Your bid is to be in based on the Contract Documents, as prepared by SOM, and other Bid Instructions, Contract Appendices, and Attachments all as listed herein and in future Addenda. 2 Proposal/Bid Bids shall be submitted on the requested Bid Form with any other subcontractor proposal information necessary for a complete evaluation. Include company name, project reference, and Bid Package and submit to the attention of Balfour Beatty Construction, Attn: Chet Brians, VP Preconstruction at above referenced address, no later than July 15, 2015 at 2:00PM. In the preparation of your bid proposal, please consider the following: 1. Subcontractor shall fill out the Bid Form and submit with the bid proposal. This form will be issued as a separate Addendum. This form contains important information that will be used to evaluate the responsiveness of your proposal. 2. The firm submitting this proposal/bid agrees to provide the scope of work outlined within this Invitation to Bid and the Contract Documents for the amount referenced on the Bid Form in accordance all of the referenced attachments and with the terms of the Balfour Beatty Construction subcontract agreement. 3. Subcontractors are encouraged to submit a detailed scope letter with your Bid Form to allow an evaluation of your proposed scope of work, interpretations, assumptions, or qualifications. 4. The successful Subcontractor will be required to execute Balfour Beatty Subcontract Agreement without modification. A Design-Build Form of Agreement will be utilized for those Bid Packages that include Design. 6. General Requirements, (Appendix A), shall be made a part of any Agreement and must be considered when preparing the bid. 7. Appendix B "Scope of Work" shall be followed in the preparation of the bid. This will follow as an Addendum, and will be ultimately be attached to the Subcontract Agreement. Any scope questions or clarifications must be submitted in writing. 8. Subcontractors shall visit the project site prior to submitting a bid to ensure a complete understanding of the existing conditions and scope of work. 9. By submitting a bid, the Subcontractor acknowledges the right of Contractor to, without explanation, reject any or all bids either in whole or in part, or to waive any informality or irregularity in any bid received for any reason, or to accept any bid considered being in the best interest of the Owner. 10. Conditional bids or exceptions to the Bid Documents may at Contractor s sole discretion, be cause for rejection of the bid. Contractor does not obligate itself to accept the lowest bid or any other bid. 11. Selection of subcontractor will be based on overall completeness of proposal, adherence to the defined Scope of Work, experience, price, prequalification, and level of SBE participation which is further defined herein and in the Bid Documents. 2 P a g e

Bidders shall promptly notify Contractor of any ambiguities, discrepancies or omissions discovered in the Bid Documents, and if there is any doubt as to their meaning as it relates to design or construction. All inquiries shall be directed to Chet Brians, VP of Preconstruction in writing. The last day to ask RFI s prior to submitting your bid is defined herein. Oral explanations or answers shall not be valid. Revisions, clarifications and/or additional information will be issued to all Bidders in Addenda. All Addenda issued prior to the bid due date shall become a part of the Bidding Documents and any costs shall be included. 13. Each bidder shall be a licensed contractor pursuant to the California Contractors License Law required for the performance of work within its specialty. 14. Subcontractor may be asked to provide a payment and performance bond for the full value of its proposal. This value should be excluded from the bid amount, but Bond Rate provided. 15. Subcontractors must be available to participate in a thorough bid review and scope analysis and project discussion within five days after the Bid Due Date. Subcontractor shall be notified with the respective date and times. Subcontractor Prequalification: All subcontractors intending to propose on the project must either have a current prequalification within the Balfour Beatty Construction prequalification system or complete online Subcontractor Pre- Qualification Questionnaire prior to submitting your bid, which can be accessed at: Under the Partner tab is a drop down menu. The equal opportunity provisions are part of the project documents and are being provided for review. These documents will be part of your Subcontract Agreement. The following outlines a general summary of the project goals: 3 P a g e

4 Small Business Enterprises (SBE): This project is subject to the OCII s 50% SBE subcontracting participation goal with first consideration given in the following order: 1) SBE s/lbe s located in the Project Area; 2) Other San Francisco-based SBE s/lbe s; 3) Non San Francisco-based SBE s which should be used to fulfill the SBE goal only if San Francisco based SBE s are not available, qualified, or if their bids or fees are significantly higher. SBE s and Local Business Enterprises (LBE s) currently certified will be considered in the award of this work. To count towards the project s SBE goal, a business should be certified by the LBE with the City and County of San Francisco on or before the date of the bid. There is also a 50% SBE goal for suppliers, therefore, please list involvement of any suppliers or lower tier-subcontractors that may be included in your bids as wells as their SBE/LBE status. Please include your SBE or LBE certification documentation with your bid and identify the dollar value of work that will be provided on your Bid Form. OCII s Small Business Enterprise (SBE), Construction Workforce, and Prevailing Wage policies apply Construction Work-Force Goals: City Build will serve as the Project s primary point of referral for local hiring. Union/Prevailing Wage Provisions: The project is subject to the OCII s prevailing wage requirements. It shall be mandatory upon the Trade Contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all workers employed by them in the execution of the contract. Subcontractor to identify any union affiliations, if applicable, for the scope of work covered under the Subcontractor s bid proposal Payroll Requirements Subcontractors will be required to submit certified payrolls every week. Preconstruction Meeting Selected Subcontractors shall attend a preconstruction meeting with Balfour Beatty, the OCII, and City Build. This meeting must be held prior to the commencement of any Subcontractor s work onsite. 4 P a g e

5 Sub-Tier Subcontractors and Suppliers As part of your proposal, provide a list of any sub-tier subcontractors or suppliers that Subcontractor intends to use for this project. Please note on Bid Form provided whether sub-tier subcontractors or suppliers are being used to fulfill the SBE goals and list the companies and approximate value of their scope of work. This is a critical part of the selection process.
