4 2018 Fairfield Farmers Market Vendor Agreement for the EBT Card Program The Fairfield Farmers Market is pleased to accept EBT cards (food stamp cards) at our market. The Market s goal is to increase access of fruits and vegetables to low income consumers and increase foot traffic to the downtown area. EBT participants will purchase wooden tokens valued at $1 each from the Farmers Market staff, located at the Fairfield Main Street Booth. Tokens will be used to purchase approved products from vendors. Wooden tokens may be used to purchase: breads, cereals, fruits, vegetables, meats, fish, poultry, seeds and plants which product food for consumption. Wooden tokens may NOT be used to purchase: any nonfood items: soaps, paper products, household supplies or prepared hot foods and beverages. The Fairfield Farmers Market will redeem wooden tokens only for eligible foods. Tokens may be redeemed for cash at the Fairfield Main Street booth. The EBT Card Program requires all vendors to sign this agreement indicating they are aware of and understand the rules of this program. The Fairfield Farmers Market views this as a joint responsibility. I, on behalf of, agree to abide by the rules herein as they relate to the processing of EBT transactions. I /we agree to follow all EBT Card Program Rules, as outlined below. Vendor Date Business Name Program Rules No currency is to be given as change or exchanged for tokens. The sale must be for the exact amount of the token(s) or the customer can make up the difference with cash. You may only accept Fairfield Main Street Certified Farmers Market tokens. Tokens from other Farmers Markets cannot be accepted and will not be redeemed at our market. All market vendors & farmers must accept tokens only for eligible products. Customers using tokens must receive the same respect as other customers. All food-stamp eligible food items, food seeds, and food plants can be purchased with tokens. Hot food, hot beverages, non-food items (flowers, clothing, crafts) CANNOT be purchased with tokens. Vendors may NOT set minimum purchase requirements and NO cash can be given as change with tokens. Additionally, the selling of token for cash is a violation of the EBT Card Program. Please report any violation to the Fairfield Farmers Market Staff. 5 GENERAL INFORMATION / RULES & REGULATIONS 1. LOCATION: The Fairfield Farmers Market is located in downtown Fairfield. We re located East of the I-80 Freeway off the Texas Street exit. The exact location will be determined. 2. SET UP: Grower booth sites will be determined on later date. Grower parking permits will be distributed on opening day of market. Signs are to be placed on the driver s side of vehicle dashboard so law enforcement may identify as legally parked. 3. WEIGHTS/STAKES: are Required: Winds can go up to 40mph. Set-up is not permitted without weights or stakes. 4. START OF MARKET: The market begins at 3:00pm; growers must be ready to sell at that time. BREAK DOWN & CLEAN UP: Growers are responsible to maintain a clean area within and outside of their booth space. All debris must be placed in the trash, recycling and food waste bins designated for the event. If sampling is provided, please equip your booth with a trash container. Smoking is absolutely not permitted anywhere at the market. 5. INCLEMENT WEATHER: In the event of bad weather; contact the Market Manager prior to noon of market day. When in doubt, arrive at the market and the Market Manager will provide you information regarding take-down. FARMERS & GROWERS 1. Farmers must obtain a Certified Producer s Certificate before participating in the market. The Fairfield Farmers Market is a Certified Market operation in accordance with the regulations established in the California Administration Code, Title 3, Group 4, Article 6.5, Direct Marketing. This market is subject to all pertinent local, State and Federal regulations and laws, including current regulations of second certificates. 2. All farmers/producers must have acquired and submitted copies of their Certified Producers Certificate as well as the following (if applicable): a. Health Certificate b. Nursery License c. WIC Number & Certificate 3. LOAD LISTS: At the end of each market day; Farmers/Growers are required to submit a Load List which provides the identity and quantity of each product sold at our market as it appears on their certified producer s certificate. If a Load Sheet is not submitted, a $25.00 fee will be applied to the stall fee upon return to the market and participation may begin only upon submission of Load Sheet. 4 PRICES & SIGNAGE: Prices and Grower Signage must be clearly posted at time of market. Growers are not allowed to sell product until Signage & Prices are posted. Further, all pre-packaged products must be labeled with vendor s name, address, name of product and weight or quantity. 5. WEIGHING DEVICES: Produce may be sold by weight Only if scales are certified by the County Department of Weights and Measures. All commodities must meet the requirements of the California Food and Agriculture code. 6. PRICE SETTING: Involvement among growers to raise prices or exertion of any influence, pressure or persuasion on any grower to raise prices is strictly forbidden. 7. PRODUCT QUALITY: High quality, vine-ripened, fresh produce is expected and must meet minimum quality standards as specified by Federal and State regulations for maturity and quality (Section ). The Market Manager has authority to ask that poor quality products be removed on any given market day. In case of a dispute, the matter may be referred to the Farmers Market Management for further action. 8. SAMPLING: Producers are encouraged to provide samples when possible. Samples must be provided according to Health Department regulations which are listed in your Fairfield Farmers Market Packet. 9. ORGANIC PRODUCE: Certified producers selling organic produce must have a COFA valid organic registration at their booth and provide the Market Manager with a copy. Any organic producer who is selling more than $5,000 worth of produce, must be certified by an accredited certification agent in California. 10. PROCESSED FOODS: All vendors selling processed foods must have proof of product liability and County Health Certificate Certified Kitchen, of which both copies shall be provided to the Market Manager.
