1 CIMB ISLAMIC BANK BERHAD S TERMS & CONDITIONS GOVERNING THE CIMB 2018 UNFIXED DEPOSIT CAMPAIGN 1. The CIMB 2018 Unfixed Deposit Campaign( Campaign ) is organised by CIMB Islamic Bank Berhad ( the Bank or CIMB Islamic ) and shall commence from 1 July 2018 to 30 September 2018, both dates inclusive ( the Campaign Period ). The Bank reserves the right upon giving fourteen (14) days notice to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 2. Subject to Clause 3. below, the Campaign is open to all: a) Small medium enterprise/enterprise banking/commercial banking customers as determined by the Bank which may include but not limited to sole proprietorships, partnerships, private limited companies, charitable/non-profit organization, societies and professional partnerships; and b) Individual customers above the age of 18 years old including joint account accountholders. (hereinafter referred to as ( Eligible Customer(s) ). 3. The following individuals/entities shall be excluded and NOT eligible to participate in this Campaign:- a) Permanent and/or contract employees of CIMB Group and/or their immediate family members (i.e. spouses, children, parents, brothers and sisters). CIMB Group means the groups of companies/legal entities of which CIMB Group Holdings Berhad, being the holding company of CIMB Group Sdn Bhd has a controlling interest, directly or indirectly, either by itself or through its subsidiaries; and b) Corporate Banking customers. Special Profit Rates for Fixed Return Income Account i Placements 4. To be entitled to the following Special Rates under this Campaign, the Eligible Customer(s) must make a minimum single deposit placement amount as per the table below during the Campaign Period in Fixed Return Income Account-i Maturity Returns or Fixed Return Income Account-i Monthly Returns (hereinafter collectively referred to as ( FRIA-i ):- FRIA-i Tenure Special Profit Rates for FRIA-i Placements ( Special Rates ) Minimum Single Deposit Placement Amount in FRIA-i account 12 months 4.30% p.a. RM10,000 Campaign Mechanism 5. The Special Rates are applicable for FRIA-i placement of one (1) cycle only. 6. The FRIA-i placement must be performed at physical counters at any branches of the Bank. 2 7. The deposit of the minimum single deposit placement amount must be solely of fresh funds ( Fresh Funds ). Fresh Funds referred to herein shall be defined to mean monies or funds howsoever transferred, credited or paid into the Current Account-i or Savings Account-i ( CASA-i ) of the Eligible Customer(s) from other bank(s) and/or financial institution(s) but excludes monies transferred from CIMB Bank Berhad, through whatever means including but not limited to Inter Bank Giro transfers and collection and payment of cheques drawn on such other bank(s) and where such monies or funds paid or credited into the CASA-i of the Eligible Customer(s) are utilised by the Eligible Customer(s) to make new deposit placements pursuant to the terms and conditions herein within three (3) business days after such monies or funds have been paid or credited into the CASA-i of the Eligible Customer(s). Deposit placements made by way of cheques are subject to their clearance and will only be considered as deposit placements by the Eligible Customer(s) after the cheques are paid or cleared. 8. Payment of profit earned will be credited to the Eligible Customer(s) designated CASA-i maintained with the Bank. If the Eligible Customer(s) have an existing Current Account or Savings Account maintained with CIMB Bank Berhad, the Bank may accept this existing Current Account or Saving Account to be an affiliate account for the above purposes (herein referred to as Affiliate Account ). 