PHOTO CONTEST PROMOTION ( Contest ) Terms and Conditions The promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. 2. Who May Enter The Promoter is conducting a We Love Our Hogan Home photo contest promotion ( Contest ) amongst Coastal Bend residents who own and currently live in a Hogan home ( Contestant ). Entry is only open to Contestants who: Are currently living in a Hogan home that they own Submit a photo reflecting her/his family enjoying their favorite part of the home to under the We Love Our Hogan Home contest tab Complete the Contest entry form with valid contact details Are over 18 years old Multiple entries are not possible. The Contest is not open to: employees of the Promoter; parties to whom the Promoter has contracted work in relation to the Contest; parties who are otherwise directly involved with this Contest; or any immediate family member of the above mentioned parties. 3. Contest Period Contest entry opens at 8.00 AM on Friday 1st April 2016 until Friday 13th May 2016 at 5.00PM Central Daylight Time (CDT).

2 4. Cost There is no cost or fee to enter the Contest. 5. How to Enter During the Contest Period (Weeks 1-4), Contestants must submit a photo that best showcases the Contestants enjoying their favorite part of their Hogan home. Contestants must include enough background in the photo to show the amenities in use including an explanation of why the Contestant loves the Hogan home in 50 words or less. To enter the Contest: Facebook: and go to the We Love Our Hogan Home tab. Follow the directions provided to complete the entry form; upload photo, consent to Contest Terms & Conditions, and submit. Photo must be submitted in JPEG, GIF or PNG format and cannot exceed 2MB in size. All entries must be received by 5PM CDT 29th April To enter the Contest: Online: hoganhomestexas.com/ and go to the We Love Our Hogan Home page. Follow the directions provided to complete the entry form; upload photo, consent to Contest Terms & Conditions, and submit. Photo must be submitted in JPEG, GIF or PNG format and cannot exceed 2MB in size. All entries must be received by 5PM CDT 29th April Content of Entries Entries must not include the faces or other personal information of any persons other than the Contestant and Contestant s immediate family. The Promoter reserves the right to reject any entry, including any entry deemed by the Promoter, in its sole discretion, to be inappropriate. Without limiting the Promoter s discretion, entries must not include any content that: 1) is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane

3 or pornographic; contains nudity; 2) promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message; 3) is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries; 4) defames, misrepresents or contains disparaging remarks about other people or companies; 5) contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, addresses or street addresses; 6) contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission; 7) contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission; 8) contains look-alikes of celebrities or other public or private figures, living or dead; 9) communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or 10) violates any law.

Prizes and Total Prize Pool The prize pool comprises two (2) individual prizes: People s Choice: One (1) gift card to Niko s Steakhouse for $200 Hogan s Choice: One (1) gift card to Niko s Steakhouse for $ Winners for the prizes All eligible entries received during the Contest Period will be published on Hogan Homes s Facebook page under the We Love Our Hogan Home contest tab once voting commences. The People s Choice winner will be the photo with the most votes. The Hogan s Choice winner will be chosen by the Promoter. The Promoter reserves the right to change the winner selection method at its sole discretion. Winners will be decided and announced by 16th May Notification of Winners Winners will be notified by within 5 working days after voting is complete. Winners must claim their prize within fourteen (14) days of the date of notification. Prizes can be either collected in-person or mailed to the winner s residential address within 2 weeks. Winners will be required to provide identification and supporting documentation necessary to prove they comply with these Terms & Conditions. If a winner cannot be reached by the Promoter within fourteen (14) days using the contact information provided at the time of entry, that winner shall forfeit the prize. 10. Publication Details Winners will be published on hoganhomestexas.com/, Hogan Homes Texas Twitter, Hogan Homes Texas Instagram, and other communication platforms used by the Promoter.

5 11. Ownership By submitting a photo to this Contest, the Contestant recognizes that the Provider claims ownership of the photo and caption for future marketing purposes. 12. Exclusion of Liability (a) (b) (c) (d) (e) (f) (g) (h) The Promoter makes no representation nor provides any warranties as to the quality, suitability or merchantability of the prizes offered. The Promoter is not responsible for any losses associated with any change to the value of any of the prizes. To the maximum extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any Contestant or any other person however caused including but not limited to consequential (including economic) loss by reason of any act or omissions, deliberate or negligent, by the Promoter or its employees or its contractors or its agents in connection with supply of the prizes awarded to the prize winners. The Promoter s decision on all matters pertaining to this Contest will be final. The Promoter is under no obligation to provide reasons for any of its decisions. The Promoter is under no obligation to engage in any form of correspondence whatsoever with Contestants or their representatives in matters relating to the Contest. A prize must be taken as offered and cannot be varied. A winner may be liable to declare a prize for tax purposes. The Promoter takes no responsibility for any tax payable on a prize. If any tax is payable on a prize it is the sole responsibility of the

6 winner. (i) (j) The Promoter accepts no responsibility if the prizes are lost, stolen, damaged or tampered with in any way. The Promoter does not take responsibility for misdirected mail or mail received late and the Promoter will not be liable for any loss resulting from transit of prizes. The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the Contest each Contestant releases Facebook from any and all liability in relation to the Contest. 13. Privacy The Promoter collects personal information from all Contestants in order to determine their eligibility to enter into the Contest and to administer and complete this Contest. It is a condition of entry that each winner consents to the publication of an abbreviation of their name, Hogan Homes neighborhood and their photos in any publication relating to this Contest. If the requested information is not provided, the Contestants will not be eligible to participate in the Contest or to claim a prize and their entry may be discarded. 14. Inconsistency To the extent that there is any inconsistency between these terms and conditions and any other published material, these terms and conditions will prevail. By participating in the Contest, each Contestant acknowledges that these terms and conditions are legally binding. The Promoter reserves the right to withdraw or amend the Contest as necessary due to circumstances outside its control.
