5 TERMS AND CONDITIONS OF MISS EARTH SINGAPORE Miss Earth Singapore 2016 (hereinafter referred to as the Contest ) is organised by (collectively, the Organiser ). These Terms and Conditions shall apply to all stages of the Contest. 2. Each contestant must complete the Organiser s Miss Earth Singapore 2016 contestant entry form ( the Contestant Form ) and attend an interview session which shall be held on the day of application or at any time to be determined by the Organisers and at a venue to be determined by the Organisers. A copy of the contestant s NRIC or Passport must be attached to the Contestant Form. The Organisers reserve the right to reject any application that fails to satisfy the aforesaid requirements. 3. Closing date for applications is Each contestant warrants that her performances shall not infringe the rights (including copyrights) of or defame or embarrass any person, firm or company. 5. The Contest is open to all single naturally born female citizens of Singapore who are at least eighteen (18) years of age and under twenty-six (26) years of age on November All contestants below 21 years of age are required to obtain their parent s/guardian s consent on the Contestant Form. 6. Each contestant warrants that she is of a minimum height of 1.64m and above. 7. Each contestant warrants that she is not married and do not have a child. 8. Each contestant warrants that she is not the current title-holder in any other international pageant or competition. 9. Each contestant warrants that she has not been charged or convicted in any court of law in any country. 10. Each contestant warrants that she is not a fugitive nor is she wanted by any law enforcement agency. 11. The contestant agrees that the Organiser shall have the exclusive right to take photographs, record or otherwise reproduce all or any part of her performances or other appearances in connection with the Contest. Each contestant hereby consents and agrees to the Organisers or any of them recording her performance(s) at all stages of the Contest, including the interview session, whether such recording be audio, audio-visual or in the form of photographs and further acknowledges that each of the Organisers retain the right to edit and to telecast any recording so made. Each contestant hereby assigns to the Organisers absolutely, all vested, contingent and future rights in her performances and the Organisers shall own the sole and exclusive rights to such performances. Each contestant further agrees to complete any formalities or sign any documents necessary to perfect this assignment. 12. By participating in the Contest, the contestant irrevocably and unconditionally grants to the Organiser all consents and waivers necessary for the Organiser to record and use her performances, in any manner whatsoever and in any part of the world as the Organiser shall in its sole discretion deem fit. The contestant acknowledges that the Organiser shall be at liberty to publish and otherwise use any recording made by any of the Organiser, including without limitation audio recordings, visual recordings and photographs, for the promotion and publicity of the Contest. 13. The selection and number of judges at each stage of the Contest shall be at the Organiser s sole discretion and the judges decision at all stages of the Contest is final. No enquiries, appeals, verbal or written, shall be entertained. The contestant shall accept and abide by any and all decisions made by the Organiser the panel of judges concerning, without limitation, decisions relating to the Contest, interviews with the contestant, the award of prizes (if any) and/or artiste contracts (if any) and the division of prizes (if any) in the event of a tie. 14. If the contestant withdraws from any stage of the Contest for any reason whatsoever, the contestant shall reimburse the Organiser on demand for all losses, costs and expenses suffered and incurred by the Organiser as a result of the contestant s withdrawal. The contestant agrees that a statement issued by the Organiser as to the amount of such losses, costs and expenses suffered and/or incurred by it shall, in the absence of manifest error, be conclusive and binding upon the contestant. 15. In the event the Organiser deems it necessary to re-record any part of any round of the Contest, the contestant agrees to be prepared to perform again for re-assessment. 16. While participating in the Contest, a contestant shall not, without the prior written consent of the Organiser enter into any agreement with or participate in any other programme produced by any person/company in the business of producing, transmitting or exhibiting programmes for or on television in Singapore and elsewhere. 17. Each contestant shall make full and honest disclosure of particulars as requested in the Contestant Form and Personal Particulars Form. Each application shall be accompanied by the following recent 4R colour photographs of the contestant: 1 close-up facial shot (taken without make-up and with hair off the face) and 1 full-length shot. All photographs submitted shall be the property of the Organiser who may, without reference to any contestant, use such photographs for any reasonable purpose or publicity. 5

