3 Executive Summary The proposed bus terminal at Mitra Samaj is exclusively for BRTS buses and as this terminal right in middle of the city, the terminal design is unique and aesthetic. It is located 1.5km from the Jubilee Circle. The area of proposed site is 36Gunte and 10Annas. As per the land use patterns, the entire stretch i.e. from Jubilee Circle to Anjuman Circle and from Anjuman Circle to Jubilee Circle surrounded by commercial, Government land and only few residential buildings. As per JMC three properties will be affected, One title holder is private person. Out of the two remaining properties one belongs to HDMC and the other is Government property. In addition to existing approved RAP of Hubli Dharwad BRTS project, The Resettlement Action Plan for the Hubli-Dharwad BRTS at Mitra Samaj was prepared to address and mitigate the impacts arising out of the Project. Socio-economic surveys were conducted, as per the census survey it is found that among total PAPs, 03 are THs, out of which 1 belongs to government, 1 lease holder and another one is private property. Two (2) title holders and 33 NTHs are having business in the existing buildings, out of which 3 are Kiosks, 5 commercial Squatters 25 commercial Tenants. Those structures which are located in private and government land will be compensated as per the provisions of the Entitlement matrix. The private owner will have choice for consent award for 2.5 times of guidance value, if he won t agree for consent award, the general award will be passed as per New Act provisions. The total land requirement estimated for the project is 35 gunte and 10 annas, out of which 1.07 Gunte of private land and Gunte Government land and 6 Gunta belongs to Hubli Dharwad Municipal Corporation (HDMC). Public consultations were held on and The outcomes of the consultations are incorporated in the Social Impact Assessment of the project. The outcomes will be incorporated in the designing of infrastructure and as inputs for the resettlement plan preparation and implementation. This RAP is also prepared in accordance with the stipulations and guidelines provided in the project specific Entitlement Matrix for the BRTS Project, GEF SUTP s ESMF (Environmental and Social Management Framework), the project authority proposes to acquire land through consent award following the Karnataka Highways Act, 1964 and LA (Karnataka Extension and Amendment) Act, It is expected that land acquisition under this Act will help the PAPs to receive the market price/replacement cost of land as compensation. There will be Negotiation Committee and the role of the committee will be to negotiate the price of land with the entitled persons. The guidance value of land in respective area will be considered as the base for negotiation. Entitlements include payment of cash compensation for land preferably through consent award as per the provisions of the Karnataka Highways Act. The owner/tenant will be given the right to salvage material from the affected structure and will be given adequate notice for Hubli-Dharwad BRTS Co. Ltd. Page 3

4 removal of structure and shifting. Shifting allowance of Rs.6655/- will be given to all major impact categories and Livelihood Restoration allowance of Rs.19965/- will be given for Loss of Livelihood. Rental allowance for a period of six months at the rate Rs.2396/- for commercial categories of tenants will be given. Hubli - Dharwad Municipal Corporation will be requested to provide preferential allocations of alternate commercial space for the licensed Kiosks which are located in the land to be acquired. For those who are losing livelihood, one family member (male or female) of the affected family will be provided necessary training for development of entrepreneurship skills by co-ordinating with HDMC or other Government Departments to take up self-employment projects. Additional support to vulnerable groups would be given through pension schemes, if eligible as per the criteria prescribed in respective schemes. RAP will be implemented by the Environment and Social Development Cell. The land acquisition will be done by competent authority as per the applicable act and ESDC will be responsible for all the activities related to Resettlement and Rehabilitation. All grievances will be settled through existing grievance redress committee. The grievance redress process specifies procedures for registering and addressing complaints including appeal mechanisms. The estimated total budget for the implementation of RAP is Rs Crore. 5 1 Introduction The Resettlement Action Plan for the Hubli-Dharwad BRTS at Mitra Samaj was prepared to address and mitigate the impacts arising out of the Project. The RAP was prepared based on the socio-economic survey conducted on The Hubli-Dharwad BRTS Company Limited has completed the Joint Measurement Certificate (JMC) survey on The JMC report has been finalised. The social impact of the project are detailed in the succeeding paras. 2 Extent of land to be acquired guntas of land is being acquired for the BRTS at Mitra Samaj, Dharwad. One title holder is private land owner. Out of the two remaining, one property belongs to HDMC and other one belongs to Government. The Government has given the land to Mitra Samaj Trust on a 99 years lease. The lease period of land had expired. Some structures were constructed by lease holders, and they are eligible for ex-gratia compensation for loss of structures as per the entitlement matrix approved for the project. 6 3.2 Project Affected Persons The total number of project affected persons is 35. The classification of PAPs by category is indicated in the following table. The details of the PAPs are enclosed in Annexure I. In case of major impacted titleholders, R&R assistance for shifting, subsistence allowance will be discussed during finalization of the land acquisition compensation rate and accordingly agreed as needed based on the severity of the impacts. 