3 BOND & INSURANCE REQUIREMENTS It is suggested that this Exhibit be provided to the Contractor s insurance provider. Contractor shall not commence work until all required bonds and insurance coverages have been obtained and such insurance has been reviewed and accepted by the Owner. Certificates of Insurance on the current ACORD form shall be issued to the Owner showing all required insurance coverages. Bonds Required Construction, installation and service contracts (including repair and alteration) exceeding $50,000 require that 100% Performance and Payment Bonds be furnished by the successful bidder (contractor). All such bids must include a 5% Bid Bond and extend one year past the completion date to cover defective materials and workmanship. Non Construction and non-installation or service contracts exceeding $50,000 require that a 100% Supply Bond be furnished by the successful bidder (contractor). Bonds shall be issued by a company authorized to do business in Texas with an A.M. Best Company rating of at least A- X and included on the U.S. Department of the Treasury Listing of Approved Sureties (Dept. Circular 570). The contractor shall absorb any and all costs of such Bonds. Insurance Required Automobile Liability insurance covering Any Auto Comprehensive (Commercial) General Liability insurance including Products, Completed Operations, Independent Contractors, Broad Form Property Damage, Pollution and Blanket Contractual Liability coverages. XCU exclusions to be removed when underground work is performed. Professional Errors & Omissions Liability insurance may be required from all contractors and licensed or certified as professionals; e.g., engineers, architects, insurance agents, physicians, attorneys, banks, financial consultants, etc. Limit Required $1,000,000 Combined Single Limit $1,000,000 Aggregate, Occurrence and Personal Injury $ 500,000 Fire Damage $ 5,000 Medical Payments Per Project Aggregate including Completed Operations One time professional contract amount; $1,000,000 Occurrence & Aggregate minimum Retroactive Date preceding date of contract must be shown Extended Reporting Period three years past completion of contract
4 Workers Compensation insurance with limits to comply with the requirements of the Texas Workers' Compensation Act. Employers Liability insurance Umbrella or Excess Liability insurance (excess of primary General Liability, Automobile Liability and WC Coverage B) Statutory Limits $1,000,000 One time contract amount for all contracts exceeding $100,000, up to $25,000,000 total limit Limits for primary policies may differ from those shown when Umbrella or Excess Liability insurance is provided. All Risk Builders Risk Property Insurance shall be required for all construction contracts when property of the owner is at risk or in the care, custody and control of the Contractor. Builders Risk insurance shall be required for all construction contracts requiring a bond. All Property insurance shall include coverage against the perils of Flood and Earthquake. (Installation Floater may be substituted when contract involves installation only.) Contract Amount or Replacement Cost Value of Scope of Work which ever is greater Permission to Occupy granted Deductible: 1% of contract, $50,000 maximum, unless otherwise approved by the Owner. Note: insert desired deductible amount Insurance Conditions All insurance coverages shall be issued on an Occurrence basis (except Professional Liability) by companies acceptable to the Owner and licensed to do business in Texas (exception: Texas Mutual). Such companies shall have a Best's Key rating of at least "A- X". All certificates must include: 1. The location or description and the bid number or Purchase Order number 2. A 60 day notice of cancellation of any non-renewal, cancellation or material change to any of the policies 3. "Additional Insured" on the Property, General Liability, Automobile Liability and Umbrella (Excess) Liability policies naming the Owner 4. A "Waiver of Subrogation" clause in favor of the Owner will be attached to the Workers Compensation, General Liability, Automobile Liability, Umbrella Liability and the Property insurance policies 5. In addition to certificates of insurance, copies of policy endorsements must be provided (a) listing the Owner as Additional Insured, and (b) showing waivers of subrogation in favor of the Owner: CG2010, CG2037, CG2404, CA0070, CA0032, WC0003 or their equivalents.
5 All insurance must be maintained for one year following substantial completion with Certificates of Insurance provided. Contractor shall be responsible for all deductibles; the Owner shall approve the deductibles selected. If any policy has aggregate limits, a statement of claims against the aggregate limits is required. The Owner reserves the right to review the insurance requirements during the effective period of any contract to make reasonable adjustments to insurance coverages and limits when deemed reasonably prudent by the Owner based upon changes in statutory laws, court decisions or potential increase in exposure to loss. Refer to minimum depth of aggregate as detailed in the specification. #4 Please Advise what the 5ft Impermeable Cover consists of on C8.00. Is this intended to be an extension of the track cross section? Refer to Sheet C8.00 included in Addendum #3. #5 Sheet C5.00- Is the reference to the 1.2' curb in the lower right corner reffering to the height of the curb or is this intended to be a 1.2' wide curb? If it is a 1.2' wide curb please show extents of this curb and the 6" curb refernce in the upper left corner.

At the bottom of the chart is says " below the "final" ground surface elevation". this mean from the top of the proposed field (turf) elevatipon or the subgrade below the turf section? Does This refers to the subgrade below the turf section. Crusher Screenings (3/8" minus) are readily available material. Screening will meet the requirements for Select Fill in Para 3 on p11 of the geotech report, except for the 7 PI. Screenings typically have a 5 PI. Would crusher screenings be acceptable for the select fill? This is not acceptable. Ref C8.00- Does the pole vault area have the same subgrade preparation requirements as the Footbal Field. The hatching is similar but the line slants are opposite of the field. Pole Vault has the same subgrade prep requirement as the track surface. Ref C5.00 and C8.00- both plans indicate Tirf area is to extend outside the track to the existing sidewalk. Accordingly, these turf areas will have to have the same field subgrade preparation as the main field. IF an 8' or 5' overex is utilized in this area the existing sidewalk will probably have to be replaced as it would be displaced during construction. Refer to Sheet C8.00 included in Addendum #3.

As well as the connections for the trench drains? This is not acceptable. Sheet A1.04 shows turf on the North side of the field, and outside of the track. Sheet A1.02 shows no turf in that area. Sheet A1.02 indicated the Turf Pattern only. Sheet A1.04 indicates the turf required beteen the multipurpose facility and the track. Refer to Sheet C8.00 in addendum #3. Sheet A1.04 shows slot drain at the field side of the Dzone. Is this correct? This is correct. At the transition between the Turf and Track D Zone has a slot drain. Sheet C8.00 shows to install impervious cover to at least 5' beyond track perimeter. Sheet C5.00 does not show concrete on the south perimeter of the track nor does it show concrete around the sand pit. Which do you prefer? Refer to Sheet C8.00 included in Addendum #3. #14 Sheet A1.05 Detail 1 shows impermeable liner under the football field. The notes provide information for a geotectile filter fabris which is permeable. What material is required impermeable or permeable? Geotextitle Filter Fabric (permeable) is indicated in details 3 and 4 on A1.03. Impermeable liner is specified and used in details 1, 2, 3, and 4 on A1.05. #15 1. The geotechnical report I have is dated January 2015, The plans call for one dated February Is there another one than can be provided? Refer to Addednum #1 for revised Geotechnical Report. #16 The geotechnical report nor specs give any indication of what percentage of lime needed to accomplish soil modification. Refer to Addednum #1 for revised Geotechnical Report. #17 Chemical injection is also listed as a soil modifying procedure. Yet no mentions is made as to accomplish this. Refer to Addednum #1 for revised Geotechnical Report. #18 Is there a list of soil modifying considerations that are avaialble. Refer to Addednum #1 for revised Geotechnical Report. #19 The existing outside long jump / triple jump runways. Are they to be resurfaced and included in this project? Yes the existing runways located on the east side fo the stadium are to be resurfaced in the project.
