As a starting point the Board of Directors shall elaborate a status quo report of their waterway administrations (Task ). This report shall include general information on the organizational and legal structures, the existing tasks and objectives as well as the available resources of each waterway administration. Based on this information a SWOT analysis (Strengths-Weaknesses-Opportunities-Threats) shall be

5 elaborated for each waterway administration, which shall be presented and discussed during a Board of Directors meeting. The results of the status quo report are the basis for the discussions between the participating directors on common future objectives of waterway administrations on the river Danube (Task ). Based on these findings a set of recommendations shall be elaborated for every waterway administration, which aims at optimizing the framework conditions of the respective waterway administration (Task ).

6 4 LEGAL BACKGROUND OF EAEMDR According to clauses of the Peace Treaty of Neuilly dealing with the Danube river navigational regime and the rights of the European Danube Commission, the obligation of the Danube countries were defined, namely: to maintain the river in navigable conditions, to develop the hydrological and hydrographical surveys. More specifically, they are mentioned in chapter 2, part 9, articles of the Contract and named «Clauses regarding the Danube». In order to implement those goals in 1935 the «Danube Measurement Service» was founded in Bulgaria with a head office in Lom, part of the main Directorate of the Railways and Ports within the Ministry of Transport. Soon after that, it was renamed to «Hydrographical Service». The main tasks were: the maintenance of the navigational way, the preparation of charts of the Danube River and the organization of hydrometeorological observations in the Bulgarian part of the river. In 1949 the Hydrographic service Lom was moved to the Ministry of National Defense and so became part of the Danube Fleet with a head office in Ruse. Since 1 st January 1953 the Danube Hydrographic service was back to the Ministry of Transport with a new name: «Administration of the navigational way». The new element in its activity signaling and maintenance of the navigational way in the Bulgarian part of the Danube River was the beginning of a real specialized service like the ones already existing in the other countries following the requirements of the Danube Commission.

7 In beginning of April 1956 the Council of Ministers adopted a decree for the establishment within the Ministry of Transport of an «Administration for maintenance of the navigational way and exploration of the Danube River» with a head office in Ruse. With a Decree of the Council of Ministers No. 212/ the Administration was transformed into Executive Agency for Exploration and Maintenance of the Danube River (EAEMDR). The Agency is a national public authority within the Ministry of Transport, Information Technology and Communications (MTITC). Figure 1 EAEMDR in the MTITC organizational chart It is a secondary administrator of budget credits. According to Art. 77 of the Law for the sea waters, the inland waterways and the ports of the Republic of Bulgaria the Minister of Transport, Information Technology and Communications, through EAEMDR shall organize, manage and control the exploration and the maintenance of the conditions for navigation in the inland waterways of the Republic of Bulgaria in compliance with the internal and international law. The headquarter of the Agency is in the city of Ruse.

8 The supervision over inland waterway navigation is implemented by Executive Agency Maritime Administration within the Ministry of Transport, Information Technology and Communications. On the following figure are shown all the administrative structures subjected to the Minister of Transport, Information Technology and Communications. Figure 2 Structures subjected to the Minister of Transport, Information Technology and Communications Besides these structures there is one more organization which is responsible for the management of the infrastructure of the public transport ports of national importance. This is the Bulgarian Ports Infrastructure Company state enterprise within the MTITC. The implementation of the activities of EAEMDR is based on the following legal framework: Decree 212/ of the Council of Ministers Structural Regulation of the Executive Agency for Exploration and Maintenance of the Danube River Law on the Maritime Spaces, Inland Waterways and the Ports of the Republic of Bulgaria

9 Convention on the Navigational Regime Along the Danube River Law for the Administration Public Procurement Law Assignment of Small Public Procurement Ordinance Manual for planning, preparation and implementation of projects under Operational programme on Transport ORGANIZATIONAL STRUCTURE AND MAIN TASKS EAEMDR is managed and represented by Executive Director. The Executive Director is appointed by the Minister of Transport, Information Technology and Communications subject to approval by the Prime Minister, for five years, without limitation on the number of mandates served. The administrative management of the organisation is implemented by the Secretary General, who is appointed by the Executive Director. The Agency is organised in 4 directorates forming the general and the specialized administration. Figure 3 EAEMDR organisational chart

