4 INVITATION FOR THE BIDS/TENDERS Binding /Rebinding of National Science Library (NSL) Journals/Books Etc. 1. Sealed bids in three envelops, viz. Technical Bid, Financial Bid and Earnest Money Deposit (EMD), valid for 90 days are invited from the reputed Binding Houses doing high quality library binding, for binding/ rebinding of National Science Library s (NISCAIR) journals and books etc. All the respective contents, i.e. Technical Bid, Financial Bid and Earnest Money Deposit, should be submitted in three different envelopes duly sealed and clearly marking the type of content, bidder s name & address on the top of the sealed envelopes. 2. The details of the binding required are given in the Chapter- 5. Those who are willing and are in a position to quote in accordance with the requirements stated in the schedule may submit tender to this office on Proforma for bank guarantee for performance security or Bank draft attached as Annexure -2. The conditions governing the contract are given in Chapter -2. 5 Chapter 1 INSTRUCTIONS TO BIDDERS/TENDERS 1.1 Eligible Bidders This invitation for bids is open to binding houses having sufficient requisite facilities and binding capacity of who have worked worth more than Rs.2 lakhs in libraries of government departments/autonomous bodies/public sector undertakings, R&D and Academic institutions, in a financial year. 1.2 Cost of Bidding The bidder shall bear all costs associated with the preparation and submission of its bid. NISCAIR will in no case be responsible or liable for these costs, regardless of the conduct or the outcome of the bidding process Empanelment/Award of Contract (a) It is planned to prepare a panel of high quality Binding Firms who can execute high quality Library Binding. Approximate value of the contract is Rs.2 lakhs per year. (b) The acceptance of the quotation will rest with the Director, NISCAIR who does not bind himself to accept the lowest quotation and reserves the right to reject or accept any or all the quotations received without assigning any reason. (c) Binding jobs have to be executed strictly as per the schedule. 1.3 The Bidding Documents The services required, bidding procedures and contract terms are prescribed in the bidding documents. In addition to the invitation for bids, the bidding document for binding includes : a) Instructions to bidders/tenderers b) Categories of Jobs and Specifications for Binding (Chapter 5) c) General terms and conditions of contract d) Proforma for Bid guarantee e) Bid/Tender form f) Bid Security Form (EMD) The bidder is expected to examine all instructions, forms, terms and conditions, specifications, schedule to Tender, and other documents before quoting. Failure to furnish all information required or submission of bid not substantially responsive to the bidding documents in every respect will be at the Bidder s risk and may result in rejection of its bid. 1.4 Preparation of Bids Technical and Financial Bids: The bids are to be submitted in two parts in separate sealed envelopes. a) Technical Bid + Earnest Money Deposit (EMD) b) Financial Bid If the EMD is not received or is not in order, the technical bid will not be opened Technical Bid The Technical bid prepared by the bidder shall be provided in the following Model Response Format. Model Response Outline a) Standing of Bidder The firm should have three years working experience in binding. b) The annual turnover of the firm should be worth more than Rs.2 lakhs from government departments/autonomous bodies/public sector undertakings, R&D and Academic institutions in a financial year (proof may be enclosed). c) Three Performance Certificates for the last one year from the libraries of Government/Semi Govt./Autonomous/Private/ R & D and Academic institutions. d) Pan No./TIN No. 5

6 e) Manpower available with the binder. f) Telephone lines ( one mobile no. is a must) g) Samples of four publications of any size (one each of Full leather, Half leather, Rexene & cheap binding). h) Financial Bid The financial bid shall indicate the unit price for each and every item indicated in the specifications. (i) The bidders must quote their rates strictly as per Tender for binding work in separate envelopes. (ii) The prices quoted must be net per unit as shown in the Chapter-5 (iii) The rate must be stated for each item separately both in words and figures. If there is discrepancy between the price quoted in word and figures the price which ever is the higher of the two will be treated as the bid price. (iv) The price quoted by the tenderers should be inclusive of Sales Tax: Service tax and other Govt. levy. (v) The prices once accepted by NISCAIR shall remain valid till the successful execution of the order and till the order is fully effected and accepted or 36 months from the date of award of contract. NISCAIR shall not entertain any increase in the rates during the period. However, in the event there is a reduction or increase in Taxes/ Government levies/duties during the period of execution of the order, the rates shall be suitably adjusted with effect from the date notifying the said reduction or increase in the Government levy/excise duty. (vi) Rates should be valid at least for 90 days from the date of opening of the technical bids. 1.5 Submission of Bids Sealing and Marking of Bids i. The bids shall be submitted in two separate sealed covers which shall be marked as Technical Bid, Financial Bid. EMD should be submitted with technical bid. ii) The outer envelope containing Technical Bid, Financial Bid, and EMD shall be addressed to The Director, National Institute of Science Communication and Information Resources, Dr. K.S. Krishnan Marg, New Delhi iii) The outer and inner envelopes shall indicate the name and address of the bidder to enable the bid to be returned unopened in case it is declared received late. iv) Faxed or bids sent through will not be entertained Deadline for Submission of Bids a) Bids must be received by NISCAIR at the mentioned address not later than the time and date specified on the cover page. In the event of the specified date for the submission of bids being declared a holiday for NISCAIR, the bids will be received up to the appointed time on the next working day. b) The Director, NISCAIR may, at his discretion extend this deadline for submission of bids by amending the bid documents, in which case all rights and obligations of NISCAIR and bidders previously subject to the deadline will thereafter be subject to the deadline as extended Late Bids Any bid received by NISCAIR after the deadline for submission of bids prescribed by the NISCAIR will be rejected and / or returned unopened to the bidder. 1.6 Bid Opening and Evaluation Opening of Technical Bids NISCAIR will open all technical bids in the first instance if the EMD is submitted as per requirement in the presence of bidders representatives, who choose to attend, at the time on the date and at the place specified in the `Invitation for Bids. The bidder or bidders representatives present there shall sign a register evidencing their attendance Clarification of Bids a) During evaluation of the bids, NISCAIR may, at its discretion, ask the Bidder for clarification of its bid. The request for clarification and the response shall be in writing and no change in price or substance of the bid shall be sought, offered or permitted. b) No bidder shall contact NISCAIR on any matter relating to its bid from the time of the bid opening to the time the contract is awarded. If the Bidder wishes to bring additional information to the notice of NISCAIR, it should be done in writing. c) Any effort by a Bidder to influence NISCAIR in its decisions on bid evaluation, bid comparison or contract award decisions may result in rejection of the Bidder s bid. 6

