It s a combination of a Farmers Market, a Flea Market and Craft Show. 50% of the Market will be reserved for locally grown/produced farmer s market items. The remaining space will be available to flea market and craft vendors. 4 Downtown Denton Main Street INDEMNITY/HOLD HARMLESS AGREEMENT To the fullest extent permitted by law, the undersigned Organization agrees to indemnify and hold the Downtown Denton Main Street Organization (DDMS), Property owner at site of event, its elected and appointed officials, employees, volunteers and others working on behalf of DDMS, harmless from and of the bodily injury, sickness, or disease (including death resulting at any time therefrom) which may be sustained or claimed by any person or persons, or the damage or destruction of any property, including the loss of use thereof, based on any act or omission, negligent or otherwise, of the Organization, or anyone acting on its behalf in connection with or incident to the 2017 Open Air Market to be held at the corner of 3 rd and Market St. in Denton MD, except that the Organization shall not be responsible to DDMS on indemnity for damages caused by or resulting from DDMS sole negligence; and the Organization shall, at its own cost and expense, defend any such claims and any suit, action, or proceeding which may be commenced thereunder, and the Organization shall pay any and all judgments which may be recovered in any suite, action or proceeding, and any and all expenses including, but not limited to, costs, attorney s fees and settlement expenses, which may be incurred therein. 5 Rules and Procedures 2017 Market Season Downtown Denton Open Air Market is open to local farmers, seafood harvesters, crafters, and flea market items. There are different applications attached, one for farmers and another for craft/flea market vendors. Participation in the market is for commercial farmers, growers and licensed seafood harvesters in the region. Fruits, vegetables, grains, nuts, berries, herbs, eggs, cheese, meat and ornamental plants (flowers, potted plants) produce by farmers will be offered for sale Farmers should agree to sell primarily products and crops they grew or produced themselves. When purchase of agricultural products by farmers/growers to resale at the market is proposed, the products purchased for resale should be grown in the Delmarva region and should be labeled appropriately. All resale produce will require labeling of grower or region of origin. There will be no wholesale produce or wholesale seafood allowed. Seafood Harvesters must be licensed to sell and will handle their produce within health and safety regulations. Any farmer or seafood harvester offering cooked or processed food must have approval of the Caroline County Health Department. Confirmation of Caroline County Health Department approval is required. Non Farmer / Grower may be considered eligible to sell at the Downtown Denton Farmers Market if you are a baker, cheese maker, or meat/seafood processor and are producing products yourself using regional ingredients. Consideration will be given to allow other vendors on a case by case basis. All producers offering cooked or processed food must have approval of the Caroline County Health Department. 6 Flea Market / Crafters may participate with a booth space, however it s on a first come, first serve basis. 50% of the market space is reserved for farmer s market food grown in the local area. This is an outdoor market located at the corner of Market St. and Third St. in downtown Denton. The market day and are the Third Thursday of each month (May Oct. 2017) 3p.m. 6p.m.(ish) The market will begin May 18, 2017 and continue through October 19, Vendors can start to set up 2 hours before the market opens. The market is open at 3p.m. and will remain open for sales through 6p.m.(ish) Any special exceptions must be approved by management. Vendors will be responsible for their own tables, displays, tents, umbrellas, etc. Food vendors will be responsible for their own food permits from the office of the Caroline Co. Health Department. Please abide by their guidelines. The weekly market fee is $10.00 per 10ft. space. Payment is due prior to market opening each day. Cash or checks accepted. If paying by check, please make out to DDMS and mail or deliver to 4 N. Second St. Denton, MD between the hours of 8:30a.m. 4p.m. Monday Friday. Or drop in the night deposit box at the Denton Town Office to the left of the 2 nd Street entrance. All vendors must give notice by 12p.m. Wednesday if they will NOT be attending that Thursday. If any vendor fails to give notice by this deadline, the vendor must still pay for their spot regardless of attendance. Special exceptions may be made at the discretion of management due to but not limited to medical emergency or illness. In such case vendor is still asked to notify management as soon as they realize inability to attend.