10 The general administration of EAEMRD is implemented by Administrative, Legal, Financial and Accounting Services Directorate. The functions of this directorate are connected with supporting the Executive director and the specialized administration as well as with communication and providing services to external bodies. Some of its main responsibilities are: Consulting and providing opinion on legal issues Preparation of internal operational documents and providing proposals for amendments of the existing related legislation Procedural representation of the Agency Preparation of the draft budget of the Agency as well as the reports for its spending Organization of service providing The specialised administration of EAEMDR is implemented by 3 directorates in accordance with their specific functions for exploration and maintenance of the waterway, namely: Maintenance of the Navigational Way and Technical Directorate (MNWTD) Hydrotechnical and Projects Directorate (HTPD) Hydrology and Hydrometeorology Directorate (HHMD) MNWTD is structured in two sections Navigational way section and Technical section. 11 The main responsibilities of this directorate are as follows: Performs the entire complex of works for maintaining the navigational way of the Danube river, the water areas of the ports, winter camps and temporary winter shelters according to the recommendations of the Danube Commission (DC) and the decisions of the Joint Bulgarian- Romanian Commission for maintenance and improvement of the fairway Organize proper and permanently functioning navigational conditions Performs the necessary dredging works on the fairway, the winter camps and the temporary winter shelters in order to achieve the dimensions recommended by the DC Performs manoeuvring and emergency rescuing works Prepares and disseminate information concerning the status of the fairway and the changes in the navigational conditions and issues weekly bulletins Performs trailing and clearing of the navigational way, the navigational channels the winter areas of the ports, winter camps and temporary winter shelters by organising the respective diving and vessel lifting works Produce the navigational signs and perform repairs and maintenance of the floating and bank signs

12 Manage the activity of technical devices for gathering of oil spills, the location of special water surroundings and the receiving the waste oil containing waters from transit passing vessels in the common Bulgarian-Romanian section of the Danube Together with HTPD coordinate the quarries for extraction of inert materials from the Danube regarding the navigational safety Participates in the preparation of projects and statements for implementation of dredging works HTPD is also structured in two sections Hydrotechnical section and Project section Figure 5 Sections within HTPD The main responsibilities of this directorate are as follows: Performs the entire complex of hydrographical and morphological surveys in the Bulgarian section of the Danube river Performs measurements in the critical areas for navigation, water areas of the ports, winter camps (firths), temporary winter shelters and secondary branches

13 Performs special measurements for defining the midstream of the Danube river that are directly connected with the state ownership of islands and the state boundary Organises and perform measurements for hydrographical, pilots and navigational maps of the Danube river Produce hydrographical layouts, hydrographical surveys, longitudinal and cross sections of the Danube river concerning design and construction works in the Bulgarian stretch of the river for the needs of the river transport and upon request of physical persons and/or legal entities Prepares Register of sandbars, study and analyse the changes in the critical for the navigation sections in order to consider the bet possible alternative for improving the navigational conditions Prepares projects for riverbed deepening works and flow guiding cuts for improving the navigational conditions on the Danube fairway, in the water areas of the ports, winter camps and areas where timely intervention is needed

14 Performs investor s control and supervision over the construction for the needs of the Agency as well as for the overall and current repairs of the buildings Prepares, elaborate and disseminate ENCs for the Bulgarian section of the Danube in accordance with the international standards Prepares and implement EU funded projects and projects financed under international programmes related to the inland waterway transport Organise and coordinate the international communication and cooperation of the Agency The projects that currently are under preparation or implementation by EAEMDR are: Construction of a winter camp for winter pass of 39 vessels 3rd stage The first 2 stages of this project are financed under PHARE and the 3 rd is from the national budget Improvement of the navigation in the joint Bulgarian-Romanian section of the Danube river from rkm 530 to rkm 520 Batin and from rkm 576 to rkm Improvement of the navigational systems and topohydrographical measurements along the Danube River These 2 projects are included in the Bulgarian Sectoral Operational Programme on Transport EAEMDR is a partner in the following projects, financed under The South East Europe Transnational Cooperation Programme: In 2009 the Agency submitted official request for joining the partnership of the PLATINA project within which to implement activities as a Promotion and Development Centre.