7 Evaluation of Technical Bid a) Prior to the detailed technical evaluation, NISCAIR will determine the substantial responsiveness of each bid to the Bidding Documents pursuant to Clause For purpose of this Clause, a substantially responsive bid is one, which conforms to all the terms and conditions of the Bidding Documents without material deviations. b) A bid determined as not substantially responsive will be rejected by NISCAIR and may not subsequently be made responsive by the Bidder by correction of the non-conformity. c) The Technical Bid evaluation will be done on the basis of Clause The bidders short listed by NISCAIR based on evaluation of their technical bids may be called for detailed discussions with a team selected by NISCAIR for the purpose, at a specified date, time and venue, if needed Opening of Financial Bids i) NISCAIR will open the Financial Bids of only those bidders who have been found to be technically qualified. j) The Financial Bids of the technically qualified bidders shall be opened in the presence of their representatives, who choose to be present, on a specified date, time and venue Evaluation and Comparison of Bids a) Arithmetical errors will be rectified on the following basis: If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected. If the vendor does not accept the correction of errors, its bid will be rejected. If there is a discrepancy between words and figures, whichever is the higher of the two will be treated as the bid price. 1.7 Award of Contract Award Criteria Subject to the signing of contract, NISCAIR will award the Contract to the successful Bidder whose bid has been determined to be substantially responsive and has been determined as the best evaluated bid provided further that the Bidder is determined to be qualified to perform the Contract satisfactorily NISCAIR s Right to accept or reject any Bid or all Bids NISCAIR reserves the right to accept or reject any bid in a part or full, and to annul the bidding process and reject all bids at any time prior to award of contract, without thereby incurring any liability to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the grounds for NISCAIR s action Notification of Award a) Prior to the expiry of the period of bids validity, NISCAIR will notify the successful Bidder in writing by letter or by fax, to be confirmed in writing by speed post or hand delivered letter, that its bid has been accepted. b) The notification of Award will constitute the formation of the Contract Signing of Contract At the same time as NISCAIR notifies the successful Bidder that its bid has been accepted, NISCAIR will send the Bidder the Contract Performance Security i) The vendor/contractor should furnish performance security to 10% value of the total contract value valid upto 38 months from the date of implementation of the contract. ii) The proceeds of the performance security shall be payable to NISCAIR as compensation resulting from the Vendor s failures to complete its obligation under the contract. iii) The performance security shall be in the following form : 7

8 A Bank guarantee from a scheduled bank in form provided by NISCAIR ( Annexure 2). Failure of the successful Bidder to comply with the requirement of Signing of Contract shall constitute sufficient grounds for the annulment of the award in which event NISCAIR may make the award to the next evaluated bidder or call for new bids and forfeiture of the EMD Corrupt or Fraudulent Practices a) Vendors shall observe the highest standard of ethics during the procurement and execution of the contract. b) NISCAIR will reject a proposal for award if it determines that the Bidder recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question. c) Miscellaneous a) It will be imperative on each bidder to fully acquaint itself of all the local conditions and factors, which would effect on the performance of the contract. b) During the validity of this bid or during the extended period, if any, if the bidder provides the same or equivalent services to any other Department/Organization in India at a price lower than the price fixed for NISCAIR, the bidder shall automatically pass on the benefits to NISCAIR. 1.8 Factors Affecting the Award of Contact a) The bidder should have its own Contract support facilities. The support facilities should be fully owned and managed by the bidder. b) Conformity with the Request for Bid/Tender required and conditions. c) The assessment based on the response to Model Response Outline. d) The assessment of the capability of the bidder to meet the terms and conditions. Payment Conditions Payment will be made within 30 days after receiving bills in duplicate and satisfactory execution of the jobs. The Director, NISCAIR reserves the right to make suitable deduction from the binders s bill, in case binding work is delayed and the quality of wok is not satisfactory. 8

