13 CITY OF OCEAN SHORES, WASHINGTON ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF OCEAN SHORES, WASHINGTON, FIXING THE AMOUNT OF THE ANNUAL AD VALOREM PROPERTY TAX LEVY NECESSARY FOR FISCAL YEAR 2018; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the Ocean Shores City Council has met and considered its budget for fiscal year 2018; and WHEREAS, the Ocean Shores City Council is required, pursuant to Chapter 35A.33 RCW, within the time therein specified, to adopt an ordinance fixing the amount of ad valorem taxes to be levied for the ensuing year; and WHEREAS, in accordance with RCW and Chapter 35A.33 RCW, the City Council held a public hearing on October 9, 2017, to consider budget issues, including revenue sources and possible increases in property tax revenues; and WHEREAS, the City of Ocean Shores actual levy amount from the previous year was $3,131,166.42; and WHEREAS, the actual levy amount from the previous year included a $0.277 levy lid lift for the City s Library; and WHEREAS, the $0.277 levy lid lift for the City s Library expires on December 31, 2017; and WHEREAS, the City s 2018 basic levy starting point is $2,785,825.10, as calculated by the Grays Harbor County Assessor s Office; and WHEREAS, the population of the City of Ocean Shores is less than 10,000; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF OCEAN SHORES DOES HEREBY ORDAIN AS FOLLOWS: Section 1. A decrease in the regular property tax levy is hereby authorized for the levy to be collected in the 2018 tax year. That the annual amount of Ad Valorem Tax Levies of the City of Ocean Shores for the fiscal year 2018, necessary to raise the amount of estimated expenditures be, and the same are hereby levied upon real and Page 1 of 3 Ordinance No. 6. 14 personal property subject to taxation in said city in all assessment districts thereof and upon each dollar of taxable value, as follows: To wit: In all assessment Districts for the payment of $2,813, or amount limited by law, which includes an increase of 1% on the City s 2018 basic levy starting point of $2,785, The previous year was $3,131, and the dollar decrease would be $317, which would be a decrease of % from the previous year. This decrease is exclusive of additional revenue resulting from new construction, improvements to property, newly constructed wind turbines, solar, biomass, and geothermal facilities and any increase in the value of state assessed property, any annexations that have occurred and refunds made. Voter Approved Regular Levy: For EMS purposes a levy of $488, or amount limited by law. The previous year was $483,324.00, the dollar increase would be $4, which is an increase of 1%. This increase is exclusive of additional revenue resulting from new construction, improvements to property, newly constructed wind turbines, solar, biomass, and geothermal facilities and any increase in the value of state assessed property, any annexations that have occurred and refunds made. Voter Approved Debt Purposes: 2002 Treatment Facilities G.O. Bonds: $1,520,000 Section 2. That said taxes herein provided for are levied for the purposes of raising revenue sufficient to pay the principal and interest upon the general bonded indebtedness of the City of Ocean Shores, for a portion of the General Fund and for the operation of the different departments of the municipal government of the City of Ocean Shores for the fiscal year beginning January 1, 2018 and ending December 31, 2018, and are hereby levied upon all real and personal property as shown by the assessment in the County of Grays Harbor as finally fixed by the County and State Board of Equalization and as extended upon the books of the County Assessor, showing the property within the said City subject to taxation for municipal purposes and upon the amount of said real and personal property as certified by the County Assessor, all pursuant to and under the virtue of the laws of the State of Washington. Section 3. That the taxes collected from the levies hereby fixed and made, together with the estimated revenues from sources other than Ad Valorem taxation which constitute the appropriations of the City of Ocean Shores for the fiscal year 2018, and hereby appropriated as itemized and classified in the annual budget for the fiscal year Page 2 of 3 Ordinance No. 6. The several provisions of this ordinance are declared to be separate and severable and the invalidity of any clause, sentence, paragraph, subdivision, section, subsection, or portion of this ordinance, or the invalidity of the application thereof to any person, property, or circumstance, shall not affect the validity of the remainder of this ordinance or the validity of its application to other persons, property, or circumstances. Section 5. Any act pursuant to the authority of this ordinance taken after the passage of this ordinance is ratified and confirmed. Section 6. This Ordinance shall take effect five (5) days after the date of publication. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF OCEAN SHORES, WASHINGTON, ADOPTING THE 2018 BUDGET WHEREAS, notice of hearings for the adoption of the budget have been published pursuant to RCW 35A , designating the date, time, and place for the public hearings on the budget; and WHEREAS, the City Council, at public meetings on October 23, 2017 and November 13, 2017, did meet in accordance with the notice of hearing to consider adoption of the budget; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF OCEAN SHORES, WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Estimated resources for the year 2018 for all funds are set forth in summary form in the attached Exhibit A entitled City of Ocean Shores Operating and Capital Budget, and are hereby appropriated as shown for expenditures, transfers or ending balances during the year Section 2. Year-end resources in any fund which exceeded the estimate shown in the attached Exhibit A are hereby appropriated as ending balances for that fund. Section 3. Pay grids and salary schedules, as set forth in previously adopted collective bargaining agreements are hereby adopted by reference and made part of the 2018 budget. Section 4. This Ordinance shall take effect five (5) days from the date of publication. Once established, adjustments are made to the amount of tax collectable on a daily basis. These changes are due to exemptions granted after levy certification, BOE decisions, destroyed property removals or other corrections. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OCEAN SHORES, WASHINGTON, AUTHORIZING THE CITY TO RE-LEVY TO RECOVER LOST TAX REVENUES AS PROVIDED FOR IN SUBSTITUTE SENATE BILL 5705 AMENDING RCW FOR 2018 WHEREAS, each January a new tax roll is created to levy the property taxes for that year; and WHEREAS, once established, the tax roll becomes a living document with adjustments made to the amount of tax collectable on a daily basis due to exemptions granted after levy certification, County Board Of Equalization decisions, destroyed property removals, or other corrections or adjustments; and WHEREAS, due to such other corrections and adjustments, in 2018 the City of Ocean Shores will receive less tax revenue than for 2017 ( lost tax revenue ); and WHEREAS, the State passed Substitute State Bill 5705 in 2013 amending RCW , which allows taxing districts to recover such lost tax revenues through a redistribution of lost tax revenues across the district s taxpayers ( re-levying ); and WHEREAS, the City Council of the City of Ocean Shores has reviewed the SB 5705 amendments to RCW and deems it to be in the best interests of the City to authorize such re-levying for lost tax revenues; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ocean Shores, Washington, that the Mayor is authorized to execute the appropriate documents to re-levy and redistribute such lost tax revenues in the taxing district for the year PASSED AND ADOPTED by the City Council of the City of Ocean Shores, Washington, at a regular, open public meeting on this 13th day of November ATTEST: Crystal L. Staff would like to confirm that the layout, as conceptually represented, is consistent with Council s vision for Alternative D prior to proceeding with the work to conceptually lay out the remainder of the project (to the City Gates) and prepare a planning level cost estimate. Please note that while the figures look slightly different, the only substantive changes are the color variations and addition of callouts. Once the planning level cost estimate and conceptual layout of the corridor is complete, Staff will return to Council to confirm a preferred alternative and the separate bike lane / sidewalk or shared use pathway prior to beginning design and environmental permitting work.
