1 Semua Risiko Kontraktor Terma & Syarat

2 POLISI INSURANS SEMUA RISIKO KONTRAKTOR BAHAWASANYA PIHAK DIINSURANSKAN yang dinamakan dalam Jadual bersama-sama ini telah membuat cadangan bertulis kepada (kemudian dari ini dipanggil Syarikat ) dengan melengkapkan soal selidik yang, bersama-sama apa-apa jua pernyataan lain secara bertulis oleh Pihak Diinsuranskan untuk tujuan Polisi ini, adalah disifatkan sebagai terkandung di dalam ini. MAKA DENGAN INI POLISI INSURANS INI MENYAKSIKAN bahawa tertakluk pada Pihak Diinsuranskan membayar kepada Penanggung Insurans premium yang tersebut dalam Jadual dan tertakluk pada terma, pengecualian, peruntukan dan syarat-syarat yang terkandung dalam ini atau diendors padanya Penanggung Insurans akan mengganti rugi Pihak Diinsuranskan dengan cara yang diperuntukkan kemudian dari ini. PENGECUALIAN AM Penanggung Insurans tidak akan mengganti rugi Pihak Diinsuranskan dari segi kerugian, kerosakan atau liabiliti secara langsung atau tidak langsung disebabkan oleh atau yang timbul daripada atau yang diburukkan oleh (a) (b) (c) (d) peperangan, pencerobohan, tindakan musuh luar Negara, pertempuran (sama ada peperangan diisytiharkan atau tidak), perang saudara, penentangan, revolusi, pemberontakan, penderhakaan, rusuhan, mogok, sekatan masuk kerja, kegemparan awam, pemerintahan tentera atau rampasan kuasa, sekumpulan orang yang berniat jahat atau yang bertindak bagi pihak atau berkaitan dengan mana-mana organisasi politik, konspirasi, perampasan, penawanan, pengambilan atau pemusnahan atau kerosakan yang diarahkan oleh mana-mana kerajaan de jure atau mana-mana pihak berkuasa awam; tindak balas nuklear, radiasi nuklear atau pencemaran radioaktif; tindakan atau kecuaian yang disengajakan oleh Pihak Diinsuranskan atau wakil-wakilnya; Pemberhentian kerja sama ada keseluruhan atau sebahagian. Dalam mana-mana tindakan, guaman atau prosiding lain di mana Penanggung Insurans mengatakan bahawa atas alasan peruntukan Pengecualian a) di atas, mana-mana kerugian, kemusnahan, kerosakan dan liabiliti tidak dilindungi oleh insurans ini beban membukti agar kerugian, kemusnahan, kerosakan atau liabiliti sedemikian dilindungi adalah atas Pihak Diinsuranskan. TEMPOH PERLINDUNGAN Liabiliti Penanggung Insurans akan bermula, dengan tidak menyentuh mana-mana tarikh sebaliknya yang ditetapkan dalam Jadual, sebaik sahaja apabila memulakan kerja atau selepas pemunggahan item yang dimasukkan dalam Jadual di tapak. Liabiliti Penanggung Insurans tamat tempoh bagi bahagian kerja kontrak yang diinsuranskan itu diambil alih atau dimulakan operasinya. Selewat-lewatnya Insurans tersebut akan tamat tempoh pada tarikh yang ditetapkan dalam Jadual. Mana-mana lanjutan Tempoh Insurans adalah tertakluk pada persetujuan bertulis Penanggung Insurans. 1

3 SYARAT-SYARAT AM 1. Mematuhi dan memenuhi sewajarnya terma Polisi ini setakat mana ia berkaitan dengan apa-apa yang perlu dilakukan atau dipatuhi oleh Pihak Diinsuranskan dan kebenaran kenyataan dan jawapan dalam soal selidik serta cadangan yang dibuat oleh Pihak Diinsuranskan hendaklah menjadi syarat duluan kepada mana-mana liabiliti Penanggung Insurans. 2. Jadual dan Seksyen (Seksyen-seksyen) hendaklah disifatkan sebagai terkandung dalam dan menjadi sebahagian daripada Polisi dan ungkapan Polisi ini di mana-mana juga digunakan dalam kontrak ini hendaklah dibaca sebagai mencakupi Jadual dan Seksyen (Seksyen-seksyen). Mana-mana perkataan atau ungkapan yang telah diberi maksudnya yang spesifik dalam mana-mana bahagian Polisi ini atau Jadual atau Seksyen (Seksyen-seksyen) hendaklah mengambil makna sedemikian di mana-mana juga ia terdapat. 3. Pihak Diinsuranskan hendaklah atas tanggungannya sendiri mengambil semua langkah berjaga-jaga yang munasabah dan mematuhi semua syor yang munasabah pemegang insurans untuk mengelakkan kerugian, kerosakan atau liabiliti dan mematuhi keperluan berkanun dan syor pengilang. 