9 Chapter 2 Conditions of the Contract AS PER SCHEDULE ATTACHED I. To provide trouble-free Library binding services as per terms and conditions in the tender document to our satisfaction. High quality Full Leather, Half-Leather Full Rexene and cheap binding of Library Books & Journals. The detailed technical specifications and the items for which rates are required are given in Chapter 4 II. If the firm fails to execute the job within the stipulated time or leaves the job incomplete or refuses to complete the work or takes more than the schedule fixed time then the firm will be liable to penalized. The Director, NISCAIR reserves the right to impose a penalty at his discretion. In such cases, The Director, NISCAIR reserves the right to terminate the contract without any advance notice and the firm will be blacklisted. III. It will be the responsibility of the firm to Collect the Books/Journals after counting as per given lists from the Library and deliver the bound volumes, as per given list, at the Library for which no transportation charges will be paid. IV. This contract will be for a period of 36 months (Three years), i.e. from the date of the award letter, but renewed/ reviewed annually on the basis of performance. However, the contract may be extended or curtailed at the discretion of the Director, NISCAIR depending on the performance of the firm. V. EMD of Rs.5,000/- (Rupees Five thousand only) is required to be submitted with Tender by way of Cross Demand Draft in favour of Director, NISCAIR. Without EMD the tender will be summarily rejected. VI. The successful tenderer will be required to deposit 10% of the total value of the contract ( will be decided at the time of award of contract) as Performance/Security Deposit. VII. The successful tenderer would have to ensure safe custody of books etc. and get his godown/factory comprehensively insured for a value of Rs.1,00,000/- ( Rupee one Lakh only). VIII. Good quality chemical adhesives like Flexi Bond or Fevicol, stitching thread, leather, cardboard and Rexine etc. must be used. Color/quality of the same must be got approved before binding. IX. Canvassing in connection with the tender is strictly prohibited and the tenders submitted by the contractor who resort to canvassing will be liable to rejection on the ground alone. X. The Director, NISCAIR reserves the right to accept or reject any or all quotations without assigning any reason and engage more than one binding contractor for award of binding jobs. XI. The Director NISCAIR reserves the right to terminate the contract with immediate effect if the services are found to be unsatisfactorily without assigning any reason. XII. The quality of service will be reviewed after every three months. XIII. The binding firm may be black-listed, if it does not meet the obligations of the contract or does not provide the satisfactory service. XIV. The performance security deposit would be refunded after two month of successfully completion of contract and no interest would be paid. 9

10 Chapter 3 Schedule of Requirements Introduction The National Institute of Science Communication and Information Resources (NISCAIR) is a constituent unit of the Council of Scientific & Industrial Research (CSIR). The R & D programmes being undertaken at NISCAIR are geared towards meeting the information needs of different segments of the society. Apart from bringing out a variety of scientific and technical publications and providing information services and training in science communication. Scope of Work and Requirements It is planned to prepare a panel of high quality Binding Firms who could provide high quality library binding services to our satisfaction as per the terms and conditions in the tender. In case there is any delay in supplying the bound documents back to Library, the Director, NISCAIR reserves the right to withdraw the job and no payment would be made for any part of the job completed or in progress and the security deposit will be forfeited. The bidder may inspect books/journals for Binding and have an idea about the nature of work involved in order to make estimates about the cost of work required to be done. 13 Chapter 6 Contract Agreement This agreement made the day of.20.. between National Institute of Science Communication and Information Resources ( hereinafter the NISCAIR) of one part and.( Name of the vendor (hereinafter the Vendor ) of the other part. Whereas NISCAIR invited bids for certain services. Viz. binding, and has accepted a bid by the supplier for supply of those services in the sum of Rs.(Rupees ) (Contract prices in words and figures ) (hereinafter called the Contract Price ). Now this agreement is witnessed as follows : 1. In this agreement words and expressions shall have the same meanings as are respectively assigned to them in the Conditions of Contract referred to. 2. The following documents shall be deemed to form and be read and construed as part of this agreement, viz.. a) the bid form and the price schedule submitted by the bidder b) the technical specifications c) the General terms and conditions of the contract d) NISCAIR s notification of award In consideration of the payments to be made by NISCAIR to the Vendor as hereinafter mentioned the Vendor hereby covenants with the purchaser to provide the services and to remedy defects therein conformity in all respects with the provisions of the contract. NISCAIR hereby covenants to pay the Vendor in consideration of the provisions of services, the contract price or such other sum as may become payable under the provisions of the contract at the times and in the manner prescribed by the contract.
