1 Request for Proposals Parking Lot Services The St. Cloud Housing and Redevelopment Authority is accepting proposals from qualified individuals or firms to provide parking lot crack filling, seal coating and restriping at 15 HRA owned developments in St. Cloud (see attached property list). The scope of work includes providing labor and materials for parking lot crack filling, seal coating and restriping to properties owned and operated by the HRA. Respondents agree that there will not be discrimination as to race, sex, religion, color, age, creek, or national origin in regard to obligations, work and service performed under those terms of any contract ensuing from this RFP. The St. Cloud Housing and Redevelopment Authority and/or Owner reserves the right to reject any or all bids or to waive any informalities in the bidding. Attention is called to the provisions for equal employment opportunity and the payment of not less than the minimum federal wage rates must be paid. The work to be performed under this contract is subject to the requirements of section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (section 3). The purpose of section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by section 3, shall, to the greatest extent feasible, be directed to low income persons, particularly persons who are recipients of HUD assistance for housing. The parties to this contract agree to comply with HUD's regulations in 24 CFR part 135, which implemented section 3. As evidenced by their execution of this contract, the parties to this contact certify that they are under no contractual or other impediment that would prevent them from complying with the part 135 regulations. The contractor agrees to send to each labor organization or representative of workers with which the contractor has a collective bargaining agreement or other understanding, if any, a notice advising the labor organization or workers' representative of the contractor's commitments under this section 3 clause, and will post copies of the notice in conspicuous places at the work site where both employees and applicants for training and employment positions can see the notice. The notice shall describe the section 3 preference, shall set forth minimum number and job titles subject to hire, availability of apprenticeship and training positions, the qualifications for each; and the name and location of the person(s) taking applications for each of the positions; and the anticipated date the work shall begin.

2 The contractor agrees to include this section 3 clause in every subcontract subject to compliance with regulations in 24 CFR part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or in this section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 135. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 135. The contractor will certify that any vacant employment positions, including training positions, that are filled (1) after the contractor is selected but before the contract is executed, and (2) with persons other than those to whom the regulations of 24 CFR part 135 require employment opportunities to be directed, were not filled to circumvent the contractor's obligations under 24 CFR part 135. Noncompliance with HUD's regulations in 24 CFR part 135 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts. With respect to work performed in connection with section 3 covered Indian housing assistance, section 7(b) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450e) also applies to the work to be performed under this contact. Section 7(b) requires that to the greatest extent feasible (i) preference and opportunities for training and employment shall be given to Indians, and (ii) preference in the award of contracts and subcontracts shall be given to Indian organizations and Indian-owned Economic Enterprises. Parties to this contract that are subject to the provisions of section 3 and section?(b) agree to comply with section 3 to the maximum extent feasible, but not in derogation of compliance with section 7(b). 3 Scope of Proposal The bidder shall be held to have examined the premises and site and specifications and to have satisfied themselves as to the condition of the premises, obstructions, the actual levels and other factors necessary for carrying out the work before the delivery of their proposal. The bidders shall also acquaint themselves with the character and extent of the Owner s operations in the area of the work, so that they may plan their services accordingly. No allowances or extra payment will be made to a Contractor for or on account of costs or expenses occasioned by failure to comply with the provisions of this paragraph or by reason of error or oversight on the part of the bidder or on account of interference by the Owner s or other Contractor s activities. It shall be expressly understood that the Owner s operations will take precedence over any other activity. Crack Filling and Sealcoating Services All services shall be performed at times mutually agreed upon between Owner and Contractor. Contractor shall be responsible for complying with all local ordinance regarding working times. Contractor assumes all liability for complying with local ordinances. Any changes to the established schedule must have prior approval of the Owner and scheduled at the least disruptive time possible. The contractor agrees that once work has begun on any date, they will be completed within twenty-four (24) hours, unless unusual weather prevents compliance. Blow cracks out ¾ deep and fill them with MNDOT SPEC 3723 HOT RUBBER. If needed go over them twice. When sealcoating use an asphalt emulsion sealer, add polymer additives plus 2 # s of sand in per gallon and apply at a rate of 1 gallon per 55 SQ.FT. in 2 coats Striping Striping services shall be performed at times mutually agreed upon between Owner and Contractor. Contractor shall be responsible for complying will all local and state laws or ordinances. Contractor assumes all liability for complying with afore mentioned laws and ordinances. The contractor agrees that once striping has begun on any date, they will be completed within twenty-four (24) hours, unless unusual weather prevents compliance. Restripe matching existing including all curbs and walkways that are currently painted. Use Epoxy (Plural component Liquid) paint and install according to the manufacturer's specifications.

4 Workmanship Performance will be evaluated based upon the expectation of a neat, professional looking appearance of the grounds. Where, not more specifically described in any of the various sections of these specifications, workmanship shall conform to all the methods and operations of best standards and accepted practices of the trade or trades involved and shall include all items required for completion of the services. Personnel skilled in their respective lines of work shall execute all work. The Owner may request a meeting with the Contractor at any time for the purpose of evaluating the Contractor s performance. Any item not completed to the satisfaction of the Owner will be corrected by the Contractor within a mutually agreed upon timeframe. Failure by the Contractor to remedy concerns of the Owner may result in the termination of this contract.