9. The Bank reserves the right, from time to time, to vary the Special Rates and/or the FRIA-i Tenure requirement, upon giving fourteen (14) days prior notice provided always that the revised Special Rates shall not be less than the Minimum Profit Rate as stipulated under the terms and conditions for FRIA-i accounts. 10. Early and/or Part Withdrawal of FRIA-i: i. Placement before 1 September 2018: In the event that the Eligible Customer(s) withdraws or uplifts the FRIA-i before the completion of first three (3) months of the FRIA-i Tenure, the Eligible Customer(s) agree to waive all profit payable. If the Eligible Customer(s) withdraws or uplifts the FRIA-i on the fourth month onwards before maturity date, the Eligible Customer(s) agree to waive half (50%) of the Special Rates earned for the completed months on the withdrawn/uplifted amount only. The Eligible Customer(s) hereby agrees and authorises the Bank to deduct and/or to set off from the principal FRIA-i amount in respect of any profit paid or credited to the Eligible Customer(s) CASA-i/Affiliate Account which the Eligible Customer(s) is not entitled to as a result of the early upliftment of the FRIA-i placement. ii. Placement from 1 September 2018 onwards: In the event that the Eligible Customer(s) withdraws or uplifts the FRIA-i before maturity date, the Eligible Customer(s)agree to waive all profit payable. The Eligible Customer(s) hereby agrees and authorises the Bank to deduct and/or to set off from the principal FRIA-i amount in respect of any profit paid or credited to the Eligible Customer(s) CASA-i/Affiliate Account which the Eligible Customer(s) is not entitled to as a result of the early upliftment of the FRIA-i placement. 11. In the event the Eligible Customer(s) would like to withdraw the FRIA-i before the maturity of the FRIAi Tenure, the Eligible Customer(s) may opt to perform a partial withdrawal or a complete early upliftment of the balance in the FRIA-i account. 12. Renewal: Upon maturity of the 12 months FRIA-i Tenure, the Special Rates will cease to apply and the Eligible Customer(s) hereby agrees and authorises the Bank to automatically renew or roll over the 12 months principal FRIA-i amount and the prevailing CIMB Islamic board rate applicable at the time of renewal or roll over shall apply. 3 General Terms and Conditions 13. By participating in this Campaign, the Eligible Customers are deemed to have read, understood and agreed to be bound by these Terms & Conditions as well as consented to CIMB Islamic processing and disclosing their personal data in accordance with the CIMB Group Privacy Notice which can be found at and agree that all decisions fairly and reasonably made by CIMB Islamic in relation to every aspect of this Campaign shall be final, binding and conclusive. 14. CIMB Islamic s decision on all matters relating to this Campaign, including the determination of Eligible Customer(s) and the entitlement to the Special Rates are final, binding and conclusive provided the same must be seen to be fair and reasonable. No correspondence, queries, protests or attempts to dispute the same will be entertained unless the same is due to the gross negligence or default of CIMB Islamic. 15. CIMB Islamic has the right and is entitled, upon giving twenty-one (21) days prior notice, to debit the FRIA-i or any other account of the Eligible Customer(s) maintained with CIMB Islamic at any time as it deems appropriate with the applicable or prevailing statutory fees, stamp duties, commissions, bank charges and/or, service charges. 