Minto Road, New Delhi , for the following work/ job subject to terms and conditions enclosed herewith as Annexure-A & B S. No. Description of Works Rate (Rs.) 1. Scope of Work for Overhauling of PLCC On per day basis. Panels: i) Through checking of all modules of PLCC panels. ii) Measure levels at each module output. If level is mismatched, rectify the defective module. iii) Measure Tx/Rx level at Co-axial of all PLCC panels. If level is mismatched, rectify the problem. iv) Through checking & rectification of any problem in communication system with remote end S/stn. iv) Through checking & rectification of Protection Coupler of all lines. v) Installation & wiring of Coupler unit in speech panel, to make it as speech + protection panel. vi) Measure level at LMU and problem (if any) of LMU should be rectified. vii) wiring & soldering of Motherboard of PLCC panels should be checked & rectified. viii) Re-calibration of all PLCC panels. ix) Inter-trip checking with remote end

3 Annexure-A DELHI TRANSCO LIMITED Terms & Conditions The contractor shall strictly follow the terms and condition given here under for the works:- 1 SCOPE OF WORK:- Contractor will satisfy himself with the details of the work to be executed and if considered necessary they should visit the site & get any other information required in this connection 2 T&P: - Necessary shut down, Manpower assistance, Level meter/level Oscillator, all associated drawings will be arranged by DTL. Any special T&P, test kit should be arranged by the party free of cost. 3 Work Contract Sales Certificate/Tax clearance /EPF/ESI number and ensure about the remittance of share of employees/employers each month with RPFC and morever documentary proof should be submitted alongwith the bid,failing which bids are likely to be rejected. 4 SAFETY:- The contractor shall make all the arrangements for the safety of his staff. The DTL shall not be responsible in any way for injury/ disablement, accident to any workman on this account & will be free from any legal bindings in this regard. DTL will not be responsible to pay any damage to the workman of the contractor or any outside agencies. The contractor shall make all payment & other contributions, if any, which may have to be made in regard to the workman under any statute or rules or regulations. The DTL shall not be responsible for those payments 5 DTL shall not be responsible for any injury/ or loss suffered by the contractor/ his workman. The contractor shall arrange to cover all such workman under the employees State Insurance Scheme if applicable to the area & premises where the workman are working. Alternatively, the contractor shall have insurance policy to pay compensation under the workman s compensation Act, or under the personal accident insurance cover to meet with all legal requirements in this respect. 6 The contractor will undertake to indemnity DTL against liabilities or damages by way of compensation arising from any accidents to the person or property or any other person employed or otherwise during the progress of the contract & the DTL shall not entertain any claim in this respect. 7 The contractor shall be solely responsible & shall ensure due compliance with all the legal requirement concerning the workman employed by him under the provision of applicable labour and other legislations. In the event of the contractor committing any fault resulting in DTL being required to insure any liability of expenses or DTL being required to any notice / summons in this respect the same shall be entitled to recover form the contractor liability attached to it due to any proceedings. 8 The contractor shall accept all risks of stoppage of hindrances to his work by
4 outside interferences. 9 Tenders of those tenderers, who have not purchased this tender documents or remitted tender cost if downloaded from website, will not be accepted 10 The rates quoted must be firm inclusive of all Taxes,duties and levies etc. 11 DTL reserves the right to revise or amend the specification and other conditions prior to the date notified for opening of the tenders. Such revisions and amendments, if any, will be communicated to all tenderers as amendment or addenda 12 Contractor shall take necessary steps to ensure that all the electrical installations of the DTL and other services like water connections pipe lines, sewar pipe lines, open drains, telephone cables, etc. are not damaged by his workers in any way. Contractor will be responsible for all such damages and shall have to repair or failing which he has to pay entire cost of damages. In case of damages to DTL property / material contractor has to pay replacement cost. 13 Before carrying out the work, it shall be entire responsibility of the contractor to take all the safety precautions and shut downs, etc. if required during the execution of work. All shut downs will be taken by DTL supervisory staff. 14 The work has to be carried out according to the specifications given in-contract according to the satisfaction of DTL representatives. 15 The quantity of work can vary up to plus/ minus 25% depending upon the requirement at the discretion of the DTL. 16 In the event of any obstruction at site, change in scheme, or due to any reasons the contract can be cancelled for the balance quantity of the unexecuted work. The work can also be suspended temporarily due to any reasons and for such period, extension will be given by Manager (T) if required on the written request of the contractor. 