2 The Port St. Lucie Urbanized Area (PSL UZA) is comprised of both Martin County and St. Lucie County. Federal Transit Administration (FTA) funding is allocated to the PSL UZA annually and it is required that both Martin County and St. Lucie County agree to an apportionment split. Historically, St. Lucie County and Martin County have split the FTA Section 5307 Urbanized Formula Funding Grant for Operating and Capital Assistance for the PSL UZA with a % / % respectively. Upon submitting the FY15 split letter to St. Lucie County for signature, St. Lucie County refused to sign and countered with a split of % / % which comes from the FTA Table 3A Section 5307 Operating Assistance Special Rule Operator Caps for Urbanized Areas over 200,000 in population and attached hereto as Exhibit A. The percentages provided in the FTA Table 3A are based on fixed route vehicle revenue hours (VRH) dedicated to the urbanized area only and represent the maximum dollar amount in operating assistance each grantee can apply for. After negotiation, St. Lucie County staff submitted a second proposal request to change the split percentage to 70.40% / 29.60% using a formula provided by the Florida Department of Transportation s (FDOT) Federal Grants Administrator and attached as Exhibit B. FDOT s split recommendation (Exhibit B) is weighted on vehicle revenue miles (VRM), passenger miles, operating expenses and population within the urbanized area for both fixed route and demand response services. Martin County transit staff recommends a combination of two split percentages. For the capital portion of the PSL UZA, the historical split will be used. For the operating portion of the funding, the FDOT formula will be used. This result is a net percentage split of 69.53% / 30.47% or $2,047,323 / $897,195 as per Exhibit C. The consequence of this split change is a decrease in available funds to Martin County of $74,832 from the historical split for FY15. ISSUES: FTA requires that the governing Board accepting the funds approve any change in the allocation split of the PSL UZA. St. Lucie County staff and Martin County staff are recommending the split of 69.53% / 30.47% or $2,047,323 / $897,195 respectively for the FTA Section 5307 FY15 funds. For future funds, an agreement for the allocation split will need to be negotiated and approved by both the St. Lucie County Board and the Martin County Board. Staff will bring a recommendation back to the BOCC once the FY16 funding allocation tables have been released by FTA. St. Lucie County has requested that the FTA Table 3A be used as the new method of funding split for FY16 and future years for both operating and capital. Using this method for FY15 would have resulted in a decrease of 10.14% or $298,392 to Martin County. Since Martin County and St. Lucie County differ in the process used to deliver transit services to the community, it is anticipated that using either one of these methods to split funding would decrease Martin County s portion each year. Thus, reducing transit services or increasing County general funds to maintain current level of services. LEGAL SUFFICIENCY REVIEW: ea 2 of 9
3 This item has been reviewed for legal sufficiency to determine whether it is consistent with applicable law, has identified and addressed legal risks, and has developed strategies for legal defensibility. RECOMMENDED ACTION: RECOMMENDATION Move that the Board authorize the Engineering Department Director to sign the FY15 FTA Section 5307 Formula Funding Split Letter, whereas Martin County would receive $897,195 out of $2,944,518, the total FY15 allocation. ALTERNATIVE RECOMMENDATIONS If Board does not approve, a meeting between the Martin BOCC and St. Lucie BOCC will need to be set up to negotiate an agreed upon split for FY15 Section 5307 Formula Funds.