16. The Eligible Customers (s) FRIA-i account and/or signed up Eligible Product(s) (i) MUST not be in breach of the terms and conditions governing FRIA-i account and/or signed up Eligible Product(s) AND (ii) MUST not be terminated or closed or be made subject to any attachment, adverse orders made by the Court or any authorities sanctioned by laws, delinquent, and/ or be invalid or cancelled as determined by CIMB Islamic during the Campaign Period and/or before the crediting of the profit, otherwise the Eligible Customer(s) will be disqualified from participating in this Campaign and/or being entitled to the Special Rates. 17. By participating in this Campaign, the Eligible Customers hereby agree that CIMB Islamic shall not in any manner whatsoever be liable or held responsible to the Eligible Customers if CIMB Islamic is unable to perform in whole or in part of any of its obligations herein, attributable directly or indirectly to the failure of any mechanical or electronic device, data processing system, transmission line, electrical failure, industrial dispute, war, strike, riot, any act of God beyond CIMB Islamic 's control or due to any factor in a nature of a force majeure which is beyond CIMB Islamic s reasonable control. 18. CIMB Islamic reserves the right to extend, shorten, discontinue, cancel, terminate or suspend this Campaign by giving fourteen (14) calendar days prior notice to the Eligible Customers. For the avoidance of doubt, any extension, shortening, discontinuance, cancellation, termination or suspension of this Campaign by CIMB Islamic shall not entitle any of the Eligible Customers or any other persons whosoever to any claim or compensation against CIMB Islamic for any losses or damages suffered or incurred by the Eligible Customers as a direct or indirect result of the act of extension, shortening, discontinuance, cancellation, termination or suspension of this Campaign. 19. CIMB Islamic shall not be liable to any Eligible Customers or any party for any loss or damage of whatsoever nature suffered (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in this Campaign unless the same shall arise from and are caused directly by CIMB Islamic s gross negligence or wilful default. CIMB Islamic reserves the right upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( Amendment ) any of the Terms and Conditions herein. Notification to Eligible Customers in respect of the Amendment shall be effected at CIMB Islamic s absolute discretion through any one of the following means of communication, namely, via electronic communication display at CIMB Islamic s website and CIMB Islamic s branches or CIMB Islamic s Currency Exchange counters where detail provisions regarding the Amendment may be provided in the notice itself or may be provided to the Eligible Customers upon request; or by effecting an advertisement regarding the Amendment in one newspaper of CIMB Islamic s choice or by any other means of notification which CIMB Islamic may select and the Amendment shall be deemed as binding on the Eligible Customers as from the date of notification of the Amendment or from such other date as may be specified by CIMB Islamic in the notification. Eligible Customers acknowledge and agree to access CIMB Islamic s website at regular intervals to view the terms and conditions of the Campaign and to ensure that they are kept up-todate with any changes or variations to these terms and conditions. 21. No compensation in cash or any kind shall be given to the Eligible Customers for any losses or damages suffered or incurred by the Eligible Customers as a direct or an indirect result of such amendment, variation, deletion, addition or alteration of the Terms and Conditions herein. 