CALL TO ORDER: The meeting of the was called to order by Chairman Hough at 5:15 PM on Thursday,, in suite 102 of the Nannini Administration Building, Elko, Nevada. ROLL CALL: Members Present: Absent : Others Present: John Kingwell, Supervisor/Planner Eleanor O Donnell, Administrative Assistant Peggy Pierce-Fitzgerald, Planning Tech/GIS Operator Curtis Moore, District Attorney s Office PLEDGE OF ALLEGIANCE: Chairman Hough led the pledge of allegiance. APPROVAL OF MINUTES June 16, 2016 regular meeting minutes

2 Page 2 MOTION: Commissioner Galyen moved to approve the minutes from the June 16, 2016 meeting as written, Commissioner Larason seconded. Motion carried. COMMENTS BY THE GENERAL PUBLIC No comments NOTICE OF THE APPEAL PROCESS Chairman Hough advised everyone of the appeal process. PRELIMINARY HEARINGS Betty Reed Bear Revocable Living Trust An application submitted by Betty Reed Bear Revocable Living Trust for a change of zoning request from Special Lands to M1, General Industrial uses as allowed within the M1 District. Location: A parcel of land located in Section 30, T.35 N., R. 56 E., M.D. B. &M., Elko, County, Nevada, being Parcel 4 as shown on the Record of Survey for Betty Reed Bear Revocable Living Trust, on file in the office of the Elko County Recorder, Elko, Nevada as File No APN H-023. Address is 6923 E. Idaho St., Elko, NV. Applicant/Owner: Betty Reed Bear Revocable Living Trust John Kingwell stated the application is ready to move forward to a public hearing in August.

3 Page 3 MOTION: Commissioner Galyen made a motion to forward Application No , Betty Reed Bear Revocable Living Trust, for a public hearing to the August 18, 2016 meeting, seconded by Commissioner Judd. Motion passed. PUBLIC HEARINGS David & Naomi Heneage (Continued from the June 16, 2016 meeting) A public hearing regarding an application requesting a street/roadway or other right of way vacation submitted by David & Naomi Heneage, for a vacation of a portion of 3 rd Street and West Street, located in the Town of Gold Circle (Midas), Nevada. Location: A portion of West Street along Block P, Lots 1 & 2, and a portion of 3rd Street along Block P, Lot 1, as shown on File 82, Town of Gold Circle, filed in the office of the Elko County Recorder. Located in Midas, Nevada. Applicant/ Owner: Naomi & David Heneage Mr. Kingwell had presented the staff report during the last meeting for application David & Naomi Heneage. Amendments to the staff report were made after a consultation with the applicant and the county surveyor. The amendments are written in blue. Mr. Kingwell read the amendments that were made to the staff report. Mr. Kingwell stated that Mr. Heneage had gone out and located the pins to his property. Mr. Heneage has agreed not to build on the RS 2477 roadway.

4 Page 4 Mr. Kingwell explained the importance of not building on the RS 2477 roads as they exist. The county will not allow any abandonment on RS 2477 roadways. Mr. Kingwell read the staff recommendations, findings and conditions with the amendments. Chairman Hough expressed his concerns with the prescriptive roads within Elko County. Discussion followed on RS 2477 roads and the importance of prescriptive roads within Elko County and the restrictions on building within the roadways. Curtis Moore explained that RS 2477 protects the existing roads. Public comments: David Heneage thanked Mr. Kingwell and Commissioners on their cooperation on this issue. Mr. Heneage went out and found the original pins to his property. He stated that a dozer drove right through the pins that are 20 wide without damaging them. Mr. Heneage stated that the road extends 4 tenths of a mile, and hasn t been driven on for quite some time and ends at a cliff. He stated that it is over grown by weeds. He said that the property that he owns is completely off the road. Mr. Heneage explained what he did to survey the property and the RS 2477 roadway. He stated that he was pretty lucky and the RS 2477 roadway barely touches his property. He stated that he has no problem with the agreement that was made with the Elko county staff. He commented that the prescriptive roads were an issue and that maybe there could be a study done regarding them. Chairman Hough asked if he was satisfied with the agreement. Mr. Heneage stated that he is satisfied with the staff findings and agreement. MOTION: Commissioner Galyen moved to forward an application , David & Naomi Heneage, to the Elko County Commission with the Planning Commission s recommendation for approval with staff s recommendation, conditions and findings, seconded by Commissioner Judd. Motion passed.

5 Page Timothy and Timbre Young An application submitted by Timothy and Timbre Young requesting a conditional use permit to allow for an invalid residence for a family member under Elko County Code (B) 14. Location: A Acre parcel of land described as Parcel 1 of that Parcel Map for Edward Jaffe with File No filed in the office of the Elko County Recorder September 12, Said parcel is located in Section 17, Township 34 N., Range 55 E., M.D.B. & M. Address is 1625 Royal Crest Drive in Elko, NV. Owner/Applicant: Young, Timothy C. & Timbre D. Mr. Kingwell stated staff is still awaiting a letter from the applicant outlining the condition and the reason why the need for a secondary residence and would like to continue this item until the next meeting. Public Comments: Mary Sheen stated that she just received the agenda and staff report today. She expressed her concerns regarding their access off of Sundance Drive. She stated that she doesn t think an ambulance or fire truck can get down the driveway they are creating off of Sundance Drive for the secondary residence. MOTION: Commissioner Larason moved to continue application to the August meeting, seconded by Commissioner Judd. Motion passed.

6 Page 6 OTHER BUSINESS None STAFF UPDATE AND COMMISSIONERS COMMENTS Commissioner Galyen asked if the board could submit to Mr. Kingwell, a list of projects that the Planning Commission has approved in the past and what the status of these projects are. If any board member would like to a list to Mr. Kingwell before the agenda date, he could review the status and report back at the next meeting. Commissioner Hough commented on Oasis and how he would be interested in the status of that area. Commissioner Galyen commented on sending Mr. Kingwell an so he can research the status and report back to the board at the next meeting.