17 PAYMENT:- The payment shall be made within one month of receipt of bills from the contractor after the completion of the work as mentioned in the notice inviting quotation. Payment will be made as per actual measurement 18 PENALTY: - A token penalty of 1% per week of period of delay subject to maximum of 10% of the value of the unexecuted portion of the contract would be levied in case of delay in execution of the work beyond the stipulated completion period of extension if any, granted to them by the DTL. 19 The contractor has to execute the work on working days during the working hours. However, if required, the work can be executed on holidays; under special circumstances. 20 The contractor shall not without any consent of this department assign or sublet the whole or part of the contract. 21 The contractor shall make his own arrangements for drinking water & other facilities for his labour/ staff 22 No idle charges shall be payable by the department. 23 ARBITRATION:- If the disputed question or controversy the settlement of which is not herein specially provided for shall at any time arise between the DTL and the supplier/ contractor relating to this order of the portion of the same or the right of duties or liabilities of either party then in every such case, the matter in dispute shall be referred to the Arbitration of the GM(SLDC) or his
5 nominee and the decision of the GM(SLDC) or his nominee shall be final and binding on both the parties. The provisions of Indian Arbitration Act, in force, amended from time to time shall be applied to such arbitration proceedings. Arbitration proceedings shall be held at Delhi and only Delhi Courts will have to payable by the DTL to the contractor or vice-versa shall be withheld on account of such proceedings unless arbitration proceedings. 24 The work shall be started within one hour from the date of notice either through telegram, through special messenger or telephonically. 25 Contractor shall be required to strictly adhere to the safety regulations & electrical regulations/ Act. 26 This office reserves the right to get the work executed from the departmental staff or any outside agency at contractor cost and risk if work is not completed within the stipulated period without any valid reason. 27 In case of transportation works contractor shall strictly observe the regulations as laid down by Traffic Police. Any damage to DTL property/material during the course of transportation shall be recovered from the contractor s bill. 28 SECURITY:- Security to be deposited in 10% of the total value of the contract which would be refunded within six months after the satisfactory completion of jobs 29 Mandatory deduction towards Income Tax, work contract act 1999 etc, if applicable, shall be deducted by the payees department of DTL. 30 The stipulated completion period has been given in good faith. However the contractor has to complete the work in minimum possible time by providing parallel gangs as per site requirements on the direction of Engineer In charge at site, otherwise poor performance may be recorded. 31 Force Majeure Clause Condition:- This penalty amount will not be, deducted from the payment due to delay by strikes, fire accidents or any other case, beyond the control of the contractor, a reasonable extension would be granted, subjected to satisfactory proof furnished in time and accepted by the DTL. 32 DELHI Transco Limited reserves the right to cancel this Tender/Quotation without assigning any reason. 6 A: General: TERMS & CONDITIONS Annexure-B 1 The sealed quotation should reach in the office of the DGM(SCADA),building Minto Road New Delhi latest by A.M on and the same shall be opened at A.M on in the office of DGM(SCADA),Minto Road, New Delhi. 2 The tenderer must submit the tender in single envelope Earnest Money, price bid etc. The envelope should be tagged and properly sealed with official seal of tenderer. Tenderer must also indicate the following particulars on the face of offered envelope, failing which the offer shall be ignored:- (A) Name & address of the tenderer. (B) Tender No. DTL/Opr-SLDC/2007/Manager(Comm.).for Revival of Carrier protection panel for Mandaula-SOW, Mandaula-Gopalpur, IPExtn.(Pragati)-Sarita Vihar- Badarpur-Mehrauli Carrier Protection link. (C) (D) (E) (F) due on. Validity of offer days. (In case validity is indicated less than 120 days OFFER ENVELOPE will not be opened.) EMD particulars - DD No. for an amount Rs. dated valid for minimum 180 days from date of opening. Tender cost to be remitted by DD/Pay order in favour of Delhi Transco Limited, payable at Delhi/ New Delhi. If downloaded from DTL/SLDC/Delhi Govt website, (E) should be enclosed in the envelope, duly mentioning the same with details on the face of the envelope. 3 The tenderer is required to submit the tender document duly signed on each page with official seal in token of acceptance of NIT terms & conditions, otherwise the offer is likely to be ignored. 4 Tenders of those tenderers, who have not purchased this tender documents or remitted tender cost if downloaded from website, will not be accepted. 5 The rates should be quoted on the basis of the units specified in words as well as in figures without any cutting, in case of differences of values/rates in figures and words of any confusion it will be constituted to take the rates which are lowest. The rates should be firm in all respect. 6 Bidders are required to deposit. the Earnest Money of Rs.2000/- (Rupees two thousand only) in DD/Pay order /BC, No. Other mode i.e. cheque, FDR Bank Guarantee etc shall not be acceptable, irrespective of the fact that any firm is / are
