contractor is responsible for adhering to requirements set forth by the Vermont Department of Health with regard to asbestos and lead abatement. An asbestos assessment by KAS, Inc. of Williston, Vermont, will be provided to the contractor upon completion of the asbestos survey sometime after September 4, Removal of demolition debris and household hazardous waste to an approved landfill (this includes debris from the demolition of houses, garages, driveways, sidewalks, and above grade concrete slabs). 4. Abatement of asbestos and/or lead-based paint, if necessary. 5. The work required under this contract includes all tools, labor, materials, equipment and fees necessary to complete the scope of the work herein. 6. The contractor will be responsible for arranging for staging of all materials, supplies, equipment and vehicles needed for the work. 4

5 7. The contractor shall erect and maintain effective protective barriers (including but not limited to barricades, fencing, etc.) to protect neighbors and the general public. 8. The contractor shall be responsible for contacting DIGSAFE as appropriate. 9. All structures must be completely removed from the property, including all site improvements such as driveways, walk-ways, accessory structures, and other such improvements. 10. The Contractor is responsible for proper and legal disposal of all materials removed from the property. Burying and burning of any materials is not allowed. Copies of manifests for all materials disposed of must be provided. 11. Septic tanks must be pumped, and filled in place with clean fill, crushed in place, or removed and properly disposed of in accordance with the most recent adoption of Chapter 1 of the Vermont Environmental Protection Rules: Wastewater System and Potable Water Supply Rules. Municipal connections must be capped below the ground surface. Proof of a final inspection must be provided with the Contractor s invoice. 12. Water wells must be properly abandoned in accordance with the most recent adoption of Chapter 21 of the Vermont Environmental Protection Rules: Water Supply Rule. Municipal connections must be capped below the ground surface. Proof of Final Inspection must be provided with the Contractor s invoice. 13. Removal underground petroleum tanks must be properly disposed of in accordance with the guidelines set forth by the Waste Management Division of the Vermont Department of Environmental Conservation. A list of contractors that specialize in this work as well as environmental contractors may be requested from the Waste Management Division. Above ground petroleum tank removal and proper disposal guidance may also be obtained from this office. If contamination is found on the property, or if during work a spill occurs, stop work and contact to make a report and obtain guidance on the next steps to take regarding cleanup. Please alert the State Hazard Mitigation Officer as this may result in a change to the scope of work, timeline, and ensuring adequate funding is available. 14. If demolition results in excavation, holes, or unusual contours, then finish grading and/or fill may be required to return the site to a natural state, including vegetation. Bank Stabilization, applying geotextile, seeding, vegetation the graded site is included. 15. Work shall be compliant with the State Hazard Mitigation Officer either directly or through the DEMHS mitigation staff and the Vermont Department of Health. 5

6 16. All work on the project as a whole must be completed within ninety (90) days of the Notice to Proceed. If additional time is required for any reason, including weather delays and delays caused by the community, the State, or FEMA, the Contractor must provide a written request for extension, which then must be approved by the community. Subcontractors In the event the contractor wishes to use sub-contractors on this project, the contractor shall so state in his bid document. Sub-contractors are subject to the approval of the State and/or Town. Accordingly, the contractor shall not contract with a proposed person or entity to which the Town disapproves. The contractor shall retain and coordinate any and all subcontractors as needed to perform the project. All costs associated with any subcontractors and the completion of the work described herein shall be included in the contractor s lump sum price. Payment Payment will be made to the contractor in the following manner: Payment #1: Upon 30.0% completion of the project, 30% will be paid. Payment #2: Upon 60.0% completion of the project. Another 30% will be paid. Payment #3: Upon completion of the project (completion is defined as all punch list items being complete including grading, seeding, mulching, bank stabilization and clean-up of the site). Another 30% will be paid. Payment #4: Upon approval of the final inspection by the Division of Emergency Management and Homeland Security (DEMHS) mitigation staff, the town will pay the demolition contractor for the work completed in accordance with the subgrant agreement and contract, and pay the final 10%. Insurance Demonstration that the contractor and subcontractors have or can obtain the following insurance coverage: Commercial General Liability Insurance: Includes but not limited to Bodily Injury, Personal/Advertising Injury, Broad Form Property Damage, Products and Completed Operation Liability and Contractual Liability within the limits of, at 6