4. (a) Wakil-wakil Penanggung Insurans hendaklah pada bila-bila masa yang munasabah mempunyai hak untuk memeriksa risiko dan Pihak Diinsuranskan hendaklah menyediakan wakil-wakil Penanggung Insurans dengan segaka butiran dan maklumat yang perlu untuk menilai risiko. (b) Pihak Diinsuranskan hendaklah dengan serta merta memberitahu Penanggung Insurans melalui telegram dan secara bertulis mana-mana perubahan material dalam risiko dan sebab atas tanggungannya sendiri langkah berjaga-jaga tambahan yang perlu di ambil sebagaimana yang diperlukan oleh keadaan, dan skop perlindungan dan/atau premium hendaklah, jika perlu, diselaraskan sewajarnya. Tiada apa-apa perubahan material boleh dibuat atau diterima oleh Pihak Diinsuranskan yang risikonya bertambah, kecuali kesinambungan insurans disahkan secara bertulis oleh Penanggung Insurans. 5. Sekiranya berlaku apa-apa peristiwa yang mungkin menimbulkan sesuatu tuntutan di bawah Polisi ini, Pihak Diinsuranskan hendaklah (a) (b) (c) (d) (e) memberitahu Penanggung Insurans dengan serta merta dengan menelefon atau menghantar telegram serta secara bertulis, dengan memberikan gambaran sifat dan takat kerugian atau kerosakan; mengambil semua langkah dalam kuasanya untuk meminimumkan takat kerugian atau kerosakan; memulihara bahagian yang terjejas dan memastikan ia boleh tersedia untuk pemeriksaan oleh seorang wakil atau jurustatistik Penanggung Insurans; membekalkan semua maklumat yang berkenaan dan bukti dokumentari seperti yang diperlukan oleh Penanggung Insurans; memaklumkan pihak berkuasa polis sekiranya berlaku kerugian atau kerosakan yang disebabkan oleh kecurian atau rompakan. Penaggung Insurans, dalam apa-apa hal pun, tidak akan bertanggungjawab ke atas kerugian, kerosakan atau liabiliti yang tiada notisnya diterima oleh Penanggung Insurans dalam masa 14 hari dari masa ia berlaku. 2

4 Sebaik sahaja selepas pemberitahuan kepada Penanggung Insurans di bawah syarat ini, Pihak Diinsuranskan boleh melakukan pembaikan atau penggantian mana-mana kerosakan kecil; dalam semua kes lain seorang wakil Penanggung Insurans hendaklah berpeluang memeriksa kerugian atau kerosakan sebelum apa-apa pembaikan atau pindaan dijalankan. Sekiranya wakil Penanggung Insurans tidak melakukan pemeriksaan dalam tempoh masa yang boleh dianggap mencukupi dalam keadaan yang sedemikian, Pihak Diinsuranskan layak meneruskan pembaikan atau penggantian. Liabiliti Penanggung Insurans di bawah Polisi ini dari segi mana-mana item yang mengalami kerosakan hendaklah dihentikan sekiranya item yang berkenaan tidak dibaiki dengan betul tanpa berlengah-lengah. 6. Pihak diinsuranskan hendaklah atas tanggungan Penanggung Insurans melakukan dan bersetuju dalam melakukan dan membenarkan untuk dilakukan semua tindakan dan benda sedemikian sebagaimana yang perlu atau dikehendaki oleh Penanggung Insurans bagi kepentingan apa-apa hak atau pemulihan, atau mendapatkan bantuan atau ganti rugi daripada pihak-pihak (selain yang diinsuranskan di bawah Polisi ini) yang kepadanya Penanggung Insurans berhak untuk atau mungkin disubrogasi sebaik sahaja mereka membayar atau membaik pulih apa-apa kerugian dan kerosakan di bawah Polisi ini, sama ada tindakan dan benda-benda tersebut menjadi perlu atau dikehendaki sebelum atau selepas Penanggung Insurans mengganti rugi Pihak Diinsuranskan. 