Marks son, Army Captain Marks, who had just returned from duty in Afghanistan. Captain Marks was joined at the podium by his wife Jessica, and spoke about his seven years of service in the Army, his experiences in Afghanistan, and their next assignment at Ft. Leonard Wood, Mo. Both answered questions about military life and experience. Ald. Burghart led the Council and audience in a round of applause for the couple. 3. Bruno and Burghart reported they had received minimal negative feedback from their ward, and the organizers answered questions from Aldermen about how residents, church-goers and businesses are notified prior to the event, and what accommodations would be made. Recommend Resolution Authorizing Professional Services Agreement with SB Friedman for an Analysis of Project Costs and Projected Revenues Related to Proposed Industrial Development within the Southeast Area Master Plan in the Amount of $20, Moved by Ald. Maladra commented that of the many strategic plans he has seen, this one was the most clean and concise and other Aldermen added their positive comments as well. Clements and City Administrator Dawkins answered questions and described how the plan is a set of goals, and that items can be addressed and added, and how citizens can request items be added. The next steps to be taken in November are for the City Council to review and approve the plan. 4. NEW BUSINESS/PUBLIC COMMENT Ald. CALL TO ORDER Mayor Burns called the meeting to order at 7:47 PM noting all aldermen were present. 2. POLICY DISCUSSION ON AFFORDABLE HOUSING Mayor Burns noted that no action would be taken at this meeting; that it was informational only. Burns introduced Community Development Director DeGroot, who gave a presentation on the topic of affordable housing. The entire presentation is available on the City website. Highlights included: 1. The stated goal to add more units in the City, with a goal of 10% affordable housing. 2. Definition as to how affordable is defined as based on a percentage of income, as shown on charts in the presentation. 3. A description of various tools and incentives and examples of how these could be used by the City of Geneva. 4. Reviewed findings showing the lack of impact on property values based on studies from OCTOBER 15, 2018 SPECIAL COMMITTEE OF THE WHOLE

7 7 2 All aldermen present participated in a discussion of the merits, challenges and goal to encourage the construction of more affordable housing units in the City. Highlights included: 1. More policy discussion is needed on the topic. 2. How the council can proceed to work on the issue. 3. The potential advantages of being a home-rule city VS non-home-rule, and how St. Charles is approaching development of affordable housing. 4. Working within the SPAC plan, which includes this topic. Members of the audience contributed to the discussion. Ald. Clements and others felt that more public input from a broader group of residents is needed. Mayor Burns concluded the discussion noting that there was no consensus reached at the meeting for a housing policy. Burns added that by his count, there were nine aldermen wanting to learn more and invite further input before proceeding. 3. NEW BUSINESS / PUBLIC COMMENT None 4. ADJOURNMENT On a motion by Ald. Call to Order The meeting was called to order at 8:30am, located in the Fabyan Conference Room of the Comfort Suites Hotel, Geneva, IL. A motion by Ald. Marks to waive Robert s Rules was heard, with Ald. Clements offering a second. V/V: 10-0 Motion carried. Burns introduced hotel General Manager Eric Lightner who welcomed everyone and provided some information on the hotel s history and plans for the future. 2. Items of Business a. Strategic Planning and Budget Development Workshop Administrator Dawkins provided an overview of the current fiscal year s goals, noting the 2 nd quarter report was provided in their packets. She then reviewed what was determined as priorities at last year s planning meeting, in addition to future projects. Topics included pedestrian safety, east side development/redevelopment goals and projects, Southeast Master Plan status, zoning updates, and housing ordinance research. After a short break, SPAC Chair Elizabeth Clements reviewed the new strategic plan and the prioritized goals and objectives that SPAC identified for the next fiscal year. After this review, the committee took part in their own prioritization exercise. The committee also reviewed next fiscal year s budget development calendar and discussed topics to be considered for inclusion in the budget, as well as how certain funds might be allocated. Asst. CA McCready then provided information regarding the compensation study implementation based on the Gallagher report that was approved in The committee offered feedback and other ideas on staff recruitment techniques, and other employee benefits to be more competitive with other communities and job sectors. 10 10 Proclamation National Epilepsy Awareness Month WHEREAS, epilepsy is a chronic disorder defined by recurrent, unprovoked seizures and any people with epilepsy have more than one type of seizure and may have other symptoms of neurological problems; and WHEREAS, one-third of people with epilepsy live with uncontrolled seizures because no medication or surgery will work for them; and WHEREAS, in sixty percent of the cases, the cause is unknown and more than three million Americans are afflicted with some type of Epilepsy and of this number over 130,000 are Chicago area residents; and WHEREAS, lack of education about this disorder has contributed to age old myths, superstitions and prejudices at school and in the workplace, contributing to isolation, discrimination, anxiety and depression; and WHEREAS, many people with epilepsy are subject to isolation and discrimination at school or in the workplace; and NOW, THEREFORE, I, Kevin R. Burns, Mayor of the City of Geneva, Illinois, do hereby proclaim November 2018, as National Epilepsy Awareness Month in Geneva, and urge health care professionals, school officials, local officials, youth organizations and community groups to unite in our city s commitment to fight epilepsy. Illinois State Statutes require the City to approve a levy estimate at least 20 days prior to adoption and to file tax levies no later than the last Tuesday in December (December 25, 2018). The filing date is extended to Wednesday, December 26, 2018 due to Christmas falling on the last Tuesday of December.