7 minimal, $1,000,000 Combined Single Limit for each occurrence. The Consultant must list the Town as an Additional Insured on its Commercial General Liability Policy. Workers Compensation & Employers Liability: Within limits of, at minimal, $500,000 for any one occurrence. Coverage shall be maintained without interruption from date of commencement of the work until the date of final payment. Certificates of Insurance acceptable to the Town shall be filed with the Town prior to execution of the contract between the Town and contractor. Indemnification The contractor will indemnify and hold harmless the Town of Middlesex, its agents and employees from and against all claims, damages, losses and expenses. This indemnification shall include attorney s fees arising out of, or resulting from the performance of the work, and is caused to whole, or in part, by any negligent or willful act or omission of the contractor, subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. In any and all claims against the Town of Middlesex or any of its agents or employees, by any employee of the contractor, any subcontractor, anyone directly or indirectly employed by any of them, or anyone for whose acts any of them may be liable, the indemnification obligation shall not be limited in any way by any limitation of the amount or type of damages, compensation or benefits payable by or for the contractor or any subcontractor under workmen s compensation acts, disability benefit act or other employee benefit acts. The obligation of the contractor under this paragraph shall not extend to the liability of the Town of Middlesex, its agents or employees arising out of preparation or approval of drawings, opinions, reports, surveys, change orders, designs, or specifications. Suspension by the owner for convenience The Town may, without cause, order the contractor in writing to suspend, delay or interrupt the work in whole or in part for such period of time as the Town may determine. Only adjustments for lost days shall be made. Information for Bidders Pre-bid site visits may be arranged after September 4, 2013, by calling the Middlesex Town Clerk at (802) Bids shall be provided on company letterhead and signed by an Authorized Agent of the demolition contractor. Bids shall be in the form of a written bid that includes a 7

8 description of work to be performed, a description of the finished work, a schedule and budget for the service rendered. In addition, the contractor shall provide three client references for similar demolition work. In addition the bid shall include a list of any subcontractors that will be utilized and verification of insurance with specific coverages described earlier. ONE lump sum amount shall be provided for demolition for both properties as follows: 191 and 195 Three Mile Bridge Road. Lump Sum $ The Bid Award shall be made to the responsive and responsible bidder or bidders providing the lowest and best bid amount per determination of the Middlesex Select Board. As the Grant Awards for this project serve as the funding basis and are not adjustable, the lump sum contract cost cannot be modified by a change order. Bids will be received by the Town no later than 4:30 pm, Thursday, September 19, Bids shall be delivered in a sealed envelope to: Sarah Merriman, Middlesex Town Clerk and Select Board Assistant, 5 Church Street, Middlesex, Vermont, In the alternative, bids may be ed to Sarah Merriman at middlesxtwnclrk@comcast.net. The subject line shall have BID FOR DEMOLITION in it. Bids received after the deadline will not be accepted. Bids shall be effective and valid for 180 days after date and time set for receipt of bids. The Town of Middlesex may waive any informalities or minor defects and/or reject any and all bids. Any bid may be withdrawn prior to September 19, By submitting a bid, the bidder acknowledges the following: 1. The conditions affecting the work, including but not limited to physical conditions of the site which may bear upon site access, handling and storage of tools and materials, access to water, electrical service or other utilities, or which may otherwise affect performance of required activities; 2. The character and quantity of all surface and subsurface materials or obstacles to be encountered in so far as this information is reasonably ascertainable from an inspection of the site, including exploratory work done by the Owner or Owner s Representative; 8
