1 Wholesale Sales Tax Return The Virginia Wholesale Sales Tax Return is a monthly return filed by licensed distributors. The distributor will be required to file fuel sales in detail delivered to the localities listed in this document. P a g e 1

5 Definitions: Cost price means the actual cost of the fuels in money or other consideration. Cost price includes all federal and state excise taxes and storage tank fees paid by the distributor and any transportation or delivery charges. Separately stated federal diesel fuel excise taxes may be excluded from the sales price and the cost price, however, any distributor who fails to exclude the federal diesel excise tax when collecting any sales tax may not deduct the federal diesel excise tax from his taxable sales. No deduction is allowed for the cost of the property sold, the cost of materials used, labor or service costs, losses or any items of expense. Gross sales are the total for the sales of fuel to retail dealers except for sales to retail dealers that are also a licensed wholesale distributor. Gross sales includes the cost of the fuel, markup, federal and state excise taxes, and storage tank fee but does not include separately stated federal diesel excise tax or the fuels wholesale sales tax. Sales to government entities and non-profit 501(c)(3) entities are required to be included in gross sales. Retail Dealer is any person, including a distributor who sells fuel to a consumer or to any person for any purpose other than resale. Sales price means the total amount charged in money or other consideration by the distributor for the sale of fuels. This includes transportation or delivery charges, all applicable federal and state excise taxes, and storage tank fees. No deduction is allowed for the cost of the property sold, the cost of materials used, labor or service costs, losses or any items of expense. However, sales price does not include the following amounts: Separately stated federal diesel fuel excise taxes. Separately stated federal diesel fuel excise taxes may be excluded from the sales price, however, any distributor who fails to exclude the federal diesel excise tax when collecting any sales tax may not deduct the federal diesel excise tax from his taxable sales. Any finance charges, carrying charges, service charges or interest from credit extended under conditional sale contracts or conditional contracts providing for deferred payments. Any bad check and late payment charges. Any charges for billing and collection services. P a g e 5

Include sales to government entities and 501(c)(3) entities within any of the qualifying counties and or cities in Gross Sales of Fuel. Do not report sales to other licensed wholesale distributors. For sales within the qualifying counties and or cities, you are required to report the following: 1. Schedule Code Schedule Number 16A 2. Enter on this schedule, on a transaction by transaction basis, the fuel delivered to your own retail outlet(s) for retail sale within any of the qualifying counties and or cities. For sales within the qualifying counties and or cities, you are required to report the following: 1. Schedule Code Schedule Number 16B 2.
