1 AGENDA REPORT TO: Mayor & City Commission FROM: Ken Hibl, City Manager DATE: August 4, 2017 RE: Necessity Hearing Beech Street Improvement Project (Driveway Approaches) For the Agenda of August 7, 2017 Background. During the conduct of a scheduled City Commission meeting on February 20, 2017, the Commission approved the abandonment of a portion of the Beech Street Right-of-Way. A subsequent discussion ensued regarding a proposed street rehabilitation project for this street and whether curbing and driveway approaches should be included in the project and who pays for these construction items. A decision to use a rolled asphalt curb versus a typical concrete curb was made. Similarly, the City Staff has proposed that asphalt driveway approaches be utilized for this project. I ve prepared the requisite report (copy att d) regarding the necessity of the driveway approaches for this improvement project and Diane Lyon, our City Clerk, has caused public notice (copy att d) to be published to allow the conduct of a Necessity Hearing for this project. The City Commission is now asked to conduct the Necessity Hearing and make a determination as to the necessity of the project. Issues & Questions Specified. Should the City Commission hold a public hearing on necessity for the proposed project and render a decision in respect to the necessity to pave the driveway approaches within the boundaries of the improvement project? Alternatives. 1. Hold the hearing and declare the necessity of the project.. 2. Hold the hearing and declare the project not to be necessary. 3. Do not hold the hearing.. 4. Set the matter aside for further consideration and/or deliberation at a later date. Financial Impact. The total estimated project cost of paving the driveways within the project area is $1,954.13; I propose these costs should be borne by the property owners. Recommendation. I recommend that the City Commission approve by motion the conduct of a public hearing and subsequently declare the necessity of the project. Attachments. 1. Manager s Report. 2. Public Notice. 3. 2 CITY MANAGER S REPORT PROPOSED DRIVEWAY APPROACHES FOR THE BEECH STREET IMPROVEMENT PROJECT AUGUST 3,, 2017 BASIS FOR THE REPORT.. This report is provided to the Clare City commission IN ReSPONSE R TO COMMISSION DISCUSSION RELATED TO THE ABANDONMENT OF A PORTION OF THE BEECH STREET RIGHT-OF OF-WAY AND AN ENSUING DISCUSSION RELATED TO CURB AND APPROACHES AT THE SCHEDULED FEBRUARY 20 TH COMMISSION MEETING. The report provides specific information to the City Commission to assist in facilitating decisions in respect to a potential public street improvement project and outlines general plans, estimates of costs of the project; the estimate of the potential life of the proposed project; and a description of the proposed assessment district. The report is mandated and its content specified by chapter 4, Section of the Clare City Codes and Ordinances. SCOPE OF THE PROPOSED PROJECT.. The proposed project involves the needed improvement of PORTIONS OF BEECH B STREET, AND MORE SPECIFICALLY THE PAVING OF DRIVEWAY APPROACHES IN CONJUNCTION WITH A PLANNED STREET REHABILITATION PROJECT. Estimated costs ARE $1, FOR 1,188 square feet of asphalt for paving of driveway approaches for five property owners. PLANS. No engineering plans are required for this portion p of the project. DETERMINATION OF NECESSITY.. The existing driveway approaches are unimproved and generally a combination of dirt and gravel, thereby causing dirt and gravel to migrate onto the paved street, which will ultimately cause damage to the street and shorten its lifespan. The proposed improvements will clearly benefit the immediately affected parties and the City of Clare as a whole. ESTIMATED LIFE OF THE PROJECT.. The minimum estimated life of the project is twenty-five (25( 25) ) years. ESTIMATED TOTAL COST OF THE PROJECT.. $1, , RECOMMENDED PORTION OF THE PROJECT TO BE BORNE BY THE BENEFITED PARTIES.. $1, , RECOMMENDED PORTION OF THE PROJECT TO BE BORNE BY THE CITY OF CLARE AT LARGE. NONE.

6 RESOLUTION A RESOLUTION OF THE CLARE CITY COMMISSION DECLAREING THE NECESSITY OF PAVING DRIVEWAY APPROACHES AS A COMPONENT OF A STREET IMPROVEMENT PROJECT FOR ONE BLOCK OF BEECH STREET. WHEREAS, the City is in the process of completing three primary street improvement projects (Beech Street, W. Seventh Street, & John R Street) that were included in the City s 2017/2018 Construction Improvement Program (CIP); and WHEREAS, a proposed component of the Beech Street Improvement Project is to pave the currently unimproved driveway approaches within the project area; and WHEREAS, the City Manager has prepared a report outlining the necessity to pave said unimproved driveway approaches as required by Chapter 4 of the Ordinance Codes of the City of Clare; and WHEREAS, the City Commission has reviewed said report: has deemed that paving said unimproved driveway approaches is justified; and has subsequently held a public hearing to hear objections to the necessity of the proposal; and NOW THEREFORE BE IT RESOLVED THAT the Clare City Commission hereby declares the necessity to pave the presently unimproved driveway approaches within the 2017/2018 Beech Street Improvement Project boundaries and that the costs for paving said approaches should be borne by the respective property owners within said project area. ALL RESOLUTIONS AND PARTS OF RESOLUTIONS INSOFAR AS THEY CONFLICT WITH THE PROVISIONS OF THIS RESOLUTION BE AND THE SAME ARE HEREBY RESCINDED. The Resolution was introduced by Commissioner and supported by Commissioner.