7 registered with: DTL/DGS/NSIC. No relaxation on this a/c is to be granted, except in the case of public sector Undertaking. 7 The rates quoted should be valid for 180 days from the date of opening of quotations/ tenders. No bidder will have a right to change the rates opening the quotations/ tender except during the negotiations, if required. 8 Earnest money equivalent to the specified amount, prescribed in the quotation/ tender document shall be deposited along with quotation/ tender by bank draft of any scheduled Bank of Delhi in favour of Delhi Transco Limited. The same shall be refunded without interest after decision of the case, without earnest money offer will not be opened. In the event of the offer is accepted, it can be adjusted towards the security deposit amount, if desired by the successful bidder. 9 SECURITY DEPOSIT:- Apart from earnest money the successful party will have to deposit security through 10% of the total value of the contract for the performance of the contract within seven days from date of communication and acceptance of the order or before start of work whichever is earlier. The security deposit will be retained till the work is completed satisfactory and would only be refunded on satisfactory operation of the contract after a period of six months. No interest will be payable on the above amount and on security deposit. Any damage caused to the material/ tools of the Delhi Transco Limited will be recovered from the security deposit/ earnest money or other running bills. Safety of DTL material and property handed over to the contractor will be the responsibility of the contractor. 10 In case of opening is holiday/ closed day, opening date may be treated as the next working day or can be postponed by the office opening authority 11 In complete quotations/ tender will be rejected summarily 12 PAST EXPERIECE :- Contractor should mention their past experience in doing the similar type of jobs by indicating work order no, date, amount and security of job executed must be indicated. 13 COMPLETION REPORT:- The work must be completed within a period of 90 days from the date of receipt of the order failing which a penalty will be 0.5% per week or part thereof subject to a maximum of 5 % of the value of unexecuted portion. 14 INCOME TAX CLEARANCE, SALE TAX REGISTRATION CERTIFICATES,EPF/ESI number. The tenderer while submitting the tender must submit/a copy of Income tax clearance certificate from the income tax & Works Contract Cell of Sale Tax Deptt. of the Area in which they are assessed/ EPF/ESI number, failing which the offer shall be ignored. The tenderer must ensure about the remittance of share of employees/employers each month with RPFC and morever documentary proof should be submitted alongwith the offer,failing which the offer is likely to be rejected. 15 The contractor must hold PAN card issued by the Income Tax Department 16 TERMS OF PAYMENT: - The payment shall be made within one month of receipt of bills from the contractor after the completion of the work as
8 mentioned in the notice inviting tender. 17 In case of any dispute of any form the decision of DGM(SCADA) shall be final and binding. 18 The Delhi Transco Limited shall not be responsible in any way for the injury/ disablement / accident to the contractor or any of his staff deployed for the work. 19 Any defect if noticed and pointed out by the Asstt. Managers have to be attended to his entire satisfaction prior to submission of the bill for payment 20 The Delhi Transco Limited reserves the right to accept or reject any offer in whole or without assigning any reasons. 21 Successful contractor whose offer is accepted will be required to execute an agreement on a stamp paper of Rs. 100/- within seven days of the issue of the written order. The agreement paper to be furnished by successful contractor and he will not be paid for such paper. 22 The contractor shall abide by all contractual obligations as per Delhi Transco Limited / DVB norms. 23 The Delhi Transco Limited reserves the right of dividing the work. Order can be split in more than one party. 24 GUARANTEE:- All PLCC panels will carry a free rectification warranty of 06 months. 25 Special: 1 Necessary shut down, Manpower assistance, Level meter/level Oscillator, all associated drawings will be arranged by DTL. Any special T&P, test kit should be arranged by the party free of cost. 2 Fooding & Accommodation will be arranged by the party on their behalf. 3 Local conveyance for carrying-out the work at various DTL sub-stations will be provided by DTL free of cost. 4 Party has to plan in a fashion to complete the job within daily working hours. i.e 10A.M to 6 P.M.