3.3 Tenants The number of tenants require to be shifted are 25, and all belong to out of which all are commercial category. 8 5 Public Consultation meeting with Dharwad city PAPs Consultation, participation and disclosure will ensure that information provided and feedback obtained on proposed project of Hubballi- Dharwad BRTS terminal, be adequately considered in the project design. It will also provide adequate opportunities for consultation/participation of PAPs in the project process. The consultation process was carried out with the following objectives: To promote awareness among the PAPs and to public about the proposed project. To familiarize the people with technical, social and economic issue of the project for better understanding; To stimulate community self-evaluation and analysis; To identify the environmental issues relating to project components; To secure people s input in respect of project design, selection of mitigation measures and monitoring strategies viz. incorporating the suggestions made during consultations into project design as found feasible; To assess the views of the beneficiary community; A) Public Consultation meetings Public consultation has been considered to be an extremely important process and the RAP is prepared on the basis of people s perceptions about the project impacts and felt needs. It is ensured that results of public consultation whichever deemed feasible have been incorporated in the final design. 9 B) Public consultation meeting with Tenants Date: Venue: HDBRTS Company Negotiation meeting was conducted by Hubli-Dharwad BRTS Company Lt. with tenants of Mitra Samaj premises and Mitra Samaj committee. The members present in the meeting expressed their demands which are as follows: Demands of the Tenants The compensation of the structures should be paid to the tenants. The tenants insisted to increase the assistance. The tenants demanded for alternate shops before demolishing the building and to provide proper rehabilitation assistance. Explanation given by Hubli- Dharwad BRTS Company Limited. The structures compensation will be paid to the lease holder. The tenants will gets interior works valuation amounts apart from R&R assistance. Rehabilitation and resettlement assistance will be paid as per approved entitlement matrix. Project authority will try to explore the possibility of facilitating assistance to eligible PAP s in link with various Government schemes. The following notified Government Schemes are being considered for the vulnerable groups and linking them to respective PAPs category. 11 6 Socio-Economic Survey The socio economic survey was done to identify project affected people, families and to develop their socio-economic profile by conducting survey and collecting information related to various aspects such as demography, occupational and income details. The objectives of the study are: To assess the socio-economic impacts of Project Affected Persons/ Families. To assess the number of house structures that will be affected. To arrive at a rehabilitation package for PAPs. 6.1 Social Assessment of PAPs Social Assessment has been made on the basis of data collected. It is observed that more than 50% belongs to vulnerable groups, more than 75% of the PAPs are under working age groups and have a monthly income above Rs.4000/- per month. 12 Occupation No. % Medical shop Pan shop Others Total Occupational Distribution of PAPs brings out the fact that most of the PAPs are working as labourers on daily basis. 50% PAPs are daily earners (Bag repairers and Kiosks) among PAPs. About 06 percent workers are medical shop and about 20% workers are also having small business. The entitlement matrix as approved for the Hubli-Dharwad BRTS project is as follows. The Entitlement Matrix: The Entitlement Matrix addresses three broad categories of social and economic impacts, which require mitigation in this project. Loss of assets, including land and house; Loss of livelihood or income opportunities; and Collective impacts on groups, such as loss of common property resources The first two categories represent direct project impacts on an identified population. The affected people will be surveyed and registered, and project monitoring and evaluation will compare long term impact against baseline socio-economic data. The third category represents an indirect impact, where group members need not be individually registered. Gains and losses of a group-oriented nature are not quantifiable in terms of impact on the individual. Mitigation and support mechanisms will be collectively oriented, and the Hubli-Dharwad BRTS Co. The common property resources and the Community infrastructure (bus shelters, community ponds and other assets, if any) will be relocated in consultation with the community. The Religious structures, if any, on private lands will be entitled for compensation at current PWD schedule of rates without depreciation. Religious structures constructed by encroaching on Government lands i.e., parks, roads and public spaces etc will be relocated in consultation with the community. 1. Mitigation measures Unforeseen impacts shall be documented and mitigated based on the principles provided in this policy. 16 2) As part of consent award negotiations, the additional compensation for resettlement (subsistence allowance, shifting allowance etc) will be fully factored into and reflected in the consent award as a separate line item in the compensation negotiated under consent award. 8 Grievance Redress Committee Already Grievance Redress Committee has been formed with Deputy Commissioner of the Dharwad district as head, Representative of reputed NGO, Representative from social sector/retired government officer and a Representative of SPV as Convener (Manager R&R and HR). GRC will hear complaints and facilitate solutions; and the process, as a whole, will promote dispute settlement through mediation to reduce litigation. The following existing GRC committee members will continue for this purpose also.
