8 EXECUTIVE SUMMARY The Government of Chhattisgarh (GoCG) plans to improve about 916 kms of the state road network under Chhattisgarh State Roads Sector Development Project (CSRSDP) with the assistance of Asian Development Bank. The Chhattisgarh Public Works Department is the executing agency for the project. All 19 project roads have been divided into three Groups (Group A, B &C). The Consultancy services have been engaged for advisory and construction supervision. The Supervision Consultancy works for Group C Road (Package-16 to 19) comprising of km road network have been awarded to M/s. Intercontinental Consultant and Technocrats Pvt. Ltd. (ICT) in joint venture with M/s. RODIC Consultant Pvt. Ltd. The subprojects (Package-16 to 19) have been assessed to be of environmental category B as per ADB s Safeguard Policy Statement (2009) and environmental assessment guidelines The civil work contract has been awarded for all four packages (Package-16 to 19). The package-16 & 19 were handed over to contractor on 20 th April 2015 and the physical progress on these packages are % and % respectively whereas package 17 & 18, which were handed over to contractor on 13 th April 2016, have achieved physical progress 0.49 % and 1.13 % respectively as contractors were mainly engaged in preconstruction activities like mobilization of plants and equipment s, construction of camps, establishing of laboratories, erection and commissioning of plants, marking of centerline, checking of GPS pillars, benchmarks etc. The cuttings of trees are being carried out and almost completed. Supervision Consultant, through its environmental expert and site staff is monitoring the implementation of environmental issues. The contractors have also been asked to nominate one of their staff as Environmental Safeguard Officer so that he may be guided /trained in EMP implementation. The one day workshop on social and environmental safeguard issues was organized by consultant on in ICT Project Office, Bilaspur with an aim to improve compliance with Safeguard Measures provided in contract documents and as agreed with ADB. The issues related to Implementation of Environmental Management & Monitoring Plan (EMMP) and social aspects were covered by Environmental Specialist and Social Specialist of ICT Pvt. Ltd. The PIU staff, supervisory/field staff of consultant, concerned and Contractor s key staff along with their environment & social safeguard officers were invited to attend the program. There is a provision of Grievances Redress Mechanism (GRM) related to the implementation of the project. The GRM include formation of District level Grievance Redress Committee (GRC) comprising of District Commissioner, revenue official, forest official, public representative and respective nodal officer from PWD. The Group-C projects falls in five district namely Janjgir-Champa, Bilaspur, Mungeli, Kabirdham and Baloda Bazar District. The Grievance Redressal Committee (GRC) has been formed in all five districts. The contractors have been advised take care of environmental issues emerging by execution of project and strictly adhere to the provisions of EMP and FIDIC conditions to minimize negative impact on surrounding. The Supervision Consultant has assessed the implementation of EMMP during the reporting period as partially satisfactory because there is partial compliance by contractor on issues like safety arrangements, traffic management and usage of personal protective equipment (PPE) by the construction workers of Package-16 to 19. 9 1.0 INTRODUCTION The Government of Chhattisgarh (GoCG) plans to improve the state road network under Chhattisgarh State Roads Sector Development Project (CSRSDP) with the assistance of Asian Development Bank and for that has applied a loan through Government of India from the Asian Development Bank (ADB) for the improvement of about 916 kms state roads in Chhattisgarh. This road up-gradation and rehabilitation project will improve transport efficiency of the State road network which will contribute to expansion of economic opportunities and poverty reduction. The Chhattisgarh Public Works Department is the executing agency for the project. The project roads have been divided into three Groups (Group A, B &C). The Consultancy services have been engaged for advisory and construction supervision, institutional strengthening, social rehabilitation and resettlement, environmental mitigation and road safety measures. The Supervision Consultancy works for Group C Road (Package-16 to 19) have been awarded to M/s. Intercontinental Consultant and Technocrats Pvt. Ltd. (ICT) in joint venture with M/s. RODIC Consultant Pvt. Ltd. The sub-projects (Package-16 to 19) have been assessed to be of environmental category B as per ADB s Safeguard Policy Statement (2009) and environmental assessment guidelines PROJECT DESCRIPTION This project comprises of widening and strengthening of state highways and major district roads. Under Group-C roads, there are four packages -16 to 19 comprising of km road network. Progress Status of Pre-Construction Activities The preconstruction activities like mobilization of plants and equipment s, construction of camps, construction of laboratories, erection and commissioning of plants for Package 16 &19 have been completed and is in progress for Package 17 &18. Marking of centreline, checking of GPS pillars, benchmarks are also in progress for Package 17 &18. a) Construction Camps The following Construction camps are being established: Package 16: Established Batching Plant at (RHS), HMP at km (LHS) and site office at Km near Hathanewara Village Package17: Camp established at Gobripat (KOTA) village at Km (LHS) Package 18: Established at Ch Km (LHS) Package 19: Construction Camp established at Km near Shiv Petrol pump, Masturi. 