7. Sekiranya timbul apa-apa perbezaan berhubung dengan amaun yang perlu dibayar di bawah polisi ini (liabiliti sebaliknya diterima), perbezaan yang sedemikian hendaklah dirujuk kepada keputusan seseorang penimbangtara yang akan dilantik secara bertulis oleh pihak-pihak dalam perbezaan atau, sekiranya mereka tidak dapat bersetuju dengan seorang penimbangtara, maka diputuskan dua orang penimbangtara, setiap seorang dilantik secara bertulis oleh setiap satu pihak dalam masa satu bulan kalendar setelah dikehendaki berbuat demikian secara bertulisoleh kedua-dua penimbangtara sebelum mereka dirujuk. Wasit hendaklah duduk bersama-sama penimbangtara dan mempengerusikan mesyuarat. Pemberian award hendaklah merupakan syarat dahuluan kepada mana-mana hak tindakan terhadap Penanggung Insurans. 8. Sekiranya sesuatu tuntutan itu dari apa-apa segi sekalipun adalah fraud, atau sekiranya apa-apa perakuan palsu dibuat atau digunakan untuk menyokongnya, atau sekiranya mana-mana cara atau devis fraud digunakan oleh Pihak Diinsuranskan atau sesiapa yang bertindak bagi pihaknyauntuk memperoleh manfaat daripada Polisi ini, atau sekiranya tuntutan dibuat dan ditolak dan tiada tindakan atau guaman dimulakan dalam masa tiga bulan penolakan tersebut, atau dalam hal penimbangtaraan berlaku seperti yang diperuntukkan di sini, dalam masa tiga bulan selepas penimbangtara atau penimbangtara-penimbangtara atau wasit telah membuat award mereka, maka semua manfaat di bawah Polisi ini akan terlucut hak. 9. Sekiranya pada masa itu mana-mana tuntutan timbul di bawah Polisi ini terdapat mana-mana insurans lain melindungi kerugian, kerosakan atau liabiliti yang sama, Penanggung Insurans tidak bertanggungjawab untuk membayar atau menyumbangkan bahagian yang melebihi perkadaran mana-mana tuntutan bagi kerugian, kerosakan atau liabiliti sedemikian. 3

5 SEKSYEN I - KEROSAKAN MATERIAL Penanggung Insurans dengan ini bersetuju dengan Pihak Diinsuranskan bahawa jika pada bila-bila masa semasa tempoh perlindungan item itu atau mana-mana bahagian daripadanya yang tersenarai dalam Jadual ditimpa kerugian atau kerosakan fizikal yang tak diduga atau secara tiba-tiba atas apa-apa sebab, selain yang secara khusus tidak termasuk dalam senarai yang dikecualikan, dalam keadaan yang memerlukan pembaikan atau penggantian, Penanggung Insurans akan mengganti rugi Pihak Diinsuranskan berkenaan dengan kerugian dan kerosakan itu, sebagaimana yang disediakan kemudian dari ini, melalui pembayaran secara tunai, penggantian atau pembaikian (atas pilihan Penanggung Insurans) sehinggalah ke amaun yang tidak melebihi satu tahun insurans berkenaan dengan setiap item yang ditentukan dalam Jadual jumlah yang ditetapkan padanya dan tidak melebihi jumlah keseluruhan yang dinyatakan dalam jadual sebagai yang diinsuranskan. Penanggung Insurans juga akan membayar ganti Pihak Diinsuranskan kos membersihkan sampah sarap berikutan mana-mana kejadian yang menyebabkan tuntutan dibuat di bawah Polisi ini dengan syarat jumlah berasingan dengan itu telah dimasukkan ke dalam Jadual. PENGECUALIAN ISTIMEWA BAGI SEKSYEN 1 Penanggung Insurans walau bagaimanapun tidak bertanggungjawab bagi a) deduktibel yang dinyatakan dalam jadual ditanggung oleh Pihak Diinsuranskan dalam mana-mana kejadian; b) kerugian yang disebabkan dalam apa-apa jenis atau huraian sekalipun termasuk penalty, kerugian akibat kelewatan, kurang prestasi, kehilangan kontrak; c) kerugian atau kerosakan yang disebabkan oleh kesilapan dalam reka bentuk ; d) kos penggantian, pembaikan atau pembetulan material yang cacat dan/atau kemahiran kerja, tetapi pengecualian ini adalah terhad kepada item yang terjejas secara langsung dan tidak akan disifatkan sebagai mengecualikan kerugian atau kerosakan kepada item yang dikendalikan secara betul hasil daripada kemalangan yang disebabkan oleh kecacatan material dan/atau kemahiran kerja; e) haus dan lusuh, kakisan, oksidasi, kemerosotan akibat kurang penggunaan dan keadaan atmosfera biasa; f) kerugian atau kerosakan kepada loji pembinaan, peralatan dan jentera pembinaan yang disebabkan oleh kerosakan elektrik dan jentera, kegagalan