6 18. All details submitted in the Contestant Form and Personal Particulars Form shall be deemed to be current. In the event of any change of such details, the contestant shall notify the Organiser immediately. 19. The Organiser shall be under no liability whatsoever to the contestant or her personal representatives, in respect of any loss, damage or injury to life or property sustained by any contestant at any stage of the Contest, unless such loss, damage or injury is caused by the Organiser s gross negligence. 20. Contestants who fail to attend environmental activities, sponsors visits, training sessions, rehearsals, fashion shows, photoshoots, hair and grooming sessions, recording sessions, coronation night or other special events related to the Contest shall be disqualified if the reasons for such absence are found to be unacceptable by the Organisers. If disqualified by the Organizers, the contestant shall reimburse the Organiser on demand for all losses, costs and expenses suffered and incurred by the Organiser as a result of the contestant s withdrawal. The contestant agrees that a statement issued by the Organiser as to the amount of such losses, costs and expenses suffered and/or incurred by it shall, in the absence of manifest error, be conclusive and binding upon the contestant. If Contestants fail to attend the Coronation Night, a penalty of SGD3,000 will be imposed. 21. The contestant shall at all times comply strictly with the Organiser s specifications/requirements (whether oral or written) as to the contestant s appearance, physical characteristics, skills, attire and/or accessories. A failure to meet such specifications/requirements shall result in disqualification from the Contest. 22. For the avoidance of doubt, the Organiser reserves the right to disqualify any contestant from the Contest on the grounds of undesirable conduct and/or appearance. 23. The contestant shall not, without the prior written consent of the Organiser, speak to the press or other media nor give any interviews or comments relating to the Contest, the contestant herself or other contestants nor disclose any information whatsoever relating to Miss Earth Singapore activities & 24. The Organiser reserves the right to substitute, add to or alter any item on the list of prizes offered before the Finals of the Contest. All prizes won by the contestant at the Contest shall not be transferable nor exchangeable for cash or otherwise. 25. The Organiser, as organiser, does not undertake any responsibility to ensure that prizes will be delivered by the sponsors to any prize winner. No agreement shall arise or be constituted, and no obligation will be incurred by any of the Organiser or by companies in and affiliates of the by reason of the contestant s participation in the Contest or by reason of anything done or omitted to be done by the contestant as a result of or on account of the Contestant Form, Personal Particulars Form or the Contest. In the event that the sponsor fails or refuses, for whatever reason, to deliver or transfer the prize or make good on its promise or offer to the contestant, the Organiser shall not be liable or responsible for losses (of any nature whatsoever) arising from such failure or refusal. 26. Non-compliance with or breach of any of these Terms and Conditions shall immediately disqualify the contestant from further participation at any stage of the Contest, including the international contest and any cash and prizes won shall be forfeited. 27. The contestant warrants that she is free to enter, participate and perform in the Contest, including the international contest and is under no restriction, limitation or disability (contractual or otherwise) to do so. 28. No contestant shall at any time during the Contest commercially exploit or aid the commercial exploitation of her participation in the Contest in any way whatsoever. 29. There shall be no claims against the Organiser, in the event the Contest is annulled, cancelled or postponed by circumstances beyond the reasonable control of the Organiser. 30. Each contestant agrees to promote/sell at least 10 tickets for the coronation night. 31. The Organiser reserves the right to amend or vary any of these Terms and Conditions without prior notice to any contestant. 32. The contestant shall indemnify and keep each of the Organiser, any company in and affiliates of the C. T. Hansen International s agents and employees ( the Indemnified Parties ) fully indemnified against any and all loss, damage, claims and costs (including legal costs on a full indemnity basis) suffered and/or incurred by any of the Indemnified Parties as a result of the contestant s breach of any of these Terms and Conditions. 33. The chosen title-holders will be contracted for 1 year to during their reign. A separate contract of agreement will be issued and signed upon winning the title. This contract of agreement is provided as attachment with this application for the chosen finalists for reference. Your signature is required upon reading this contract of agreement for confirmation. 34. All contestants, by participating in the Contest, agree to be bound by these Terms and Conditions. 35. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. 6
