2 IACS legislative framework (1/2) Amendments to Regulation (EU) No 809/2014 Still a working document DS/CDP/2017/08 to introduce monitoring and the use of geo-tagged photos, drones, Sentinels data as complementary evidence in OTSC IACS legislative framework (1/2) Derogation May 2017 from the deadline for submission of applications (15 May 15 June) Farmers affected by adverse weather conditions Derogation August 2017 from the level of advance payments for DP (Article 75(1) of Regulation (EU) No 1306/2013) Adopted by written procedure in 2 steps: Belgium, Czech Republic, Spain, Italy, Latvia, Lithuania, Hungary, Poland, Portugal and Finland. Ireland, Greece, Croatia, Romania and the United Kingdom (N- Ireland). 2

3 2017: minor changes Guidance documents OTSC (DSCG/2014/32), LPIS/EFA layer (DSCG/2014/33) GSAA amended (DSCG/2014/39, CDP October 2017) to take into account the 'greening review' New definitions of certain EFA elements Removal of dimension limits Requirement of 100% administrative checks re: the ban on use of plant protection products on certain EFAs JRC CDP (Oct 2017): Geotagged photos + LPIS upkeep & monitoring. Guidance documents (Cont) 2018: possible amendment of the OTSC and LPIS guideline to take into account the Omnibus changes (new definition of permanent grassland) and amendments to Reg. 809/2014 (additional evidence that can be used for OTSC) Complemented by technical DG JRC guidance 3

4 2017 implementation support visits to Member States 6 countries visited so far: RO, PL, BG, AT, IT, LT To discuss Member States' main experiences on implementing the management and control elements of the CAP To exchange ideas for further simplification and future CAP reform In some cases combined with LPIS-QA support visit Also meetings with farmers associations to have their input Implementation support visits to Member States Examples of challenges mentioned: Controls of Active Farmer, Young Farmers payment, Small Farmers Scheme Introduction of 'Yellow Card' - considered burdensome Application of Permanent Grassland definition Penalties regime not understandable for farmers Examples of issues for future changes Continue simplification and reduction of admin burden Increase tolerances for area determination Integrate cross compliance with other requirements (greening etc.) Widen possibility to reduce OTSC-rate to all schemes Move towards 'preventative' approach based on Sentinel images etc. 4

5 AAR and Action Plans For Direct Payments in 2017 currently 1 action plan finalised, 3 on-going and 5 possible plans under consideration Examples of issues to be addressed: Correct area cannot be determined due to weaknesses in LPIS or lack of update; incorrect interpretation of area eligibility rules etc. Identification and registration of animals not reliable; animal on-the-spot checks not of sufficient quality The respect of the active farmer conditions is not correctly or sufficiently checked AAR and Action Plans Examples of actions introduced by Member States in their action plans to address the abovementioned issues Acquisition of new/better orthophotos; shorten the LPIS update cycle; training of staff to better interpret images; improve support to beneficiaries when they submit geospatial aid application; perform field visits for quality control Campaign among farmers to promote correct animal I&R, including improved notification procedures and forms; revise instructions and check-lists for inspectors; revise arrangements with delegated bodies carrying out the checks Change of procedures; training of staff; improve information and guidance to applicants 5