berfungsi, kemusnahan dan ketidaktentuan, pembekuan bahan pendingin atau bendalir lain, pelincir yang defektiff atau kurang minyak atau bahan pendingin, tetapi sekiranya akibat kerosakan atau ketidaktentuan sedemikian kemalangan berlaku serta mengakibatkan kemusnahan luaran, maka kemusnahan yang sedemikian boleh diganti rugi; g) kerugian atau kerosakan kepada kenderaan yang dilesenkan untuk kegunaan di jalan raya am atau pengangkutan air atau kapal terbang; h) kerugian atau kerosakan ke atas fail, lukisan, akaun, bil, mata wang, setem, surat ikatan, bukti hutang, wang kertas, sekuriti, cek; i) kerugian atau kerosakan yang ditemui hanya pada masa menyenaraikan inventori. 4

6 PERUNTUKAN YANG DITERIMA PAKAI BAGI SEKSYEN 1 Memo 1- Jumlah yang Diinsuranskan: Adalah menjadi kehendak bagi insurans ini bahawa jumlah yang diinsuranskan seperti yang dinyatakan dalam Jadual hendaklah tidak kurang daripada bagi item 1 : nilai penuh kerja-kerja kontrak apabila siap pembinaan, termasuk semua material, upah, tambang muatan, cukai kastam, dius, dan material atau item yang dibekalkan oleh Prinsipal; bagi item 2 dan 3 : nilai penggantian loji pembinaan, peralatan dan jentera pembinaan, yang bermaksud kos penggantian, item yang diinsuranskan dengan item baru daripada jenis dan kapasiti yang sama; dan Pihak Diinsuranskan mengaku janji untuk menambah atau mengurangkan amaun insurans sekiranya berlaku mana-mana turun naik material dalam upah atau harga dengan sentiasa menjadi syarat bahawa tambahan atau pengurangan tersebut akan berkuat kuasa hanya apabila perkara yang sama telah direkodkan dalam Polisi oleh Penanggung Insurans. Jika, sekiranya berlaku kerugian atau kerosakan, didapati bahawa jumlah yang diinsuranskan adalah kurang daripada amaun yang diperlukan untuk diinsuranskan, maka amaun yang boleh didapat kembali oleh Pihak Diinsuranskan di bawah Polisi ini akan dikurangkan pada perkadaran yang sedemikian sebagai jumlah ditanggung yang diinsuranskan kepada amaun yang perlu untuk diinsuranskan. Setiap objek dan item kos adalah tertakluk kepada syarat ini secara berasingan. Memo 2 - Asas Penyelesaian Kerugian: Sekiranya berlaku apa-apa kerugian dan kerosakan, asas mana-mana penyelesaian di bawah Polisi ini hendaklah a) Sekiranya berlaku kerosakan yang boleh dibaiki kos pembaikan yang diperlukan untuk memulihkan item kepada keadaannya sebaik sahaja sebelum berlaku kerosakan tolak salvaj, atau b) Sekiranya berlaku kerugian menyeluruh - nilai sebenar item sebaik sahaja sebelum berlakunya kerugian tolak salvaj, walau bagaimanapun, hanya ke takat kos yang dituntut terpaksa ditanggung oleh yang diinsuranskan dan ke takat ia termasuk dalam jumlah yang diinsuranskan dan dengan sentiasa menjadi syarat bahawa syarat dan peruntukan telah dipatuhi. Penanggung Insurans akan membuat bayaran hanya setelah berpuas hati dengan pemberian bil dan dokumen yang perlu bahawa pembaikan telah dijalankan atau penggantian telah berlaku, mengikut mana-mana yang berkenaan. Semua kerosakan yang boleh dibaiki hendaklah dibaiki, tetapi jika kos membaiki mana-mana kerosakan adalah bersamaan atau melebihi nilai item sebaik sahaja sebelum kerosakan berlaku, penyelesaian hendaklah dibuat atas asas yang diperuntukkan dalam b) di atas. Kos mana-mana pembaikan sementara akan ditanggung oleh Penanggung Insurans sekiranya pembaikan sedemikian menjadi sebahagian daripada pembaikan akhir dan tidak bertambah dalam perbelanjaan pembaikan menyeluruh. Kos mana-mana pindaan, tambahan dan/atau penambahbaikan tidak boleh didapatkan kembali di bawah Polisi ini. Memo 3- Tambahan Had Perlindungan: Caj tambahan untuk lebih masa, kerja malam, kerja semasa cuti am, tambang muatan ekspres dilindungi oleh insurans ini hanya jika dipersetujui sebelum ini dan khususnya secara bertulis. 5
