2 This project is related to the St. Lucie Inlet Management Plan Implementation. Bathtub Beach has been subject to erosion related issues beginning in the Fall 2007 time frame. Repeated dune breaches caused road closures on MacArthur Blvd. and required extensive emergency sand trucking projects to stem the damage. After each event the beach and dune rolled further west. Today the dune actually sits on the west side of the original beach parking lot and is now immediately adjacent to MacArthur Blvd. Although the last 18 months have been somewhat kinder to the County beach, presenting no emergencies, it has lost its resiliency and much of its storm protection value. Additionally, it should be noted that the erosion stress previously experienced at Bathtub Beach appears to have moved slightly south to the beach fronting the Sailfish Point Community. Over the last few years, the homes that were originally constructed well back from the waterline began to experience accelerated erosion and loss of the beach and dune that had protected their homes, and eventually resulted in major damage to the homes. As a last resort, seawalls were constructed to protect the structures only. Sailfish Point Property Owners and Country Club Association, Inc. (SPPOA) stated the desire to construct a beach and dune project such that these walls would be buried from sight and serve only as protection against major storms. The beaches that front Bathtub Beach Park and Sailfish Point form a unique system, bounded by a continuous reef to the east that prevents the normal onshore-offshore movement of sand and inlet/jetty to the south that cuts off the northward movement of sand. In order to address beach management issues in this system, a system-wide approach is required. To accomplish this, on September 10, 2013 the SPPOA entered into a Memorandum of Agreement (MOA) with Martin County to construct the Sailfish Point/Bathtub Beach Restoration Project (Project) and split all project costs evenly. (A copy of the MOA is attached) The Project is approximately 1 mile long beginning about 500 ft. north of Bathtub Beach Park and extending south into Sailfish Point. The Project is expected to require more than 300,000 cy of sand which is to be taken from a combination of locations: 2 flood shoals inside the St. Lucie Inlet, the St. Lucie Inlet impoundment basin and navigation channel. Removal of sand from the impoundment basin and navigation channel will have an added benefit of extending the time before a major maintenance dredge project is required. A single bid for the project was received by the County on January 13, 2016 from Ferreira Construction. After verification of the bid, Ferreira Construction was determined to be a qualified bidder. Staff has estimated the full cost, inclusive of construction observation, contract administration, monitoring, parking lot restoration, dune vegetation and contingencies to be $ 5,325,000. The SPPOA voted to fund 50% of the local Project cost share at their meeting on January 22, State funding for this Project is partially dependent on public parking, restroom facilities and access. The original beach parking lot accommodated over 150 cars while the current parking lot can hold a maximum of 70 cars. A minimum of 100 spaces is required to receive the maximum cost share through the state grant. During construction, the parking lot will be used as a staging area and the sand stored in the north end of the lot will be moved east into the newly constructed project. Site restoration will require the re-establishment of an efficiently planned parking lot with a capacity over 100 cars. This work was not requested in the Project s bid specifications nor was it a part of the bid proposal from Ferriera. Agreement/Contract drafted by Martin County Attorney s Office 80741c8b 2 of 12

Purpose of the Agreement/Contract Contract award of $3,498,000 for the Bathtub Beach / Sailfish Point Beach Renourishment Project. New/Renewal/Modified This is a new contract. Duration: January 26, 2016 through June, 2016 Benefits to Martin County Restoration of an important tourist and recreational area, improvements to ecological function of the area, protection of upland infrastructure including MacArthur Blvd, and mitigation for St. Lucie Inlet impacts. Cost to Martin County $1,677,643. ISSUES: The low bidder for the Bathtub Beach/Sailfish Point Beach Construction Project is Ferreira Construction at $3,498,000. An additional $1,827,000 in construction related costs for work not covered in the Ferriera contract include tasks such as: site restoration, dune vegetation and post-project monitoring are expected. The estimated total for all tasks is $5,325,000. Reimbursement through the grant agreement with DEP for this project is expected to pay for approximately $1,969,715 in project costs. LEGAL SUFFICIENCY REVIEW: This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, has identified and addressed legal risks, and has developed strategies for legal defensibility. RECOMMENDED ACTION: RECOMMENDATION a. Move that the Board approve the recommended Project bid with Ferreira Construction and authorize execution of the proposed contract. b. Move that the Board amend CIP sheet for the Project to reflect all project related activities, appropriate bid award and additional revenues. c. Move that the Board approve the Budget Resolution for the Project. ALTERNATIVE RECOMMENDATIONS Provide additional direction to staff. 12 MARTIN COUNTY FY 2016 CAPITAL IMPROVEMENT PLAN (CIP) Project Information Title: Project #: Location: Bathtub Beach & Sailfish Point Beach Restoration 2072 Hutchinson Island Priority LOS Category: Estimate Level 2 (Restoration) Non-concurrency 2 District: Project Description and Justification Countywide Status Revision 1/26/2016 Bathtub Beach & Sailfish Point beaches have suffered from storm impacts annually during the September-October time frames since Storms will continue to have severe impacts on these beaches and cause unfunded emergency response efforts, typically in the range of $500,000 of County funded work each year. In 2014, the County entered into an agreement with the Sailfish Point POA, allowing Sailfish Point to proceed with design and permitting efforts for a project encompassing a continuous stretch of beach along portions of the Sailfish Point coastline and Martin County's Bathtub Beach Park. The County ageeed, that if constructed, the project cost would be split equitably between the two parties. It is estimated that approximately 350,000 cubic yards of sand will be required for this project. The proposed source for this sand is the St. Lucie Inlet flood shoal. As the current Draft Inlet Management Plan alots 34,000 cy/yr of sand bypassing to this project area, the cost for this sand is shown in the St. Lucie Inlet Maintenance CIP sheet. This equates to 20% of the initial project costs. Bathtub Beach is an extremely popular destination for local families and visitors to the area. Although a wider more stable beach will Enter Map Here be a great benefit in the future, an empahasis on education and outreach efforts will be required during construction to keep the public informed of restricted access. The project eligibility in the State's Long Range Beach Management program has been reduced from 50% to 27. 8% of the project costs based on the number of parking spaced currently available.
