1 Waterfront Day At John Wayne Marina Greetings! You are invited to submit an application for the Waterfront Day at John Wayne Marina. The event will be held at John Wayne Marina at 2577 West Sequim Bay Road, Sequim, WA The hours of the show will be from 8 AM to 6 PM with continuous activities and entertainment. We work hard to make the vendors and displays, food and entertainment offerings a draw to the community and others interested in the waterfront. If you would like to be a part of the event, please complete the enclosed application. Applications will be accepted until August 1, 2018 and will be accepted on a first come, first served basis. There is no booth fee or deposit required with your application. This is a free event. After your application is received and reviewed, you will receive notification of acceptance or be advised if your name has been added to our waiting list. 3 WATERFRONT DAY Good Faith Pledge, Release Form, and Hold Harmless Waiver I, the Undersigned agree to adhere at all times to all rules, regulations and policies of the Port of Port Angeles and to follow all directions and instructions of its officials, including its Security Personnel. The undersigned hereby releases the Port of Port Angeles of any care, custody or control against loss theft, vandalism and/or fire during this even on Saturday, September 15, If items are to be sold, I, the Undersigned certify that I will only sell the type of items presented in this application. I, the Undersigned do hereby agree to release, relieve, discharge, indemnify, defend and hold harmless the Port of Port Angeles, staff, all Waterfront Day participants, Steve Speidel (MAC), City of Sequim, and the Jamestown S Klallam Tribe and their officers, agents, volunteers and employees, from all claims, losses, suits, damages, judgments, expenses, costs, and charges of every kind, including court costs and attorney s fees, resulting from its occupancy of the space herein under agreement by reason of personal injuries, death or property damages. The undersigned further agrees to indemnify, defend and hold harmless the Port of Port Angeles staff, all Waterfront Day participants, Steve Speidel (MAC), the City of Sequim and the Jamestown S Klallam Tribe and their officers, agents, volunteers and employees, from any claims arising out of acts of negligence of undersigned, his agents or employees. This paragraph shall survive termination of this Agreement. I, the Undersigned fully understand that the terms of the entire Release Form shall serve as a Full Release, Full Release of Liability, and Full Assumption of risks for myself, my heirs, executors and administrators and for all persons authorized by me accompanying me to the Event. I, the Undersigned understand that I am solely responsible for collecting and paying sales taxes on my gods and services for any and all business licenses necessary for doing business in the City of Sequim and the State of Washington. I, the Undersigned have read the entire Release Form, understand its terms and acknowledge that without my acceptance, I will not be permitted to participate in the Event. I, the Undersigned hereby accept all of the terms of the entire Release Form and Full Release of Liability as evidenced by my signature below. 4 WATERFRONT DAY Saturday, September 15, 2108 Vendor/Exhibitor Selection Process: The Port of Port Angeles s goal is to make an effort to offer a variety of display items, merchandise, foods and beverages. While there may be some overlap in offerings by vendors, every attempt is made to minimize this. Vendors and exhibitors are accepted to the Event based upon how their items meet this goal and the quality of the food and display items. Hours of Operation: All booths must be open for business and ready Saturday, 8 a.m. to 6 p.m. If you choose to break down early, you will not be accepted to the Event again. If you arrive late, you will not be permitted to participate. Waterfront Day load-in will be available starting at 6 a.m. Saturday morning. Health Permits are required for food booths: You will need to obtain a temporary health permit from Clallam County for the Event. Clallam County charges a fee for the permit processing. Certificate of Liability Insurance: Include a copy of your Certificate of Insurance that names the Port of Port Angeles and Jamestown S Klallam Tribe as additional insured. Booth Security: Booths must be covered and able to withstand wind and rain. There is NO security patrol, any merchandise should be secured and the Port is not responsible for loss or damage. Booth Weights and Safety: Sequim Bay as a propensity for strong wind gusts, so in order to increase your safety and the safety of your neighbors, weights must be attached to each leg. Each leg of your canopy/tent must have 30 lbs. minimum weights attached. These weights must attached by a rope that is stretched tight so that the weight is suspended off the ground. Booth Fire Certification: All tent/structure membranes, and all combustible decorative materials (sheers, curtains, draperies flooring, tarps, blinds, etc.) shall be treated or constructed from a material that is flame resistant and has the appropriate label permanently attached to all sections of fabric. NFPA 701, CPAI 84, and California Fire Marshal Title 19 labels are accepted as approved. Page 4 of 5

5 Additional Fire Department Requirements for tents: (See City of Sequim Notice of Decision Temporary Activity Permit (TAP ) Attach A, B, and C posted at (Waterfront Day Wordpress.com) 1. Each cooking structure that produced grease-laden vapors shall have a type K fire extinguisher for immediate access. Extinguishers shall be mounted in a stable manner, in plain view, and with unobstructed access. 2. LP-gas containers shall remain OUTSIDE, at the back (rear), of the tent/canopy at ALL times. Small cylinders can be set in a milk crate and large cylinders can be secured to a post. The safety release valve shall be pointed away from the structures. 3. Vending stands for cooking food that produce grease-laden vapors or use oils for cooking shall be separated by a minimum of 20 feet from other tents/canopies/buildings. 4. Fire extinguishers with a rating of 2A-10BC shall be provided within 30 feet of travel distance to cooking food vendors. If a fire extinguisher meets this requirement with a fire extinguisher already installed for the regular booths (75 foot travel requirement) then an additional fire extinguisher is not required. Extinguishers shall be mounted on a red 4x4 stand-alone post. The stand shall be four (4) feet tall and placed in a visible and accessible location with signage attached pursuant to Fire Codes. If your food vending unit is a mobile cooking vehicle, the following applies: Conversion vending units (mobile cooking vehicles) that produce grease-laden vapors shall have been inspected and passed the Washington State Labor and Industries requirements under RCW and WAC V. The LI insignia, designating that the Conversion Vending Unit has passed the Washington State requirements, shall be affixed on the vehicle in accordance with RCW and WAC V. Acceptance Notification: Vendor/Exhibitor notifications of acceptance will be sent as soon as your application has been reviewed and approved.