15 In connection with its international activities EAEMDR participates in: the Danube Commission in Budapest; the Working Group for the Inland Waterway Transport in the UN ECE based in Geneva; the Joint Bulgarian Romanian Commission for the Ruse Giurgiu Bridge; the Joint Bulgarian Romanian Commission for the Danube River; the GIS Forum Danube and in the activity of several other international organizations, concerning infrastructure, environment and other problems of the Danube river and of the European internal waterways as well. 16 The main responsibilities of this directorate are as follows: Performs all hydrological measurements and the entire complex of 24-hour synoptic and meteorological observations on the Danube River Performs all measurements to define the low and high navigation water level and the water temperature Performs measurements to define the flow velocity in the fairway and in the port areas as well as in the critical for the navigation sections and the Ruse Giurgiu bridge Performs measurements to determine the alluvial flow of the river at the main hydrometric stations Implements research activities in the field of the river s hydrology Performs daily, monthly, annual and multiannual documents on the basis of he meteorological data from the HMSs of the Agency Issues two-day and weekly forecasts for the water levels of the river as well as three-day prognosis for ice appearance Issues daily Hydrometeorological and Navigational Bulletin for the Danube River Submit storm notices to the skippers, ship owners, ports and Civil Defence services.

18 Financial resources The budget of the Agency is formed from national budget funds. It also has incomes for providing services to external bodies. The national budget funds include transfers from the budget of the MTITC for expenditures related to the implementation of the state functions of the Agency and to the payments for services necessary for its activities. The budget if elaborated every year according to the MTITC methodology. 20 The allocations for investments in the years are graphically expressed in the following figure: Figure 12 EAEMDR investments share Technical assets EAEMDR has 14 vessels for the implementation of its main activities as well as the relevant hydrological and hydrographical equipment. The Agency owns a dredger and three self-propelled barges. The Vida dredger has a capacity of 150 m 3 per hour and the barges have load capacity of 381 tones. This equipment is used to perform dredging works at dangerous locations and access channels of ports. The dredging data for 2008 are the following: Along the fairway not performed Ports m3 Gaining of inert materials m3 New construction works not performed Figure 13 The Vida dredger

21 The hydrographic ship Vit is used to maintain the navigational conditions and if necessary the following ships are also used: Dunav, Yantra, Kableshkov and Vidbol. Figure 14 Installation of buoys with the ship Vit The floating and coastal signs for maintenance of the navigational conditions are produced in the workshop of EAEMDR as well as the concrete anchors and reinforced concrete posts needed for installation of the coastal signs. Figure 15 Oil skimmer Pomorie The Agency collects oily and greasy ship waste according to the Law on waste management. The oil skimmer is effectively used to control oil spills and in event of a damage or breakdown of an oil transferring equipment. The volume of oil tank is 19.3 m³.

23 For implementation of Vessels lifting and emergencyrescuing operations EAEMDR owns a floating crane with loading capacity of up to 100 tons. Figure 18 Crane Titan From 15th May 2009 the Agency put into operation a new BG IALA beacon. Figure 19 IALA beacon The main purpose for establishment of this station is increasing the safety for the navigation by improving the accuracy in positioning and controlling of the vessels along the Danube river.

24 7 SWOT-ANALYSIS Strengths The Agency has a good leadership and management that provide more than 50 years good image and stable positions of he organization. It has strong partners not only on a national but on international level as well. EAEMDR keeps good working relations with other organizations, especially with the Romanian ones. The international activities of the Agency and the participation in international projects provide its good international presence. Weaknesses The restricted budget is a significant weakness of EAEMDR because it prevents the organization to implement its activities to maximum extent and limits the investment policy. There is need of additional training of the experts in order to be aware of and in line with the new approaches and technologies in the implementation of the activities. The periodical staff reductions lead to shortage of qualified staff. Opportunities In order to overcome some of the abovementioned weaknesses a good opportunity is the international partnership and cooperation which helps the experts to gain and to exchange experience with our partners. Other solution could be the development of potential human resources through voluntary training organized by the Agency, where out experts can share their knowledge and skills with potential employees. Due to the fact that EAEMDR see itself in the future as a modern and developed organization it a good opportunity could be the approval of our request to implement activities as a promotion and development center within the PLATINA project. Threats The political factor is one that affects mainly the public authorities among which is EAEMDR. The economical situation is also affecting all the actors in the public and the private sector not only on a national but on international level. These 2 threats lead to third one possible unforeseen cuttings of the budget. Due to the competition between the public and private sectors a risk of shifting of qualified staff to the private sector also

25 exists. Last but not least, negative impact on the working process and difficulties for decision making could cause the insufficient coordination between state institutions that happens sometimes and needs to be improved.