22. These Terms and Conditions (as amended from time to time pursuant to Clause 20) shall prevail over any provisions or representations contained in any other promotional materials advertising this Campaign. These Terms and Conditions are to be read in conjunction with the prevailing terms and conditions of the FRIA-i account and terms and conditions governing FRIA-i account which shall apply in addition to the Terms and Conditions herein. 23. The terms and conditions applicable to this Campaign are available at These Terms and Conditions shall be subject to the application of any prevailing laws, guidelines, directives, notices, regulations enacted and/or any other written laws or which are issued by Bank Negara Malaysia or any other body having supervisory authority over the Bank in relation to or which are applicable to the Campaign or any matters herein. 25. If there is any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the Bahasa Malaysia and English version of these Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned, where request had been made by the Eligible Customers and noted and acknowledged by CIMB Islamic in its records that the Bahasa Malaysia version of the FRIA-i account Terms and Conditions has been selected by the Eligible Customers to govern the operation of the Eligible Customers use of FRIA-i account, then the Bahasa Malaysia version of these Terms and Conditions shall prevail. 5 TERMA-TERMA DAN SYARAT-SYARAT CIMB ISLAMIC BANK BERHAD YANG MENGAWAL KEMPEN UNFIXED DEPOSIT CIMB Kempen Unfixed Deposit CIMB 2018 ("Kempen") dianjurkan oleh CIMB Islamic Bank Berhad ("Bank" atau "CIMB Islamic") dan akan bermula dari 1 Julai 2018 hingga 30 September 2018, termasuk kedua-dua tarikh ("Tempoh Kempen" ). Bank menyimpan hak selepas memberi notis empat belas (14) hari untuk menukar tempoh dan / atau tarikh permulaan dan / atau tarikh tamat Tempoh Kempen. Kelayakan 2. Tertakluk kepada Klausa 3 di bawah, Kempen ini adalah terbuka kepada semua: c) Pelanggan-pelanggan pertubuhan perusahaan kecil dan serdehana/perusahaan perbankan/perbanking komersial sebagaimana yang ditentukan oleh Bank yang merangkumi tetapi tidak terhad kepada milik tunggal, perkongsian, syarikat sendirian berhad, organisasi amal/bukan untung, pertubuhan dan perkongsian profesional; dan d) Pelanggan-pelanggan individu melebihi umur 18 tahun termasuk pemegang akaun bersama dan/atau akaun amanah bawah umur. (secara kolektif dirujuk sebagai Pelanggan-pelanggan Yang Layak ). 3. Individu-individu/Entiti-entiti berikut adalah dikecualikan and TIDAK layak untuk menyertai Kempen ini:- c) Kakitangan-kakitangan tetap dan/atau kontrak Kumpulan CIMB dan/atau ahli keluarga terdekat mereka (iaitu pasangan, anak-anak, ibu bapa, adik-beradik). Kumpulan CIMB bermaksud kumpulan syarikat-syarikat/entiti-entiti undang-undang yang mana CIMB Group Holdings Berhad, sebagai syarikat induk CIMB Group Sdn Bhd mempunyai kepentingan kawalan, secara langsung atau tidak langsung, sama ada dengan sendirinya atau melalui anak-anak syarikatnya); dan d) Pelanggan-pelanggan Perbankan Korporat. Kadar Keuntungan Istimewa untuk Peletakan Akaun Pulangan Pendapatan Tetap-i 4. Untuk berhak mendapat Kadar Istimewa di bawah Kempen ini, Pelanggan-pelanggan Yang Layak hendaklah membuat jumlah peletakan deposit tunggal minimum untuk tempoh yang ditetapkan seperti dalam jadual di bawah sepanjang Tempoh Kempen dalam Akaun Pulangan Pendapatan Tetap-i - Pulangan Matang atau Akaun Pulangan Pendapatan Tetap-i - Pulangan Bulanan (selepas ini secara kolektif dirujuk sebagai ("FRIA-i"):- Tempoh FD Kadar Keuntungan Istimewa untuk Peletakan FRIA-i ( Kadar Istimewa ) Jumlah Peletakan Deposit Tunggal Minimum dalam akaun FRIA-i 12 bulan 4.30% setahun RM10,000 Page 5
