2 HISTORY o Jun. 16, 1997 original Mutual Aid Agreement with the City of Cleveland o Aug. 31, 2005 new Mutual Aid Agreement to include Public Square, Transit Zone & Bus Rapid Transit (BRT) Zone

5 HISTORY o Apr. 1, 2008 First Amendment to include additional traffic enforcement jurisdiction (bus layovers and train crossings) o May 7, 2010 Second Amendment to amend service area and clarify procedures for prisoners health care costs at City jails and to expand GCRTA jurisdiction on Euclid Avenue to sidewalks up to store fronts
6 HISTORY o Aug. 17, 2015 Third Amendment to include traffic enforcement for bus lanes on Clifton Boulevard
7 FOURTH AMENDMENT Purpose To provide consistency in certain policies, protocols and training among all police departments having concurrent jurisdiction in the City of Cleveland
8 PROTOCOLS & POLICIES o Pursuit Policy consistent with the Cleveland Division of Police (CDP) o Use of Force Policy consistent with the CDP o Any updates of either policies by either department to be shared for continued consistency
9 GCRTA PRISONERS o City of Cleveland no longer will accept GCRTA prisoners for booking, incarceration or services, and will bear no costs o GCRTA will book and house prisoners with Cuyahoga County o GCRTA is in discussions with the County regarding jail costs
10 GCRTA PRISONERS o GCRTA will abide by the Cleveland Municipal Court goal of holding uncharged detainees no longer than 36 hours o GCRTA, when necessary, will transport and guard prisoners pursuant to Cleveland Municipal Court warrants requiring hospital/ health care for up to 8 hours, not to exceed an additional 8 hours
11 TRAINING o GCRTA will provide officers, dispatchers and supervisors with the same or comparable training on use of force, pursuit, crisis intervention, bias free policing, community policing, investigatory stops and searches and arrests as required by the Ohio Peace Officer and Training Act (OPOTA) and as may be enhanced by CDP and GCRTA applicable policies
12 TRAINING o Within 60 days CDP will provide GCRTA with applicable scheduled dates of CDP training to assist GCRTA in training their personnel o Upon request GCRTA will provide CDP with information about the type of training provided by GCRTA and confirmation thereof
13 TRAINING o Each party is responsible for the costs of their respective training o CDP and GCRTA Transit Police will cooperate in joint training initiatives
14 COMPLAINT PROCESS o Within one year of the CEO being hired, GCRTA will establish a transparent process, accessible to the public, made up of nonpolice personnel, for submission of public complaints o Staff is working on this process and a recommendation will be made to the Board o Complaint process will be shared with CDP
15 RECOMMENDATION Staff recommends that the Audit, Safety, and Real Estate Committee refer the Fourth Amendment to the Mutual Aid Agreement Between the City of Cleveland and the Greater Cleveland Regional Transit Authority to the full Board for approval