Burns City Council Rita Kruse, Finance Manager Stephanie Dawkins, City Administrator Benjamin McCready, Assistant City Administrator/Director of Administrative services Date: November 13, 2018 Re: Estimate of tax Levy for Purposes of Truth in Taxation Mayor Burns and Members of the City Council: The Illinois Property Tax Code, Truth in taxation Law (35 ILCS 200/18-55 et. seq.) requires that not less than 20 days prior to the adoption of the City s property tax levy, the corporate authorities of the City shall determine the amounts of money estimated to be necessary to be raised by taxation for that year upon the taxable property in the City. The 2018 property tax levy is scheduled to come before the governing body for consideration and approval on December 03, Staff is bringing forward for your consideration and approval an estimated tax levy in the amount of $5,283,451. Since the final levy cannot exceed the estimated tax levy, it is prudent to approve an estimated levy that is higher than the expected final levy. This is because the equalized assessed valuation (EAV) figure that we are using to calculate the levy is an estimate provided by the County and the final EAV that will be determined next March may be lower due to tax appeals. The City is a non-home rule municipality that is subject to the Property Tax Extension Limitation Law (PTELL) as dictated by the State. The statutes limit the increase in the amount of property taxes extended (for capped funds) to the annual change in the applicable Consumer Price Index (CPI). For this levy, the CPI is 2.1%. The CPI is provided to us and the County by the Illinois Department of Revenue. In addition, the City is allowed to capture the increase in the equalized assessed valuation (EAV) of the City that is attributable to new construction and

14 annexation. The new construction figure is provided to us by the County. In order to ensure that the City captures this new growth, it is recommended that the City pass a levy which includes both the CPI and the new construction. The actual amount of the levy may be lowered by the County once the true EAV of the City is known in March The amount of the levy can (and likely will) decrease; but in no case can it exceed the amount reflected in the estimate approved by the City Council. The final EAV is calculated in the late winter or early spring for the tax levy completed the previous December. EAV Increase The 2018 taxable EAV is currently estimated to increase from $1,010,041,569 to $1,055,982,640, an increase of 7.97%, for the fifth year in a row. This net $45,941,071 increase consists of an estimated $38,665,438 (3.83%) increase in current EAV (based on township assessor s estimates compiled to-date) and an increase due to new construction EAV of $7,275,633 (0.72%). Application of Consumer Price Index and New Construction The index used to determine the increase is the CPI-U or the Consumer Price Index for All Urban Consumers. For the December 2018 levy payable in 2019 this increase is 2.1%. Section of the Property Tax Code defines extension limitation: as... the lesser of 5% or the percentage increase in the Consumer Price Index during the 12-month calendar year preceding the levy year.... This change was measured from December 2017 to December 2018 by the Illinois Department of Revenue. Debt Service Levy Decrease The 2018 property tax levy also includes a 36.24% decrease in the debt service levy due to the annual debt service payments that the City is obligated to pay. The total amount of debt service that will be levied on the property tax bill is $650,650. Below is a graph representing FY 2020 and future required debt service payments. 15 Fire Pension PA Levy Per the Public Act , the City may levy for a portion of the pension contribution outside of the property tax cap. PA provided for reciprocity between all Article 4 firefighter pension funds and for transfers of credit and contributions from IMRF to a firefighter pension fund. This act also increased minimum pensions and survivor benefits. The act allowed for the actuarial to decimate pension contributions related to the act. The amount determined by the actuarial for levy year 2018 is $34,712. Public Safety Pension Valuations The Geneva Police Pension Fund experienced an investment return of 5.85%, annual payroll increase of 7.0% and the percent funded increased from 54.4% to 56.2%. This funds levy requirement increased from $1,360,637 to $1,566,101 or 13.2%. The Geneva Firefighters Pension Fund experienced an investment return of 4.9%, annual payroll decrease of 1.3% and the percent funded decreased from 75.1% to 72.4%. This funds levy requirement increased from $543,009 to $649,249 or 16.4%. Although the City doesn t levy the full amount the Public Safety pension fund requirements, the balance necessary comes from sales taxes, income taxes and other revenue streams. SSA s Ordinances for the SSA levy extensions will be presented for consideration and approval at the December 3, 2018 as well as the corporate and debt service ordinance. These levies are for the maintenance costs associated with each SSA and