6 Mekanisme Kempen 5. Kadar Istimewa adalah terpakai bagi peletakan FRIA-i untuk satu (1) kitaran sahaja. 6. Penempatan FRIA-i mesti dilakukan di kaunter fizikal di mana-mana cawangan Bank. 7. Jumlah peletakan deposit tunggal minimum mesti semata-mata daripada dana segar fresh funds ("Fresh Funds"). Fresh Funds yang dirujuk di sini akan ditakrifkan sebagai bermaksud wang atau dana walau bagaimanapun dipindahkan, dikreditkan atau dibayar ke dalam Akaun Semasa-i atau Akaun Simpanan-i ("CASA-i") Pelanggan-pelanggan Yang Layak daripada bank dan / atau institusi kewangan lain tetapi tidak termasuk wang yang dipindahkan dari CIMB Bank Berhad melalui apa jua cara termasuk tetapi tidak terhad kepada pindahan Interbank Giro dan pengumpulan dan pembayaran cek yang dibuat pada bank lain dan di mana wang atau dana tersebut dibayar atau dikreditkan ke dalam CASA-i Pelanggan-pelanggan Yang Layak digunakan oleh Pelanggan-pelanggan Yang Layak untuk membuat penempatan deposit baru menurut terma dan syarat yang terkandung dalam tempoh tiga (3) hari perniagaan selepas wang atau dana tersebut telah dibayar atau dikreditkan ke dalam CASA-i Pelanggan-pelanggan Yang Layak. Penempatan deposit yang dibuat melalui cek adalah tertakluk kepada pelepasan mereka dan hanya akan dianggap sebagai penempatan deposit oleh Pelangganpelanggan Yang Layak setelah cek dibayar atau dilepaskan. 8. Keuntungan yang diperolehi akan dikreditkan ke CASA-i yang ditetapkan oleh Pelanggan-pelanggan Yang Layak yang dikekalkan dengan Bank. Sekiranya Pelanggan-pelanggan Yang Layak mempunyai Akaun Semasa atau Akaun Simpanan sedia ada yang dikekalkan dengan CIMB Bank Berhad, Bank boleh menerima Akaun Semasa atau Akaun Simpanan sedia ada ini untuk menjadi akaun gabungan untuk tujuan di atas (selepas ini dirujuk sebagai Akaun Afiliasi ). 9. Bank menyimpan hak, dari semasa ke semasa, untuk mengubah Kadar Istimewa dan/atau keperluan Tempoh FRIA-i, dengan memberikan notis terdahulu empat belas (14) hari dengan syarat selalu bahwa Kadar Istimewa yang telah disemak semula tidak boleh kurang daripada Kadar Keuntungan Minimum sebagaimana yang ditetapkan di bawah terma-terma dan syarat-syarat untuk akaun FRIA-i. 10. Pengeluaran Awal dan/atau Pengeluaran Sebahagian FRIA-i: iii. Peletakan sebelum 1 September 2018: Sekiranya Pelanggan-pelanggan Yang Layak mengeluarkan atau menunaikan FRIA-i sebelum tamatnya tempoh tiga (3) bulan yang pertama Tempoh FRIA-i, Pelanggan-pelanggan Yang Layak bersetuju untuk mengetepikan semua keuntungan yang kena dibayar. Jika Pelanggan-pelanggan Yang Layak mengeluarkan atau menunaikan FRIA-i dari bulan keempat dan seterusnya sebelum tarikh pematangan, Pelanggan-pelanggan Yang Layak bersetuju untuk mengetepikan separuh (50%) daripada Kadar Istimewa yang diperolehi untuk bulan-bulan yang telah diselesaikan atas jumlah yang dikeluarkan / ditunaikan sahaja. Pelanggan-pelanggan Yang Layak dengan ini bersetuju dan memberi kuasa kepada Bank untuk memotong dan / atau menolak dari amaun prinsipal FRIA-i berkenaan dengan apa-apa keuntungan yang dibayar atau dikreditkan ke CASAi / Akaun Afiliasi Pelanggan-pelanggan Yang Layak di mana Pelanggan-pelanggan Yang Layak tidak berhak menerima sebagai akibat daripada penunaian awal penempatan FRIA-i. iv. Peletakan FD mulai 1 September 2018: Sekiranya Pelanggan-pelanggan Yang Layak mengeluarkan atau menunaikan FRIA-i sebelum tarikh pematangan, Pelanggan-pelanggan Yang Layak bersetuju untuk mengetepikan semua Page 6