15 b) Tree Cutting Status The cuttings of trees are being carried out based on the approval of competent authority. It is carried out with all safety requirements. However, there is a provision of Accident Prevention (Safety) Officer in contract who has been nominated by respective contractors for implementation of Environmental and Social Safeguard issues. During the progress review meeting the civil work contractors were reminded to obtain all permissions required under the existing statutory environmental regulations mainly Consent to establish and operate Hot Mix Plant/ Crushers/ Batching Plant/WMM Plant, Permission to withdraw water for construction, permission for Quarry/Borrow areas, PUC for construction vehicles, labor license, Insurance policies etc.. The contractors were also advised to go through the Environmental Management Plan (EMP) provided in contract agreement and implement the mitigation measures suggested thereon. The reporting formats were developed in consultation with contractors and were issued to them for reporting in monthly progress report. The contractors of package -16 & 19 are submitting Environment and Social Safeguard Compliance Report every month. The contractors of package -17 & 18 have not submitted any report till date. 18 B. Implementation Schedule The Project Sheorinarayan-Birra-Champa (SH-9) package -16 consists of rehabilitation and upgrading to two lanes with 2.5m earthen shoulder having length of km. The Project Jairamnagar Masturi Malhar Jondhara Lawan Road (MDR) package -19 consists of rehabilitation and upgrading to two lanes with 1.5m earthen shoulder having length of km. The Time for Completion for package-16 & 19 is 24 months (730 days) from Commencement Date on 20 th April The project Ratanpur Kota Lormi (SH-10) package-17 consist of rehabilitation and upgrading to two lanes with 2.5m earthen shoulder having length of km. The project Lormi Pandariya Roadfrom (Ch to ) & Mungeli Lormi Road (Ch to ) with Mungeli Bypass from Ch to package-18 ( total length km) consist of rehabilitation and upgrading to two lanes with 2.5m earthen shoulder for Lormi- Pandariya Road and 1.5m earthen shoulder for Mungeli- Lormi Road with Bypass. The Time for Completion for package-17 & 18 is 24 months (730 days) from Commencement Date on 13 th April COMPLIANCE TO NATIONAL/STATE/LOCAL REGULATIONS The Chhattisgarh Public Works Department, an executing agency for the project, have obtained permissions required for trees cutting. PIU and supervision consultant asked the civil works contractors to obtain all permissions required under the existing statutory environmental regulations. Supervision Consultant is regularly reminding contractors to obtain/renew statutory clearances/consents for Quarry/Borrow areas from Mining Departments/DEIAA and for plants established at their respective sites from State Pollution Control board and to submit the complete details regarding the status of clearances/approvals/consents applied for/obtained. The Contractors have also been asked to submit Pollution Under Control Certificate (PUC) for vehicles engaged on construction activity. The status of Compliance with Environmental Regulations is detailed in Annexure- I 3.0 STATUS OF COMPLIANCE WITH SAFEGUARDS LOAN COVENANTS Safeguards Covenants Description Status of Compliance / Remarks Schedule 5 Para No. 4 The Borrower shall ensure or cause the EA to ensure that the preparation, design, construction, implementation, operation and decommissioning of the Project, and all Subprojects facilities comply with (i) all applicable laws and regulations of the Borrower and the State relating to environment, health, and safety; (ii) the Environmental Safeguards; (iii) the EARF; and (iv) all measures and requirements set forth in the respective IEE and EMP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report. It is being complied with. All environment safeguards requirements being implemented in accordance with relevant policies and regulations of the Government of India, State Government of Chhattisgarh and the ADB Safeguard Policy Statement, 2009 (SPS). All measures and requirements set forth in the respective EMPs are being implemented accordingly. Environmental Safeguard Monitoring Page 15

19 Safeguards Covenants Schedule 5 Para No. 5 Schedule 5 Para No. 6 Schedule 5 Para No. 7 Description The Borrower shall ensure or cause the EA to ensure that all land and all rights-of way required for the Project, and all Project/Subproject facilities are made available to the Works contractor in accordance with the schedule agreed under the related Works contract and all land acquisition and resettlement activities are implemented in compliance with (i) all applicable laws and regulations of the Borrower and the State relating to land acquisition and involuntary resettlement; (ii) the Involuntary Resettlement Safeguards; (c) the RF; and (d) all measures and requirements set forth in the respective RP, and any corrective or preventative actions set forth in a Safeguards Monitoring Report. Without limiting the application of the Involuntary Resettlement Safeguards, the RF or the RP, the Borrower shall ensure or cause the EA to ensure that no physical or economic displacement takes place in connection with any Subproject until: (a) compensation and other entitlements have been provided to affected people in accordance with the RP; and (b) a comprehensive income and livelihood restoration program has been established in accordance with the RP. In the event of any Subproject involving indigenous peoples, the Borrower shall ensure or cause the EA to ensure that the preparation, design, construction, implementation and operation of the Project, each Subproject and all Project/Subproject facilities comply with (a) all applicable laws and regulations of the Borrower and the State relating to indigenous peoples; (b) the Indigenous Peoples Safeguards; (c) the IPPF; and (d) Status of Compliance / Remarks Project roads (package-16 &19) have been handed over to the contractor on 20 th April, Project roads (package-17 &18) have been handed over to the contractor on 13 th April, The details about land acquisition and resettlement activities being implemented are provided in Social Monitoring Report. The compensation and other entitlements provided to affected people and establishment of comprehensive income and livelihood restoration program are detailed in Social Monitoring Report. (a) The Borrower shall ensure or cause the EA to ensure that all necessary budgetary and human resources to fully implement the EMP, the RP and the IPP as required, are made available. (b) The EA shall designate at least one expert each to supervise implementation of the EMPs and RPs. The Borrower shall ensure or cause the EA to ensure that all bidding documents and contracts for Works contain provisions that require contractors to: (a) comply with the measures and requirements relevant to the contractor set forth in the IEE, the EMP, the RP and the IPP (to the extent they concern impacts on affected people during construction), and any corrective or preventative actions set out in a Safeguards Monitoring Report; (b) make available a budget for all such environmental and social measures; (c) provide the CGPWD with a written notice of any unanticipated environmental, resettlement or indigenous peoples risks or impacts that arise during construction, implementation or operation of the Project/Subproject that were not considered in the IEE, the EMP, the RP or the IPP; (d) adequately record the condition of roads, agricultural land and other infrastructure prior to starting to transport materials and construction; and (e) fully reinstate pathways, other local infrastructure, and agricultural land to at least their pre-project condition upon the Status of Compliance / Remarks All necessary budgetary and human resources required to implement the EMP is made available. One Environmental Expert and One Social Expert placed to PIU (H.Q.) to supervise implementation of the EMPs and RPs respectively. The Borrower shall ensure or cause the EA to ensure the following: (a) submit semi-annual Safeguards Monitoring Reports to ADB and disclose relevant information from such reports to affected persons promptly upon submission; (b) if any unanticipated environmental and/or social risks and impacts arise during construction, implementation or operation of the Project/Subproject that were not considered in the IEE, the EMP, the RP or the IPP as applicable, promptly inform ADB of the occurrence of such risks or impacts, with detailed description of the event and proposed corrective action plan; and (c) no later than three months from the commencement of RP implementation of the first Subproject, engage qualified and experienced external experts or qualified nongovernmental organizations under a selection process and terms of reference acceptable to ADB, to verify information produced through the project monitoring process for resettlement, environment and indigenous peoples (if any), and facilitate the carrying out of any verification activities by such external experts; (d) report any breach of compliance with the measures and requirements set forth in the EMP, the RP or the IPP promptly after becoming aware of the breach. The Borrower shall ensure or cause the EA to ensure that no proceeds of the Loan under the Project are used to finance any activity included in the list of prohibited investment activities provided in Appendix 5 of ADB s Safeguard Policy Statement (2009). 22 4.0 COMPLIANCE TO SAFEGUARDS MANAGEMENT PLAN Supervision Consultant, through its environmental expert and site staff is monitoring the implementation of environmental issues on package-16 to19 which have been awarded and construction activities are being carried out by contractor. The contractors were asked to nominate one of their staff as Environmental Safeguard Officer so that he may be guided /trained in EMP implementation. The supervision consultant submits Monthly/Quarterly progress report to PWD that includes information on implementation of environmental issues. The environmental information captured in these reports includes environmental monitoring status of construction sites, pollution control measure being adopted, and measures for workers safety at construction site and camp site, safety of road user/public etc. The Supervision Consultant has assessed the implementation of EMMP during the reporting period as partially satisfactory because there is partial compliance by contractor on issues like safety arrangements, traffic management and usage of personal protective equipment (PPE) by the construction workers. The statutory permissions are also to be obtained for the construction plants being erected by contractor, for extraction of ground water, for borrow/quarry areas etc. The complaint handling system has been established at each construction sites for effective and timely redressal of public grievances. The Supervision Consultant has not received any complaint from the public on environmental issues during this reporting period i.e. from January to June The one day workshop on social and environmental safeguard issues was organized by consultant on in ICT Project Office, Bilaspur with an aim to improve compliance with Safeguard Measures provided in contract documents and as agreed with ADB. The training program was started at 3:00 PM with the inaugural address by Mr. K.P. Dutta Roy, Team Leader, CSRSP (Group-C Project), in which he emphasized the importance of social & environmental issues in project execution. He informed the gathering that, being ADB funded project, non-compliance of environmental and social safeguards (proper implementation of EMP and RP) will be reviewed seriously and stern actions will be taken for non-compliance. The photographs of project site/activities are enclosed as Annexure-IV. The issues related to Implementation of Environmental Management & Monitoring Plan (EMMP) were covered by Mr. Pawan Malik, Environmental Specialist and social aspects were addressed by Dr. S.K. Singh, Social Specialist of ICT Pvt. Ltd. The PIU staff, supervisory/field staff of consultant, concerned and Contractor s key staff along with their environment & social safeguard officers were invited to attend the program. The various issues covered in this training program includes but not limited to: Environmental Safeguards Requirements, Environmental Management & Monitoring Plan (EMMP) and its Implementation Roles and Responsibilities of ADB's/ Client's/ Consultant's/Contractors in safeguards compliance Clearances Required for Project, Social impact assessment process and understanding resettlement planning documents, resettlement framework etc. Environmental Safeguard Monitoring Page 19

23 Practical experience, thoughts and photographs of good and bad practice being observed at various sites. Challenges in implementing EMMP, effect of EMP noncompliance, ways to handle persistent non-compliance by different stakeholders, Prerequisite of updating of RPs and its disclosure before community and on websites of Executing Agency and ADB The specified role of NGO in every stages of project implementation and support of CSC Expert Tenure and extension of NGOs involvement in RP implementation The formats to be used for reporting at different interval of times and its uniformity The modalities and steps required for shifting of CPRs, social welfare of public/contractor's personnel, reporting requirements, reporting formats etc. After presentation, questions and answers session was held in which contractors raised their queries and same was replied by concerned specialist. The Participants appreciated the program which ended at 5:30 PM with the vote of thanks from Team Leader of M/s ICT. A view of the capacity building workshop held on ENVIRONMENTAL MONITORING RESULTS AND UNANTICIPATED IMPACTS The baseline environmental monitoring has already been conducted for all four packages and detailed results for ambient air quality, water quality, soil quality and noise levels are provided in IEE reports. Subsequently a comprehensive environmental monitoring plan has been prepared and provided in IEE Report as well as in Civil Work Contract. The monitoring programme has Environmental Safeguard Monitoring Page 20

24 been designed focusing monitoring during construction and operation stage. The following Environmental Parameters shall be monitored: a) Ambient Air Quality Monitoring b) Water Quality c) Noise Level Monitoring The contractors have been advised to carry out the environmental monitoring as per the environmental monitoring plan provided in IEE report/ Civil Work Contract and submit a copy of the monitored results on regular basis. During this reporting period, environmental monitoring was carried out by the civil work contractors of Package-16 & 19 in the month March and January 2016 respectively. The work on Package 17&18 were commenced on 13 th April and contractors were busy in mobilizing their resources to the site and doing preconstruction activity. The all the parameters monitored are within permissible limit. The environmental monitoring Reports are enclosed as Annexure-II. 6.0 IMPLEMENTATION OF GRIEVANCE REDRESS MECHANISM AND COMPLAINTS RECEIVED FROM STAKEHOLDERS There is a provision of Grievances Redress Mechanism (GRM) related to the implementation of the project, particularly regarding the environmental management plan. The GRM include formation of District level Grievance Redress Committee (GRC) comprising of District Commissioner, revenue official, forest official, public representative and respective nodal officer from PWD. Similarly village level GRC are to be formed in the project. The GRM framework is shown below: The Group-C projects falls in five district namely Janjgir-Champa, Bilaspur, Mungeli, Kabirdham and Baloda Bazar District. The Grievance Redressal Committee (GRC) has been formed in all five districts. The letters regarding formation and composition of GRC are attached as Annexure-III. From Package-16 to 19, till date no complaint received from the public/commuter on environmental safeguard issues. Environmental Safeguard Monitoring Page 21

25 7.0 CONCLUSION AND RECOMMENDATIONS The contractors are being reminded to take care of environmental issues emerging by execution of project and strictly adhere to the provisions of EMP and FIDIC conditions to minimize negative impact on surrounding. Some of the areas which need improvement are providing safety measures for worker & traffic, debris/construction waste disposal, dust suppression and camp site management. The contractors of Package-16 to 19 have been asked to obtain all remaining statutory permissions, to conduct HIV/AIDS awareness program regularly at site, to conduct Environmental Monitoring as per environmental monitoring plan provided in contract and to provide PPE to all workers and ensure its use by them. The Contractors assured to put all efforts to comply with the EMP/Contractual requirements. The Supervision Consultant has assessed the implementation of EMMP during the reporting period as partially satisfactory because there is partial compliance by contractor on issues like safety arrangements, traffic management and usage of personal protective equipment (PPE) by the construction workers.
