MONTHLY NEWS AND INFORMATION FROM THE FUND SECRETARY Retiree Healthcare Update Retiree health insurance is a necessary and vital component of retirement security for retired City workers and their dependents. Unfortunately, securing retiree health care from the City has been the subject of an ongoing legal struggle for nearly thirty years. Currently, the matter of whether retirees are entitled to health care is pending in the circuit court of Cook County before Judge Cohen. Local 2 recently posted Judge Cohen s ruling and an article written by Counsel for Local 2 analyzing Judge Cohen s July 21, 2016 ruling. Local 2 s analysis is available on their website Upon the issuance of the ruling, Counsel for the plaintiff, Clint Krislov, made several motions which Judge Cohen ruled on, on August 8, As it relates to retired city workers who worked for the Chicago Fire Department, the rulings on the motions as they impact the four subclasses of retirees are summarized as follows: Subclass 1 (those retiring prior to December 31, 1987) & Subclass 2 (those retiring between January 1, 1988 and August 23, 1989). Judge Cohen s decision indicates that the City has already conceded that they will provide Subclass 1 and 2 up to 55% of their premiums and healthcare coverage. Plaintiff s attorney Krislov noted that the City has only agreed that they would provide up to 55% and thus there is an issue of what the actual benefit looks like. Due to the lack of clarity, Judge Cohen ordered the City to meet with Krislov to determine what the benefit will look like for the Korshak sub-class and the Window sub-class. That meeting is expected to be scheduled in the next few weeks. Subclass 3 (any participant in the Fund prior to August 23, 1989). Judge Cohen s July 21, 2016 decision ruled that the Pension Code in 1983 provided for a health insurance benefit of $55 per month for retirees who were not qualified for Medicare and $21 per month for retirees who were Medicare eligible. Furthermore, since the language which provided for the benefit was not time limiting, such as in subsequent revisions to the Pension Code, the Judge did not give a definitive ruling because he concluded there is a factual dispute that requires that the parties put on evidence. Although this summary attempts to summarize Judge Cohen s ruling, there may be an issue as to who is actually included in Subclass 3 and whether that subclass includes only those who had not yet retired as of August 23, 1989.

2 Subclass 4 (any person who became a participant in the Fund after August 23, 1989). Judge Cohen granted Krislov s motion for 304(a) language for Subclass 4 which enables the Plaintiff s attorney to take an immediate appeal to the Appellate Court from Judge Cohen s decision disposing of their rights to any future healthcare benefits from the City that they may have pursuant to this litigation. All of our participants should follow the developments in this matter as it may very well impact retirement decisions of current and future retirees of the Chicago Fire Department. While the Fund is NOT a health and welfare fund and has no control over health care insurance matters, the Fund will endeavor to keep Fund members informed of developments in the Underwood litigation. The Fund is very aware of retirees concerns and the potentially serious impact the Underwood decision may have on retired employees retirement security.