7 keuntungan yang kena dibayar. Pelanggan-pelanggan Yang Layak dengan ini bersetuju dan memberi kuasa kepada Bank untuk memotong dan / atau menolak dari amaun prinsipal FRIA-i berkenaan dengan apa-apa keuntungan yang dibayar atau dikreditkan ke CASA-i / Akaun Afiliasi Pelanggan-pelanggan Yang Layak di mana Pelanggan-pelanggan Yang Layak tidak berhak menerima sebagai akibat daripada penunaian awal penempatan FRIA-i. 11. Sekiranya Pelanggan-pelanggan Yang Layak ingin mengeluarkan FRIA-i sebelum pematangan Tempoh FRIA-i, Pelanggan-pelanggan Yang Layak boleh memilih untuk melaksanakan pengeluaran sebahagian ataupun penunaian awal sepenuhnya ke atas baki di dalam akaun FRIA-i. 12. Pembaharuan: Selepas tempoh matang 12 bulan Tempoh FRIA-i, Kadar Istimewa tidak akan digunapakai dan Pelanggan-pelanggan Yang Layak dengan ini bersetuju dan memberi kuasa kepada Bank untuk secara automatik membaharui atau meletakkan semula jumlah prinsipal FRIA-i 12 Bulan dan kadar semasa CIMB Islamic Bank yang berkenaan pada masa pembaharuan atau peletakan semula akan digunapakai Terma-Terma dan Syarat-Syarat Am 13. Dengan menyertai Kempen ini, Pelanggan-pelanggan Yang Layak disifatkan telah membaca, memahami dan bersetuju untuk terikat dengan Terma-Terma dan Syarat-Syarat ini serta memberi kebenaran kepada CIMB Islamic untuk memproses dan mendedahkan data peribadi mereka menurut Notis Privasi Kumpulan CIMB yang mana boleh didapati di dan bersetuju bahawa semua keputusan yang dibuat secara adil dan munasabah oleh CIMB Islamic berhubung dengan setiap aspek kempen ini adalah muktamad, mengikat dan konklusif. 14. Keputusan CIMB Islamic mengenai semua perkara yang berkaitan dengan Kempen ini, termasuk penentuan Pelanggan-pelanggan Yang Layak dan hak untuk Kadar Istimewa adalah muktamad, mengikat dan memberi konklusif dengan syarat yang sama hendaklah dianggap adil dan munasabah. Tiada surat-menyurat, pertanyaan, protes atau percubaan untuk mempertikaikan perkara yang sama tidak akan dilayan kecuali yang sama ada disebabkan kecuaian melampau atau keingkaran CIMB Islamic. 15. CIMB Islamic mempunyai hak dan berhak, setelah memberikan notis dua puluh satu (21) hari terdahulu, untuk mendebitkan FRIA-i atau mana-mana akaun lain Pelanggan-pelanggan Yang Layak yang dikekalkan dengan CIMB Islamic pada bila-bila masa yang dianggap sesuai dengan fi berkanun, duti setem, komisyen, caj bank dan/atau caj perkhidmatan yang terpakai atau semasa. 16. Akaun FRIA-i dan /atau Produk-produk Yang Layak yang didaftar Pelanggan-pelanggan Yang Layak (i) MESTI tidak melanggar terma-terma dan syarat-syarat yang mengawal akaun FRIA-i dan / atau Produk-produk Yang Layak yang didaftar DAN (ii) MESTI tidak akan ditamatkan atau ditutup atau dijadikan tertakluk kepada apa-apa lampiran, perintah yang dibuat di Mahkamah atau mana-mana pihak berkuasa yang dibenarkan oleh undang-undang, delinkuen dan/atau tidak sah atau dibatalkan dalam definisi CIMB Islamic sepanjang Tempoh Kempen, dan / atau sebelum mengkreditkan keuntungan, jika tidak, Pelanggan-pelanggan yang Layak akan hilang kelayakan daripada menyertai Kempen ini dan / atau berhak menerima Kadar Istimewa. Dengan menyertai Kempen ini, Pelanggan-pelanggan Yang Layak dengan ini bersetuju bahawa CIMB Islamic tidak akan dengan apa-apa cara bertanggungjawab atau memegang untuk bertanggungjawab kepada Pelanggan-pelanggan Yang Layak jika CIMB Islamic tidak dapat melaksanakan secara keseluruhan atau sebahagian daripada kewajipannya di sini, yang boleh dikaitkan secara langsung atau tidak langsung terhadap kegagalan mana-mana peranti mekanikal atau elektronik, sistem pemprosesan data, talian penghantaran, kegagalan elektrik, pertikaian industri, peperangan, mogok, rusuhan, apa-apa perbuatan Tuhan di luar kawalan CIMB Islamic atau disebabkan oleh faktor apa pun sifat force majeure yang berada di luar kawalan munasabah CIMB Islamic. 