Topics to be considered include: Practical and commercial concerns for financial institutions adopting cloud computing solutions, including how much data and processing banks can migrate to the public cloud given their fiduciary responsibilities and regulatory requirements relating to, among others, privacy and data retention. The cross-border implications of cloud computing arrangements, including storage and processing of EU data outside of the EU. Security and information assurance aspects of cloud computing for financial institutions, including bank personnel accessing bank systems using personal devices, whether as part of a bring your own initiative or otherwise. Sourcing considerations, standardisation, rationalisation and restructuring the IT environment when migrating to the cloud. 3 Wednesday 30 May Registration Mobility Mobility has not only changed the world of telephony but is also affecting how people conduct transactions and even do their banking. Banks have developed platforms and technology to enable customers to access and use bank services via mobile phones and other wireless devices. A range of legal concerns arise when transitioning banking services such as payment services to different platforms including mobile phones, tablets and other personal devices. Another mobile payment example is wireless point-of-sale technologies. Among issues to be discussed are: Cross-border commercial and legal issues relating to mobile banking, including competition law concerns, anti-money laundering and privacy law issues. Emerging competition between telcos, financial institutions and other actors for control of the mobile payment space. The EU implementation of the Payment Services Directive and similar initiatives in other jurisdictions. AEGON Bank and HCL will jointly present a case study on the development of mobile banking apps and platforms. Indeed, bank-ina-box has almost come of age. The challenges of moving to as-a-service environments in the financial services sector will be reviewed, both for internal and customer-facing functions. Topics to be covered include: Which banking services are sufficiently repeatable, high-volume and standardised to be acquired on an as-a-service basis? Legal and commercial challenges associated with vertical rather than horizontal bundling of banking services. Structuring alliances to enable two or more entities to provide an integrated as-a-service offering. Portability of as-a-service offerings and the avoidance of lock-ins. Challenges for financial institutions in customising as-a-service offerings. Using the E-Commerce Directive to offer cross-border banking services Case study of Royal Bank of Canada s migration to a virtual bank in the US. 4 Wednesday 30 May continued IT driving business transformation in financial institutions Cloud computing and other on-demand services result in a closer alliance between IT professionals and their business unit customers in financial institutions, possibly even external customers. The conference will conclude by exploring how these IT developments are driving business transformation in the financial services sector and, from a practical perspective, what counsel should know. This final session will be an interactive panel discussion involving several of the financial institution representatives who were speakers in other sessions. Topics to be discussed include: When is the task at hand not a one-off contract but part of a larger, IT driven, business initiative? The changing role of the CIO and of IT legal counsel, both inhouse and external. Governance in a multi-vendor IT environment with both high touch and low touch IT providers. Driving cooperation among suppliers on a panel to enhance innovation and facilitate enterprise-wide objectives. The Mediation Techniques Subcommittee of the International Bar Association felt that there was a need for a practical collection of tips from and for practising mediators of different styles, facing different sorts of issues and still be usable by mediators at an early stage in their career but also to contain sufficient variety to still be interesting to more experienced mediators. They deal with developing bodies of law coming to grips with questions posed by new technologies. The mandate of the Technology Law Committee is broad and includes virtually any kind of technology. Advert space At present, the Committee has seven subcommittees with the following areas of focus: The Emerging Technologies Subcommittee focuses on emerging technologies which include areas ranging from Life Sciences through to Nano Technology. The focus of the Outsourcing and Shared Services Subcommittee is on outsourcing service and supply agreements in all their aspects. The Internet Business Subcommittee focuses broadly on e-commerce and other internet issues. The User Generated Content Subcommittee deals with the user generated content issues that are challenging the internet and entertainment industries. The Intrusive Technologies Subcommittee focuses on technologies that may threaten the privacy and security of individuals, ranging from satellite surveillance to smart cards.