are determined by our Public Works and Community Development staff often working in conjunction with a Homeowners Association. Recommended Estimated Levy Based upon the above discussion and consideration, staff is recommending the City Council approve the proposed City levy estimate of $5,283,451 (see chart below) and $651,650 debt service levy estimate. This estimated levy was calculated using the 2.1% CPI and the estimated value of new growth at.72%. As stated previously, the final levy will be approved in December by the City Council and the actual final rate will be determined by the County and can (and likely will) be lower, but in no case higher than the estimate recommended. Recommend Estimated Levy and Effect on Tax Rate Although the estimated levy shows an decrease of.77% for the corporate levy (excluding debt service), the actual tax rate for an individual property taxpayer will decrease due to the estimated increase in the EAV and the city debt service levy decreasing by over 35%. The original bid from the Western Avenue Transformer Procurement included, as an option, for a City of Geneva representative and the Consulting Engineer (Stanley Consultants) to witness the factory testing of the transformer prior to shipment. This option is included as is easier to correct any deficiencies or workmanship at the factory rather than post delivery at the substation. Subsequent to the construction of the transformer, witness testing was delayed due to work schedules at the factory. Testing was further delayed due to Hurricane Florence. To prevent any delay in delivery of the transformer, the factory proceeded with testing without the City of Geneva Representative or Stanley Consultants being on site. All test data was provided to Stanley Consultants, and after their careful review was accepted in-lieu-of witness testing. I light of the witness testing not being performed, City of Geneva requested a change order to reduce the total cost of the contract by the amount of the witness testing. The original agreement with Stanley Consultants did not include Witness Testing costs. Those costs, if required were to be provided through the Transformer Procurement Bid. The transformer manufacturers provided an optional amount for witness testing that included the cost of the owner s engineer. Since the witness testing was eliminated at the last minute from the transformer manufacturers scope, and since the transformer manufacturer has provided a credit to the City of Geneva for those costs per their bid, Stanley Consultants has requested reimbursement from the City for their time preparing for the witness testing and the airline ticket. During the general construction of the transformer foundation, it was discovered that the foundation of the static mast pole was too close to the new transformer foundation. Unfortunately, it had been shown incorrectly on the original plans for the substation. Stanley Consultants revised and corrected the plans and provided an additional specification for the work to the City of Geneva. The Standard Terms and Conditions of the agreement provide that the extent of the agreement may only be amended by written instrument signed by both parties. No Executive Summary: On September 17, 2018 the Geneva City Council awarded the 2018 Storm and Sanitary Sewer Replacement project to Patnick Construction in the amount of $125, Staff is presenting Change Order #1 for consideration. The construction of the sanitary sewer behind 8 Stevens Street, old Geneva Bottling Works, was planned to be laid in the same trench as the existing sanitary sewer. This was done to reduce the need for rock excavation due to the proximity to the Fox River. During the construction of the new sanitary sewer it was discovered that when the building west of the Geneva Bottling Works was constructed, it was placed only a few feet from the existing sanitary sewer. Because of this situation, roughly 90 feet of the new sanitary sewer will need to be relocated outside of the existing trench to avoid damage to the building foundation. Moving the sanitary sewer will require rock excavation which was not included in the contract. Rock excavation will require a larger machine to break the bedrock and will take additional manhours. Staff has negotiated a price for the rock excavation in the amount of $ per cubic yard. Based on the field conditions during construction staff is estimating 40 cubic yards of rock excavation will be needed. Based on this estimate the overall cost for rock excavation will be $18, At the time the bid specifications were developed, staff relied on records for the asphalt pavement thickness on Euclid Avenue. During construction of the new storm sewer, it was discovered that the pavement thickness was 8 inches, not 4 inch as written in the records. The contract price for the Class D Asphalt Patch, 4-inch is $87.00 per square yard. Staff negotiated a price with Patnick for a Class D Asphalt Patch, 8-inch at $ per square yard. The increase for this item is estimated to be $4, Staff is requesting approval of Change Order #1 in the amount not-to-exceed $25,000.00