18. CIMB Islamic menyimpan hak untuk melanjutkan, memendekkan, menghentikan, membatalkan, menamatkan atau menangguhkan Kempen ini dengan memberikan notis terdahulu 14 hari kalendar kepada Pelanggan-pelanggan yang Layak. Untuk mengelakkan keraguan, sebarang pelanjutan, pemendekan, penamatan, pembatalan, penamatan atau penggantungan Kempen ini oleh CIMB Islamic tidak akan memberi hak kepada mana-mana Pelanggan-pelanggan yang Layak atau manamana orang lain kepada mana-mana tuntutan atau pampasan terhadap CIMB Islamic untuk sebarang kerugian atau kerosakan yang ditanggung atau dialami oleh Pelanggan-pelanggan yang Layak sebagai hasil langsung atau tidak langsung dari tindakan pelanjutan, pemendekan, penamatan, pembatalan, penamatan atau penggantungan Kempen ini. 19. CIMB Islamic tidak akan bertanggungjawab kepada mana-mana Pelanggan-pelanggan Yang Layak atau mana-mana pihak untuk apa-apa kehilangan atau kerosakan apa jua sifat yang dialami (termasuk tetapi tidak terhad kepada, kehilangan pendapatan, keuntungan atau muhibah, langsung atau tidak langsung, sampingan, berbangkit, teladan, punitifatau ganti rugi khas mana-mana pihak) walau bagaimanapun timbul, berhubung dengan penyertaan atau bukan penyertaan dalam Kempen ini kecuali yang sama akan timbul dan disebabkan langsung oleh kecuaian melampau atau keingkaran CIMB Islamic. 20. Pemberitahuan kepada Pelanggan-pelanggan Yang Layak berhubung dengan Pindaan tersebut akan dilaksanakan mengikut budi bicara mutlak CIMB Islamic melalui salah satu cara komunikasi berikut, iaitu, melalui paparan komunikasi elektronik di laman web CIMB Islamic dan cawangan CIMB Islamic atau kaunter Pertukaran Mata Wang CIMB Islamic di mana peruntukan terperinci berkenaan dengan Pindaan itu boleh diperuntukkan dalam notis itu sendiri atau boleh diberikan kepada Pelanggan-pelanggan Yang Layak atas permintaan; atau dengan membuat iklan mengenai Pindaan dalam satu akhbar pilihan CIMB Islamic atau dengan apa-apa cara lain pemberitahuan yang boleh dipilih oleh CIMB Islamic dan Pindaan itu dianggap sebagai mengikat Pelanggan-pelanggan Yang Layak dari tarikh pemberitahuan Pindaan atau dari tarikh lain yang dinyatakan oleh CIMB Islamic dalam pemberitahuan itu. Pelangganpelanggan Yang Layak mengakui dan bersetuju untuk mengakses laman web CIMB Islamic pada selang masa yang tetap untuk melihat terma dan syarat Kempen dan untuk memastikan bahawa mereka sentiasa dikemaskinikan dengan apa-apa perubahan atau variasi terhadap terma-terma dan syarat-syarat ini. 21. Tiada pampasan wang tunai atau apa-apa jenis akan diberikan kepada Pelanggan-pelanggan Yang Layak untuk sebarang kerugian atau kerosakan yang ditanggung oleh Pelanggan-pelanggan Yang Page 8
9 Layak sebagai hasil langsung atau tidak langsung dari pindaan, pengubahan, pemadaman, penambahan atau pengubahan Terma-Terma dan Syarat-Syarat yang terkandung di sini. 22. Terma-Terma dan Syarat-Syarat ini (seperti yang dipinda dari semasa ke semasa menurut Klausa 20) akan mengatasi sebarang peruntukan atau representasi yang terkandung dalam bahan promosi lain yang mengiklankan Kempen ini. Terma-Terma dan Syarat-Syarat ini hendaklah dibaca bersama dengan terma-terma dan syarat-syarat semasa akaun FRIA-i dan terma-terma dan syarat-syarat yang mengawal akaun FRIA-i yang akan diguna pakai sebagai tambahan kepada Terma-Terma dan Syarat- Syarat yang terkandung di sini. 23.
